Olay\u0131n duyulmas\u0131n\u0131n ard\u0131ndan Odam\u0131z yetkilileri ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131m\u0131z olay yerine hareket ederek geli\u015fmeleri ve kurtarma \u00e7al\u0131\u015fmalar\u0131n\u0131 yak\u0131ndan izlemi\u015ftir.\u00a0 <\/p>\n<p>Kazayla ilgili olarak y\u00fcr\u00fct\u00fclen incelemeler sonucunda a\u015fa\u011f\u0131daki tespitler yap\u0131lm\u0131\u015ft\u0131r:<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kazan\u0131n meydana geldi\u011fi ocakta k\u00f6m\u00fcr \u00fcretimi &#8220;yeralt\u0131 \u00fcretim y\u00f6ntemi&#8221;yle ger\u00e7ekle\u015ftirilmektedir. &#8220;3 vardiya&#8221; \u00fcretim yap\u0131lan ocakta yakla\u015f\u0131k 150 ki\u015fi \u00e7al\u0131\u015fmaktad\u0131r. Kazan\u0131n oldu\u011fu vardiyada ise 32 i\u015f\u00e7inin g\u00f6rev yapt\u0131\u011f\u0131 saptanm\u0131\u015ft\u0131r.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Oca\u011fa, 220 metre uzunlu\u011fundaki desandre (e\u011fimli galeri\/yol) ile inilmekte olup k\u00f6m\u00fcr i\u00e7inde s\u00fcr\u00fclen taban yollar\u0131 ile madencilikte &#8220;ayak&#8221; olarak isimlendirilen, k\u00f6m\u00fcr \u00fcretim alanlar\u0131na ula\u015f\u0131lmaktad\u0131r. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 K\u00f6m\u00fcr damar\u0131n\u0131n kal\u0131nl\u0131\u011f\u0131 9-12 metre aras\u0131nda de\u011fi\u015fmekte olup, damar e\u011fimi 20 derece civar\u0131ndad\u0131r.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Oca\u011f\u0131n havaland\u0131r\u0131lmas\u0131, ana vantilat\u00f6r ve tali pervanelerle ger\u00e7ekle\u015ftirilmektedir. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00dcretim yap\u0131l\u0131rken sert k\u00f6m\u00fcr damar\u0131nda patlay\u0131c\u0131 madde kullan\u0131larak gev\u015fetme yap\u0131lmaktad\u0131r.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ocakta her vardiyada bulunmas\u0131 gereken maden m\u00fchendisi say\u0131s\u0131 yeterli de\u011fildir.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00c7al\u0131\u015fan i\u015f\u00e7iler \u00e7evre k\u00f6ylerden sa\u011flanmakta olup sendikal\u0131 de\u011fillerdir. Genellikle e\u011fitim seviyeleri d\u00fc\u015f\u00fck olup, d\u00fc\u015f\u00fck \u00fccretlerle \u00e7al\u0131\u015fmaktad\u0131rlar.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kaza, 16-24 vardiyas\u0131nda ayakta k\u00f6m\u00fcr \u00fcretimi yap\u0131lmas\u0131 esnas\u0131nda ortamda bulunan grizunun (metan gaz\u0131+hava kar\u0131\u015f\u0131m\u0131) patlamas\u0131yla meydana gelmi\u015ftir. Grizunun patlamas\u0131 ile olu\u015fan y\u00fcksek s\u0131cakl\u0131k ve karbon monoksit (CO) gaz\u0131 \u00e7al\u0131\u015fan i\u015f\u00e7ilerin yanmalar\u0131na ve zehirlenmelerine yol a\u00e7arak \u00f6l\u00fcmlerine neden olmu\u015ftur.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Grizu patlamas\u0131n\u0131n \u015fiddetiyle g\u00f6\u00e7\u00fckler meydana gelmi\u015f ve i\u015f\u00e7iler g\u00f6\u00e7\u00fck alt\u0131nda kalm\u0131\u015ft\u0131r.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Yetkililerce olay\u0131n\/kazan\u0131n nedenlerini belirlemek \u00fczere bilirki\u015filer atanm\u0131\u015f ve incelemeler ba\u015flat\u0131lm\u0131\u015ft\u0131r. Ancak ilk tespitlerden olay\u0131n, \u00e7al\u0131\u015fma ortam\u0131nda belirli bir oran\u0131n \u00fczerinde bulunmamas\u0131 gereken metan gaz\u0131n\u0131n, bir \u0131s\u0131 kayna\u011f\u0131yla (muhtemelen patlay\u0131c\u0131 madde kullan\u0131lmas\u0131 sonucu) tetiklendi\u011fi ve grizunun patlad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kaza sonras\u0131 kurtarma i\u015flemlerinde ciddi organizasyon ve koordinasyon yetersizli\u011fi bulunmaktad\u0131r.<\/p>\n<p>Madencilik sekt\u00f6r\u00fc, do\u011fas\u0131 gere\u011fi \u00f6zellik arz eden ve bu nedenle bilgi, deneyim, uzmanl\u0131k ve s\u00fcrekli denetim gerektiren d\u00fcnyan\u0131n en zor ve riskli i\u015f koludur. Maden kazalar\u0131 incelendi\u011finde olay\u0131n; teknik, sosyal, ekonomik, e\u011fitim, planlama ve denetim sorunlar\u0131 gibi pek \u00e7ok nedeni oldu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p>T\u00fcrkiye i\u015f kazalar\u0131nda d\u00fcnyada \u00fc\u00e7\u00fcnc\u00fc, Avrupa\u2018da birinci s\u0131rada yer almaktad\u0131r. \u00d6zel maden i\u015fletmelerinde, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi \u00f6nlemleri genellikle\u00a0 maliyet unsuru olarak g\u00f6r\u00fclmektedir. Maden kazalar\u0131 son y\u0131llarda belirgin olarak artmaktad\u0131r. Odam\u0131z kay\u0131tlar\u0131na g\u00f6re, 2008 y\u0131l\u0131nda 43 maden \u00e7al\u0131\u015fan\u0131 i\u015f kazas\u0131 sonucu ya\u015fam\u0131n\u0131 yitirmi\u015fken,\u00a0 2009 y\u0131l\u0131nda bu say\u0131 son kaza ile birlikte 76\u2018ya \u00e7\u0131km\u0131\u015ft\u0131r. Ancak bu say\u0131n\u0131n daha y\u00fcksek oldu\u011fu tahmin edilmekte ve hayat\u0131n\u0131 kaybedenler i\u00e7erisinde maden m\u00fchendisi meslekta\u015flar\u0131m\u0131z da bulunmaktad\u0131r. \u00d6zellikle yeralt\u0131 k\u00f6m\u00fcr madencili\u011fi, i\u015f\u00e7i say\u0131s\u0131 ba\u015f\u0131na d\u00fc\u015fen kaza ve \u00f6l\u00fcm s\u0131ralamas\u0131nda b\u00fct\u00fcn sekt\u00f6rlerin ba\u015f\u0131nda yer almaktad\u0131r. Bu nedenle, madencilik sekt\u00f6r\u00fc daha yak\u0131ndan izlenmeli, de\u011ferlendirilmeli ve kaza \u00f6nleme \u00e7al\u0131\u015fmalar\u0131na daha fazla a\u011f\u0131rl\u0131k verilmelidir. Odam\u0131z\u0131n her zaman dile getirdi\u011fi gibi meydana gelen bu &#8220;kazalar kader de\u011fildir&#8221;. Bu ac\u0131 olaylar e\u011fer gerekli \u00f6nlemler al\u0131nmaz ise periyodik olarak devam edecektir. <\/p>\n<p>\u00d6zellikle 80\u2018li y\u0131llar\u0131n ba\u015f\u0131ndan itibaren uygulamaya konulan \u00f6zelle\u015ftirme, ta\u015feronla\u015fma, rod\u00f6vans vb yanl\u0131\u015f uygulamalar; kamu madencili\u011fini k\u00fc\u00e7\u00fcltm\u00fc\u015f, kamu kurum ve kurulu\u015flar\u0131nda uzun y\u0131llar sonucu elde edilmi\u015f olan madencilik bilgi ve deneyim birikimini da\u011f\u0131tm\u0131\u015ft\u0131r. Yo\u011fun birikim ve deneyime sahip olan kurum ve kurulu\u015flar yerine \u00fcretimin, teknik ve alt yap\u0131 olarak yetersiz, deneyim ve uzmanla\u015fman\u0131n olmad\u0131\u011f\u0131 ki\u015fi ve \u015firketlere b\u0131rak\u0131lmas\u0131, buna ek olarak kamusal denetimin de yeterli ve etkin bir bi\u00e7imde yap\u0131lamamas\u0131 i\u015f kazalar\u0131n\u0131n artmas\u0131na neden olmaktad\u0131r.<\/p>\n<p>\u00dclkemizde; y\u00fcksek risk ta\u015f\u0131yan, kurals\u0131z ve denetimsiz \u00e7al\u0131\u015fan, m\u00fchendislik bilim ve tekni\u011finden uzak, teknik eleman\u0131n g\u00f6zetim ve denetimi olmaks\u0131z\u0131n, tamamen ilkel ko\u015fullarda \u00e7al\u0131\u015fan pek \u00e7ok maden i\u015fletmesi bulunmaktad\u0131r. Bu i\u015fletmelerde her an kaza olma olas\u0131l\u0131\u011f\u0131 mevcuttur. Bu nedenlerle;<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Sekt\u00f6r\u00fcn \u00f6zelli\u011fi g\u00f6z \u00f6n\u00fcne al\u0131narak kapsaml\u0131 bir risk haritas\u0131n\u0131n ilgili Bakanl\u0131klarca haz\u0131rlanmas\u0131 ve denetimlerin buna g\u00f6re yap\u0131lmas\u0131 gerekmektedir. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Teknik nezaret\u00e7i ve i\u015f g\u00fcvenli\u011finden sorumlu olan m\u00fchendis \u00fccretini, denetlemek durumunda oldu\u011fu i\u015fyeri sahibinden almakta olup bu durum m\u00fchendisin i\u015fletme ile ilgili kararlar\u0131nda \u00f6zg\u00fcr davranmas\u0131n\u0131 engellemektedir. Bu a\u00e7\u0131dan, teknik nezaret\u00e7inin ve i\u015f g\u00fcvenli\u011finden sorumlu m\u00fchendisin \u00f6zg\u00fcrce karar verebilmesi ve g\u00f6revini lay\u0131k\u0131yla yerine getirebilmesi amac\u0131yla, \u00fccretini olu\u015fturulacak bir fondan almas\u0131 i\u00e7in gerekli yasal d\u00fczenlemeler acilen yap\u0131lmal\u0131d\u0131r. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kazalar\u0131n \u00f6nlenebilmesi i\u00e7in bilimsel ve teknik yat\u0131r\u0131mlar\u0131n yan\u0131 s\u0131ra, \u00f6rg\u00fctlenmenin ve sendikala\u015fman\u0131n \u00f6n\u00fcndeki engellerin kald\u0131r\u0131lmas\u0131, \u00e7al\u0131\u015fma ya\u015fam\u0131 ile birlikte \u00e7al\u0131\u015fanlar\u0131n sosyal ve ekonomik ya\u015famlar\u0131n\u0131n da iyile\u015ftirilmesi zorunludur. Ayr\u0131ca, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi yat\u0131r\u0131mlar\u0131 te\u015fvik edilerek desteklenmelidir. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u0130\u015f g\u00fcvenli\u011fi denetiminden birinci derecede sorumlu olan \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 ile Enerji ve Tabii Kaynaklar Bakanl\u0131\u011f\u0131, ya\u015fanan i\u015f kazalar\u0131n\u0131n \u00f6nlenebilmesi i\u00e7in g\u00f6revlerini tam olarak yerine getirmelidir. Yasal mevzuatlarda yap\u0131lacak d\u00fczenlemelerle denetim mekanizmalar\u0131n\u0131n g\u00fc\u00e7lendirilmesi gerekirken,\u00a0 \u00e7\u0131kar\u0131lan y\u00f6netmelikte denetimin \u00f6zelle\u015ftirildi\u011fi ve ticarile\u015ftirildi\u011fi, i\u015f g\u00fcvenli\u011fi m\u00fchendislerinin g\u00f6rev, yetki ve sorumluluklar\u0131n\u0131n net olarak tan\u0131mlanmad\u0131\u011f\u0131, meslek odalar\u0131n\u0131n g\u00f6r\u00fc\u015flerinin dikkate al\u0131nmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 taraf\u0131ndan \u00e7\u0131kar\u0131lan yeni \u0130\u015f Kanunu ve ilgili y\u00f6netmelikleri, madencilik sekt\u00f6r\u00fcnde etkin denetlemenin yap\u0131labilmesi bak\u0131m\u0131ndan yetersizdir ve ciddi sak\u0131ncalar i\u00e7ermektedir. S\u00f6z konusu mevzuat, yeniden g\u00f6zden ge\u00e7irilerek madencilik sekt\u00f6r\u00fcn\u00fcn \u00f6zellik arz eden sorunlar\u0131 da g\u00f6z \u00f6n\u00fcne al\u0131narak yeniden d\u00fczenlenmelidir. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kaza sonras\u0131 organizasyon ve koordinasyonun, Enerji ve Tabii Kaynaklar Bakanl\u0131\u011f\u0131 b\u00fcnyesinde kurulacak bir birim taraf\u0131ndan y\u00fcr\u00fct\u00fclmesi, buna ili\u015fkin planlamalar\u0131n bu birim taraf\u0131ndan geli\u015ftirilerek kaza sonras\u0131 ya\u015fanan belirsizliklerin giderilmesi b\u00fcy\u00fck \u00f6nem arz etmektedir.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kazalar\u0131n olu\u015fmas\u0131na neden olan etkenlerin; ilgili kurum ve kurulu\u015flar\u0131n koordinasyonu ile birlikte en k\u0131sa zamanda masaya yat\u0131r\u0131lmas\u0131 ve \u00e7\u00f6z\u00fcmlenebilmesi i\u00e7in acil olarak bir eylem plan\u0131 haz\u0131rlanmas\u0131 gerekmektedir. Ulusal \u00f6l\u00e7ekte olu\u015fturulacak bu yap\u0131n\u0131n; kazalar\u0131n \u00f6nlenmesi i\u00e7in gerekli risk haritalar\u0131n\u0131 \u00e7\u0131karmas\u0131, gerekli planlamalar\u0131 ve e\u011fitimleri koordine etmesi, ilgili yasa ve y\u00f6netmelikleri tekrar g\u00f6zden ge\u00e7irerek sahan\u0131n ihtiya\u00e7lar\u0131na uygun olarak yeniden d\u00fczenlemesi ve i\u015f g\u00fcvenli\u011fi k\u00fclt\u00fcr\u00fcn\u00fcn geli\u015ftirilmesi i\u00e7in \u00e7al\u0131\u015fmalar yapmas\u0131 gerekmektedir.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 T\u00fcm maden i\u015fletmelerinde maden \u00fcretimi, mutlaka yeterli say\u0131da maden m\u00fchendisi nezaretinde yap\u0131lmal\u0131d\u0131r. \u0130\u015fyerinde her vardiyada daimi olarak maden m\u00fchendisi bulundurmayan i\u015fletmelere \u00fcretim izni verilmemelidir.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131, denetim eleman\u0131 olarak yararlanaca\u011f\u0131 maden m\u00fchendisi kadrolar\u0131n\u0131 \u00e7o\u011faltarak denetimlerini art\u0131rmal\u0131d\u0131r. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Enerji ve Tabii Kaynaklar Bakanl\u0131\u011f\u0131\u2018n\u0131n madencilikten sorumlu birimi olan Maden \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018ne, yasa ile &#8220;madencilik faaliyetlerinin i\u015f g\u00fcvenli\u011fi ve i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ilkelerine uygun y\u00fcr\u00fct\u00fclmesini takip etme&#8221; g\u00f6revi de verilmi\u015ftir. Bu kurulu\u015f, madencilik sekt\u00f6r\u00fcn\u00fcn ihtiya\u00e7lar\u0131na y\u00f6nelik olarak yeniden yap\u0131land\u0131r\u0131larak, i\u015f g\u00fcvenli\u011fi ile ilgili denetim birimini olu\u015fturmal\u0131, personel kadrosu gerek nicelik gerekse nitelik bak\u0131m\u0131ndan geli\u015ftirilmelidir. <\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Maden M\u00fchendisleri Odas\u0131\u2018n\u0131n g\u00f6revi ve yasal hakk\u0131 olan mesleki denetimin engellenerek \u00fcye denetimini yeterince yapamamas\u0131 da sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcn\u00fc zorla\u015ft\u0131rmaktad\u0131r.
