K\u00f6pr\u00fc ve Kuzey Marmara Otoyolu&#8217;nun ba\u011flant\u0131 yollar\u0131na mahkeme dur dedi. Mimarlar Odas\u0131 \u0130stanbul B\u00fcy\u00fckkent \u015eubesi ve \u015eehir Planc\u0131lar\u0131 Odas\u0131 \u0130stanbul \u015eubesi&#8217;nin \u201cKuzey Marmara Otoyolu \u0130stanbul \u0130li, Beykoz \u0130l\u00e7esi, Bo\u011fazi\u00e7i Gerig\u00f6r\u00fcn\u00fcm ve Etkilenme B\u00f6lgesi Ge\u00e7i\u015fi ile Sar\u0131yer \u0130l\u00e7esi, Rumelifeneri Bo\u011fazi\u00e7i Gerig\u00f6r\u00fcn\u00fcm ve Etkilenme B\u00f6lgesi ge\u00e7i\u015flerine ili\u015fkin 1\/5000 \u00f6l\u00e7ekli Koruma Ama\u00e7l\u0131 Naz\u0131m Plan\u0131 De\u011fi\u015fikli\u011fi\u201dne ili\u015fkin \u0130stanbul 8. \u0130dare Mahkemesi&#8217;ne a\u00e7t\u0131\u011f\u0131 davada mahkeme, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;n\u0131n plan tadilat\u0131n\u0131 iptal etti.<\/p>\n<p><strong>Ismarlama plan de\u011fi\u015fikli\u011fi<\/strong><br \/>\n\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;n\u0131n 2013 y\u0131l\u0131nda ger\u00e7ekle\u015ftirdi\u011fi plan de\u011fi\u015fikli\u011fini iptal eden \u0130dare mahkemesi gerek\u00e7eli karar\u0131nda Kuzey Otoyolu Projesi&#8217;nin \u0130stanbul\u2019un ana ula\u015f\u0131m aks\u0131n\u0131 olu\u015fturan Bo\u011faz ge\u00e7i\u015f ve g\u00fczerg\u00e2hlar\u0131n\u0131n \u00fcst \u00f6l\u00e7ekli \u00c7evre D\u00fczeni Plan\u0131\u2019nda g\u00f6sterilmedi\u011fini ve yine Bakanl\u0131k taraf\u0131ndan y\u00fcr\u00fcrl\u00fc\u011fe konulan 1\/25.000 \u00f6l\u00e7ekli Kuzey Marmara Otoyolu Naz\u0131m \u0130mar Plan\u0131 imar mevzuat\u0131ndaki plan tan\u0131mlar\u0131yla uyumsuz oldu\u011funu a\u00e7\u0131klad\u0131. Mahkeme ayr\u0131ca ba\u011flant\u0131 yolunun g\u00fczergalar\u0131n\u0131n, do\u011fal kaynaklar\u0131 ve ekolojik rezervleri olumsuz etkileyece\u011fini a\u00e7\u0131klad\u0131.<\/p>\n<p><strong>Yetki \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;nda de\u011fil<\/strong><br \/>\n\u0130dare mahkemesi, Bo\u011fazi\u00e7i geri g\u00f6r\u00fcn\u00fcm ve etkilenme b\u00f6lgesi olan bu alanda 2960 say\u0131l\u0131 Bo\u011fazi\u00e7i Kanunu h\u00fck\u00fcmlerinin uygulanmas\u0131 gerekti\u011fini, kanuna g\u00f6re de planlama yetkisinin \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi\u2019nde oldu\u011funu ancak plan\u0131n Bakanl\u0131k\u00e7a yap\u0131lmas\u0131n\u0131n yetki y\u00f6n\u00fcnden hukuka ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011funu belirtti.<\/p>\n<p><strong>&#8216;M\u00fccadelemiz s\u00fcrecek&#8217;<\/strong><br \/>\nTMMOB \u015eehir Planc\u0131lar\u0131 Odas\u0131 \u0130stanbul \u015eubesi ve TMMOB Mimarlar Odas\u0131 \u0130stanbul B\u00fcy\u00fckkent \u015eubesi, mahkemenin karar\u0131 sonras\u0131nda yay\u0131mlad\u0131klar\u0131 ortak a\u00e7\u0131klamada \u201cYap\u0131ld\u0131\u011f\u0131 takdirde \u0130stanbul\u2019un gelece\u011fini derinden\/geri d\u00f6n\u00fc\u015fs\u00fcz etkileyecek\u00a0 nitelikte bir kent su\u00e7u olan \u00dc\u00e7\u00fcnc\u00fc Bo\u011faz K\u00f6pr\u00fcs\u00fc ve Kuzey Marmara Otoyolu\u2019na kar\u015f\u0131 kamu yarar\u0131 ve meslek ilkelerimiz do\u011frultusunda hukuk m\u00fccadelemizi s\u00fcrd\u00fcrece\u011fimizi kamuoyunun bilgisine sunar\u0131z.\u201d dedi.<\/p>\n<p><em><strong>politeknik.org.tr<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"Kuzey Marmara Otoyolu&#8217;nun 3.
