Sendikan\u0131n 2 bin \u00fcyesinin \u00f6nemli bir k\u0131sm\u0131 elektrik da\u011f\u0131t\u0131m \u015firketlerinde bulunmaktad\u0131r.<\/p>\n<p>bedas-\u00f6n\u00fcSendikan\u0131n kurulu\u015fundan sonra ba\u015flatt\u0131\u011f\u0131 \u00f6rg\u00fctlenme \u00e7al\u0131\u015fmalar\u0131 yo\u011fun i\u015fveren bask\u0131s\u0131na maruz kalm\u0131\u015ft\u0131r. Bask\u0131lardan kaynakl\u0131 uzun s\u00fcren sessiz bir d\u00f6nemin ard\u0131ndan 2011 y\u0131l\u0131nda ba\u015flatt\u0131\u011f\u0131 yeni m\u00fccadele d\u00f6neminde i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi \u00f6nemli ve merkezi bir yer tutmaktad\u0131r.<\/p>\n<p>Sendika T\u00fcrkiye\u2019de ilk defa olarak 2013 y\u0131l\u0131nda yap\u0131lan genel kurulunda t\u00fcz\u00fck de\u011fi\u015fikli\u011fine gitmi\u015f, 7 Merkez Y\u00f6netim Kurulu \u00fcyeli\u011finden birisini \u201c\u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Sekreteri\u201d olarak belirlemi\u015ftir.<\/p>\n<p>Sendika \u00f6rg\u00fctl\u00fc oldu\u011fu pek \u00e7ok i\u015fyerinde i\u015fverenle yap\u0131lan g\u00f6r\u00fc\u015fmelerde ve eylem s\u00fcre\u00e7lerinde \u0130S\u0130G talepleri, k\u0131rm\u0131z\u0131\u00e7izgi ile belirtilen \u00f6ncelikli ba\u015fl\u0131klar\u0131 olu\u015fturmu\u015ftur.<\/p>\n<p>Grev yasa\u011f\u0131 olan bir i\u015fkolu olmas\u0131na ra\u011fmen sendikan\u0131n \u00f6nc\u00fcl\u00fc\u011f\u00fcnde Tunceli, \u0130zmir, Hakkari, A\u011fr\u0131, \u0130stanbul gibi pek \u00e7ok ilde elektrik da\u011f\u0131t\u0131m \u015firketi i\u015f\u00e7ileri 6331 say\u0131l\u0131 yasan\u0131n 13. maddesinde belirtilen \u201c\u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma haklar\u0131n\u0131\u201d kullan\u0131lm\u0131\u015flard\u0131r. Bu direni\u015flerin ard\u0131ndan \u00e7al\u0131\u015fan g\u00fcvenli\u011fi noktas\u0131nda kazan\u0131mlar da elde edilmi\u015ftir.<\/p>\n<p>\u0130stanbul \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Meclisi\u2019nin bir bile\u015feni olan D\u0130SK\/Enerji-Sen ayr\u0131ca ba\u015fka 5 i\u015f\u00e7i sendikas\u0131n\u0131n da kat\u0131l\u0131m\u0131yla Ocak 2014\u2019de DGB (Alman Sendikalar Konfederasyonu) E\u011fitim Merkezi ile birlikte \u201c\u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Alan\u0131nda \u0130\u015f ve Sosyal Standartlar\u0131n Uygulanmas\u0131\u201d projesine ba\u015flam\u0131\u015ft\u0131r.<\/p>\n<p><strong>1. Enerji sekt\u00f6r\u00fc\/Enerji i\u015f kolu<\/strong><\/p>\n<p>Enerji sekt\u00f6r\u00fc esas olarak enerjinin \u00fcretimi, iletimi ve da\u011f\u0131t\u0131m\u0131 hizmetlerini kapsar. Ancak i\u015fkolunun kapsam\u0131 kullan\u0131lan referansa g\u00f6re de\u011fi\u015fiklik g\u00f6stermesi i\u015fkolu \u00fczerinde \u0130S\u0130G y\u00f6n\u00fcnden yap\u0131lan istatistiksel\/niceliksel de\u011ferlendirmeleri de kimi zaman tart\u0131\u015fmal\u0131 bir hale getirebilmektedir.<\/p>\n<p>SGK istatistikleri, \u00c7SGB istatistikleri, i\u015fkollar\u0131 y\u00f6netmeli\u011fi, tehlike s\u0131n\u0131flar\u0131 tebli\u011fi, T\u00dc\u0130K raporlar\u0131nda yer alan veriler i\u00e7eriklerinin \u00f6rt\u00fc\u015fmemesi nedeniyle ciddi bir kapsam sorunu olu\u015fturmaktad\u0131r.<\/p>\n<p>O nedenle \u00f6ncelikle i\u015fkolunun kapsam\u0131ndaki bu belirsizli\u011fi k\u0131saca de\u011ferlendirmek gerekir.<\/p>\n<p>\u0130\u015fkollar\u0131n\u0131 belirlemek \u00fczere yayg\u0131n olarak NACE (AB\u2019de ekonomik faaliyetlerin istatistiksel s\u0131n\u0131fland\u0131rmas\u0131) kodlar\u0131 esas al\u0131n\u0131yor. AB uyum s\u00fcreciyle beraber bu kodlar resmi i\u015flem ve de\u011ferlendirmelerde yayg\u0131nla\u015fm\u0131\u015ft\u0131r.<\/p>\n<p>T\u00dc\u0130K rehberlerinde [1] yer alan NACE s\u0131n\u0131fland\u0131rmas\u0131na g\u00f6re (Rev.2) B\u00f6l\u00fcm D- Elektrik, gaz, buhar ve iklimlendirme temini ba\u015fl\u0131\u011f\u0131 alt\u0131nda 35 ikili koduyla ba\u015flayan i\u015fyerleri bulunmakta, B\u00f6l\u00fcm E- E Su temini, kanalizasyon, at\u0131k y\u00f6netimi ve iyile\u015ftirme ba\u015fl\u0131\u011f\u0131 alt\u0131nda 36, 37, 38 ikili koduyla ba\u015flayan i\u015fyerleri bulunmaktad\u0131r<\/p>\n<p><strong><a href=\"\/wp-content\/uploads\/2014\/11\/hansel_enerji_1.jpg\"><img decoding=\"async\" width=\"625\" height=\"418\" class=\"alignnone size-full wp-image-13417\" src=\"\/wp-content\/uploads\/2014\/11\/hansel_enerji_1.jpg\" alt=\"hansel_enerji_1\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/11\/hansel_enerji_1.jpg 625w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/11\/hansel_enerji_1-300x200.jpg 300w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/11\/hansel_enerji_1-150x100.jpg 150w\" sizes=\"(max-width: 625px) 100vw, 625px\" \/><\/a><\/strong><\/p>\n<p>Ancak 6356 say\u0131l\u0131 Sendikalar ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanununa dayan\u0131larak yay\u0131nlanan \u0130\u015fkollar\u0131 Y\u00f6netmeli\u011fine g\u00f6re bu iki k\u0131s\u0131mdan sadece 35 ve 36 kodlar\u0131 enerji i\u015fkolu olarak de\u011ferlendirilmekte ve i\u015fkolunda \u00e7al\u0131\u015fan i\u015f\u00e7ilerin en az yar\u0131s\u0131 farkl\u0131 ikili kodla kay\u0131t olmu\u015f i\u015fyerlerinde \u00e7al\u0131\u015ft\u0131klar\u0131 i\u00e7in SGK, T\u00dc\u0130K verilerinden bunlarla ilgili ayr\u0131nt\u0131l\u0131 verilere ula\u015fmak m\u00fcmk\u00fcn olamamaktad\u0131r.<\/p>\n<p>\u00d6rne\u011fin pek \u00e7ok elektrik da\u011f\u0131t\u0131m \u015firketi SGK kay\u0131tlar\u0131nda \u201c\u00f6zel in\u015faat faaliyetleri\u201d ad\u0131 olarak tan\u0131mlanan 43 ikili koduyla yer ald\u0131klar\u0131 i\u00e7in bu \u015firket verilerinin di\u011fer in\u015faat \u015firketlerinden ayr\u0131\u015ft\u0131racak ayr\u0131nt\u0131da veri payla\u015f\u0131m\u0131 mevcut de\u011fildir.<\/p>\n<p>SGK 2012 y\u0131l\u0131 istatistiklerinde 35 ve 36 faaliyet kodlar\u0131nda kay\u0131tl\u0131 i\u015fyerlerinde 117 bin sigortal\u0131 \u00e7al\u0131\u015fmakta iken, \u00c7SGB kay\u0131tlar\u0131na g\u00f6re Ocak 2013\u2019de Enerji i\u015fkolunda yakla\u015f\u0131k 235 bin i\u015f\u00e7i \u00e7al\u0131\u015fmaktayd\u0131.<\/p>\n<p>Dolay\u0131s\u0131yla bu belirsizlik nedeniyle yaz\u0131da \u201cenerji sekt\u00f6r\u00fc\u201d olarak ge\u00e7en ifadeler NACE kodlamas\u0131na g\u00f6re D ve E k\u0131s\u0131mlar\u0131n\u0131, \u201cenerji i\u015fkolu\u201d olarak ge\u00e7en ifadeler ise Sendikalar ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu ve \u0130\u015fkollar\u0131 Y\u00f6netmeli\u011finde belirtilen 14 nolu Enerji i\u015fkolunu ifade etmektedir.<\/p>\n<p><strong>1.1. Enerji i\u015fkolunda \u00e7al\u0131\u015fan profili<\/strong><\/p>\n<p>\u0130\u015fkolu kapsam\u0131ndaki i\u015fyerlerinin \u00f6nemli bir k\u0131sm\u0131 Tehlike S\u0131n\u0131flar\u0131 Tebli\u011fi\u2019ne g\u00f6re \u00e7ok tehlikeli s\u0131n\u0131fta yer almaktad\u0131r. Ancak yukar\u0131da belirtilen nedenlerden kaynakl\u0131 \u00e7ok tehlikeli i\u015fkolunda yer alan i\u015fyerlerinin ve buralarda \u00e7al\u0131\u015fan i\u015f\u00e7ilerin tam say\u0131s\u0131na eri\u015fmek m\u00fcmk\u00fcn olamamaktad\u0131r.<\/p>\n<p>Yap\u0131lan i\u015fin niteli\u011fi gere\u011fi i\u015fkolu \u00e7al\u0131\u015fan profili genel olarak vas\u0131fl\u0131 emek g\u00fcc\u00fcd\u00fcr. \u0130\u015f\u00e7ilerin \u00f6nemli bir k\u0131sm\u0131 meslek lisesi, meslek y\u00fcksek okulu ve fak\u00fclte mezunudur.<\/p>\n<p>\u0130\u015fkolu cinsiyet bak\u0131m\u0131ndan erkek yo\u011fun bir i\u015fkoludur. Sendikal\u0131 i\u015f\u00e7ilerde kad\u0131n i\u015f\u00e7i oran\u0131 % 4\u2019e yak\u0131n oranlarda seyretmektedir. Enerji sekt\u00f6r\u00fc verilerini de\u011ferlendirdi\u011fimizde ise kad\u0131n i\u015f\u00e7i oran\u0131 2013 y\u0131l\u0131 itibariyle % 7,8 olarak g\u00f6z\u00fckmektedir [2].<\/p>\n<p>Enerji i\u015fkolunda ise kad\u0131n i\u015f\u00e7i oran\u0131 2014 Temmuz verilerine g\u00f6re % 15,3\u2019t\u00fcr [3].<\/p>\n<p><strong>1.2. \u0130\u015fletme profili<\/strong><\/p>\n<p>Enerji i\u015fkolunda, \u00fclkenin d\u00f6rt bir yan\u0131na da\u011f\u0131lm\u0131\u015f \u00e7ok say\u0131da k\u00fc\u00e7\u00fck i\u015fyerinin yan\u0131 s\u0131ra 500\u2019\u00fcn \u00fcst\u00fcnde i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerinin ve buralarda \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131 di\u011fer pek \u00e7ok i\u015fkoluna g\u00f6re y\u00fcksektir.<\/p>\n<p>Sekt\u00f6rdeki kamu i\u015fyeri a\u011f\u0131rl\u0131\u011f\u0131 son y\u0131llarda \u00f6zellikle elektrik \u00fcretim, da\u011f\u0131t\u0131m i\u015fletmelerinin \u00f6zelle\u015ftirilmesi ve \u00f6zel do\u011falgaz da\u011f\u0131t\u0131m \u015firketlerinin say\u0131s\u0131n\u0131n artmas\u0131 ile h\u0131zla d\u00fc\u015fmektedir.<\/p>\n<p><strong>1.3. \u0130\u015f\u00e7i\/Sendikal\u0131 i\u015f\u00e7i say\u0131s\u0131<\/strong><\/p>\n<p>\u0130\u015fkolu ge\u00e7mi\u015ften bug\u00fcne kadar sendikala\u015fma oran\u0131 hep y\u00fcksek olmu\u015ftur. Bunun esas nedeni ise i\u015fkolunda kamu i\u015fyerlerinin a\u011f\u0131rl\u0131\u011f\u0131 ve buralarda \u00f6zellikle 1980 \u00f6ncesinde y\u00fcr\u00fct\u00fclen sendikal m\u00fccadelenin kazan\u0131mlar\u0131d\u0131r. 1980 darbesinin ard\u0131ndan i\u015fkolunda kalan tek \u00f6rg\u00fctl\u00fc sendika T\u00fcrk-\u0130\u015f\u2019e ba\u011fl\u0131 Tes-\u0130\u015f oldu. Ancak 90\u2019lar\u0131n ortas\u0131ndan itibaren y\u00fckselmeye ba\u015flayan \u00f6zelle\u015ftirme, ta\u015feronla\u015ft\u0131rma sald\u0131r\u0131s\u0131na tepkisiz kalan ve z\u0131mnen onay veren sendika h\u0131zla \u00fcye kaybetti.<\/p>\n<p>1994\u2019te TES-\u0130\u015e 130 bin \u00fcye ile i\u015fkolunda % 97,3 oran\u0131nda \u00f6rg\u00fctl\u00fcyd\u00fc. 20 y\u0131l sonra i\u015fkolunda \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131 2 kattan daha fazla b\u00fcy\u00fcy\u00fcp 273 bine ula\u015fmas\u0131na ra\u011fmen 2014\u2019de \u00fcye say\u0131s\u0131 dramatik bir d\u00fc\u015f\u00fc\u015fle 54 bine gerilemi\u015ftir. \u0130\u015f\u00e7i temsiliyeti ise % 19\u2019larda kalmaktad\u0131r [4].<\/p>\n<p><strong>2. Enerji i\u015fkolunda i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi<\/strong><\/p>\n<p>2003-2011 y\u0131llar\u0131 aras\u0131nda E\u00dcA\u015e, TE\u0130A\u015e ve TEDA\u015e\u2019larda meydana gelen i\u015f kazalar\u0131n\u0131 inceleyen bir \u00e7al\u0131\u015fmaya g\u00f6re[5];<\/p>\n<p><a href=\"\/wp-content\/uploads\/2014\/11\/hansel_enerji_2.jpg\"><img decoding=\"async\" width=\"622\" height=\"220\" class=\"alignnone size-full wp-image-13418\" src=\"\/wp-content\/uploads\/2014\/11\/hansel_enerji_2.jpg\" alt=\"hansel_enerji_2\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/11\/hansel_enerji_2.jpg 622w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/11\/hansel_enerji_2-300x106.jpg 300w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/11\/hansel_enerji_2-150x53.jpg 150w\" sizes=\"(max-width: 622px) 100vw, 622px\" \/><\/a><\/p>\n<p>\u00d6l\u00fcml\u00fc\/a\u011f\u0131r yaralanmal\u0131 kaza oran\u0131n\u0131n T\u00fcrkiye ortalamas\u0131 % 4 oldu\u011fu g\u00f6z \u00f6n\u00fcnde bulunuldu\u011funda sekt\u00f6r\u00fcn \u00e7al\u0131\u015fan g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan ne kadar ciddi tehlikeler i\u00e7erdi\u011fi daha net g\u00f6z\u00fckmektedir.<\/p>\n<p><strong>2.1. Kurumlarda \u0130S\u0130G K\u00fclt\u00fcr\u00fc<\/strong><\/p>\n<p>Yine ayn\u0131 makalede yer alan verilerden \u0130S\u0130G e\u011fitimi alan \u00e7al\u0131\u015fanlar\u0131n oranlar\u0131n\u0131 g\u00f6steren bilgiler de olduk\u00e7a \u00e7arp\u0131c\u0131d\u0131r:<\/p>\n<p>TEDA\u015e (2010): % 9,7<\/p>\n<p>TE\u0130A\u015e (2011): % 6,8<\/p>\n<p>E\u00dcA\u015e (2011): % 22,3<\/p>\n<p>\u0130\u015f kazalar\u0131 ya\u015fayan enerji i\u015f\u00e7ilerinin mesleki e\u011fitim niteliklerine g\u00f6re de\u011ferlendirildi\u011fine; \u201c\u2026 E\u00dcA\u015e\u2019ta kazalar\u0131n %38,2\u2019ine, TE\u0130A\u015e\u2019ta kazalar\u0131n % 41,3\u2019\u00fcne ve TEDA\u015e\u2019ta kazalar\u0131n % 57,8\u2019ine hi\u00e7bir teknik e\u011fitim almayan \u0130lk\u00f6\u011fretim ve Lise mezunu \u00e7al\u0131\u015fanlar\u0131 maruz\u201d kalm\u0131\u015ft\u0131r.<\/p>\n<p>\u201cKazaya maruz kalan \u00e7al\u0131\u015fanlar\u0131n E\u00dcA\u015e\u2019ta yakla\u015f\u0131k % 85\u2019inin, TE\u0130A\u015e\u2019ta % 69\u2019unun, TEDA\u015e\u2019da ise % 89\u2019unun daha \u00f6nceden \u0130S\u0130G e\u011fitimi alm\u0131\u015f\u201d i\u015f\u00e7ilerdir.<\/p>\n<p>Bu veriler her ne kadar \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu \u00e7\u0131kmadan \u00f6nceki d\u00f6neme ait olsa da \u00f6zellikle elektrik da\u011f\u0131t\u0131m \u015firketlerinin \u00f6zelle\u015ftirmelerinden sonra da benzer durumlar\u0131n devam etti\u011fi d\u00fc\u015f\u00fcncesindeyiz. Elektrik da\u011f\u0131t\u0131m \u015firketlerinin \u00f6zelle\u015ftirme s\u00fcrecinde ihaleyi kazanan \u015firketlerin hi\u00e7birinin elektrik da\u011f\u0131t\u0131m \u015firketi i\u015fletme tecr\u00fcbesi olmamas\u0131 nedeniyle, pek \u00e7ok \u015firketin \u00fcst\/orta kademe y\u00f6netici \u00f6zelle\u015ftirmeden sonra da g\u00f6revlerine devam etmi\u015flerdir. Bu s\u00fcreklilik \u0130S\u0130G alg\u0131s\u0131ndaki zay\u0131fl\u0131\u011f\u0131n \u00f6zelle\u015ftirmeden sonra da devam etmesine neden olmu\u015ftur.<\/p>\n<p><strong>2.2. T\u00dc\u0130K verileri<\/strong><\/p>\n<p>T\u00dc\u0130K verilerine g\u00f6re [6] Elektrik, gaz, buhar, su temini ve kanalizasyon sekt\u00f6r\u00fcnde i\u015f kazas\u0131 ge\u00e7irenlerin oran\u0131 2007-2013 aras\u0131nda herhangi bir de\u011fi\u015fikli\u011fe u\u011framam\u0131\u015ft\u0131r. Buna g\u00f6re sekt\u00f6rde \u00e7al\u0131\u015fanlar\u0131n % 5.4\u2019\u00fc son 12 ay i\u00e7erisinde i\u015f kazas\u0131 ge\u00e7irmi\u015flerdir.<\/p>\n<p>\u0130\u015f kazas\u0131 ya\u015fanma oran\u0131 madencili\u011fin arkas\u0131ndan ikinci s\u0131rada yer almaktad\u0131r.<\/p>\n<p>Enerji sekt\u00f6r\u00fcnde i\u015fe ba\u011fl\u0131 sa\u011fl\u0131k sorunu ya\u015fayanlar\u0131n oran\u0131 ise % 4 civar\u0131ndad\u0131r. T\u00fcm sekt\u00f6rlerin ortalamas\u0131 ise % 2.1\u2019dir.<\/p>\n<p><strong>2.3. Avrupa Birli\u011fi \u00fclkelerinde enerji sekt\u00f6r\u00fcnde i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131<\/strong><\/p>\n<p>2007 y\u0131l\u0131 son 12 ay i\u00e7erisinde i\u015f kazas\u0131 ge\u00e7irenlerin oran\u0131 % 3.2\u2019dir. Enerji sekt\u00f6r\u00fcnde ise bu oran % 2.5 civarlar\u0131nda seyretmekte [7].<\/p>\n<p>Bu verilere g\u00f6re \u00fclkemizde enerji sekt\u00f6r\u00fcnde i\u015f kazas\u0131 ortalamas\u0131 Avrupa Birli\u011fi \u00fclkelerinin iki kat\u0131ndan daha fazla g\u00f6z\u00fckmektedir.<\/p>\n<p>Enerji sekt\u00f6r\u00fcnde i\u015fe ba\u011fl\u0131 sa\u011fl\u0131k sorunu ya\u015fayanlar\u0131n oran\u0131 ise % 6\u2019d\u0131r. Bu oran\u0131n \u00fclkemizden y\u00fcksek olmas\u0131 Avrupa Birli\u011fi \u00fclkelerinde meslek hastal\u0131klar\u0131 ve i\u015fe ba\u011fl\u0131 sa\u011fl\u0131k sorunu tespit s\u00fcre\u00e7lerinin daha sa\u011fl\u0131kl\u0131 i\u015flemesiyle a\u00e7\u0131klanabilir.<\/p>\n<p><strong>3. Enerji-Sen sendikac\u0131l\u0131k anlay\u0131\u015f\u0131<\/strong><\/p>\n<p>D\u0130SK\/Enerji-Sen Sendikas\u0131 2005 y\u0131l\u0131nda ba\u011f\u0131ms\u0131z bir sendika olarak kuruldu. Enerji i\u015fkolunda resmi rakamlardaki y\u00fcksek sendikala\u015fma oran\u0131na ra\u011fmen enerji i\u015f\u00e7ilerinin g\u00fcnden g\u00fcne g\u00fcvencesizle\u015fti\u011fi, kazan\u0131lm\u0131\u015f haklar\u0131n\u0131 kaybetti\u011fi ger\u00e7e\u011finden hareket etti. Bu durum Sendikan\u0131n kurulu\u015funun ilan edildi\u011fi 1 Aral\u0131k 2005 tarihli a\u00e7\u0131klamada \u015fu \u015fekilde yer al\u0131yordu: \u201cEnerji emek\u00e7ilerinin \u00fczerine yap\u0131\u015ft\u0131r\u0131lan farkl\u0131 etiketler, i\u015fkolumuzdaki \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n s\u00fcrekli olarak g\u00fcvencesizle\u015ftirme y\u00f6n\u00fcnde geli\u015ftirilmesinin perdesi haline getirildi. Maalesef enerji i\u015fkolunda kurulu bulunan mevcut sendikal yap\u0131 bu sald\u0131r\u0131lar\u0131 g\u00f6\u011f\u00fcslemek do\u011frultusunda m\u00fccadele etmek bir yana, AKTA\u015e, \u00c7ukurova ve bir\u00e7ok \u00f6rnekte oldu\u011fu gibi sermayenin uygulamalar\u0131n\u0131n i\u00e7inde yer ald\u0131.\u201d [8]\n<p>Kurulu\u015fun ard\u0131ndan i\u015fkolunda \u00f6rg\u00fctl\u00fc bulunan sendikan\u0131n ve kamu i\u015fyerleri y\u00f6neticilerinin ortak davran\u0131\u015f\u0131 ile sendikan\u0131n E\u00dcA\u015e, BEDA\u015e ve \u0130GDA\u015e\u2019ta \u00e7al\u0131\u015fan genel ba\u015fkan\u0131 ve y\u00f6netim kurulu \u00fcyeleri dahil olmak \u00fczere 27 i\u015f\u00e7i sendikan\u0131n kurulu\u015funu takip eden 2 ay i\u00e7erisinde i\u015ften at\u0131ld\u0131lar. Daha sonra a\u00e7\u0131lan davalar kazan\u0131lm\u0131\u015f olsa dahi bu durum sendikan\u0131n kurulu\u015funda yaratt\u0131\u011f\u0131 heyecan ve ivmenin s\u00fcrd\u00fcr\u00fclmesini bir \u00f6l\u00e7\u00fcde engelledi.<\/p>\n<p>Sendika daha sonra 2010 y\u0131l\u0131 sonunda ger\u00e7ekle\u015ftirilen 2. Ola\u011fan Genel Kurulu\u2019ndan bir s\u00fcre sonra yeniden kapsaml\u0131 bir \u00f6rg\u00fctlenme s\u00fcreci ba\u015flatt\u0131. Bu kez b\u00fct\u00fcn bask\u0131, tehdit ve i\u015ften at\u0131lmalara ra\u011fmen bug\u00fcne kadar kesintisiz bir b\u00fcy\u00fcme ve \u00f6rg\u00fctlenme ata\u011f\u0131 sa\u011flanm\u0131\u015f oldu. Sendika art\u0131k \u0130stanbul\u2019dan Urfa\u2019ya, \u0130zmir\u2019den A\u011fr\u0131\u2019ya, Trabzon\u2019dan Diyarbak\u0131r\u2019a onlarca ilde binlerle ifade edilen \u00fcyesi olan bir i\u015f\u00e7i sendikas\u0131 olarak s\u0131n\u0131f m\u00fccadelesinde yerini ald\u0131.<\/p>\n<p>Sendikan\u0131n son 3 y\u0131lda g\u00fcvencesiz \u00e7al\u0131\u015fma ve i\u015ften atma ko\u015fullar\u0131na kar\u015f\u0131 direni\u015fle ge\u00e7meyen neredeyse tek bir g\u00fcn\u00fc olmad\u0131. Hatta pek \u00e7ok zaman ayn\u0131 anda T\u00fcrkiye\u2019nin birden fazla ilinde direni\u015fler \u00f6rg\u00fctlendi. Bu konuda 2013 y\u0131l\u0131n\u0131 veri alan bir de\u011ferlendirmede D\u0130SK\/Enerji-Sen en fazla eylem yapan 3. i\u015f\u00e7i sendikas\u0131 oldu\u011fu belirtilmektedir [9].<\/p>\n<p><strong>3.1. Enerji-Sen \u0130S\u0130G anlay\u0131\u015f\u0131<\/strong><\/p>\n<p>Enerji-Sen\u2019in 2. Ola\u011fan Genel Kurulu\u2019nun ard\u0131ndan \u0130S\u0130G sendikan\u0131n g\u00fcndeminde \u00fcst s\u0131ralarda yer almaya ba\u015flad\u0131. Sendika bu d\u00f6nemde i\u015fkolunda ya\u015fanan i\u015f cinayetlerine kar\u015f\u0131 s\u0131n\u0131rl\u0131 da olsa tepkiler geli\u015ftirdi. Adana Kozan\u2019daki G\u00f6kdere K\u00f6pr\u00fc Baraj\u0131\u2019nda (\u015eubat 2012), Erzurum Karasu Baraj G\u00f6l\u00fc\u2019nde (Nisan 2012), Giresun Dereli HES \u015eantiyesi\u2019nde (May\u0131s 2012), Adana Toroslar EDA\u015e\u2019ta (May\u0131s 2012) ya\u015fanan i\u015f cinayetlerine kar\u015f\u0131 a\u00e7\u0131klamalar yap\u0131ld\u0131, kurulan \u0130stanbul \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Meclisi eylem ve etkinliklerine kat\u0131l\u0131mlar sa\u011fland\u0131 [10].<\/p>\n<p>Sendika, Mart 2013\u2019te ger\u00e7ekle\u015fen 3. Ola\u011fan Genel Kurulu ile birlikte \u0130S\u0130G alan\u0131nda sistemik bir \u00e7al\u0131\u015fma y\u00fcr\u00fctmeyi \u00f6n\u00fcne koydu.<\/p>\n<p>Genel Kurul\u2019da Sendika Merkez Y\u00f6netim Kurul \u00fcyeli\u011fi say\u0131s\u0131 artt\u0131r\u0131larak \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Sekreterli\u011fi olu\u015fturuldu. Bu \u015fekilde i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 konusunu sendikan\u0131n temel g\u00fcndemlerinden biri haline getirmek hedeflendi.<\/p>\n<p>Sendikan\u0131n bu d\u00f6nemde \u0130S\u0130G konusundaki hedeflerini \u00f6zetlemek gerekirse;<\/p>\n<p>\u201cYa\u015fam\u0131m\u0131za kast edebilecek \u00e7al\u0131\u015fma ko\u015fullar\u0131na kar\u015f\u0131 ba\u015fta \u201cg\u00fcvenceli \u00e7al\u0131\u015fma\u201d talebimizden ald\u0131\u011f\u0131m\u0131z g\u00fc\u00e7le hukuki hakk\u0131m\u0131z olan \u00e7al\u0131\u015fmama hakk\u0131m\u0131z\u0131 kullanaca\u011f\u0131m\u0131z bir m\u00fccadele ve \u00f6rg\u00fctlenme d\u00fczlemi olu\u015fturmak.<\/p>\n<p>\u0130\u015f Kazas\u0131 sonucu yaralanan enerji i\u015f\u00e7ileri ile ve hayat\u0131n\u0131 kaybeden enerji i\u015f\u00e7ilerinin aileleri ile dayan\u0131\u015fma i\u00e7inde olmak.<\/p>\n<p>\u0130\u015fyerlerimizde \u0130SG konusundaki eksikliklerin takip\u00e7isi olmak ve bu konuda hukuki ve fiili m\u00fcdahalelerde bulunmak.<\/p>\n<p>\u0130SG Kanunu gere\u011fi olu\u015fturulmas\u0131 gereken \u0130SG kurullar\u0131nda yer almak, bu kurullar\u0131 sendikal \u00f6rg\u00fctl\u00fcl\u00fc\u011f\u00fcn b\u00fcy\u00fcmesi ve kurumsalla\u015fmas\u0131 a\u00e7\u0131s\u0131ndan bir olanak olarak de\u011ferlendirmek, kurullardaki i\u015f\u00e7i kat\u0131l\u0131m\u0131n\u0131n ve etkisinin artmas\u0131 i\u00e7in \u00e7aba g\u00f6stermek.<\/p>\n<p>\u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131n\u0131n yok say\u0131lmas\u0131 anlam\u0131na gelen ta\u015feron \u00e7al\u0131\u015fmaya kar\u015f\u0131 m\u00fccadeleyi kesintisiz s\u00fcrd\u00fcrmek.<\/p>\n<p>Ba\u015f\u0131ndan beri \u00e7al\u0131\u015fmalar\u0131na destek verdi\u011fimiz \u0130stanbul \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Meclisi i\u00e7erisinde daha etkin bir tutum almak ve \u0130S\u0130G Meclisleri\u2019nin yayg\u0131nla\u015fmas\u0131 i\u00e7in \u00e7aba harcamak [11].\u201d<\/p>\n<p><strong>3.2. Enerji-Sen \u0130S\u0130G pratikleri<\/strong><\/p>\n<p>Sendika \u00f6rg\u00fctlendi\u011fi b\u00f6lgelerde yukar\u0131da belirtilen hedefler \u00e7er\u00e7evesinde pratikler hayata ge\u00e7irmi\u015ftir.<\/p>\n<p>Enerji i\u015fkolunun \u0130S\u0130G a\u00e7\u0131s\u0131ndan \u00e7ok tehlike s\u0131n\u0131f olarak de\u011ferlendirilen yap\u0131s\u0131 sendikan\u0131n \u0130S\u0130G eksenli taleplerinde 6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun 13. Maddesini kullanmay\u0131 yayg\u0131n olarak g\u00fcndeme getirmi\u015ftir. Son bir y\u0131l i\u00e7erisinde Tunceli (Haziran 2013), \u0130zmir (Aral\u0131k 2013), A\u011fr\u0131 (\u015eubat 2014), Diyarbak\u0131r (Nisan 2014), Hakkari (Haziran 2014), Van\/Mu\u015f (Haziran 2014), \u0130stanbul (Temmuz 2014) illerinde elektrik da\u011f\u0131t\u0131m \u015firketlerinin de\u011fi\u015fik servislerinde 13. Maddeye dayan\u0131larak \u0130S\u0130G g\u00fcndemli \u2018\u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131\u2019n\u0131 kullanma eylemleri ger\u00e7ekle\u015ftirildi.<\/p>\n<p>Bu eylemlerden baz\u0131lar\u0131 uyar\u0131 ama\u00e7l\u0131 olarak yap\u0131lsa da, Tunceli, Hakk\u00e2ri i\u015fyerlerindeki eylemler i\u015fverenle birer protokol imzalan\u0131p talepler kabul edilene kadar s\u00fcrd\u00fcr\u00fcld\u00fcler.<\/p>\n<p>Eylemlerde sendika, \u00e7al\u0131\u015fma hayat\u0131nda ya\u015fad\u0131klar\u0131 \u00fccret d\u00fc\u015f\u00fckl\u00fc\u011f\u00fc, ta\u015feron \u00e7al\u0131\u015fma gibi \u0130S\u0130G ile dolayl\u0131 ilgili konular\u0131n yan\u0131nda yasal \u0130S\u0130G \u00f6nlemlerinin al\u0131nmas\u0131 gibi do\u011frudan talepleri de g\u00fcndeme getirdi.<\/p>\n<p>\u00d6rne\u011fin 3 Haziran 2013 g\u00fcn\u00fc AKSA F\u0131rat EDA\u015e Tunceli \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019nde i\u015f ba\u015f\u0131 yapmayan i\u015f\u00e7ilerin talepleri \u015fu \u015fekildeydi:<\/p>\n<p><strong>1-<\/strong> T\u00fcm i\u015f\u00e7iler kadrolu olarak i\u015fe al\u0131nmal\u0131d\u0131r.<\/p>\n<p><strong>2-<\/strong> Ge\u00e7i\u015f d\u00f6neminde hi\u00e7bir hak kayb\u0131n\u0131n olmamas\u0131 ve fazla mesailerin \u00f6denmesi<\/p>\n<p><strong>3-<\/strong> Maa\u015flar 1500 TL+yemek \u00fccreti \u015feklinde yeniden d\u00fczenlenmelidir<\/p>\n<p><strong>4-<\/strong> \u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi konusunda eksikler h\u0131zla tamamlanmal\u0131d\u0131r [12].<\/p>\n<p>\u0130zmir Gediz EDA\u015e b\u00fcnyesinde \u00e7al\u0131\u015fan enerji i\u015f\u00e7ilerinin 23 Aral\u0131k 2013 g\u00fcn\u00fc yapt\u0131klar\u0131 i\u015f b\u0131rakma eyleminin 2 temel talebi vard\u0131: \u201c\u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi \u00f6nlemlerinin al\u0131nmas\u0131 ve \u00fccret kalemi i\u00e7erisinde yer almayan yol ve yemek paras\u0131n\u0131n verilmeye ba\u015flanmas\u0131.\u201d [13]\n<p>T\u00fcm i\u015fyerlerinde \u0130S\u0130G talepli eylemler \u00f6rg\u00fctlenirken konu ayn\u0131 zamanda i\u015fyerinin bulundu\u011fu ilin \u00c7al\u0131\u015fma ve \u0130\u015fkurumu \u0130l M\u00fcd\u00fcrl\u00fcklerine de iletildi. Yarg\u0131tay\u2019\u0131n bozdu\u011fu dava halen yerel mahkemede devam etmektedir.<\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi \u00e7ok tehlikeli bir i\u015f kolunda can g\u00fcvenli\u011fi tehlikesinin olu\u015ftu\u011fu bir durum olmas\u0131na ra\u011fmen sendikan\u0131n resmi kurumlara yapt\u0131\u011f\u0131 yap\u0131lan ba\u015fvurulara ancak 4-5 ayl\u0131k zaman dilimleri i\u00e7erisinde yan\u0131t verilmektedir. Sadece bu durum dahi \u00fclkemizde \u0130S\u0130G\u2019in bulundu\u011fu durumun ac\u0131 bir ifadesidir.<\/p>\n<p>De\u011finilmesi gereken bir ba\u015fka nokta ise \u0130SG Kanunu 13. maddeye dayand\u0131r\u0131larak yap\u0131lan ba\u015fvurular\u0131n (\u0130stanbul hari\u00e7) hi\u00e7birinde i\u015fyeri \u0130SG Kurulu\u2019nun toplan\u0131p i\u015f\u00e7ilerin taleplerine yan\u0131t vermemi\u015f olmas\u0131d\u0131r. \u0130stanbul BEDA\u015e\u2019ta verilen yan\u0131t ise a\u015fa\u011f\u0131da ayr\u0131ca de\u011ferlendirilecektir.<\/p>\n<p><strong>3.3. \u0130S\u0130G konusunda uluslararas\u0131 \u00e7al\u0131\u015fmalar<\/strong><\/p>\n<p>D\u0130SK\/Enerji-Sen sendikas\u0131 i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi konusunda uluslararas\u0131 deneyim payla\u015f\u0131m\u0131 ve dayan\u0131\u015fman\u0131n \u00f6nemine inan\u0131yor. Bu konuda Alman Sendikalar\u0131 Konfederasyonu DGB\u2019nin E\u011fitim Merkezi taraf\u0131ndan desteklenen \u201cSa\u011fl\u0131kl\u0131 \u00c7al\u0131\u015fma: \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011finde Uluslararas\u0131 Standartlar\u0131n Uygulanmas\u0131\u201d projesinde yer al\u0131yor.<\/p>\n<p>Sendikalar\u0131n i\u015fyerlerinde \u0130S\u0130G konusunda \u00e7al\u0131\u015fanlar\u0131n konumlar\u0131n\u0131 g\u00fc\u00e7lendirmesi amac\u0131yla hayata ge\u00e7irilen ve Ocak 2014 y\u0131l\u0131nda ba\u015flay\u0131p Aral\u0131k 2016\u2019ya kadar s\u00fcrecek olan proje kapsam\u0131nda yap\u0131lan \u00e7al\u0131\u015fmalara ve i\u015f\u00e7i e\u011fitimlerine kendi \u00f6znel ko\u015fullar\u0131 ba\u011flam\u0131nda dahil oluyor.<\/p>\n<p><strong>4. D\u0130SK\/Enerji-Sen BEDA\u015e \u0130S\u0130G deneyimi<\/strong><\/p>\n<p>Bo\u011fazi\u00e7i Elektrik Da\u011f\u0131t\u0131m A\u015e, D\u0130SK\/Enerji-Sen Sendikas\u0131n\u0131n 2006\u2019dan itibaren \u00f6rg\u00fctlenme g\u00fcndeminde yer alan bir i\u015fyeridir. Sendika \u00f6zellikle 2012 y\u0131l\u0131nda yo\u011fun ve \u0131srarc\u0131 bir \u00fcyelik ve direni\u015f s\u00fcrecinin ard\u0131ndan i\u015fyerinde kal\u0131c\u0131 bir \u00f6rg\u00fctlenme sa\u011flam\u0131\u015ft\u0131r. BEDA\u015e\u2019\u0131n \u00f6zelle\u015ftirilerek CLK (Cengiz-Limak-Kolin) Ortakl\u0131\u011f\u0131na devredildi\u011fi May\u0131s 2013 \u00f6ncesinde ve sonras\u0131nda verilen hukuki ve fiili m\u00fccadelelerin sonunda maa\u015flar\u0131n zaman\u0131nda ve tam \u00f6denmesi, keyfi i\u015ften \u00e7\u0131karmalar\u0131n sona ermesi, ta\u015feronda \u00e7al\u0131\u015fan i\u015f\u00e7ilerin \u00f6nemli bir k\u0131sm\u0131n\u0131n kadroya al\u0131nmas\u0131 gibi kazan\u0131mlar elde edilmi\u015ftir.<\/p>\n<p>Dolay\u0131s\u0131yla BEDA\u015e i\u015fyeri sendikan\u0131n, \u00f6rg\u00fctlenme ve sendikal prati\u011finde \u00f6nemli bir yer tutmaktad\u0131r.<\/p>\n<p>Sendika 2014 y\u0131l\u0131ndan itibaren BEDA\u015e i\u015fyerlerinde \u0130S\u0130G konusunda sistematik olarak bir dizi giri\u015fimde bulunmu\u015ftur.<\/p>\n<p><strong>4.1. \u0130SG kurullar\u0131 i\u015f\u00e7ilerin iradesini yans\u0131tmal\u0131d\u0131r<\/strong><\/p>\n<p>Sendika \u0130SG kurullar\u0131n\u0131n mevzuat\u0131n \u015fekilsel olarak yerine getirilmesi d\u0131\u015f\u0131nda etkin olarak yeniden d\u00fczenlenmesini talep etmi\u015ftir. Bu konuda BEDA\u015e Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019ne bir yaz\u0131 yaz\u0131larak \u201c1- \u00c7al\u0131\u015fan temsilcisi belirlenmesinde \u015firketin b\u00fct\u00fcn\u00fcnde \u00e7al\u0131\u015fan i\u015f\u00e7iler yerine i\u015fletme baz\u0131nda \u00e7al\u0131\u015fan temsilcisi belirlenmesi do\u011fru olacakt\u0131r.\u201d denilmi\u015ftir.<\/p>\n<p>Ayr\u0131ca BEDA\u015e\u2019ta % 40 civar\u0131 bir \u00fcye \u00e7o\u011funlu\u011fu ile yetki alan sendikan\u0131n i\u015fyerinde \u00f6rg\u00fctl\u00fcl\u00fc\u011f\u00fcn\u00fcn \u0130SG Kurul temsilcilerinin yetkili sendikan\u0131n temsilcileri ile s\u0131n\u0131rl\u0131 kalmas\u0131n\u0131n eksiklik oldu\u011funu vurgulam\u0131\u015f, \u201c2- (\u2026) yetkili sendikan\u0131n a\u00e7ma-kesme servisinde \u00f6rg\u00fctl\u00fc olmad\u0131\u011f\u0131, aksine a\u00e7ma-kesme servisinde sendikam\u0131z\u0131n ciddi bir \u00f6rg\u00fctl\u00fcl\u00fc\u011f\u00fc oldu\u011fu malumdur.<\/p>\n<p>Dolay\u0131s\u0131yla hem i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi mant\u0131\u011f\u0131 gere\u011fi hem de a\u00e7ma-kesme servisinde \u00e7al\u0131\u015fanlar\u0131n temsiliyetinin \u201cyetkili sendika\u201d marifetiyle sa\u011flanabilmesi fiilen m\u00fcmk\u00fcn de\u011fildir.\u201duyar\u0131s\u0131nda bulunulmu\u015ftur. [14]\n<p>Ayn\u0131 yaz\u0131da s\u00f6z konusu serviste i\u015f\u00e7i temsilcisi se\u00e7iminin daha \u00f6nce BEDA\u015e y\u00f6netimi taraf\u0131ndan organize edilmemesi durumunda \u201c26 Haziran 2014 tarihinde her i\u015fletmede ayr\u0131 ayr\u0131 olmak \u00fczere \u2018\u00e7al\u0131\u015fan temsilcisi\u2019 se\u00e7imleri yap\u0131lmas\u0131 planlanmaktad\u0131r\u201d denmi\u015ftir. BEDA\u015e y\u00f6netiminin dilek\u00e7eye cevap vermemesi ve temsilci belirlemek i\u00e7in herhangi bir giri\u015fimde bulunulmamas\u0131 \u00fczerine s\u00f6zkonusu tarihte a\u00e7ma-kesme servisinde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin \u00e7o\u011funlu\u011funun kat\u0131l\u0131m\u0131 ile temsilciler belirlenmi\u015f ve temsilci listesi tek tek her i\u015fyerinden i\u015f\u00e7ilerin imzal\u0131 tutanaklar\u0131 ile birlikte BEDA\u015e GM\u2019ye yaz\u0131 ile bildirilmi\u015ftir. Ancak buna ra\u011fmen BEDA\u015e y\u00f6netimi bu yaz\u0131ya da herhangi bir cevap vermemi\u015ftir.<\/p>\n<p><strong>4.2. Yasal mevzuat\u0131n asgari gereklilikleri tamamlanmal\u0131d\u0131r<\/strong><\/p>\n<p>BEDA\u015e\u2019\u0131n \u00f6zelle\u015ftirilmesinden \u00f6nce oldu\u011fu gibi \u00f6zelle\u015ftirmeden sonra da 6331 say\u0131l\u0131 kanunun \u00e7ok tehlikeli i\u015fyerleri i\u00e7in gerektirdi\u011fi \u0130S\u0130G \u00e7al\u0131\u015fmalar\u0131 hayata ge\u00e7irilmemi\u015ftir. \u00d6zelle\u015ftirmeden bir y\u0131l sonra gelinen nokta \u015fu \u015fekildeydi: \u0130SG Kurulu ilk toplant\u0131s\u0131n\u0131 hen\u00fcz yapm\u0131\u015f, Ayl\u0131k \u0130SG Kurul toplant\u0131lar\u0131 hayata ge\u00e7irilmemi\u015f, \u0130SG e\u011fitimleri i\u015f\u00e7ilerin s\u0131n\u0131rl\u0131 bir k\u0131sm\u0131na 4\u2019er saat olarak verilmi\u015f, Risk De\u011ferlendirmesi ve Acil Durum Planlar\u0131 Hakk\u0131nda i\u015f\u00e7ileri herhangi bir bilgilendirme yap\u0131lmam\u0131\u015f, i\u015f i\u00e7in gerekli KKD\u2019ler hemen hemen ya hi\u00e7 sa\u011flanmam\u0131\u015f ya da uygunsuz KKD tedarik edilmi\u015fti.<\/p>\n<p>Bu durum daha \u00f6nce Kas\u0131m 2013 y\u0131l\u0131nda sendika taraf\u0131ndan tespit edilmi\u015f ve bir yaz\u0131 ile BEDA\u015e y\u00f6netimine bildirilmi\u015fti.<\/p>\n<p><strong>4.3. \u201c\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 engellenemez\u201d<\/strong><\/p>\n<p>Sendikan\u0131n \u0130S\u0130G konusunda \u015firket y\u00f6netimi nezdinde b\u00fct\u00fcn i\u015fbirli\u011fi \u00e7abalar\u0131n\u0131n kar\u015f\u0131l\u0131ks\u0131z kalmas\u0131 ve ayr\u0131ca \u0130S\u0130G konusunda tahamm\u00fcl kabul etmeyen eksiklikler yap\u0131lan i\u015fyeri toplant\u0131lar\u0131 ile i\u015f\u00e7ilere aktar\u0131ld\u0131. Yap\u0131lan de\u011ferlendirmelerin ard\u0131ndan 21 Temmuz 2014 g\u00fcn\u00fc 6331 say\u0131l\u0131 yasan\u0131n 13. Maddesi uyar\u0131nca BEDA\u015e a\u00e7ma-kesme servisinde \u00e7al\u0131\u015fan enerji i\u015f\u00e7ileri \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma haklar\u0131n\u0131 kulland\u0131lar. \u00d6\u011flen saatlerine kadar i\u015fyerlerinde i\u015fverenden gelecek \u00e7\u00f6z\u00fcm \u00f6nerilerini bekleyen i\u015f\u00e7iler \u00f6\u011flenleyin Taksim-Talimhane\u2019deki \u015firket GM \u00f6n\u00fcne gelerek hem sorunlar\u0131n\u0131 dilek\u00e7elerle i\u015fverene bildirdiler hem de bir bas\u0131n a\u00e7\u0131klamas\u0131 ile kamuoyuyla payla\u015ft\u0131lar.<\/p>\n<p><strong>4.4. \u0130SG Kurulunun hukuk d\u0131\u015f\u0131 karar\u0131<\/strong><\/p>\n<p>Ard\u0131ndan ya\u015fanan geli\u015fmeler ise \u00fclkemizde \u0130S\u0130G i\u015fleyi\u015finin vahametini ortaya koydu. Mevzuat gere\u011fi acilen toplanmas\u0131 gereken \u0130SG Kurulu daha sonra kurul tutanaklar\u0131ndan \u00f6\u011frendi\u011fimiz \u00fczere \u201ctopland\u0131\u201d. Toplant\u0131 tutana\u011f\u0131nda i\u015f\u00e7ilerin \u015firket i\u00e7erisinde \u0130S\u0130G ile ilgili taleplerinin herhangi birine cevap vermek yerine i\u015f\u00e7ileri 6331\u2019e ayk\u0131r\u0131 eylem yapmakla \u201csu\u00e7lad\u0131\u201d. Kurulun oy birli\u011fi ile ald\u0131\u011f\u0131 anla\u015f\u0131lan karar \u0130S\u0130G mevzuat\u0131 a\u00e7\u0131s\u0131ndan ciddi hatalar\u0131 bar\u0131nd\u0131r\u0131yordu. Kurul i\u015f\u00e7ilerin somut taleplerine yan\u0131t vermesi gerekirken \u201c6331\u2019e ayk\u0131r\u0131 eylem yapmak\u201d, \u201cas\u0131l ama\u00e7lar\u0131 6331 say\u0131l\u0131 yasan\u0131n uygulamas\u0131 de\u011fil\u201d gibi ifadelerle i\u015f\u00e7ileri su\u00e7layan bir tutanak d\u00fczenledi.<\/p>\n<p>Kurul Tutana\u011f\u0131n\u0131n i\u015f\u00e7ilere duyurulmas\u0131n\u0131n ard\u0131ndan sendika tutana\u011f\u0131n h\u00fck\u00fcms\u00fcz oldu\u011fu ve i\u015ften \u00e7\u0131karmalara zemin olu\u015fturmak i\u00e7in d\u00fczenlendi\u011fini kamuoyuna duyurdu. Nitekim kurul karar\u0131ndan birka\u00e7 g\u00fcn sonra BEDA\u015e Avc\u0131lar \u0130\u015fletmesinde 24 i\u015f\u00e7i Disiplin Kurulu karar\u0131yla i\u015ften \u00e7\u0131kart\u0131ld\u0131lar. Sendika bir yandan i\u015ften \u00e7\u0131kart\u0131lan i\u015f\u00e7ilerle beraber direni\u015f \u00f6rg\u00fctlerken di\u011fer yandan da \u00f6zellikle i\u015ften \u00e7\u0131kartmaya dayanak olu\u015fturan kurul karar\u0131n\u0131n imzac\u0131lar\u0131n\u0131 kamuoyuna te\u015fhir etti. Kurul sekreteri \u0130\u015f G\u00fcvenli\u011fi Uzman\u0131 ile Kurul \u00fcyesi \u0130\u015f Yeri Hekimi\u2019ni ba\u011fl\u0131 bulunduklar\u0131 meslek odalar\u0131n\u0131n onur kurullar\u0131na verilmeleri talepli ba\u015fvurular yap\u0131ld\u0131.<\/p>\n<p>BEDA\u015e y\u00f6netimi olu\u015fan i\u015f\u00e7i ve kamuoyu tepkisi sonucu daha \u00f6nce duyurmas\u0131na ra\u011fmen daha fazla i\u015f\u00e7iyi i\u015ften atmaya cesaret edememesine ra\u011fmen Avc\u0131lar \u0130\u015fletmede i\u015ften \u00e7\u0131kart\u0131lan i\u015f\u00e7ilerin direni\u015fleri devam etmekte.<\/p>\n<p>BEDA\u015e i\u015fyerlerinde ise verilen m\u00fccadelenin de etkisiyle k\u0131smi iyile\u015ftirmeler yap\u0131lsa da halen i\u015fyerinde g\u00fcnde ortalama bir i\u015f kazas\u0131 ya\u015fanmaya devam ediyor.<\/p>\n<p><strong>5. Sonu\u00e7: Bu Daha Ba\u015flang\u0131\u00e7<\/strong><\/p>\n<p>Sendikan\u0131n s\u00fcrd\u00fcrd\u00fc\u011f\u00fc \u00e7al\u0131\u015fan sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00e7al\u0131\u015fmalar\u0131, konunun sadece i\u015f cinayetlerine tepki ba\u011flam\u0131n\u0131n \u00f6tesine ta\u015f\u0131mas\u0131 nedeniyle \u00f6nem ta\u015f\u0131yor. Buradan bak\u0131ld\u0131\u011f\u0131nda sendikalar\u0131n i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi g\u00fcndemine uzak oldu\u011fu y\u00f6n\u00fcnde genelle\u015fmi\u015f yarg\u0131 D\u0130SK\/Enerji-Sen sendikas\u0131 i\u00e7in s\u00f6z konusu de\u011fil.<\/p>\n<p>Sendikal hareketin son birka\u00e7 y\u0131lda i\u015f cinayetleri \u00fczerinden g\u00fcndemine giren \u0130S\u0130G\u2019in esas\u0131nda i\u015f\u00e7i s\u0131n\u0131f\u0131 \u00f6rg\u00fctlenmesinin \u00f6ncelikli g\u00fcndemlerinden biri olmas\u0131 gerekti\u011fi konusunda D\u0130SK\/Enerji-Sen prati\u011fi \u00f6nemli dersler i\u00e7eriyor.<\/p>\n<p>Sendikan\u0131n belki kat edecek daha \u00e7ok yolu var. Ancak g\u00fcvenli \u00e7al\u0131\u015fma ortam\u0131 m\u00fccadelesi g\u00fcvenceli \u00e7al\u0131\u015fma talebinin temel bile\u015fenlerinden biri haline getirerek bu yolda kritik bir e\u015fik a\u015f\u0131lm\u0131\u015f durumda.<\/p>\n<p>S\u00fcre\u00e7 boyunca elde edilen deneyimlerden ve tart\u0131\u015fmalardan s\u00fcz\u00fclen baz\u0131 talep ve de\u011ferlendirmelere de\u011finmekte fayda var:<\/p>\n<ul>\n<li>\u0130\u015fyerlerinde i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011finin \u00f6nko\u015fulu \u00f6rg\u00fctl\u00fc i\u015f\u00e7ilerin varl\u0131\u011f\u0131d\u0131r. Bir i\u015fyerinde sendikal \u00f6rg\u00fctlenme olmadan kal\u0131c\u0131 ve etkili bir \u0130S\u0130G prati\u011fi s\u00f6z konusu olamaz.<\/li>\n<li>Sendikalar i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131n\u0131 sadece i\u015fyeri s\u0131n\u0131rlar\u0131 i\u00e7inde de\u011ferlendirmemeli, evrensel i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 tan\u0131m\u0131 gere\u011fi toplumsal iyilik halini de g\u00f6zeterek ya\u015fama ko\u015fullar\u0131ndaki olumsuzluklar\u0131 da \u0130S\u0130G talebi olarak i\u015fyerinde ve genel d\u00fczlemde \u00f6rg\u00fctlemelidir.<\/li>\n<li>6331 say\u0131l\u0131 yasa yerine emek ve meslek \u00f6rg\u00fctlerinin g\u00f6r\u00fc\u015f ve \u00f6nerileri do\u011frultusunda yeni bir \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Yasas\u0131\u2019n\u0131n haz\u0131rlanmas\u0131 g\u00fcndeme getirilmelidir.<\/li>\n<li>Ulusal \u0130SG Konseyi\u2019nin mali ve idari ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n sa\u011flanmas\u0131; i\u015f\u00e7i temsilcisi say\u0131s\u0131n\u0131n, i\u015fveren ve devlet temsilcilerinin toplam say\u0131s\u0131ndan az olmamas\u0131 talep edilmelidir.<\/li>\n<li>Emek \u00f6rg\u00fctleri ILO Normlar\u0131n\u0131n tamam\u0131n\u0131n kabul edilmesini \u00f6ncelikli g\u00fcndemleri aras\u0131na almal\u0131d\u0131r.<\/li>\n<li>\u0130\u015fyeri \u0130SG kurullar\u0131nda \u00e7al\u0131\u015fan temsilcileri say\u0131sal olarak toplam\u0131n en az yar\u0131s\u0131n\u0131 olu\u015fturmal\u0131d\u0131r. \u0130SG kurul kararlar\u0131 tavsiye niteli\u011finden \u00e7\u0131kart\u0131l\u0131p ba\u011flay\u0131c\u0131 hale getirilmesi m\u00fccadele konusu yap\u0131lmal\u0131d\u0131r. \u0130\u015fyerlerinde \u0130S\u0130G e\u011fitimlerinin i\u00e7erikleri sendikalarla birlikte belirlenmelidir.<\/li>\n<li>\u0130S\u0130G \u00e7al\u0131\u015fanlar\u0131n\u0131n (\u0130\u015fyeri hekimi, i\u015f g\u00fcvenli\u011fi uzman\u0131 ve di\u011fer sa\u011fl\u0131k personeli) ve \u0130S\u0130G denetimi yapan m\u00fcfetti\u015flerin g\u00f6revlerini i\u015fverenden ve siyasi otoriteden ba\u011f\u0131ms\u0131z bir \u015fekilde y\u00fcr\u00fctmelerini sa\u011flayacak yasal d\u00fczenlemeler yap\u0131lmal\u0131d\u0131r.<\/li>\n<li>Meslek hastal\u0131klar\u0131 konusunda en az i\u015f kazalar\u0131\/cinayetleri kadar \u00f6ncelik verilmesi gerekir.
