Soma A.\u015e\u2019nin i\u015f\u00e7ileri s\u00f6zle\u015fmenin ba\u015f\u0131ndan beri TK\u0130\u2019nin i\u015f\u00e7isidir ve TK\u0130 ger\u00e7ek i\u015fveren olarak hem cezai, hem de hukuki anlamda sorumludur.<\/p>\n<p>Soma\u2019da ya\u015fanan katliam\u0131n arkas\u0131ndaki ger\u00e7ekler ve ya\u015fanan hukuksuzluklar teker teker ortaya \u00e7\u0131k\u0131yor. Ruhsat sahibi olan kamunun i\u015fletmeye daimi denet\u00e7i atamamas\u0131 skandal\u0131ndan sonra, TK\u0130 ile Soma A.\u015e aras\u0131nda yap\u0131lan hizmet al\u0131m s\u00f6zle\u015fmesinin de hukuksuz oldu\u011fu anla\u015f\u0131ld\u0131.<\/p>\n<p>Say\u0131\u015ftay\u2019\u0131n T\u00fcrkiye K\u00f6m\u00fcr \u0130\u015fletmeleri Kurumu S\u0131n\u0131rl\u0131 Sorumlu Ege Linyitleri \u0130\u015fletmesi M\u00fcessesesi 2012 ba\u015fl\u0131kl\u0131 raporunda \u00e7arp\u0131c\u0131 ger\u00e7ekler yer al\u0131yor. Bu ger\u00e7ekler soru\u015fturman\u0131n ve katliam\u0131n b\u00fct\u00fcn seyrini de\u011fi\u015ftirebilecek niteliktedir.<\/p>\n<p>Say\u0131\u015ftay raporuna g\u00f6re Eynez oca\u011f\u0131nda Soma A.\u015e\u2019ye hizmet al\u0131m\u0131 suretiyle 3.8 milyon ton k\u00f6m\u00fcr \u00fcrettirilmi\u015ftir (s. 44). Dolas\u0131yla bu ocakta g\u00fcnlerdir s\u00f6ylendi\u011fi gibi rod\u00f6vans (kiralama) de\u011fil, Kamu \u0130hale Kanunu\u2019na g\u00f6re yap\u0131lm\u0131\u015f hizmet al\u0131m s\u00f6zle\u015fmesi s\u00f6z konusudur.<\/p>\n<p>Ancak bu s\u00f6zle\u015fme hem Kamu \u0130hale Kanunu\u2019na, hem de \u0130\u015f Kanunu\u2019na ayk\u0131r\u0131d\u0131r ve fiili i\u015f ili\u015fkisiyle de \u00f6rt\u00fc\u015fmemektedir. Say\u0131\u015ftay raporunda vurguland\u0131\u011f\u0131 gibi, \u201cKamu \u0130hale Kanunu\u2019nun 4. maddesinde dekapaj ve benzeri i\u015fler yap\u0131m i\u015fi olarak tan\u0131mlanmas\u0131na ra\u011fmen, k\u00f6m\u00fcr kaz\u0131, y\u00fckleme ve ta\u015f\u0131ma i\u015fi TK\u0130\u2019ce sunulan raporlarla Hazine M\u00fcste\u015farl\u0131\u011f\u0131\u2019na hizmet olarak bildirilmektedir. Halbuki mahiyet olarak, yap\u0131lan i\u015fler aras\u0131nda hi\u00e7bir fark bulunmamaktad\u0131r. Bu itibarla k\u00f6m\u00fcr kaz\u0131 i\u015fi de yap\u0131m i\u015fidir. Bu kapsamda de\u011ferlendirilmesinde zorunluluk bulunmaktad\u0131r \u201c (s. 46).<\/p>\n<p>TK\u0130, Kamu \u0130hale Kanunu\u2019nun 4. maddesinde say\u0131lan hizmet i\u015fleri aras\u0131nda olmamas\u0131na ra\u011fmen, k\u00f6m\u00fcr \u00e7\u0131karma i\u015fini hizmet al\u0131m\u0131 yoluyla yapt\u0131rmaktad\u0131r. Yap\u0131lan bu i\u015f ba\u015fl\u0131 ba\u015f\u0131na yasaya ayk\u0131r\u0131 ve hileli (muvazaal\u0131) bir i\u015flemdir.<\/p>\n<p>TK\u0130 sadece Kamu \u0130hale Yasas\u0131\u2019n\u0131 \u00e7i\u011fnememi\u015f, \u0130\u015f Yasas\u0131\u2019n\u0131n 2. maddesini de a\u00e7\u0131k\u00e7a \u00e7i\u011fneyerek muvazaal\u0131 (ger\u00e7e\u011fi gizlemeye y\u00f6nelik anla\u015fma) bir alt i\u015fveren (ta\u015feron) ili\u015fkisi kurmu\u015ftur. TK\u0130 as\u0131l i\u015fin tamam\u0131n\u0131 yasada \u00f6ng\u00f6r\u00fclen ko\u015fullar olmaks\u0131z\u0131n, kendisini ihale s\u00f6zle\u015fmesiyle perdeleyerek alt i\u015fverene devretmi\u015f, bu yolla i\u015f\u00e7iyi koruyucu mevzuat\u0131n arkas\u0131na dolan\u0131p ucuz k\u00f6m\u00fcr \u00fcretmi\u015ftir.<\/p>\n<p>Yarg\u0131tay kanuna ayk\u0131r\u0131 bir \u015fekilde yap\u0131lan bu t\u00fcr hizmet al\u0131m s\u00f6zle\u015fmelerinin muvazaal\u0131 (hileli) oldu\u011funa h\u00fckmetmi\u015ftir. B\u00f6ylesine muvazaal\u0131 bir ili\u015fkide alt i\u015fverenin i\u015f\u00e7ileri (Soma A\u015e) ba\u015f\u0131ndan beri yasa gere\u011fi TK\u0130\u2019nin i\u015f\u00e7isidirler. TK\u0130 de bu i\u015f\u00e7ilerin hukuken i\u015fverenidir.<\/p>\n<p>Nitekim TK\u0130 ile Soma A\u015e aras\u0131nda yap\u0131lan s\u00f6zle\u015fmenin hukuki sak\u0131ncalar\u0131 Say\u0131\u015ftay raporunda da ifade edilmektedir. Raporda hizmet al\u0131m\u0131 suretiyle, ihalelere konu i\u015flerin g\u00f6rece olarak uygun maliyetle ve etkinlikle y\u00fcr\u00fct\u00fclmesi m\u00fcmk\u00fcn olmakla birlikte bunun \u0130\u015f Yasas\u0131 bak\u0131m\u0131ndan idareye getirece\u011fi y\u00fck\u00fcml\u00fcl\u00fcklere dikkat \u00e7ekilmektedir.<\/p>\n<p>Say\u0131\u015ftay raporunda \u015fu de\u011ferlendirmede bulunulmaktad\u0131r:<\/p>\n<p>\u201c\u0130\u015f Kanunu\u2019nun \u2018Bir i\u015fverenden i\u015fyerinde y\u00fcr\u00fctt\u00fc\u011f\u00fc mal ve hizmet \u00fcretimine ili\u015fkin yard\u0131mc\u0131 i\u015flerinde veya as\u0131l i\u015fin bir b\u00f6l\u00fcm\u00fcnde i\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren i\u015flerde i\u015f alan ve bu i\u015f i\u00e7in g\u00f6revlendirdi\u011fi i\u015f\u00e7ilerini sadece bu i\u015f yerinde ald\u0131\u011f\u0131 i\u015fte \u00e7al\u0131\u015ft\u0131ran di\u011fer i\u015fveren ile i\u015f ald\u0131\u011f\u0131 i\u015fveren aras\u0131nda kurulan ili\u015fkiye as\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisi denir. Bu ili\u015fkide as\u0131l i\u015fveren, alt i\u015fverenin i\u015f\u00e7ilerine kar\u015f\u0131 o i\u015fyeri ile ilgili olarak bu kanundan, i\u015f s\u00f6zle\u015fmesinden veya alt i\u015fverenin taraf oldu\u011fu toplu i\u015f s\u00f6zle\u015fmesinden do\u011fan y\u00fck\u00fcml\u00fcl\u00fcklerinden alt i\u015fveren ile birlikte sorumludur\u2019 h\u00fckm\u00fcne amir 2\u2019nci maddesi 6\u2019nc\u0131 f\u0131kras\u0131 kapsam\u0131nda bu husus, m\u00fcessese aleyhine \u00fccretlerini ve di\u011fer alacaklar\u0131n\u0131 alamad\u0131klar\u0131 gerek\u00e7esiyle \u00e7e\u015fitli davalar\u0131n a\u00e7\u0131lmas\u0131na ya da m\u00fcteselsil sorumluluk nedeniyle \u00f6nemli tutarlar\u0131n \u00f6denmesine neden olmaktad\u0131r\u201d (s. 8-9).<\/p>\n<p>De\u011ferlendirmeden de anla\u015f\u0131laca\u011f\u0131 \u00fczere, bu i\u015flemin hileli oldu\u011fu Say\u0131\u015ftay taraf\u0131ndan da tespit edilmi\u015ftir. Say\u0131\u015ftay as\u0131l i\u015fverenin alt i\u015fverenle birlikte sorumlu\u011funa dikkat \u00e7ekmektedir.<\/p>\n<p>Bu durumda ger\u00e7ek i\u015fveren olarak TK\u0130 y\u00f6netimi hem cezai, hem hukuki sorumlulukla kar\u015f\u0131 kar\u015f\u0131yad\u0131r.<\/p>\n<p>Ger\u00e7ek i\u015fveren olarak TK\u0130, i\u015f\u00e7iyi koruma borcunu yerine getirmedi\u011fi i\u00e7in sorumludur.<\/p>\n<p>Ger\u00e7ek i\u015fveren olarak TK\u0130, 6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Kanunu\u2019nun \u00f6ng\u00f6rm\u00fc\u015f oldu\u011fu \u00f6nlemleri almam\u0131\u015f olmaktan dolay\u0131 sorumludur.<\/p>\n<p>Ger\u00e7ek i\u015fveren olarak TK\u0130 y\u00f6neticileri, Soma A.\u015e y\u00f6neticileri gibi cezai sorumlulukla kar\u015f\u0131 kar\u015f\u0131yad\u0131r.
