TOK\u0130&#8217;nin Atak\u00f6y sahilde toplam 77 bin metrekare y\u00fcz\u00f6l\u00e7\u00fcml\u00fc 564 ada 161 -162 parseli 31 A\u011fustos 2010\u2019da ihale usul\u00fcyle \u00d6zyaz\u0131c\u0131 \u0130n\u015faat \u2013 Karadeniz \u00d6rme ortakl\u0131\u011f\u0131na sat\u0131\u015f\u0131 sonras\u0131nda ba\u015flayan hukuki s\u00fcre\u00e7te Dan\u0131\u015ftay \u0130dari Dava Daireleri Kurulu son noktay\u0131 koydu. Radikal&#8217;den \u00d6mer Erbil&#8217;in haberine g\u00f6re TOK\u0130&#8217;nin kamu yarar\u0131n\u0131 yok sayarak, sahildeki yap\u0131la\u015fman\u0131n \u00f6n\u00fcn\u00fc a\u00e7an ve ye\u015fil alanlar\u0131 yok eden projenin \u00f6n\u00fcn\u00fc a\u00e7t\u0131\u011f\u0131na karar veren Dan\u0131\u015ftay \u0130dari Dava Daireleri Kurulu (D\u0130DDK), dosyay\u0131 \u0130stanbul 4. \u0130dare Mahkemesi\u2019ne g\u00f6nderdi. Talana kar\u015f\u0131 Atak\u00f6y 1. K\u0131s\u0131m Koruma ve G\u00fczelle\u015ftirme Derne\u011fi taraf\u0131ndan ba\u015flat\u0131lan m\u00fccadele dahilinde 2011 y\u0131l\u0131nda a\u00e7\u0131lan dava, 5 y\u0131l sonra sil ba\u015ftan yeniden g\u00f6r\u00fclecek. \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ve \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi&#8217;nin her t\u00fcrl\u00fc usuls\u00fczl\u00fc\u011fe g\u00f6z yumdu\u011fu dava s\u00fcrecinde daval\u0131 parsele 16 katl\u0131 5 blok in\u015fa edildi ve konutlar\u0131n sat\u0131\u015flar\u0131 ise tamamland\u0131.<\/p>\n<p><strong>\u201cYe\u015fil alan niteli\u011findeki ta\u015f\u0131nmaz\u0131n yap\u0131la\u015fmaya a\u00e7\u0131laca\u011f\u0131 a\u00e7\u0131k\u201d<\/strong><br \/>\nTOK\u0130&#8217;nin betonla\u015fma tehlikesi ve k\u0131y\u0131 \u015feridinde beton set olu\u015fturacak projelere zemin haz\u0131rlad\u0131\u011f\u0131n\u0131 belirten D\u0130DDK \u2018\u2019yasa koyucu iptal davalar\u0131 i\u00e7in menfaat ili\u015fkisini s\u00fcbjektif ehliyet ko\u015fulu olarak getirmi\u015ftir. \u0130dari i\u015flemlerin hukuka uygunlu\u011funun iptal davas\u0131 yolu ile denetlenmesini engellemeyecek bir bi\u00e7imde anla\u015f\u0131lmas\u0131 gerekmektedir. Nitekim \u00e7evre, tarik, k\u00fclt\u00fcrel de\u011ferlerin korunmas\u0131 imar uygulamalar\u0131 gibi kamu yarar\u0131n\u0131 yak\u0131ndan ilgilendiren konularda s\u00fcbjektif ehliyet ko\u015fulunun bu durum dikkate al\u0131narak yorumlanmas\u0131 gerekti\u011fine ili\u015fkin Dan\u0131\u015ftay kararlar\u0131 yerle\u015fik i\u00e7tihat niteli\u011fi kazanm\u0131\u015ft\u0131r.
