Cumhurba\u015fkan\u0131 Ahmet Necdet SEZER&#8217;in kat\u0131l\u0131m\u0131yla da onurland\u0131r\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>\u0130ki g\u00fcn s\u00fcren \u00e7al\u0131\u015fmalarda 15 ayr\u0131 oturumda 73&#8217;\u00fc s\u00f6zl\u00fc ve 27&#8217;si yaz\u0131l\u0131 olmak \u00fczere 100 bildiri sunulmu\u015f, \u00e7al\u0131\u015fmalar akademi, b\u00fcrokrasi ve siyaset d\u00fcnyas\u0131ndaki birikimin payla\u015f\u0131m\u0131n\u0131 sa\u011flayan geni\u015f bir platformda ger\u00e7ekle\u015ftirilmi\u015ftir. <\/p>\n<p>Toprak M\u00fclkiyeti Sempozyumu, T\u00fcrkiye&#8217;de toprak sorununun hangi boyutlara, \u00f6zelliklere, gelece\u011fe d\u00f6n\u00fck olarak hangi e\u011filimlere sahip oldu\u011funu belirlemek ve hangi ara\u015ft\u0131rma ba\u015fl\u0131klar\u0131ndan olu\u015ftu\u011funu saptamak bak\u0131m\u0131ndan somut sonu\u00e7lara ula\u015fm\u0131\u015ft\u0131r. <\/p>\n<p>Sempozyum, toprak m\u00fclkiyeti sorununun farkl\u0131 uzmanl\u0131k alanlar\u0131 taraf\u0131ndan par\u00e7a par\u00e7a izlendi\u011fini, incelendi\u011fini, ancak bu par\u00e7alar\u0131n birbiriyle ili\u015fkilendirilmedi\u011fini g\u00f6stermi\u015ftir. Kuramsal bilginin \u00fcretilmesi, dolay\u0131s\u0131yla \u00fclkenin gereksinimlerine uygun politikalar geli\u015ftirilmesi bak\u0131m\u0131ndan eksikler oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Sempozyum&#8217;da ba\u015fl\u0131ca uzmanl\u0131k alanlar\u0131n\u0131n bulu\u015fmas\u0131, kuramsal bilginin in\u015fas\u0131na ve politikalar\u0131n geli\u015ftirilmesine ili\u015fkin birikimlerimizi ve beklentilerimizi art\u0131rm\u0131\u015ft\u0131r. <\/p>\n<p>D\u00fcnyada ve T\u00fcrkiye&#8217;de, mevcut toprak m\u00fclkiyeti d\u00fczenine kar\u015f\u0131 ve kamu yarar\u0131 do\u011frultusunda yeni bir toplumsal toprak d\u00fczeni yarat\u0131lmas\u0131 i\u00e7in m\u00fccadeleler verilmektedir. Bu m\u00fccadeleler, kuramsal \u00e7al\u0131\u015fmalarla da desteklenerek daha yayg\u0131n, g\u00fc\u00e7l\u00fc, etkili k\u0131l\u0131nabilir. Toprak M\u00fclkiyeti Sempozyumu, bu a\u00e7\u0131dan \u00fczerine d\u00fc\u015fen g\u00f6revi yerine getirmi\u015f olmaktan mutludur. <\/p>\n<p>Toprakta m\u00fclkiyet olgusu, topra\u011f\u0131n tapusuna\/tesciline sahip olma ile s\u0131n\u0131rl\u0131 de\u011fildir. Bu, yaln\u0131zca hukuksal bir sorun da de\u011fildir. Toprak m\u00fclkiyeti, topra\u011f\u0131n \u00fcretim arac\u0131 olarak kullan\u0131l\u0131\u015f bi\u00e7imine karar verme g\u00fcc\u00fcn\u00fc kurallara ba\u011flayan toplumsal &#8211; y\u00f6netsel &#8211; hukuksal bir \u00e7er\u00e7eve olarak g\u00f6r\u00fclmelidir. <\/p>\n<p>G\u00fcn\u00fcm\u00fczde toprak m\u00fclkiyeti sorunu, (1) k\u0131rsal, (2) kentsel, (3) do\u011fal varl\u0131klar olmak \u00fczere \u00fc\u00e7 temel boyutta kendine \u00f6zg\u00fc niteliklere ve \u00f6zelliklere sahiptir. <\/p>\n<p>K\u0131rsal Toprak M\u00fclkiyeti: \u00c7a\u011fda\u015f toplumlar\u0131n k\u0131rsal toprak m\u00fclkiyeti d\u00fczeni, tar\u0131ma dayal\u0131 feodal toplumdan sanayiye dayal\u0131 kapitalist topluma ge\u00e7i\u015fte, \u201ctoprak reformu\u201d ad\u0131 verilen devrimci bir kopu\u015f hareketiyle in\u015fa edilmi\u015ftir. Bu, feodal \u00fcretim ili\u015fkilerini \u00e7\u00f6zmek ve hem topra\u011f\u0131 hem de \u00fcreticiyi k\u00f6lelik-serflikten kurtararak \u00f6zg\u00fcrle\u015ftirmek anlam\u0131na gelir. <\/p>\n<p>K\u0131rsal alanda, feodal, yar\u0131-feodal ili\u015fkiler ile feodal art\u0131klar\u0131 tasfiyeyi ama\u00e7layan toprak reformu, T\u00fcrkiye&#8217;de s\u00fcrekli olarak g\u00fcndemde kalm\u0131\u015f ve s\u00fcrekli olarak denenmi\u015f olmas\u0131na kar\u015f\u0131n ger\u00e7ekle\u015ftirilememi\u015f, k\u0131rsal alan\u0131n sanayile\u015fmesi engellendi\u011fi \u00f6l\u00e7\u00fcde bu geleneksel ili\u015fkiler kendili\u011finden \u00e7\u00f6z\u00fclememi\u015f, aksine farkl\u0131 bir boyutta kurumsalla\u015fm\u0131\u015ft\u0131r. \u00d6zellikle G\u00fcneydo\u011fu Anadolu&#8217;da feodal toprak sahipli\u011finin \u00e7\u00f6z\u00fclmesi zaman i\u00e7inde sanc\u0131l\u0131 bir bi\u00e7imde ilerlemi\u015ftir. Bu yap\u0131 bir yandan topraklar\u0131n uygun ve do\u011fru kullan\u0131m\u0131n\u0131 \u00f6nlerken, bir yandan da topra\u011f\u0131n adil da\u011f\u0131t\u0131m\u0131 sorununu derinle\u015ftirmi\u015ftir. N\u00fcfus art\u0131\u015f\u0131n\u0131n da etkisiyle topraks\u0131z \u00e7ift\u00e7i say\u0131s\u0131 giderek artm\u0131\u015f, toprak sahibine ba\u011f\u0131ml\u0131l\u0131k yo\u011funla\u015fm\u0131\u015ft\u0131r. Sanayile\u015fme de, emek-g\u00fcc\u00fcn\u00fc yeterince so\u011furamay\u0131nca, \u00fclke giderek \u00e7e\u015fitlenen ve yo\u011funla\u015fan siyasal \u00e7alkant\u0131lar\u0131n arenas\u0131na d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. GAP \u00e7al\u0131\u015fmas\u0131 ise b\u00fcy\u00fck toprak sahipli\u011finin desteklenmesi ve topraks\u0131zl\u0131k ve yoksullu\u011fun derinle\u015fmesi y\u00f6n\u00fcnde etkide bulunmu\u015f; bak\u0131\u015f a\u00e7\u0131s\u0131nda toprak reformu boyutunun olmamas\u0131 nedeniyle \u00f6ng\u00f6r\u00fclen ama\u00e7lara ula\u015f\u0131lamam\u0131\u015ft\u0131r. Bu nedenledir ki topra\u011f\u0131n adil da\u011f\u0131t\u0131m\u0131, hem bu b\u00f6lgede hem T\u00fcrkiye&#8217;nin di\u011fer b\u00f6lgelerinde \u00fczerinde \u00e7al\u0131\u015f\u0131lmas\u0131 gereken bir sorun alan\u0131 olarak durmaya devam etmektedir. <br \/>K\u0131rsal toprak m\u00fclkiyeti, s\u00f6zle\u015fmeli \u00fcreticilik sorunuyla kar\u015f\u0131 kar\u015f\u0131yad\u0131r. S\u0131nai tar\u0131msal bitki \u00fcretiminde yayg\u0131nla\u015fan &#8216;s\u00f6zle\u015fmeli \u00fcreticilik&#8217; sistemiyle, topra\u011f\u0131n\u0131n tapusuna sahip olan k\u00f6yl\u00fc\/\u00e7ift\u00e7i \u00fcretici, tapulu topra\u011f\u0131yla, \u00fcr\u00fcn\u00fc, kendisi ve ailesiyle birlikte topluca i\u015f\u00e7ile\u015fmekte, bunlar adeta \u201c\u00e7eyizli i\u015f\u00e7i\u201d haline gelmektedir. S\u00f6zle\u015fmeli \u00fcreticilik sistemi, tapusu k\u00f6yl\u00fcde\/\u00e7ift\u00e7ide olmas\u0131na kar\u015f\u0131n, topra\u011f\u0131n kullan\u0131l\u0131\u015f\u0131na karar verme g\u00fcc\u00fcn\u00fcn, yani ger\u00e7ek m\u00fclkiyetin, yerli-yabanc\u0131 tar\u0131msal-s\u0131nai \u015firketlerin tekeline ge\u00e7mesi demektir. K\u00f6yl\u00fcl\u00fck, \u00f6zellikle k\u00fc\u00e7\u00fck k\u00f6yl\u00fcl\u00fck ve toprak, temelde ulus\u00f6tesi niteli\u011fe sahip bu tekellerin ta\u015feron i\u015f\u00e7ileri ve \u00fcretimhanelerine d\u00f6n\u00fc\u015ft\u00fcr\u00fclmektedir. Tar\u0131mda yo\u011fun ila\u00e7, g\u00fcbre ve sahte tohum kullan\u0131m\u0131, k\u0131sacas\u0131 b\u00fcy\u00fck do\u011fa su\u00e7lar\u0131, bu sistemin getirdi\u011fi olumsuzluklard\u0131r. Hem \u00e7ift\u00e7ilerimizin hem topraklar\u0131m\u0131z\u0131n bu yolla a\u011f\u0131r s\u00f6m\u00fcr\u00fcs\u00fcn\u00fcn sona erdirilmesi i\u00e7in \u00e7\u00f6z\u00fcmler geli\u015ftirilmelidir. <\/p>\n<p>Kamu tar\u0131m i\u015fletmeleri ve kamu y\u00f6netiminin tar\u0131msal \u00f6rg\u00fctlenmesi, son otuz y\u0131lda \u00f6zelle\u015ftirme politikas\u0131 do\u011frultusunda yok edilmi\u015ftir. Devlet \u00fcretme \u00e7iftlikleri \u00e7\u00f6km\u00fc\u015f, topraklar\u0131 \u00e7e\u015fitli y\u00f6ntemlerle \u00f6zel m\u00fclkiyet havuzuna aktar\u0131lmaya ba\u015flanm\u0131\u015ft\u0131r. K\u00fc\u00e7\u00fck \u00fcreticiyi b\u00fcy\u00fck toprak sahibi ve dev tekellerin tasallutundan koruyabilecek kooperatif \u00f6rg\u00fctlenmeleri, tar\u0131msal yay\u0131m kurumlar\u0131 kald\u0131r\u0131lm\u0131\u015ft\u0131r. Ziraat Bankas\u0131&#8217;n\u0131n i\u015fleyen \u00f6zelle\u015ftirmesiyle tar\u0131msal kredi sistemi, k\u00fcresel bankalar\u0131n a\u00e7\u0131k pazar\u0131 haline getirilmi\u015ftir. Kamu ara\u015ft\u0131rma kurulu\u015flar\u0131 kapat\u0131larak ve\/veya i\u015flevsizle\u015ftirilerek, tar\u0131msal \u00fcretimde teknolojik d\u0131\u015fa ba\u011f\u0131ml\u0131l\u0131k artt\u0131r\u0131lm\u0131\u015ft\u0131r. K\u0131saca \u00f6zelle\u015ftirme politikas\u0131, k\u0131rsal toprakta m\u00fclkiyet ili\u015fkilerinin b\u00fcy\u00fck toprak sahipli\u011fi ve tar\u0131msal-s\u0131nai tekeller taraf\u0131ndan y\u00f6netilmesi sonucunu yaratm\u0131\u015ft\u0131r. K\u0131rsal \u00fcretim\/m\u00fclkiyet ili\u015fkilerinde \u201cb\u00fcy\u00fck toprak sahibi &#8211; tar\u0131msal s\u0131nai tekeller ittifak\u0131\u201d yeni bir yap\u0131lanmad\u0131r; bu, \u00fczerinde durulmas\u0131 gerekli g\u00f6r\u00fclen konulardan biridir. <\/p>\n<p>Ta\u015f\u0131nmaz varl\u0131klar \u00fczerinde m\u00fclkiyet hakk\u0131, bir\u00e7ok uyu\u015fmazl\u0131\u011fa yol a\u00e7abilen \u00f6nemli bir y\u00f6netim alan\u0131d\u0131r. Kadastronun do\u011fru yap\u0131lmas\u0131, ta\u015f\u0131nmaz m\u00fclkiyet haklar\u0131n\u0131n kullan\u0131lmas\u0131nda belirleyici \u00f6neme sahiptir. Kadastro yap\u0131lan yerlerde toprak ihtilaflar\u0131n\u0131n azald\u0131\u011f\u0131 bir ger\u00e7ektir. Kadastro, tarihi, do\u011fal, k\u00fclt\u00fcrel varl\u0131klar\u0131n, \u00f6zel koruma alanlar\u0131n\u0131n koruma arac\u0131 olarak \u00f6nemli bir i\u015fleve sahiptir. Bu nedenle, kadastro konusunda, teknik uzmanl\u0131\u011f\u0131n geli\u015ftirilmesinin yan\u0131 s\u0131ra, y\u00f6netsel ve siyasal boyutlar\u0131n\u0131 da dikkate alan bir bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131n geli\u015ftirilmesi ihtiyac\u0131, \u00fczerinde d\u00fc\u015f\u00fcn\u00fclmesi gereken bir konudur. <\/p>\n<p>Bu a\u00e7\u0131dan, &#8216;arazi y\u00f6netim sistemi&#8217; ba\u015fl\u0131\u011f\u0131 alt\u0131nda geli\u015ftirilen yeni tekniklerle yakla\u015f\u0131mlar, ideolojik \u00e7\u0131k\u0131\u015f noktalar\u0131 ve siyasal dayanaklar\u0131 bak\u0131m\u0131ndan dikkatli bir irdelemeye tabi tutulmal\u0131d\u0131r. Uydu sistemlerine dayal\u0131 &#8216;arazi y\u00f6netim sistemleri&#8217; insan k\u00f6r\u00fc, pahal\u0131 ve teknolojik olarak d\u0131\u015fa ba\u011f\u0131ml\u0131 yakla\u015f\u0131mlar\u0131n \u00fcr\u00fcnleridir. Oysa, arazi y\u00f6netiminde uzmanl\u0131k bilgisi ile yerel halk\u0131n do\u011frudan i\u015fbirli\u011fi, pek \u00e7ok durumda yerinde, uygun, do\u011fru kararlar al\u0131nmas\u0131n\u0131 sa\u011flayan kat\u0131l\u0131mc\u0131 bir y\u00f6ntemdir. Bu ve benzeri teknik ve yakla\u015f\u0131mlar ihmal edilmemelidir. <\/p>\n<p>Kentsel Toprak M\u00fclkiyeti: Kentsel topraklar, rant sava\u015flar\u0131 sergilenen alanlara d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. Rant, belli bir eme\u011fin de\u011fil, do\u011frudan toplumsal ya\u015fam\u0131n ve kamusal kararlar\u0131n sonunda elde edilen ek kar diye tan\u0131mlan\u0131r. Tan\u0131m\u0131 gere\u011fi, kamudan do\u011fmu\u015f olan bu ek kar, kamuya geri d\u00f6nd\u00fcr\u00fclmelidir. <\/p>\n<p>G\u00fcn\u00fcm\u00fczde kentsel topraklar, sahiplik durumuna dayal\u0131 mutlak ranttan \u00e7ok, konum-farkl\u0131l\u0131k ve tekel rantlar\u0131na odaklanm\u0131\u015ft\u0131r. Halk\u0131n gecekondusuna, konutuna, i\u015fyerine dayal\u0131 &#8216;rant geliri&#8217;, kendi bar\u0131nma gereksinmesi i\u00e7in kulland\u0131\u011f\u0131 evin kendisi dahil, b\u00fcy\u00fck mahalleler halinde toptan ve bir hamlede, i\u00e7ine devlet g\u00fcc\u00fcn\u00fcn de kat\u0131ld\u0131\u011f\u0131 \u201ckentsel d\u00f6n\u00fc\u015f\u00fcm\u201d; \u201cgayr\u0131menkul yat\u0131r\u0131m ortakl\u0131\u011f\u0131\u201d kanallar\u0131yla toptan sat\u0131n al\u0131nabilmekte ve \u00fczerinde her t\u00fcrl\u00fc ek kar yarat\u0131labilmektedir. Amerikan tut-sat sistemi, bu s\u00fcrecin tek tek konut sahiplerine yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131n\u0131 \u00f6ng\u00f6ren par\u00e7as\u0131d\u0131r. B\u00fct\u00fcn bu s\u00fcre\u00e7, \u201cgayr\u0131menkul\u00fcn menkulle\u015ftirilmesi\u201d olarak adland\u0131r\u0131labilir. Kentsel rant, mali sistemde gizlenmi\u015ftir; \u00f6n\u00fcm\u00fczdeki d\u00f6nemde bu \u00f6zellik b\u00fct\u00fcn boyutlar\u0131yla daha a\u00e7\u0131k g\u00f6zlemlenebilecektir. <\/p>\n<p>Ulus\u00f6tesi sermayenin m\u00fclkiyet anlay\u0131\u015f\u0131 sorgulanmal\u0131d\u0131r. Bu, klasik liberalizmin y\u00fckseltti\u011fi m\u00fclkiyet anlay\u0131\u015f\u0131n\u0131 bile tan\u0131mayan; \u201czorla m\u00fclkiyet d\u00f6n\u00fc\u015f\u00fcm\u00fc\u201dn\u00fc temel ilke haline getirmi\u015f bulunan bir anlay\u0131\u015ft\u0131r. Efem\u00e7ukuru k\u00f6y\u00fcnde, y\u00fcksek getirili tar\u0131msal \u00fcretim yapan k\u00f6yl\u00fclerin arazilerini satmak istememeleri \u00fczerine, k\u00f6y arazilerinin \u201cAcele Kamula\u015ft\u0131rma Kanunu\u201dna dayan\u0131larak kamula\u015ft\u0131r\u0131lmas\u0131 ve kamula\u015ft\u0131r\u0131lan topraklar\u0131n ulus\u00f6tesi alt\u0131n \u015firketine devredilmesi, bu durumun kan\u0131tlar\u0131ndan biridir. <\/p>\n<p>M\u00fclk, m\u00fclkiyet, kamu yarar\u0131 kavramlar\u0131 yeniden tan\u0131mlanmal\u0131d\u0131r. Bu kavramlar ger\u00e7ekten genel toplumsal yarar, toplumsal e\u015fitlik, halk sa\u011fl\u0131\u011f\u0131 ve toplumsal refah bak\u0131\u015f a\u00e7\u0131s\u0131yla y\u00f6netsel ve hukuksal a\u00e7\u0131dan yeniden tan\u0131mlanmal\u0131d\u0131r. Aksi halde piyasa odakl\u0131 kamu kararlar\u0131 ve kentsel planlama, kamu hukuku ve birimlerinin varl\u0131\u011f\u0131n\u0131 ciddi bi\u00e7imde sorgulan\u0131r hale getirecektir. <\/p>\n<p>Do\u011fal Varl\u0131klar M\u00fclkiyeti: Orman, mera, bozk\u0131r, su ve k\u0131y\u0131lar, madenler gibi do\u011fal varl\u0131klar\u0131n kamusal m\u00fclkiyeti, temel ilkedir; olmazsa olmaz ko\u015fuldur. Ancak, neoliberal politikalar d\u00fcnyada oldu\u011fu gibi T\u00fcrkiye&#8217;de de bunlar\u0131 metala\u015ft\u0131rmakta, dolay\u0131s\u0131yla sat\u0131l\u0131p al\u0131nabilir, m\u00fclk edinilebilir ticari mallara d\u00f6n\u00fc\u015ft\u00fcrmektedir. Do\u011fal varl\u0131klar\u0131n ticari mala d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi, hukuk eliyle yap\u0131lmaktad\u0131r. Bu s\u00fcre\u00e7, hukuk yoluyla ve do\u011fal varl\u0131klarla do\u011frudan ili\u015fki i\u00e7inde olan toplumsal s\u0131n\u0131f ve kesimlerin i\u00e7inde bulundu\u011fu toplumsal ve siyasal yetersizlikler nedeniyle, onlar\u0131n etkili kar\u015f\u0131 koyu\u015flar\u0131 olmadan kolayca kotar\u0131labilmektedir. Do\u011fal varl\u0131klar, hem m\u00fclkiyeti hem y\u00f6netimi bak\u0131m\u0131ndan bir kamu hizmet alan\u0131 olarak \u00f6rg\u00fctlendirilmelidir. <\/p>\n<p>Yabanc\u0131lara Toprak Sat\u0131\u015f\u0131. K\u00f6y Kanunu (1924) ve Tapu Kanunu&#8217;nun (1934) yabanc\u0131lar\u0131n k\u00f6ylerde ve k\u00f6y arazilerinde ta\u015f\u0131nmaz\/toprak edinmelerini yasaklayan madde h\u00fck\u00fcmleri, 2003 y\u0131l\u0131nda y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r. Tapu Kanunu&#8217;nun de\u011fi\u015ftirilen 35. maddesi ve yine 2003 y\u0131l\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe giren Do\u011frudan Yabanc\u0131 Yat\u0131r\u0131mlar Kanunu, yabanc\u0131 ger\u00e7ek ve t\u00fczel ki\u015filerin, kendi \u00fclkelerinin yasalar\u0131na g\u00f6re kurulmu\u015f ticaret \u015firketlerinin, T\u00fcrk vatanda\u015flar\u0131n\u0131n T\u00fcrkiye&#8217;de edinebilece\u011fi b\u00fcy\u00fckl\u00fckte toprak edinmelerine olanak sa\u011flam\u0131\u015ft\u0131r.
