Buna yasa koyucular \u00f6zel istihdam b\u00fcrosu a\u00e7may\u0131 d\u00fczenleyen yasa da diyorlar. Gecenin 4\u2019\u00fcnde AKP\u2019li i\u015f\u00e7i d\u00fc\u015fman\u0131 milletvekillerinin oyuyla i\u015f\u00e7ilere k\u00f6lelik reva g\u00f6r\u00fcld\u00fc. Bu yasan\u0131n her ne kadar kad\u0131n i\u015f\u00e7ileri, ev i\u00e7i eme\u011fi ve tar\u0131m i\u015f\u00e7ilerini g\u00f6zetmek i\u00e7in haz\u0131rland\u0131\u011f\u0131 s\u00f6ylense de \u00d6zel \u0130stihdam B\u00fcrolar\u0131 arac\u0131l\u0131\u011f\u0131 ile sermaye sahipleri as\u0131l i\u015f koluna dahil olan i\u015fler i\u00e7in de i\u015f\u00e7i kiralayabilecekler. Bir ba\u015fka ifadeyle as\u0131l i\u015fkolunu kapsamayan ta\u015feron sistemi s\u0131n\u0131rs\u0131zla\u015ft\u0131r\u0131lacak. \u00d6rne\u011fin bir fabrikada, pek \u00e7ok firma temizlik, bak\u0131m ve benzeri i\u015fleri ta\u015feron arac\u0131l\u0131\u011f\u0131yla yapt\u0131r\u0131r, devlet de de bu yayg\u0131nla\u015fm\u0131\u015ft\u0131r. Ama art\u0131k ana \u00fcretim k\u0131sm\u0131nda yer alan bir i\u015f\u00e7i de kiral\u0131k i\u015f\u00e7i olabilecek, kendisiyle hi\u00e7bir ilgisi olmayan \u00f6zel istihdam b\u00fcrosundan (i\u015f\u00e7i simsarlar\u0131 diyelim) kiralanan i\u015f\u00e7i olabilecek. \u015eimdi bakal\u0131m bu rezil yasa ne getiriyor:<\/p>\n<ul>\n<li>As\u0131l i\u015fverenle hukuki bir ba\u011f\u0131 kalmayan i\u015f\u00e7iler istendi\u011fi anda i\u015ften \u00e7\u0131kart\u0131labilecek.<\/li>\n<li>\u0130\u015f\u00e7ilerin \u00f6rg\u00fctlenme haklar\u0131 da fiilen ellerinden al\u0131nm\u0131\u015f olacak.<\/li>\n<li>T\u00fcrkiye\u2019deki kay\u0131tl\u0131 istihdam\u0131n yar\u0131s\u0131 kiral\u0131k i\u015f\u00e7ilik olarak kullan\u0131lacak. Toplam istihdam\u0131n d\u00f6rtte biri kiral\u0131k i\u015f\u00e7i olabilirken, 10 ki\u015fiden az i\u015fyerlerinde yar\u0131s\u0131 olabilecek. B\u00f6ylelikle T\u00fcrkiye\u2019de toplam istihdam\u0131n neredeyse yar\u0131s\u0131 yasal olarak kiral\u0131k i\u015f\u00e7i olabilecek<\/li>\n<li>\u0130\u015f\u00e7iler her an i\u015ften \u00e7\u0131kart\u0131labilece\u011finden, k\u0131dem tazminatlar\u0131n\u0131 kullanmalar\u0131 m\u00fcmk\u00fcn olmayacak.<\/li>\n<li>Y\u0131ll\u0131k izinlerin kullan\u0131m\u0131 ise hayal olacak<\/li>\n<li>\u0130\u015f\u00e7ilerin sa\u011fl\u0131k sigortalar\u0131, gelirleri, SGK prim \u00f6demeleri de d\u00fczensiz olacak. 4 ay kiralan\u0131p 4 ay i\u015fsiz kalan i\u015f\u00e7inin aradaki s\u00fcrelerde devlete sa\u011fl\u0131k primini (Genel Sa\u011fl\u0131k Sigortas\u0131-GSS) \u00f6demesi gerekecek.<\/li>\n<li>\u0130\u015f\u00e7iler i\u015f\u00e7i simsarlar\u0131na muhta\u00e7 olacak. S\u00f6zle\u015fme imzalad\u0131\u011f\u0131 \u00f6zel istihdam b\u00fcrosu kendisini \u00e7a\u011f\u0131rmadan ba\u015fka bir i\u015fte \u00e7al\u0131\u015famayacak, \u00e7\u00fcnk\u00fc taahh\u00fct vermi\u015f olacak.<\/li>\n<li>\u0130\u015f\u00e7i simsarlar\u0131 kiral\u0131k i\u015f\u00e7ileri 3\u2019er ayl\u0131k bo\u015fluklar vererek \u00e7al\u0131\u015ft\u0131rabilecek. . \u0130\u015f\u00e7iler 3 aydan \u00f6nce \u00d6\u0130B\u2019den ayr\u0131lmak isterlerse, k\u0131dem tazminat\u0131 alamayacaklar\u0131 gibi i\u015fverene ihbar tazminat\u0131 \u00f6demek zorunda da kalabilecek. \u00d6te yandan i\u015fverenler i\u015f\u00e7ilerden \u201ccezai \u015fart\u201d ad\u0131 alt\u0131nda y\u00fcksek miktarlarda tazminat da talep edebilecek.<\/li>\n<li>Emeklilik hayal olacak.<\/li>\n<li>Kiral\u0131k i\u015f\u00e7i veya art\u0131k k\u00f6le diyebiliriz, co\u011frafi olarak T\u00fcrkiye\u2019nin her yerine g\u00f6nderilebilecek. Yerle\u015fik ya\u015fam, aile ya\u015fam\u0131, sosyal ili\u015fkiler vs. tarihte kalacak.<\/li>\n<\/ul>\n<p>Peki t\u00fcm bu s\u00f6ylenenler i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan neler getirecek:<\/p>\n<ul>\n<li>Zaten allahl\u0131k olan meslek hastal\u0131\u011f\u0131 kay\u0131t sisteminin tutulabilmesi neredeyse imkans\u0131z hale gelecek, bir i\u015f\u00e7inin ya\u015fad\u0131\u011f\u0131 sa\u011fl\u0131k sorunlar\u0131 ile \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015f aras\u0131nda \u201cuygun illiyet ba\u011f\u0131\u201dn\u0131 ispat etmesi neredeyse imkans\u0131zla\u015facak.<br \/>\n\u00d6zellikle \u00f6l\u00fcmle sonu\u00e7lanmayan ve yasal olarak \u201ci\u015f kazas\u0131\u201d olarak de\u011ferlendirilmesi gereken vakalar\u0131n \u00e7ok daha b\u00fcy\u00fck bir k\u0131sm\u0131 kay\u0131t d\u0131\u015f\u0131 hale gelecek.<\/li>\n<li>\u0130\u015f G\u00fcvenli\u011fi disiplininde en \u00f6nemli \u015feylerden birisi olan \u201ci\u015fe uygunluk\u201d ve \u201ci\u015fe al\u0131\u015fma\u201d ortadan kalkacak, 4 ay bir i\u015fte 4 ay ba\u015fka bir i\u015fte \u00e7al\u0131\u015fan i\u015f\u00e7i, ayn\u0131 i\u015fi yapsa dahi i\u015fyeri ko\u015fullar\u0131na al\u0131\u015fma evresinde ciddi \u00f6l\u00e7\u00fcde risklere maruz kalacak.<\/li>\n<li>\u0130\u015f\u00e7i ihtiyac\u0131 olan fabrikalar, kadrolu i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmak yerine \u00f6zel istihdam b\u00fcrolar\u0131ndan diledikleri say\u0131da i\u015f\u00e7iyi, belli g\u00fcn ya da saat i\u00e7in kiralayacaklar. Kiralanan i\u015f\u00e7inin, s\u00fcresi doldu\u011funda o fabrikayla ili\u015fi\u011fi kesilecek. D\u00fczenli i\u015f saati, planl\u0131 bir aile ya\u015fam\u0131, hatta d\u00fczenli yeme i\u00e7me uyku gibi do\u011frudan i\u015f\u00e7ileri fiziksel ve ruhsal a\u00e7\u0131dan olumlu etkileyebilecek etkenler tamamen bozulacak.<\/li>\n<li>Herhangi bir \u00f6l\u00fcm veya yaralanmada sermaye sahiplerini i\u015f g\u00fcvenli\u011fi konusunda rahatlatmak i\u00e7in topu istihdam b\u00fcrolar\u0131na atmak, gerek ceza davalar\u0131nda, gerekse de tazminat davalar\u0131nda i\u00e7inden \u00e7\u0131k\u0131lmaz labirentler yaratacak.<\/li>\n<li>\u00d6rg\u00fcts\u00fcz ikinci s\u0131n\u0131f stat\u00fcde s\u00fcrekli i\u015ften at\u0131lma endi\u015fesi ta\u015f\u0131yan kiral\u0131k i\u015f\u00e7iler o i\u015fletmeye hep \u201cd\u0131\u015fsal\u201d olacak ve herhangi bir i\u015fletmede dahi merkezi olarak planlanmas\u0131 ve t\u00fcm i\u015f\u00e7ileri kapsamas\u0131 gereken i\u015f g\u00fcvenli\u011fi kiral\u0131k i\u015f\u00e7ileri kapsayamayacak.<\/li>\n<li>\u00d6te yandan, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi i\u00e7in, i\u015fi \u00f6\u011frenme, i\u015fi bilen i\u015f arkada\u015flar\u0131yla deneyim payla\u015fma, i\u015fyerindeki ko\u015fullara ve \u00e7al\u0131\u015fma y\u00f6ntemlerine al\u0131\u015fma gibi hususlar bilimsel \u00e7al\u0131\u015fmalar\u0131n da g\u00f6sterdi\u011fi gibi son derece \u00f6nemli. Bu yasayla bunlar ortadan kalkacak.<\/li>\n<li>Dinlenme, sosyalle\u015fme, rahatlama i\u015f\u00e7inin sa\u011fl\u0131kl\u0131 olarak, dikkatli bir \u015fekilde i\u015fine odaklanabilmesi i\u00e7in de gerekli. Kiral\u0131k i\u015f\u00e7ilerin sendikal\u0131 olmas\u0131, hakk\u0131n\u0131 arayabilmesi, hele ki i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fine ayk\u0131r\u0131 bir durum tespit edip \u00e7al\u0131\u015fmama hakk\u0131n\u0131 kullanabilmesi imkans\u0131z.<\/li>\n<li>Kiral\u0131k i\u015f\u00e7iler birbirinden farkl\u0131 \u00f6zellikler ta\u015f\u0131yan \u00e7al\u0131\u015fma ve \u00fcretim ko\u015fullar\u0131nda, k\u0131sa s\u00fcreli zamanlarda \u00e7al\u0131\u015facak, aradaki i\u015fsizlik zamanlar\u0131nda yine \u201ck\u00f6relecek\u201d, her farkl\u0131 i\u015fletmedeki farkl\u0131 i\u015f g\u00fcvenli\u011fi y\u00f6netim sistemi, talimatlar vs. d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde her zaman \u201cs\u0131f\u0131rdan ba\u015flayacak\u201d.
