Neoliberal serbestle\u015ftirme, \u00f6zelle\u015ftirme, sendikas\u0131zla\u015ft\u0131rma, ta\u015feronla\u015ft\u0131rma, esnek, g\u00fcvencesiz istihdam politikalar\u0131, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n a\u011f\u0131r olu\u015fu, kad\u0131n, gen\u00e7, \u00e7ocuk eme\u011fi s\u00f6m\u00fcr\u00fcs\u00fc ile kay\u0131t d\u0131\u015f\u0131 istihdam, i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131n\u0131n artmas\u0131n\u0131n ba\u015fl\u0131ca nedenleri aras\u0131ndad\u0131r.<\/p>\n<p>\u0130\u015f kazalar\u0131 sonucu toplu \u00f6l\u00fcmlerin artmas\u0131 nedeniyle 2012 y\u0131l\u0131nda \u00e7\u0131kar\u0131lan 6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 G\u00fcvenli\u011fi Yasas\u0131, sonuncusu 2015\u2019te olmakta \u00fczere defalarca de\u011fi\u015ftirildi. \u0130\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131, hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeline ili\u015fkin y\u00f6netmelikler de defalarca de\u011fi\u015ftirildi. Ancak kazalar ve i\u015f cinayetleri artarak devam etmektedir. Yasa ilk g\u00fcndeme geldi\u011finde ve \u00fczerinde yap\u0131lan de\u011fi\u015fikliklere dair, i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131n\u0131n bu yasa ve mevzuat ile \u00f6nlenemeyece\u011fini hep s\u00f6yledik. Ger\u00e7ek durum ve veriler de bu y\u00f6ndedir.<\/p>\n<p><strong>M\u00fchendislik ve hekimlik d\u0131\u015flan\u0131yor, Bakanl\u0131k kadrolar\u0131 ve i\u015fverenler kay\u0131r\u0131l\u0131yor<\/strong><br \/>\n\u0130SG, t\u0131p, m\u00fchendislik ve sosyal bilimler ile ba\u011f\u0131nt\u0131l\u0131 \u00e7ok-bilimli bir konudur ancak bu disiplinler adeta cezaland\u0131r\u0131lmaktad\u0131r. \u00d6yle ki, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Yasas\u0131, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunu i\u015fverenden \u00e7ok uzmanlara ve hekimlere y\u00fcklemi\u015ftir. Ayr\u0131ca yasa yay\u0131mland\u0131\u011f\u0131ndan bu yana i\u015f g\u00fcvenli\u011fi uzman\u0131, i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personelinin i\u015fyerlerine verecekleri hizmet s\u00fcresi s\u00fcrekli olarak azalt\u0131lm\u0131\u015ft\u0131r. Zira ama\u00e7, uzman, hekim ve di\u011fer sa\u011fl\u0131k personelinin i\u015fyerlerine maliyetini azaltmakt\u0131r. Bu personelin ayda 8 dakika, 12 dakika, 16 dakika gibi \u00e7ok k\u0131sa s\u00fcrelerle g\u00f6rev yapt\u0131\u011f\u0131 i\u015fyerlerinde i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131n\u0131n azalmas\u0131n\u0131 beklemek m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Yasa ile i\u015fyeri hekimi, m\u00fchendis, teknik eleman, hem\u015fire ve di\u011fer sa\u011fl\u0131k personeline verilecek e\u011fitim hizmetleri, d\u0131\u015far\u0131dan sat\u0131n alma yoluyla ticari dan\u0131\u015fmanl\u0131k hizmetlerine d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015ft\u00fcr. \u0130\u015f g\u00fcvenli\u011fi m\u00fchendisli\u011fi ile teknisyenlik, \u201ci\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u201d alt\u0131nda bir tutulmu\u015ftur. \u00d6zel \u00f6\u011fretim kurumlar\u0131na yetki tan\u0131nmas\u0131yla m\u00fchendislik meslek \u00f6rg\u00fctlerinin fonksiyonu d\u0131\u015flanm\u0131\u015f, Bakanl\u0131k kadrolar\u0131 kay\u0131r\u0131lm\u0131\u015ft\u0131r. Bir uzman\u0131n birden \u00e7ok i\u015fyerinde dan\u0131\u015fmanl\u0131k hizmeti vermesi yoluyla tam zamanl\u0131 i\u015f g\u00fcvenli\u011fi m\u00fchendisli\u011fi d\u0131\u015flanm\u0131\u015f; uzmanlar yanlar\u0131nda \u00fccretli olarak \u00e7al\u0131\u015ft\u0131klar\u0131 i\u015fverene ba\u011f\u0131ml\u0131 k\u0131l\u0131nm\u0131\u015f; i\u015f kazalar\u0131nda i\u015fverenlerin sorumlulu\u011fu ortadan kald\u0131r\u0131lm\u0131\u015ft\u0131r. Yasadan sonra, y\u00fczlerce e\u011fitim kurumu ve iki binin \u00fczerinde Ortak Sa\u011fl\u0131k ve G\u00fcvenlik Birimi (OSGB) kurulmu\u015f, fakat yap\u0131lan d\u00fczenlemeler sonucu bunlar kapanmaya ba\u015flam\u0131\u015f, \u00fclkemiz \u201ce\u011fitim kurumu\u201d ve OSGB \u00e7\u00f6pl\u00fc\u011f\u00fcne d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr.<\/p>\n<p><strong>T\u00fcrkiye\u2019deki i\u015f kazalar\u0131na ili\u015fkin baz\u0131 veriler<\/strong><br \/>\nYaln\u0131zca zorunlu\/aktif sigortal\u0131 kay\u0131tl\u0131 \u00e7al\u0131\u015fanlar\u0131 kapsayan SGK verilerine g\u00f6re, 2014 y\u0131l\u0131nda i\u015f kazalar\u0131 say\u0131s\u0131nda yine art\u0131\u015f olmu\u015ftur. 2013 y\u0131l\u0131nda 191 bin 389, 2014\u2019te ise 221 bin 366 i\u015f kazas\u0131 ya\u015fanm\u0131\u015f; 2013\u2019e g\u00f6re y\u00fczde 15,66 oran\u0131nda art\u0131\u015f olmu\u015ftur. \u0130\u015f kazas\u0131 ge\u00e7irenlerin 28 bin 174\u2019\u00fc kad\u0131n, 193 bin 192\u2019si erkektir.<\/p>\n<p>\u0130\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sonucu \u00f6l\u00fcmlerde de art\u0131\u015f olmu\u015f, 2013 y\u0131l\u0131nda bin 360, 2014 y\u0131l\u0131nda bin 626 emek\u00e7i ya\u015fam\u0131n\u0131 kaybetmi\u015ftir. 2014\u2019te \u00f6l\u00fcmler 2013\u2019e g\u00f6re y\u00fczde 19,99 artm\u0131\u015ft\u0131r. \u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Meclisi (\u0130SGM) verilerine g\u00f6re de 2014 y\u0131l\u0131nda en az bin 886 emek\u00e7i \u00f6lm\u00fc\u015ft\u00fcr. 2015 verileri SGK taraf\u0131ndan hen\u00fcz a\u00e7\u0131klanmam\u0131\u015ft\u0131r ancak \u0130SGM verilerine g\u00f6re 2015\u2019te 13\u2019\u00fc meslek hastal\u0131\u011f\u0131 sonucu olmak \u00fczere en az bin 730 emek\u00e7i i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sonucu ya\u015fam\u0131n\u0131 yitirmi\u015ftir.<\/p>\n<p>SGK 2013 ve 2014 verilerinde meslek hastal\u0131klar\u0131ndan dolay\u0131 hi\u00e7 \u00f6l\u00fcm yoktur! Ancak \u0130SGM verilerine g\u00f6re 2013\u2019te en az 3, 2014 y\u0131l\u0131nda en az 29, 2015 y\u0131l\u0131nda en az 13 emek\u00e7i meslek hastal\u0131klar\u0131ndan dolay\u0131 ya\u015fam\u0131n\u0131 kaybetmi\u015ftir. Ger\u00e7ekte, 2014\u20132015 y\u0131llar\u0131na ait i\u015f kazas\u0131 say\u0131s\u0131 ile i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sonucu \u00f6l\u00fcm vakalar\u0131 1996 sonras\u0131n\u0131n doru\u011fu d\u00fczeyindedir. Eurostat istatistiklerine g\u00f6re de T\u00fcrkiye, 100 bin \u00e7al\u0131\u015fan ba\u015f\u0131na \u00f6l\u00fcml\u00fc i\u015f kazalar\u0131nda Avrupa\u2019da birinci s\u0131radad\u0131r.<\/p>\n<p>SGK istatistiklerinde i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131 sonucu \u00f6l\u00fcm geliri ba\u011flananlarla ilgili veriler de bulunmakta fakat dosyalar ilgili \u00f6l\u00fcm y\u0131l\u0131nda sonu\u00e7lanmad\u0131\u011f\u0131 i\u00e7in o y\u0131l\u0131n \u00f6l\u00fcmlerinden dolay\u0131 \u00f6l\u00fcm geliri alan hak sahibi say\u0131s\u0131n\u0131 tespit g\u00fc\u00e7l\u00fc\u011f\u00fc bulunmaktad\u0131r. Ancak y\u0131llar birle\u015ftirilerek ortalama tespit edildi\u011finde, \u00f6l\u00fcmlerin a\u00e7\u0131klanan\u0131n iki kat\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>2014\u2019teki i\u015f kazalar\u0131n\u0131n faaliyet gruplar\u0131na g\u00f6re da\u011f\u0131l\u0131m\u0131nda makine ve te\u00e7hizat hari\u00e7 fabrikasyon metal \u00fcr\u00fcnleri imalat\u0131 18 bin 529 i\u015f kazas\u0131 ile birinci, bina in\u015faat\u0131 13 bin 508 kaza ile ikinci, ana metal sanayii 12 bin 357 kaza ile \u00fc\u00e7\u00fcnc\u00fc s\u0131rada yer almaktad\u0131r. Fabrik metal \u00fcr\u00fcnler ile ana metal sanayinin birle\u015fik yorumlanmas\u0131 durumunda 30 bin 886 kaza (y\u00fczde 13,95) ile metal sanayii birinci; bina in\u015faat\u0131, \u00f6zel in\u015faat faaliyetleri ve bina d\u0131\u015f\u0131 in\u015faat faaliyetlerinin birle\u015fik yorumlanmas\u0131 durumunda in\u015faat sekt\u00f6r\u00fc 29 bin 701 (y\u00fczde 13,41) kaza ile ikinci; kara ve boru hatt\u0131 ta\u015f\u0131mac\u0131l\u0131\u011f\u0131, suyolu, havayolu ve ta\u015f\u0131mac\u0131l\u0131k i\u00e7in depolama ve destekleyici faaliyetlerin birlikte yorumlanmas\u0131 durumunda ta\u015f\u0131mac\u0131l\u0131k 17 bin 74 kaza (y\u00fczde 7,71) ile \u00fc\u00e7\u00fcnc\u00fc; k\u00f6m\u00fcr ve linyit \u00e7\u0131kart\u0131lmas\u0131, metal cevheri madencili\u011fi, di\u011fer madencilik ve ta\u015focak\u00e7\u0131l\u0131\u011f\u0131 ile madencili\u011fi destekleyici hizmet faaliyetlerinin birle\u015fik yorumlanmas\u0131 durumunda madencilik faaliyetleri 12 bin 884 (y\u00fczde 5,82) kaza ile d\u00f6rd\u00fcnc\u00fc s\u0131rada yer almaktad\u0131r.<\/p>\n<p>2014\u2019te en fazla \u00f6l\u00fcm ya\u015fanan faaliyet gruplar\u0131 s\u0131ralamas\u0131nda, Soma katliam\u0131 dolay\u0131s\u0131yla 335 ki\u015fi (y\u00fczde 20,60) ile k\u00f6m\u00fcr ve linyit \u00e7\u0131kart\u0131lmas\u0131 birinci s\u0131rada, 260 ki\u015fi (y\u00fczde 15,99) ile bina in\u015faat\u0131 ikinci s\u0131rada, 172 ki\u015fi (y\u00fczde 10,58) ile kara ta\u015f\u0131mac\u0131l\u0131\u011f\u0131 ve boru hatt\u0131 ta\u015f\u0131mac\u0131l\u0131\u011f\u0131 \u00fc\u00e7\u00fcnc\u00fc s\u0131rada, 143 ki\u015fi (y\u00fczde 8,79) ile bina d\u0131\u015f\u0131 yap\u0131lar\u0131n in\u015faat\u0131 d\u00f6rd\u00fcnc\u00fc s\u0131rada, 98 ki\u015fi (y\u00fczde 6,03) ile \u00f6zel in\u015faat faaliyetleri be\u015finci s\u0131rada yer almaktad\u0131r. \u00dc\u00e7, d\u00f6rt ve be\u015finci s\u0131rada yer alan in\u015faat faaliyetlerindeki i\u015f kazas\u0131 sonucu \u00f6l\u00fcm say\u0131s\u0131 501\u2019dir (y\u00fczde 30,81) ve toplam bin 626 \u00f6l\u00fcm vakas\u0131n\u0131n yakla\u015f\u0131k \u00fc\u00e7te birini olu\u015fturmaktad\u0131r.<\/p>\n<p>2014 y\u0131l\u0131nda i\u015f kazas\u0131 sonucu \u00f6l\u00fcmlerin en y\u00fcksek oldu\u011fu 19 il s\u0131ras\u0131yla; Manisa, \u0130stanbul, Ankara, \u0130zmir, Antalya, Bursa, Kocaeli, Adana, Konya, Mersin, Gaziantep, Kayseri, Karaman, Bal\u0131kesir, Mu\u011fla, Hatay, K. Mara\u015f, Zonguldak ve Tekirda\u011f\u2019d\u0131r. Hi\u00e7 \u00f6l\u00fcm ya\u015fanmayan iller ise Bing\u00f6l, Bayburt, Kilis olarak g\u00f6r\u00fcnmektedir.<\/p>\n<p>Meslek hastal\u0131klar\u0131 SGK istatistiklerinin en gayri ciddi yan\u0131n\u0131 olu\u015fturmaktad\u0131r ve 81 il i\u00e7inde yaln\u0131zca 21 ilde ve 494 vakadan ibarettir! 494 vakan\u0131n 230\u2019u sigortal\u0131l\u0131\u011f\u0131 bittikten sonra meslek hastal\u0131\u011f\u0131 te\u015fhisi konulanlar\u0131 kapsamaktad\u0131r. \u0130ller s\u0131ralamas\u0131n\u0131n ilk be\u015fi \u015f\u00f6yledir: \u0130stanbul 117 ki\u015fi, Kocaeli 33 ki\u015fi, Bilecik 31 ki\u015fi, Zonguldak 21 ki\u015fi, \u0130zmir 10 ki\u015fi! D\u00fcnyada i\u015f kazalar\u0131 oran\u0131 y\u00fczde 44, meslek hastal\u0131klar\u0131 oran\u0131 y\u00fczde 56; T\u00fcrkiye\u2019de i\u015f kazalar\u0131 oran\u0131n\u0131n y\u00fczde 99,998, meslek hastal\u0131klar\u0131n\u0131n ise on binde 2 oran\u0131nda olmas\u0131 SGK veri taban\u0131n\u0131n sorunlu yap\u0131s\u0131n\u0131 g\u00f6stermektedir.<\/p>\n<p>Kad\u0131nlar\u0131n en fazla i\u015f kazas\u0131na maruz kald\u0131\u011f\u0131 iller s\u0131ralamas\u0131nda \u0130stanbul 7 bin 144 i\u015f kazas\u0131 ile ba\u015f\u0131 \u00e7ekmekte, onu \u0130zmir 2 bin 811 i\u015f kazas\u0131yla izlemekte ve s\u0131ralama Bursa 2 bin 656, Antalya bin 947, Manisa bin 649, Kocaeli bin 517, Ankara bin 496, Tekirda\u011f bin 235, Denizli 846 i\u015f kazas\u0131 \u015feklinde s\u00fcrmektedir.<\/p>\n<p>\u00d6nerilerimiz;<\/p>\n<ul>\n<li>\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 (\u00c7SGB) hep tek ba\u015f\u0131na davranarak, sendikalar\u0131n ve meslek \u00f6rg\u00fctlerinin g\u00f6r\u00fc\u015flerini \u00f6nemsemeyerek yanl\u0131\u015f kararlar almaktad\u0131r. Mevcut sorunlar, olaylar ve ac\u0131lar\u0131n artmamas\u0131 i\u00e7in a\u015fa\u011f\u0131daki \u00f6zet \u00f6nerilerimize kulak verilmelidir.<\/li>\n<li>Sendikalar, \u00fcniversiteler, TMMOB, TTB, \u00c7SGB ve Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019n\u0131n kat\u0131l\u0131m\u0131 ile idari ve mali y\u00f6nden ba\u011f\u0131ms\u0131z, d\u00fczenleme ve denetim yapan, \u00e7o\u011funlu\u011funu emek \u00f6rg\u00fctlerinin olu\u015fturdu\u011fu ulusal bir Enstit\u00fc olu\u015fturulmal\u0131; \u00e7al\u0131\u015fma ya\u015fam\u0131na ili\u015fkin mevzuat bu enstit\u00fc taraf\u0131ndan b\u00fct\u00fcn\u00fcyle yeniden d\u00fczenlenmelidir.<\/li>\n<li>\u0130\u015fyerlerinde g\u00f6rev alacak uzman, hekim, sa\u011fl\u0131k personeli ve di\u011fer personelin e\u011fitimi ile i\u015f\u00e7i e\u011fitimleri bu Enstit\u00fc taraf\u0131ndan yerine getirilmeli, her y\u0131l yenileme e\u011fitimleri yap\u0131lmal\u0131d\u0131r.<\/li>\n<li>Bakanl\u0131k kamusal denetim y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmelidir.
