Son 12 y\u0131ll\u0131k AKP iktidarlar\u0131 d\u00f6neminde ger\u00e7ekle\u015ftirilen rant odakl\u0131 planlama politikalar\u0131 nedeniyle, b\u00fct\u00fcn \u00fclke topraklar\u0131 ya\u011fmaya a\u00e7\u0131lm\u0131\u015f ve k\u00fclt\u00fcrel, tarihsel miras, do\u011fal \u00e7evre tutars\u0131z ve geri d\u00f6n\u00fclemez bi\u00e7imde tahrip edilmeye devam etmektedir.<\/p>\n<p>K\u00fcresel ve b\u00f6lgesel \u00f6l\u00e7ekteki kriz d\u00f6nemlerinde ekonomik istikrar\u0131n s\u00fcrd\u00fcr\u00fclmesi; \u00f6ncelikle, in\u015faat ve yap\u0131 sekt\u00f6r\u00fcnde getirilen d\u00fczenlemelerle sermayenin kent topra\u011f\u0131 ve emlak rant\u0131na y\u00f6nlendirilmesi yoluyla sa\u011flanmaya \u00e7al\u0131\u015f\u0131lmaktad\u0131r. Oysa Anayasa ile; tarihsel, k\u00fclt\u00fcrel ve do\u011fal de\u011ferlerin korunmas\u0131, k\u0131y\u0131lar\u0131n, tar\u0131m arazilerinin ve orman alanlar\u0131n\u0131n korunmas\u0131, kent ve planlama politikalar\u0131n\u0131n kamu yarar\u0131na geli\u015ftirilmesi i\u00e7in Devleti gerekli tedbirleri almakla g\u00f6revlendirmi\u015f, bunun i\u00e7in gerekli yasalar\u0131 koymak ve \u00f6nlemleri almakla y\u00fck\u00fcml\u00fc k\u0131lm\u0131\u015ft\u0131r. Bu \u00e7er\u00e7evede yap\u0131l\u0131 \u00e7evrenin sa\u011fl\u0131kl\u0131 ve kamu yarar\u0131n\u0131 g\u00f6zeten politikalar \u00e7er\u00e7evesinde \u00fcretilmesi, kamu y\u00f6netiminin, merkezi ve yerel y\u00f6netimlerin, meslek mensuplar\u0131n\u0131n, meslek kurulu\u015flar\u0131n\u0131n ve ilgili t\u00fcm kesimlerin \u00fclke ve insanl\u0131k ad\u0131na ortak sorumlulu\u011fudur.<\/p>\n<p>Ancak bunun tam tersi bir anlay\u0131\u015fla \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 taraf\u0131ndan kendi i\u00e7inde tutars\u0131z, \u00e7eli\u015fki ve belirsizliklerle dolu; yasa yapma mant\u0131\u011f\u0131yla ba\u011fda\u015fmayan ve i\u015fin ehli olmayan ki\u015filerce sipari\u015f \u00fczerine haz\u0131rland\u0131\u011f\u0131 anla\u015f\u0131lan 13 adet kanunda de\u011fi\u015fiklik \u00f6ng\u00f6ren \u201cyasa tasla\u011f\u0131\u201d g\u00fcndeme getirilmi\u015ftir. \u201cTorba Yasa\u201d niteli\u011findeki d\u00fczenlemelerle esas olarak, imar, \u00e7evre, k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131n\u0131n korunmas\u0131 ile yap\u0131 denetiminde de\u011fi\u015fiklikler i\u00e7eren; TMMOB VE Odalara m\u00fcdahaleyi kapsayan yeni bir giri\u015fim ba\u015flat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>G\u00fcndeme getirilen son yasa taslaklar\u0131; kalan son do\u011fal alanlar\u0131, k\u00fclt\u00fcrel ve tarihi miras\u0131, kentsel ve k\u0131rsal t\u00fcm \u00e7evreyi ranta kurban etmenin yan\u0131 s\u0131ra; vatanda\u015flar\u0131n Anayasa ile g\u00fcvence alt\u0131ndaki haklar\u0131n\u0131 ortadan kald\u0131ran, yerel y\u00f6netimlerin yetkilerini yok ederek yetkileri merkezi idareye aktaran; ucuz emek politikalar\u0131n\u0131n yans\u0131mas\u0131 olarak emek\u00e7ileri ta\u015feronla\u015ft\u0131r\u0131p k\u00f6lele\u015ftiren, g\u00fcvencesiz \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 dayatan; mimar, m\u00fchendis ve planc\u0131lar\u0131n mesleki haklar\u0131n\u0131 ortadan kald\u0131ran ve nihayet t\u00fcm bu alanlarda kamusal sorumluluklar\u0131 nedeniyle s\u00f6z s\u00f6yleyen Meslek Odalar\u0131\u2019n\u0131 i\u015flevsizle\u015ftirip, b\u00f6l par\u00e7ala y\u00f6net modeliyle siyasi iktidara tabi k\u0131lmaya \u00e7al\u0131\u015fan, ancak diktat\u00f6rl\u00fcklerde g\u00f6r\u00fclebilecek d\u00fczenlemeler olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>\u201c3194 Say\u0131l\u0131 \u0130mar Kanunu ile Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Tasla\u011f\u0131\u201d olarak g\u00fcndeme gelen torba taslak; \u0130mar Kanunu, Yap\u0131 Denetimi Hakk\u0131nda Kanun, \u0130sk\u00e2n Kanunu, K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu, \u00c7evre Kanunu, Kat M\u00fclkiyeti Kanunu, Belediye Kanunu, Belediye Gelirleri Kanunu ve T\u00fcrk M\u00fchendis ve Mimar Odalar\u0131 Birli\u011fi Kanunu\u2019nda; yap\u0131la\u015fma ve imar, ilgili meslek alanlar\u0131 ve meslek kurulu\u015flar\u0131, tabiat ve k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n korunmas\u0131, yerel y\u00f6netimler ve sorumluluklar\u0131, \u00e7al\u0131\u015fma hayat\u0131 ve i\u015f ko\u015fullar\u0131 hakk\u0131nda demokratik, mesleki kazan\u0131m ve birikimleri yok sayan, \u00fclkenin k\u00fclt\u00fcrel ve sosyal de\u011ferlerinin yozla\u015ft\u0131r\u0131lmas\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7an d\u00fczenlemeler i\u00e7ermektedir.<\/p>\n<p>Bu d\u00fczenlemeler; y\u00f6netimde merkezile\u015fmeye yol a\u00e7arak,yerel y\u00f6netimlerin yerinden y\u00f6netim yetkilerini k\u0131s\u0131tlayacak, kamusal alanlarda yap\u0131la\u015fman\u0131n \u00f6n\u00fcn\u00fc a\u00e7acak, mesleki haklar\u0131n k\u0131s\u0131tlanmas\u0131 yoluyla mesleki e\u011fitim alan uzmanlar\u0131n sundu\u011fu nitelikli hizmetlerin topluma ula\u015fmas\u0131n\u0131 engelleyecek, kamusal hizmetleri \u00f6zelle\u015ftirerek sermayeye rant ve kar sa\u011flayacak ko\u015fullar\u0131n olu\u015fumunun yasal altyap\u0131s\u0131n\u0131 haz\u0131rlamaktad\u0131r.<\/p>\n<p>Planlama alan\u0131nda getirilen d\u00fczenlemelerle; \u00fclke \u00f6l\u00e7e\u011finde b\u00fct\u00fcnsel planlar\u0131n yerine par\u00e7al\u0131 ve b\u00f6lgesel uygulamalarla kentsel ve k\u0131rsal yap\u0131l\u0131 \u00e7evrenin niteliksizle\u015ftirilmesinin \u00f6n\u00fc a\u00e7\u0131lmaktad\u0131r. Devletin bu planlar kapsam\u0131nda sunmakla y\u00fck\u00fcml\u00fc oldu\u011fu sa\u011fl\u0131k, e\u011fitim, park, meydan ve hatta mezarl\u0131k gibi kamusal hizmetler \u00f6zelle\u015ftirilmekte, bu hizmetlere ayr\u0131lan alanlarda \u00f6zel ki\u015filerce tesisler kurulmas\u0131n\u0131n ve i\u015fletilmesine imk\u00e2n verilmektedir. S\u00f6ylemindeki referanslar\u0131n\u0131 dini motifler \u00fczerinden olu\u015fturan iktidar\u0131n, mezarl\u0131klar\u0131 dahi \u00f6zel m\u00fclkiyete ve i\u015fletmeye konu eden yasa maddeleri \u00f6nermesi ise yurtta\u015flara hangi g\u00f6zle bakt\u0131\u011f\u0131n\u0131n a\u00e7\u0131k bir g\u00f6stergesidir.<\/p>\n<p>\u00dclkemizde pek \u00e7ok kez ya\u015fanan afetlerle binlerce yurtta\u015f\u0131n hayat\u0131n\u0131 kaybetmesine sebep olan imar aflar\u0131 yoluyla, mevzuata ve kurallara ayk\u0131r\u0131 yap\u0131lar affedilerek yeni felaketlere zemin haz\u0131rlanmas\u0131 yetmezmi\u015f gibi, taslakta getirilen d\u00fczenlemelerle; afet riski alt\u0131ndaki alanlar ve kentsel d\u00f6n\u00fc\u015f\u00fcm alanlar\u0131 ilan\u0131, imar planlar\u0131 ile olu\u015fan de\u011fer art\u0131\u015f\u0131, kamula\u015ft\u0131rma, kamu ortakl\u0131\u011f\u0131 pay\u0131, resen parsel birle\u015ftirmeleri, yap\u0131la\u015fmas\u0131 sak\u0131ncal\u0131 alanlar olu\u015fturulmas\u0131 kararlar\u0131 ve bina y\u0131k\u0131m\u0131 ile yurtta\u015flar\u0131n anayasal g\u00fcvence alt\u0131ndaki haklar\u0131 yok say\u0131larak m\u00fclklerine el konabilmektedir. Bu de\u011fi\u015fikliklerle anayasal haklar olan bar\u0131nma ve m\u00fclkiyet haklar\u0131 rant arac\u0131 haline getirilmektedir.<\/p>\n<p>Kamusal denetimin bir yana b\u0131rak\u0131larak, denetimin ve \u201cfenni mesuliyet\u201din, sermaye \u015firketlerince \u00fcstlenilmesi; eser sahibi mimarlar\u0131n izni olmadan yap\u0131larda cephe de\u011fi\u015fikli\u011fi ve tadilat yap\u0131labilmesi; yap\u0131 denetimi, \u015fantiye ve benzeri yap\u0131 i\u015flerinde mimarl\u0131k ve m\u00fchendislik alanlar\u0131 d\u0131\u015f\u0131nda, ba\u015fka meslek mensuplar\u0131n\u0131n istihdam edilebilmesinin sa\u011flanmas\u0131 gibi de\u011fi\u015fikliklerle mimar ve m\u00fchendislerin mesleki haklar\u0131n\u0131n gasb\u0131 yan\u0131nda, sekt\u00f6re ucuz emek sa\u011flanmaya \u00e7al\u0131\u015f\u0131lmakta ve \u00f6teden beri do\u011fru istihdam politikalar\u0131 \u00e7er\u00e7evesinde yap\u0131 \u00fcretim ve denetim s\u00fcrecinde, mimar ve m\u00fchendislere yard\u0131mc\u0131 olmas\u0131 gerekti\u011fini ifade etti\u011fimiz teknikerler, alt\u0131ndan kalkamayacaklar\u0131 sorumluluklarla kar\u015f\u0131 kar\u015f\u0131ya b\u0131rak\u0131lmaktad\u0131rlar.<\/p>\n<p>Siyasi iktidar\u0131n, aidiyet ve kimlik duygular\u0131n\u0131n sanatsal ve mek\u00e2nsal ifadesi olan kamusal alanlara, gelece\u011fin miras\u0131n\u0131 olu\u015fturan yap\u0131l\u0131 \u00e7evreye ve \u00fclkenin tarih, k\u00fclt\u00fcr ve ya\u015fam dokusunun temeli olan mimarl\u0131\u011fa, ideolojileri do\u011frultusunda y\u00f6n verme arzusu sonucu; yap\u0131lar\u0131n mimari proje a\u015famas\u0131ndan d\u0131\u015f cephe d\u00fczenlemelerine kadar belirlenecek olan ko\u015fullarla tek tip haz\u0131rlanmas\u0131 zorunlulu\u011fu getirilmesinin \u00f6n\u00fc a\u00e7\u0131lmaktad\u0131r.<\/p>\n<p>\u0130mar Kanunu ile K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanununda yap\u0131lmas\u0131 planlanan de\u011fi\u015fikliklerle, yarg\u0131 kararlar\u0131yla uygulamas\u0131 iptal edilen planlara g\u00f6re yap\u0131lan yap\u0131lar\u0131n kazan\u0131lm\u0131\u015f hak oldu\u011fu; daha alt stat\u00fcye d\u00fc\u015f\u00fcr\u00fclen do\u011fal sit alanlar\u0131nda mevcut her t\u00fcr ve \u00f6l\u00e7ekte planlar\u0131nuygulanmas\u0131na b\u00f6lge komisyonu karar\u0131 do\u011frultusunda devam edilebilece\u011fi y\u00f6n\u00fcndeki d\u00fczenlemeler, siyasi iktidar\u0131n rejimle olan hesapla\u015fmas\u0131n\u0131n yasa metinleri i\u00e7erisine serpi\u015ftirilmi\u015f \u00f6rnekleri olarak \u00f6n\u00fcm\u00fcze \u00e7\u0131kmaktad\u0131r. Bu yolla halka miras b\u0131rak\u0131lm\u0131\u015f olan Atat\u00fcrk Orman \u00c7iftli\u011fine kondurulan ka\u00e7ak saray; tarihi yar\u0131mada siluetine tecav\u00fcz eden 16:9 gibi yap\u0131lar yasalla\u015ft\u0131r\u0131lmaya \u00e7al\u0131\u015f\u0131lmaktad\u0131r.<\/p>\n<p>Yap\u0131 Denetimi Hakk\u0131nda Kanun\u2019da \u00f6ng\u00f6r\u00fclen de\u011fi\u015fikliklerle \u201cteknik m\u00fc\u015favirlik kurulu\u015flar\u0131\u201d arac\u0131l\u0131\u011f\u0131yla proje ve yap\u0131 denetimi yap\u0131larak kamu denetimi ortadan kald\u0131r\u0131lmaktad\u0131r. Teknik m\u00fc\u015favirlik kurulu\u015flar\u0131n\u0131n; y\u0131k\u0131m i\u015fleri, proje ve yap\u0131 denetimi, riskli yap\u0131 tespiti, y\u0131k\u0131m raporu haz\u0131rlama, yap\u0131 sahibi ad\u0131na vek\u00e2let \u00fcstlenme gibi g\u00f6revlerle yetkileri geni\u015fletilerek k\u00fc\u00e7\u00fck ve orta \u00f6l\u00e7ekli yap\u0131 denetim kurulu\u015flar\u0131 tasfiye edilerek, denetimin tekelle\u015fmesinin \u00f6n\u00fc a\u00e7\u0131lmakta; geni\u015f yetkilerle \u00e7al\u0131\u015fma olana\u011f\u0131 getirilen teknik m\u00fc\u015favirlik kurulu\u015flar\u0131 kar\u015f\u0131s\u0131nda mimarl\u0131k ve m\u00fchendislik hizmetlerini bireysel icra eden meslekta\u015flar\u0131m\u0131z haks\u0131z bir rekabetin i\u00e7erisine itilerek ta\u015feronla\u015fmaya, i\u015fsizle\u015fmeye, yok olmaya itilmektedir.<\/p>\n<p>\u0130mar kanunu ve kat m\u00fclkiyeti kanunu taslaklar\u0131nda, projesiz ruhsat ve iskan d\u00fczenlemelerinin getirilmeye \u00e7al\u0131\u015f\u0131lmas\u0131 ise en basit tabiriyle ka\u00e7ak, sa\u011fl\u0131ks\u0131z, niteliksiz yap\u0131la\u015fman\u0131n \u00f6n\u00fcn\u00fc a\u00e7acak varl\u0131\u011f\u0131 kendinden menkul d\u00fczenlemeler olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>\u0130ktidar\u0131n s\u00fcreklili\u011fi hedefiyle toplumda merkezi politikalara ba\u011f\u0131ml\u0131 s\u0131n\u0131flar yaratan y\u00f6netimler, sa\u011fl\u0131ks\u0131z ve hukuk d\u0131\u015f\u0131 kentle\u015fmeye g\u00f6z yummu\u015f, yap\u0131la\u015fma nitelikli mimarl\u0131k, m\u00fchendislik ve planlama hizmetleri katk\u0131s\u0131 olmadan ger\u00e7ekle\u015fmi\u015ftir. Merkezi politikalar\u0131n \u00f6n\u00fcnde engel olarak g\u00f6r\u00fclen planlama ve mimarl\u0131k hizmetlerini sunan meslek mensuplar\u0131n\u0131n haklar\u0131 k\u0131s\u0131tlanm\u0131\u015f, mesle\u011fin kamu yarar\u0131na geli\u015fimi ve meslek mensuplar\u0131n\u0131n yetki ve sorumluluklar\u0131 \u00e7er\u00e7evesinde mimarl\u0131k, m\u00fchendislik ve planlaman\u0131n toplumun t\u00fcm kesimleri taraf\u0131ndan benimsenerek, kamusal politikalar\u0131n her d\u00fczeyinde yer almas\u0131 i\u00e7in m\u00fccadele eden meslek kurulu\u015flar\u0131 her d\u00f6nemde siyasi iktidarlar\u0131n hedefinde olmu\u015ftur. Ancak Meslek Odalar\u0131 AKP iktidarlar\u0131 d\u00f6neminde ge\u00e7mi\u015fle k\u0131yaslanamayacak \u00f6l\u00e7\u00fcde sald\u0131r\u0131yla kar\u015f\u0131 kar\u015f\u0131ya kalm\u0131\u015ft\u0131r.<\/p>\n<p>Yasa tasla\u011f\u0131 ile ge\u00e7mi\u015fte yap\u0131lan i\u015flevsizle\u015ftirme ve yetki k\u0131s\u0131tlamas\u0131 gibi d\u00fczenlemeler bir ad\u0131m ileri ta\u015f\u0131narak, meslek kurulu\u015flar\u0131n\u0131n kamu kurumu niteli\u011fi kald\u0131r\u0131lmaya \u00e7al\u0131\u015f\u0131lmakta, odalar\u0131n b\u00fct\u00fcnsel yap\u0131s\u0131 zay\u0131flat\u0131larak meslek alan\u0131nda ve meslek mensuplar\u0131n\u0131n ili\u015fkilerinde farkl\u0131 uygulamalar\u0131n olu\u015fmas\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131lmaktad\u0131r. D\u00fczenlemelerle; meslek odalar\u0131n\u0131n y\u00f6netmelik ve mevzuat\u0131n\u0131n h\u00fck\u00fcmetin program\u0131na ba\u011fl\u0131 ve onay\u0131na tabi olmas\u0131 zorunlulu\u011fu getirilerek mesleki haklar\u0131n ve hizmetlerin g\u00fcvencesi olan yap\u0131n\u0131n da\u011f\u0131t\u0131lmas\u0131 ama\u00e7lanmaktad\u0131r.<\/p>\n<p>Yine TBMM g\u00fcndemine al\u0131nan bir di\u011fer \u201cTorba Yasa Tasla\u011f\u0131\u201d olan, \u201c\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu \u0130le Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131 Hakk\u0131nda Kanun Tasla\u011f\u0131\u201d \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu, Y\u00fcksek\u00f6\u011fretim Kanunu, \u0130mar Kanunu, \u0130\u015fsizlik Sigortas\u0131 Kanunu, Hazineye Ait Ta\u015f\u0131nmaz Mallar\u0131n De\u011ferlendirilmesi ve Katma De\u011fer Vergisi Kanunu, Yap\u0131 Denetimi Hakk\u0131nda Kanun, \u0130hale Kanunu, \u0130\u015f Kanunu, Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu, Mesleki Yeterlilik Kurumu Kanunu\u2019nda getirilmesi planlanan d\u00fczenlemeler \u00e7al\u0131\u015fma hayat\u0131, sosyal sigorta ve sa\u011fl\u0131k, i\u015fsizlik ve mesleki yeterliliklerle ilgili bak\u0131\u015f\u0131n\u0131 ortaya koymas\u0131 a\u00e7\u0131s\u0131ndan ibretlik bir belge niteli\u011findedir.<\/p>\n<p>Ge\u00e7mi\u015f d\u00f6nemlerde de Torba Yasalarla yap\u0131lan de\u011fi\u015fiklikler, iktidarlar\u0131n ekonomik b\u00fcy\u00fcmeye odaklanan politikalar\u0131yla bi\u00e7imlenmi\u015ftir. Devletin asli g\u00f6revlerinden ve anayasal sorumlulu\u011fu olan; i\u015f yerlerinin ve i\u015fverenlerin denetiminin \u00f6zel sekt\u00f6re devredilmesi i\u00e7in d\u00fczenlemeler getirilmi\u015ftir.
