{"id":20844,"date":"2016-05-09T14:06:53","date_gmt":"2016-05-09T11:06:53","guid":{"rendered":"http:\/\/politeknik.org.tr\/\/?p=20844"},"modified":"2016-05-09T14:06:53","modified_gmt":"2016-05-09T11:06:53","slug":"bilgisayar-muhendisleri-odasi-esnek-calisma-guvencesizligin-geldigi-son-nokta-kiralik-iscilik","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/bilgisayar-muhendisleri-odasi-esnek-calisma-guvencesizligin-geldigi-son-nokta-kiralik-iscilik\/","title":{"rendered":"Bilgisayar M\u00fchendisleri Odas\u0131: &#8220;Esnek \u00e7al\u0131\u015fma ve g\u00fcvencesizli\u011fin geldi\u011fi son nokta: Kiral\u0131k i\u015f\u00e7ilik&#8221;"},"content":{"rendered":"<p>Uzun s\u00fcredir h\u00fck\u00fcmetin g\u00fcndeminde olan, kamuoyunda \u201ckiral\u0131k i\u015f\u00e7ilik\u201d olarak bilinen tasar\u0131, 6 May\u0131s 2016 Cuma g\u00fcn\u00fc sabaha kar\u015f\u0131 AKP milletvekillerinin oylar\u0131yla TBMM\u2019de onaylanarak yasala\u015fm\u0131\u015ft\u0131r. \u00dccretli \u00e7al\u0131\u015fan emek\u00e7iler aleyhine bir\u00e7ok d\u00fczenleme i\u00e7eren bu yasa, \u00fclkemizdeki \u00e7al\u0131\u015fma rejiminde k\u00f6kl\u00fc de\u011fi\u015fikliklere yol a\u00e7acakt\u0131r.<\/p>\n<p>2002 y\u0131l\u0131nda AKP\u2019nin tek ba\u015f\u0131na iktidara gelmesinden bu yana, \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131 d\u00fczenleyen yasa ve y\u00f6netmeliklerde pek \u00e7ok de\u011fi\u015fiklik yap\u0131lm\u0131\u015ft\u0131r. \u0130lk olarak 2003 y\u0131l\u0131nda 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun \u00e7\u0131kar\u0131lmas\u0131yla ba\u015flayan s\u00fcre\u00e7, \u201cesnek \u00e7al\u0131\u015fma\u201d ve \u201cg\u00fcvencesizlik\u201d gibi kavramlar\u0131 \u00fccretli \u00e7al\u0131\u015fanlar\u0131n temel g\u00fcndemi haline getirmi\u015ftir. Ta\u015feronla\u015fma t\u00fcm i\u015f kollar\u0131nda yayg\u0131nla\u015f\u0131rken emek\u00e7ilerin g\u00fcvenceleri birer birer t\u0131rpanlanm\u0131\u015ft\u0131r. Gelinen son noktada, \u00fccretli \u00e7al\u0131\u015fanlar\u0131n \u00f6zel istihdam b\u00fcrolar\u0131 arac\u0131l\u0131\u011f\u0131yla adeta birer \u201ci\u015f makinas\u0131\u201d gibi kiralanabilmesine olanak sa\u011flayan bir yasa ya\u015fama ge\u00e7irilmek istenmektedir.<\/p>\n<p>Bili\u015fim sekt\u00f6r\u00fcnde ve di\u011fer sekt\u00f6rlerdeki t\u00fcm \u00e7al\u0131\u015fanlar gibi meslekta\u015flar\u0131m\u0131z da yakla\u015f\u0131k 13 y\u0131ld\u0131r ya\u015fanan bu s\u00fcre\u00e7ten paylar\u0131na d\u00fc\u015feni ald\u0131lar. B\u00fcy\u00fck \u00e7o\u011funlu\u011fu \u00fccretli \u00e7al\u0131\u015fanlardan olu\u015fan bilgisayar m\u00fchendisleri; \u201cesnek\u201d \u00e7al\u0131\u015fma saatleri, \u00f6denmeyen fazla mesailer, \u201coutsource\u201d diye adland\u0131r\u0131larak gizlenen ta\u015feron \u00e7al\u0131\u015fma bi\u00e7imi gibi uygulamalarla en \u00e7ok kar\u015f\u0131la\u015fan meslek gruplar\u0131ndan birini olu\u015fturmaktad\u0131r. Bug\u00fcn say\u0131lar\u0131 40 bini a\u015fan meslekta\u015flar\u0131m\u0131z\u0131n bir k\u0131sm\u0131, t\u00fcm bu d\u00fczenlemelerin sonucu olan g\u00fcvencesizlik ve gelecek endi\u015fesiyle d\u00fc\u015f\u00fck \u00fccretlerle \u00e7al\u0131\u015fma ya\u015famlar\u0131n\u0131 s\u00fcrd\u00fcr\u00fcrken bir\u00e7ok meslekta\u015f\u0131m\u0131z da i\u015fsizlik sorunuyla y\u00fcz y\u00fcze kalmaktad\u0131r.<\/p>\n<p>TBMM\u2019de onaylanarak yasala\u015fan kiral\u0131k i\u015f\u00e7ilik d\u00fczenlemesi, \u00e7al\u0131\u015fanlar\u0131n i\u015fverenle do\u011frudan kurduklar\u0131 i\u015f ili\u015fkisinin \u00f6zel istihdam b\u00fcrolar\u0131 \u00fczerinden dolayl\u0131 olarak kurulmas\u0131 temeline dayanmaktad\u0131r. Bunun sonucu olarak i\u015fverenlerin \u00e7al\u0131\u015fanlar\u0131na kar\u015f\u0131 ta\u015f\u0131d\u0131klar\u0131 sorumluluklar\u0131n ortadan kalkmas\u0131, i\u015ften \u00e7\u0131karma maliyetlerinin d\u00fc\u015fmesi, \u00fccretli \u00e7al\u0131\u015fanlar\u0131n zaten en b\u00fcy\u00fck sorunlar\u0131ndan biri olan g\u00fcvencesizli\u011fin derinle\u015fmesi s\u00f6z konusu olacakt\u0131r. K\u0131dem tazminat\u0131 ve ihbar tazminat\u0131 gibi \u00e7al\u0131\u015fan\u0131 koruyan uygulamalar i\u015flevsizle\u015fecektir. Daha \u00f6nceki t\u00fcm d\u00fczenlemeler gibi \u201cistihdam\u0131 art\u0131raca\u011f\u0131\u201d iddias\u0131yla \u00e7\u0131kar\u0131lan bu yasan\u0131n asl\u0131nda t\u00fcm \u00fccretli \u00e7al\u0131\u015fanlar i\u00e7in adeta bir k\u00f6lelik d\u00fczenini ya\u015fama ge\u00e7irece\u011fi \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>\u00dccretli \u00e7al\u0131\u015fan meslekta\u015flar\u0131m\u0131z\u0131n ya\u015fama ve \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 zorla\u015ft\u0131ran daha \u00f6nceki t\u00fcm d\u00fczenlemelerde oldu\u011fu gibi, bu yasa de\u011fi\u015fikli\u011finin ilk uygulamalar\u0131n\u0131n g\u00f6r\u00fclece\u011fi yerlerden biri de bizim meslek alan\u0131m\u0131z olacakt\u0131r. \u00d6zel istihdam b\u00fcrolar\u0131 arac\u0131l\u0131\u011f\u0131yla istihdam edilecek olan meslekta\u015flar\u0131m\u0131z mevcut \u0130\u015f Kanunu\u2019nun sa\u011flad\u0131\u011f\u0131 g\u00fcvencelerden de yoksun kalacak, s\u00fcrekli ge\u00e7ici i\u015flerde d\u00fc\u015f\u00fck \u00fccretlerle \u00e7al\u0131\u015fmaya mecbur k\u0131l\u0131nacaklard\u0131r. \u0130\u015fverenlerce daha d\u00fc\u015f\u00fck maliyetli olan kiral\u0131k i\u015f\u00e7ilerin tercih edilmesi sonucunda, halihaz\u0131rda d\u00fczenli bir i\u015fte \u00e7al\u0131\u015fmakta olan bir\u00e7ok meslekta\u015f\u0131m\u0131z da i\u015fsiz kalacakt\u0131r. Bunlar\u0131n sonucu olarak \u00fccretler daha da d\u00fc\u015fecek, meslekta\u015flar\u0131m\u0131z her ge\u00e7en g\u00fcn daha k\u00f6t\u00fc \u00e7al\u0131\u015fma ko\u015fullar\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya kalacaklard\u0131r. S\u00fcrekli olarak ge\u00e7ici i\u015flerde \u00e7al\u0131\u015fanlar sa\u011fl\u0131k ve sosyal g\u00fcvenlik uygulamalar\u0131ndan faydalanmakta s\u0131k\u0131nt\u0131 ya\u015fayacak; i\u015fsizlik sorunlar\u0131 y\u00fcz\u00fcnden \u00e7al\u0131\u015fma ya\u015fam\u0131na zaten ge\u00e7 ba\u015flayan meslekta\u015flar\u0131m\u0131z ise emeklili\u011fi hayal bile edemeyeceklerdir.<\/p>\n<p>M\u00fchendislik mesle\u011fi, temelini bilimden al\u0131r ve kendi etik kurallar\u0131 \u00e7er\u00e7evesinde uygulan\u0131r. \u0130\u015f, a\u015f ve gelecek kayg\u0131s\u0131n\u0131n oldu\u011fu ko\u015fullarda ise mesle\u011fin gerektirdi\u011fi \u00f6nceliklerin ve kamusal \u00e7\u0131karlar\u0131n g\u00f6zetilmesi zorla\u015f\u0131r. Meslekta\u015flar\u0131m\u0131z\u0131n \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131 zorla\u015ft\u0131racak olan d\u00fczenlemelerin do\u011frudan sonucu olarak mesle\u011fimiz ve \u00fclkemiz zararl\u0131 \u00e7\u0131kacakt\u0131r. Bilgisayar M\u00fchendisleri Odas\u0131 olarak eme\u011fimize, mesle\u011fimize ve \u00fclkemize sahip \u00e7\u0131k\u0131yoruz. Kiral\u0131k i\u015f\u00e7ilik d\u00fczenlemesini kabul etmiyor, t\u00fcm meslekta\u015flar\u0131m\u0131z\u0131 ve bili\u015fim \u00e7al\u0131\u015fanlar\u0131n\u0131 bu d\u00fczenlemeye kar\u015f\u0131 birlikte hareket etmeye \u00e7a\u011f\u0131r\u0131yoruz.<\/p>\n<p><strong>BMO 3.
