Bu planlara uygunlu\u011funun incelenmesi suretiyle bilirki\u015fi incelemesi sonucuna g\u00f6re karar verilece\u011fi ifade edildi<\/strong><\/p>\n<p>Mimarlar Odas\u0131 \u0130stanbul B\u00fcy\u00fckkent \u015eubesi, Tarlaba\u015f\u0131 Yenileme Alan\u0131 ile K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma B\u00f6lge Kurulu\u2019nun 2007 y\u0131l\u0131 avan projelerinin iptal istemiyle dava a\u00e7m\u0131\u015ft\u0131. \u0130stanbul 3. \u0130dare Mahkemesi de 16 Haziran 2010 tarihinde \u201c\u2026 tescilli yap\u0131lar\u0131n, imar haklar\u0131 k\u0131s\u0131tlanm\u0131\u015f yap\u0131lar\u0131n da de\u011ferlendirilebildi\u011fi ve hukuki kurallar\u0131n olu\u015ftu\u011funun dosyadaki avan projelerde g\u00f6r\u00fcld\u00fc\u011f\u00fc, yap\u0131lan uygulaman\u0131n planlama ilke ve tekniklerine uygun oldu\u011fu ve yap\u0131lan d\u00fczenlemede \u00fcst\u00fcn kamu yarar\u0131 bulundu\u011fu\u2026\u201d y\u00f6n\u00fcndeki bilirki\u015fi raporunu dayanak alarak davan\u0131n reddine karar vermi\u015fti.<\/p>\n<p>Bu karar\u0131 temyize g\u00f6t\u00fcren Mimarlar Odas\u0131\u2019n\u0131n itiraz\u0131n\u0131 de\u011ferlendiren Dan\u0131\u015ftay 14. Dairesi, verdi\u011fi kararda s\u00f6z konusu projelerin planla b\u00fct\u00fcnl\u00fck arz etmesi gerekti\u011fini vurgulayarak:<\/p>\n<blockquote><p>An\u0131lan mevzuat h\u00fck\u00fcmleri uyar\u0131nca; sit alanlar\u0131 ile sit alanlar\u0131na ait koruma alanlar\u0131n\u0131n b\u00f6lgenin geli\u015fimine uygun olarak yeniden in\u015fa ve restore edilerek, bu b\u00f6lgelerde konut, ticaret, k\u00fclt\u00fcr, turizm ve sosyal donat\u0131 alanlar\u0131 olu\u015fturulmas\u0131 a\u015famas\u0131nda haz\u0131rlanan yenileme projelerinin, s\u00f6z konusu alanlar\u0131, koruma esaslar\u0131 ve kullanma \u015fartlar\u0131 ile yap\u0131la\u015fma s\u0131n\u0131rlamalar\u0131, sa\u011fl\u0131kla\u015ft\u0131rma, yenileme alan ve projeleri, uygulama etap ve programlar\u0131, yaya dola\u015f\u0131m\u0131 ve ta\u015f\u0131t ula\u015f\u0131m\u0131, alt yap\u0131 tesislerinin tasar\u0131m esaslar\u0131, yo\u011funluklar ve parsel tasar\u0131mlar\u0131 gibi hususlar\u0131 d\u00fczenleyen koruma ama\u00e7l\u0131 imar planlar\u0131na dayanmas\u0131, s\u00f6z konusu plan ilkeleri \u00e7er\u00e7evesinde haz\u0131rlanarak planla b\u00fct\u00fcnl\u00fck olu\u015fturmas\u0131n\u0131n gerekti\u011fi a\u00e7\u0131kt\u0131r.<\/p><\/blockquote>\n<p>Dan\u0131\u015ftay 14. Dairesi, Beyo\u011flu Kentsel Sit Alan\u0131\u2019na projelerin iptali istemi hakk\u0131nda yeniden karar verilmesi gerekti\u011fini belirtti.
