Y\u00f6netmelik`te 3194 say\u0131l\u0131 \u0130mar Kanunu ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname dayanak al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Son 20 y\u0131lda k\u00fcreselle\u015fme ad\u0131 alt\u0131nda ortaya konulan yeni liberal politikalar\u0131n \u00fclkemize yans\u0131mas\u0131yla olu\u015fan ekonomik dar bo\u011faz\u0131, kamusal kaynaklar\u0131 ve do\u011fal varl\u0131klar\u0131 piyasala\u015ft\u0131rarak a\u015fmaya \u00e7al\u0131\u015fan AKP H\u00fck\u00fcmetleri, imar mevzuat\u0131 ile olu\u015fan s\u0131n\u0131rland\u0131rmalar\u0131 ekonomik geli\u015fimin \u00f6n\u00fcnde engel g\u00f6rm\u00fc\u015f, bu alanda piyasa talepleri do\u011frultusunda bir tak\u0131m de\u011fi\u015fiklik ve d\u00fczenlemeleri birbiri ard\u0131na ger\u00e7ekle\u015ftirmi\u015ftir.<\/p>\n<p>Bu s\u00fcrecin son ad\u0131m\u0131 olarak y\u00fcr\u00fcrl\u00fc\u011fe giren Mek\u00e2nsal Planlar Yap\u0131m Y\u00f6netmeli\u011fi, in\u015faat sekt\u00f6r\u00fc ve arazi rant\u0131 \u00fczerinde temellendirilen ekonomi politikalar\u0131n\u0131n uygulanmas\u0131nda ve rant\u0131n da\u011f\u0131t\u0131m\u0131nda &#8220;planlama&#8221;y\u0131 ara\u00e7 haline getiren bir \u00e7er\u00e7eveye sahiptir. B\u00fct\u00fcnc\u00fcl planlama yerine projeci, yerel idarelerin planlama ve onama yetkilerini gasp ederek, gere\u011finde parsel baz\u0131nda yap\u0131 ruhsat\u0131 d\u00fczenleme detay\u0131na kadar inen, merkezi idarenin plan onaylar\u0131ndaki &#8220;istisna&#8221; yetkisini &#8220;genel&#8221; yetkiye d\u00f6n\u00fc\u015ft\u00fcren bir hal alm\u0131\u015ft\u0131r. Y\u00f6netmelik, dayana\u011f\u0131 olan 3194 say\u0131l\u0131 \u0130mar Kanunu`nun ruhuna ayk\u0131r\u0131 olarak Kanunla yetkilendirilmi\u015f ilgili idarelerin yetkilerine el atmakta, yerel idarelerin kararlar\u0131 \u00fczerinde merkezi bir vesayet olu\u015fturmaktad\u0131r.<\/p>\n<p>Yap\u0131lan d\u00fczenlemeler ile &#8220;planlama mevzuat\u0131&#8221; bilimsel alt yap\u0131dan uzak bir \u015fekilde, kontroll\u00fc, denetimli ve ruhsatl\u0131 yap\u0131la\u015fmay\u0131 d\u0131\u015flamas\u0131n\u0131n yan\u0131 s\u0131ra, rant bask\u0131s\u0131 alt\u0131nda direnen do\u011fal ve k\u00fclt\u00fcrel de\u011ferleri de g\u00f6zden \u00e7\u0131karmaktad\u0131r. &#8220;Kentsel Tasar\u0131m&#8221; kisvesi alt\u0131nda imar planlar\u0131ndan \u00f6nce onaylanan &#8220;projelerin&#8221; imar planlar\u0131na i\u015flenmesi zorunlulu\u011funun getirilmesiyle &#8220;proje&#8221;nin imar plan\u0131 yerine ge\u00e7irilmesine olanak sa\u011flam\u0131\u015f, b\u00fct\u00fcnc\u00fcl planlama ilkesinin i\u00e7i bo\u015falt\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Y\u00f6netmelik, piyasa taleplerinin her ko\u015fulda kar\u015f\u0131lanmas\u0131 i\u00e7in mu\u011flak, belirsiz ve esnek bir yap\u0131ya b\u00fcr\u00fcnm\u00fc\u015f, planlaman\u0131n kamu yarar\u0131 ilkesini g\u00f6z ard\u0131 ederek planlama s\u00fcrecini idari bir i\u015fleme d\u00f6n\u00fc\u015ft\u00fcrm\u00fc\u015ft\u00fcr. Mek\u00e2nsal planlar\u0131n ayn\u0131 zamanda bir hukuk belgesi niteli\u011fi ta\u015f\u0131mas\u0131 nedeniyle, planlaman\u0131n kamu yarar\u0131, e\u015fitlik ilkesi temelinde uygulama birli\u011finin sa\u011flanabilmesi i\u00e7in y\u00f6netmelikte yer alan ifadelerin, tan\u0131mlamalar\u0131n kesinlik ve a\u00e7\u0131kl\u0131k i\u00e7ermesi gerekirken bu ilke de es ge\u00e7ilmi\u015f, uygulamac\u0131lar\u0131n inisiyatifine b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>T\u00fcm planlar\u0131n ad\u0131 ge\u00e7en y\u00f6netmelik do\u011frultusunda 1 y\u0131l i\u00e7inde revize edilmesinin yasal zorunluluk olarak d\u00fczenlenmesi, uzun s\u00fcreli ara\u015ft\u0131rma, analiz ve et\u00fctlere dayal\u0131 mer`i planlar\u0131n hi\u00e7bir bilimsel temele dayanmadan piyasala\u015fma s\u00fcre\u00e7lerinden dolay\u0131 sadece revize edilece\u011fi anlam\u0131n\u0131 ta\u015f\u0131maktad\u0131r. Di\u011fer taraftan milli parklar\u0131m\u0131z, ormanlar\u0131m\u0131z, tar\u0131m alanlar\u0131m\u0131z, akarsular\u0131m\u0131z gibi gelece\u011fimizin garantisi do\u011fal varl\u0131klar\u0131m\u0131z\u0131, kent k\u00fclt\u00fcr\u00fcm\u00fcz\u00fc, belle\u011fimizi olu\u015fturan sivil mimari \u00f6rne\u011fi olan tescilli yada tescilsiz yap\u0131lar\u0131n olu\u015fturdu\u011fu k\u00fclt\u00fcrel ve tarihi de\u011ferlerimizi yok eden &#8220;b\u00fcy\u00fck proje&#8221; gibi \u00f6l\u00e7\u00fcs\u00fc, \u00f6l\u00e7e\u011fi belli olmayan bir tan\u0131mlama ile \u00fcst plan kararlar\u0131n\u0131n dahi kolayca de\u011fi\u015ftirilece\u011fi ifade edilmekte ve planlar\u0131n iptal edilmesi durumunda yeniden haz\u0131rlanacak plan i\u00e7in yeni analiz ve sentez \u00e7al\u0131\u015fmalar\u0131na gerek olmad\u0131\u011f\u0131 belirtilerek, a\u00e7\u0131k\u00e7a hukuk kararlar\u0131 hi\u00e7e say\u0131lmaktad\u0131r.<\/p>\n<p>Y\u00f6netmelik yine piyasan\u0131n talepleriyle AKP H\u00fck\u00fcmetlerinin \u00e7\u0131karm\u0131\u015f oldu\u011fu di\u011fer yasama faaliyetleri do\u011frultusunda \u00f6n\u00fcm\u00fczdeki d\u00f6nemde yap\u0131la\u015fma riski ile kar\u015f\u0131 kar\u015f\u0131ya olan; b\u00fcy\u00fck \u00e7o\u011funlu\u011fu tar\u0131m alan\u0131, mera, bozk\u0131r alanlar\u0131, k\u0131smen orman alanlar\u0131, akarsu ve g\u00f6lleri de i\u00e7ine alan; i\u00e7inde neredeyse hi\u00e7 kentsel nitelikli alan olmayan; idari olarak k\u00f6yden mahalleye d\u00f6n\u00fc\u015fen alanlara ili\u015fkin hi\u00e7bir koruyucu d\u00fczenleme getirmeyerek, talana yasal bo\u015fluk olu\u015fturmaktad\u0131r.<\/p>\n<p>Y\u00f6netmelik, ya\u015fanabilir \u00e7evre olu\u015fturman\u0131n temel gereklili\u011fi olan ki\u015fi ba\u015f\u0131na\/ya\u015fayan-ya\u015fayacak n\u00fcfusun ihtiyac\u0131 olan teknik, sosyal ve k\u00fclt\u00fcrel donat\u0131-altyap\u0131, a\u00e7\u0131k ve ye\u015fil alan standartlar\u0131n\u0131 artt\u0131rmak yerine azalt\u0131lmas\u0131 yoluna gitmi\u015f, bu kullan\u0131mlar\u0131n\u0131n piyasa mekanizmas\u0131na terk edilmesine olanak sa\u011flayan d\u00fczenlemeler yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p>Y\u00f6netmelik ile \u00fclkemizde mek\u00e2nsal planlama sisteminin en \u00f6nemli eksiklikleri aras\u0131nda olan, onaylanan planlar\u0131n onay \u00f6ncesi gerekli teknik ve mesleki denetimine y\u00f6nelik somut ve kal\u0131c\u0131 herhangi bir ad\u0131m da at\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>Sonu\u00e7 olarak Odam\u0131z taraf\u0131ndan Mek\u00e2nsal Planlar Yap\u0131m Y\u00f6netmeli\u011fi,<\/p>\n<p>1. Planlamay\u0131 i\u00e7eriksizle\u015ftirerek idari i\u015fleme d\u00f6n\u00fc\u015ft\u00fcrmek,<\/p>\n<p>2. Piyasa mekanizmas\u0131 i\u00e7inde rant temelli olarak \u015fekillenen &#8220;b\u00fcy\u00fck proje&#8221;lere her durumda uygulama imk\u00e2n\u0131 yaratmak,<\/p>\n<p>3. Kamusal alanlar\u0131n (sosyal teknik altyap\u0131- k\u00fclt\u00fcrel, e\u011fitim, sa\u011fl\u0131k ve di\u011fer) talep odakl\u0131 d\u00fczenlenmesi ile piyasa mekanizmas\u0131 \u00f6n\u00fcndeki son engelleri de kald\u0131rarak, kamu yarar\u0131 ve e\u015fitlik ilkelerini g\u00f6z ard\u0131 etmek,<\/p>\n<p>4. Toplumsal ya\u015fam\u0131n yeniden tasarlanmas\u0131n\u0131n mek\u00e2nsal yans\u0131mas\u0131n\u0131 tamamlamak i\u00e7in AKP eliyle sermaye i\u00e7in geli\u015ftirilen yeni bir giri\u015fim olarak de\u011ferlendirilmektedir.<\/p>\n<p>Bu haliyle Y\u00f6netmelik, planlaman\u0131n bilimsel esaslar\u0131na, teknik gerekliliklerine, hukuki ilkelerine, kamu yar\u0131na, planlama ve koruma mevzuat\u0131na, dayanak ald\u0131\u011f\u0131 kanuna ve kanun h\u00fckm\u00fcnde kararnameye ve Anayasaya a\u00e7\u0131k\u00e7a ayk\u0131r\u0131d\u0131r.
