Bart\u0131n Platformu\u2019nun ba\u015fvurusu sonras\u0131 konuyla ilgili oy birli\u011fi ile karar alan mahkeme tesisin \u00f6nemli \u00e7evresel etkilerinin olaca\u011f\u0131n\u0131 bunlar\u0131n g\u00f6rmezden gelinemeyece\u011fini belirtti. Mahkeme karar\u0131nda; \u201cUyu\u015fmazl\u0131k konusu tesisin \u00e7evresel de\u011ferlendirme ve ekolojik de\u011ferler y\u00f6n\u00fcnden \u00f6nemli \u00e7evresel etkilerinin olaca\u011f\u0131 hususlar\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda \u00e7evresel etki de\u011ferlendirmesi yap\u0131lmas\u0131 ve \u00c7ED raporu haz\u0131rlanmas\u0131 suretiyle i\u015flem tesis edilmesi gerekti\u011fi sonucuna var\u0131ld\u0131\u011f\u0131ndan, \u00c7evresel Etki De\u011ferlendirilmesine gerekli olmad\u0131\u011f\u0131 y\u00f6n\u00fcnde tesis edilen dava konusu i\u015flemde hukuka uyarl\u0131k g\u00f6r\u00fclmemi\u015ftir. Di\u011fer yandan, dava konusu \u2018\u00c7ED Gerekli De\u011fildir\u2019 karar\u0131na konu k\u00f6m\u00fcr haz\u0131rlama tesisinin ormanl\u0131k yerde \u00e7evresel ve ekolojik y\u00f6nden \u00f6nemli etkilere neden olabilecek alanda yap\u0131lacak olmas\u0131 nedeniyle s\u00f6z konusu faaliyetin yap\u0131lmas\u0131 halinde \u00e7evreye olumsuz etkilerinin olabilece\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan, dava konusu i\u015flemin uygulanmas\u0131nda \u00e7evre ve yap\u0131lan yat\u0131r\u0131mlar y\u00f6n\u00fcnden telafisi g\u00fc\u00e7 veya imkans\u0131z zararlar\u0131n do\u011fabilece\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r\u201d ifadeleri kullan\u0131ld\u0131.<\/p>\n<p><strong>&#8216;Hattat talan\u0131 bir kez daha kan\u0131tland\u0131&#8217;<\/strong><br \/>\nKarar sonras\u0131 a\u00e7\u0131klama yapan Bart\u0131n Platformu Hattat \u015eirketi&#8217;nin hi\u00e7bir hukuk dinlemeksizin ya\u015fam alanlar\u0131na sald\u0131rd\u0131\u011f\u0131n\u0131, bu kararla m\u00fccadelelerinin hakl\u0131l\u0131\u011f\u0131n\u0131n bir kez daha onayland\u0131\u011f\u0131n\u0131 belirtti. Platform a\u00e7\u0131klamada \u201cHattat \u015firketine ait K\u00f6m\u00fcr Haz\u0131rlama Tesisi&#8217;ne, Bart\u0131n \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan sadece be\u015f g\u00fcn i\u00e7inde &#8216;\u00c7ED gerekli de\u011fildir&#8217; karar\u0131 verilmi\u015fti. Biz bu karar\u0131n y\u00fcr\u00fctmesinin durdurulmas\u0131 ve iptali i\u00e7in Zonguldak \u0130dare Mahkemesi\u2019ne dava a\u00e7m\u0131\u015ft\u0131k. Zonguldak \u0130dare Mahkemesi 2015\/187 nolu karar\u0131yla bu karar\u0131n y\u00fcr\u00fctmesinin durdurulmas\u0131na itiraz yolu kapal\u0131 olmak \u00fczere oybirli\u011fiyle karar verdi.
