Emlak de\u011feri y\u00fcksek\u00a0arsan\u0131n payda\u015flar\u0131ndan Sitare Kaftan,\u201cTapuda arsa vasf\u0131nda g\u00f6r\u00fcnen araziyi kentsel d\u00f6n\u00fc\u015f\u00fcm k\u0131l\u0131f\u0131 alt\u0131nda elimizden almak istiyorlar\u201d\u00a0dedi.<\/p>\n<p><strong>\u015ei\u015fli\u2019nin en y\u00fcksek projesi<\/strong><br \/>\n6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi yasa kapsam\u0131na sokulan arazinin y\u00fczde 40\u2019\u0131 Ta\u015f Yap\u0131 adl\u0131 \u015firkete, y\u00fczde 16\u2019s\u0131 payda\u015flara, y\u00fczde 44\u2019\u00fc ise Sitare Kaftan ve e\u015fine ait. Kaftan ailesinin mal payla\u015f\u0131m davas\u0131 \u0130stanbul\u00a02. Aile Mahkemesi\u2019nde 8 y\u0131ld\u0131r devam ediyor. Yasa ise kentsel d\u00f6n\u00fc\u015f\u00fcm i\u00e7in y\u00fczde 67 \u00e7o\u011funluk istiyor. Ta\u015f Yap\u0131, bahse konu arazide \u015ei\u015fli Kaptanpa\u015fa Rezidans ad\u0131nda bir projeyle, b\u00f6lgenin en y\u00fcksek katl\u0131 binas\u0131n\u0131 in\u015fa edece\u011fini daha \u00f6nce duyurmu\u015ftu.<\/p>\n<p><strong>\u0130mar plan\u0131 de\u011fi\u015ftirildi<\/strong><br \/>\nAKP&#8217;ye yak\u0131n in\u015faat \u015firketlerinden biri olan Ta\u015f Yap\u0131 firmas\u0131 kat kar\u015f\u0131l\u0131\u011f\u0131 anla\u015fma yapt\u0131\u011f\u0131 proje i\u00e7in arsa payda\u015flar\u0131n\u0131n mahkemelik olmas\u0131 nedeniyle s\u00fcre\u00e7 uzad\u0131. \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 \u0130stanbul B\u00fcy\u00fck\u015fehir Belediye Meclisini devre d\u0131\u015f\u0131 b\u0131rakarak,\u00a0imar planlar\u0131nda \u201chizmet alan\u0131\u201d\u00a0stat\u00fcs\u00fcnde olan, 20 d\u00f6n\u00fcml\u00fck araziyi, ge\u00e7ti\u011fimiz 5 May\u0131s\u2019ta\u00a0\u201cTurizm Tesis Alan\u0131\u201d\u00a0stat\u00fcs\u00fcne ald\u0131. Emsali de 3 olarak belirledi. Ancak payda\u015flar aras\u0131ndaki mahkeme s\u00fcreci uzay\u0131nca arazi, yeni bir hamleyle\u00a0\u201cAfet Riski Alt\u0131ndaki Alan\u201d\u00a0ilan edildi.<\/p>\n<p>Bunun i\u00e7in de yine \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 taraf\u0131ndan lisans verilen\u00a0Etik Yap\u0131 Denetim\u00a0\u015firketine rapor haz\u0131rlat\u0131ld\u0131. \u015ei\u015fli Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fc kay\u0131tlar\u0131na g\u00f6re \u00fczerinde ta\u015f\u0131nmaz bulunmayan ve bo\u015f arsa h\u00fcviyetindeki arazi i\u00e7in \u015firket \u201cRiskli Yap\u0131 Tespit Raporu\u201d d\u00fczenledi. Oysa arazi i\u00e7inde tek katl\u0131 otopark bilet sat\u0131\u015f barakalar\u0131 ve WC\u2019ler vard\u0131. \u015eirket,\u00a0ka\u00e7ak olan ve ruhsat\u0131 dahi bulunmayan bu yap\u0131lara \u2018afet riski\u2019 raporu verdi.<\/p>\n<p>\u015ei\u015fli Belediyesi Yap\u0131 Kontrol M\u00fcd\u00fcrl\u00fc\u011f\u00fc de kap\u0131s\u0131n\u0131n tam kar\u015f\u0131s\u0131ndaki ka\u00e7ak yap\u0131la\u015fmalar\u0131 y\u0131kmak yerine,\u00a0\u201cOlas\u0131 bir kuvvetli yer hareketinde tasar\u0131m depremi istemlerini kar\u015f\u0131lamad\u0131\u011f\u0131ndan riskli yap\u0131 oldu\u011funa\u201d\u00a0karar verdi. Belediye \u201cBu arsada bina yok, bu binalar ruhsats\u0131z\u201d\u00a0diyemedi.<\/p>\n<p><strong>Se\u00e7imden bir g\u00fcn sonra bakan onay\u0131<\/strong><br \/>\nRiskli yap\u0131 raporuna dayanarak \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar kapsam\u0131na alarak arsay\u0131 kentsel d\u00f6n\u00fc\u015f\u00fcm kapsam\u0131na soktu.\u00a0 Ancak arsada hak sahibi olan payda\u015flar Stare Kaftan, Hasan Karatepe, \u0130rem Yaz\u0131c\u0131 itiraz etti. \u00c7evre ve \u015eehircilik \u0130l m\u00fcd\u00fcrl\u00fc\u011f\u00fc itiraz\u0131 g\u00f6r\u00fc\u015fmek \u00fczere 7 Haziran milletvekili se\u00e7imlerinden bir g\u00fcn sonra Bakan onay\u0131 ile Elaz\u0131\u011f \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019ne g\u00f6nderdi. Gerek\u00e7e olarak da\u00a0\u201cTekirda\u011f, K\u0131rklareli ve Edirne illerindeki riskli yap\u0131 tespitlerine yap\u0131lan itirazlar\u0131n b\u00fcy\u00fck oranda art\u0131\u015f g\u00f6stermesi, riskli yap\u0131 s\u00fcrecinin uzun s\u00fcrmesi sonucunda kesintiye u\u011framas\u0131\u201d\u00a0g\u00f6sterildi.<\/p>\n<p><strong>G\u00f6rmeden reddettiler<\/strong><br \/>\nProf. Dr. Mehmet \u00dclker, Prof. Dr. Rag\u0131p \u0130nce, Yrd. Do\u00e7. Dr Mehmet Karata\u015f, Yrd. Do\u00e7. Dr. Murat \u0130nce\u00f6z, \u0130n\u015faat M\u00fchendisi Akif Canpolat, \u0130n\u015faat M\u00fchendisi Mustafa \u00d6nde\u015f, Jeoloji M\u00fchendisi Cahit \u00d6zt\u00fcrk\u2019ten olu\u015fan Elaz\u0131\u011f Riskli Yap\u0131 Tespitine \u0130tiraz Heyeti, araziyi g\u00f6rmeden dosya \u00fczerinden de\u011ferlendirdi. Binalar\u0131n riskli oldu\u011funa kanaat getiren heyet itiraz\u0131 oy birli\u011fi ile reddetti.<\/p>\n<p><strong>Her taraftan vurgun!<\/strong><br \/>\nArsan\u0131n b\u00fcy\u00fck orta\u011f\u0131 araziyi kentsel d\u00f6n\u00fc\u015f\u00fcm kapsam\u0131na ald\u0131rarak hem sorunlu payda\u015flardan kurtuldu hem de vergi muafiyeti kazand\u0131. \u00c7\u00fcnk\u00fc bir proje kentsel d\u00f6n\u00fc\u015f\u00fcm kapsam\u0131na girince KDV oran\u0131 y\u00fczde 18 de\u011fil y\u00fczde 1 oluyor. \u0130n\u015faat\u0131 yapan firma belediye ve ruhsat harc\u0131, iskan \u00f6ncesi ve sonras\u0131 harc\u0131, damga vergisi ve noter harc\u0131 ve tapu harc\u0131 \u00f6demiyor.<\/p>\n<p><strong>Mal sahibi \u015fa\u015fk\u0131n<\/strong><br \/>\nSitare Kaftan; \u201cTa\u015f Yap\u0131 ve bir k\u0131s\u0131m k\u00f6t\u00fc niyetli payda\u015f bu davalar\u0131 konusuz b\u0131rakmak i\u00e7in 6306 say\u0131l\u0131 yasay\u0131 k\u00f6t\u00fcye kullanarak, \u015ei\u015fli Belediyesi ve \u00c7evre \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131 da kullanarak davalar\u0131 bo\u015fa \u00e7\u0131karmaya \u00e7al\u0131\u015f\u0131yorlar. Ta\u015f\u0131nmaz var oldu\u011fu g\u00fcnden beri arsa vasf\u0131ndad\u0131r. Tapu k\u00fct\u00fc\u011f\u00fcnde \u00fczerinde ta\u015f\u0131nmaz bulunmamaktad\u0131r. Riskli yap\u0131 olarak belirtilen WC ve\u00a0para\u00a0tahsilat barakalar\u0131na \u015ei\u015fli Belediyesi \u2018yap\u0131 kimlik nosu\u2019 tan\u0131m\u0131 ile numara izafe ederek su\u00e7 i\u015flemi\u015ftir\u201d dedi.<\/p>\n<p><strong>Denetim firmas\u0131: \u2018G\u00f6revimizi yapt\u0131k\u2019<\/strong><br \/>\nEtik Yap\u0131 Denetim \u015eirketi yetkilisi Ufuk Derinda\u011f da konuyla ilgili \u015fu a\u00e7\u0131klamay\u0131 yapt\u0131:\u00a0\u201cBiz arsan\u0131n i\u00e7inde ne bina varsa onu inceleriz. Tapu da g\u00f6r\u00fcn\u00fcp g\u00f6r\u00fcnmedi\u011fini bilemeyiz. Tek katl\u0131 y\u0131\u011fma yap\u0131lan binalar riskliydi. Biz g\u00f6revimizi yapt\u0131k.&#8221;<\/p>\n<p><strong>AKP Afet Yasas\u0131&#8217;n\u0131 bu talan i\u00e7in \u00e7\u0131kard\u0131<\/strong><br \/>\n6306 Say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun (Afet Yasas\u0131), 2012 y\u0131l\u0131nda \u00fclke genelinde kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131n\u0131n \u00f6n\u00fcndeki yasal engelleri kald\u0131rmak ve d\u00f6n\u00fc\u015f\u00fcm\u00fc h\u0131zland\u0131rmak \u00fczere \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131. Afet Yasas\u0131 ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 diledi\u011fince planlama ve imara a\u00e7ma yetkisi verilmi\u015fti.
