Uyar a\u00e7\u0131klamas\u0131nda ayr\u0131ca, Belediye Kanununun 73\u2019\u00fcnc\u00fc maddede ger\u00e7ekle\u015fen  de\u011fi\u015fiklikle ortaya \u00e7\u0131kacak tabloyu betimledi.<\/p>\n<p>A\u00e7\u0131klaman\u0131n tam metni ise  \u015f\u00f6yle;<\/p>\n<p><strong>Belediye Kanununda yap\u0131lan de\u011fi\u015fiklik, ne kentlerimiz ne  de halk\u0131m\u0131z a\u00e7\u0131s\u0131ndan &#8220;hay\u0131rlara vesile&#8221; olmayacakt\u0131r&#8230;<\/strong><\/p>\n<p>Bir  y\u0131l\u0131 a\u015fk\u0131n s\u00fcredir g\u00fcndemde olan ve \u00c7ar\u015famba g\u00fcn\u00fc gece yar\u0131s\u0131 yasala\u015fan, 5393  say\u0131l\u0131 Belediye Kanununun 73nc\u00fc maddesine ili\u015fkin teklif, kentlerimizdeki  karma\u015fay\u0131 b\u00fcy\u00fctecek, vatanda\u015flar\u0131n &#8220;m\u00fclkiyet hakk\u0131n\u0131&#8221;, &#8220;bar\u0131nma hakk\u0131n\u0131&#8221; ortadan  kald\u0131racak, aslen vatanda\u015fa ait olmas\u0131 gereken kent rantlar\u0131n\u0131n yanda\u015flara  aktar\u0131lmas\u0131n\u0131 sa\u011flayacak, anayasaya ayk\u0131r\u0131, hukuksuz bir d\u00fczenlemedir. Bu  nedenledir ki yap\u0131lan bu de\u011fi\u015fiklik, s\u00f6z konusu teklifin yasala\u015fmas\u0131n\u0131 sa\u011flayan  iktidar partisi mensuplar\u0131n\u0131n pek sevdi\u011fi deyimle, asla &#8220;hay\u0131rlara vesile&#8221;  olmayacakt\u0131r. <\/p>\n<p><strong>\u0130stanbul ve Ankara B\u00fcy\u00fck\u015fehir Belediyelerinin  fikri \u00f6nderli\u011finde ger\u00e7ekle\u015fen de\u011fi\u015fikli\u011fin ba\u015fl\u0131ca amac\u0131, belediyelerin i\u00e7ine  d\u00fc\u015ft\u00fckleri hukuksal \u00e7\u0131kmaz ve y\u00f6neticilerin sorumluluktan kurtulma iste\u011fidir.  <br \/><\/strong><br \/>De\u011fi\u015fiklik, bir yandan iktidar partisine mensup belediyelerin  ba\u015flam\u0131\u015f projelerdeki yasal sorunlar\u0131n\u0131 ortadan kald\u0131rmak, di\u011fer yandan ileride  yap\u0131lacak projelerde kar\u015f\u0131lar\u0131na \u00e7\u0131kacak olas\u0131 engelleri ortadan kald\u0131rmak  amac\u0131yla, \u0130stanbul ve Ankara B\u00fcy\u00fck\u015fehir Belediye Ba\u015fkanlar\u0131n\u0131n fikri  \u00f6nderli\u011finde olu\u015fturulmu\u015ftur. <\/p>\n<p>Bu teklifin \u00f6ncelik almas\u0131n\u0131n ve meclis  tatile girmeden, gece g\u00fcnd\u00fcz \u00e7al\u0131\u015farak yasala\u015ft\u0131r\u0131lmas\u0131n\u0131n ba\u015fl\u0131ca nedeni,  belediyelerce bu g\u00fcne kadar yap\u0131lm\u0131\u015f olan ve \u00e7o\u011fu yeterli hukuki dayanaktan  yoksun olan uygulamalardan dolay\u0131 ileride bu uygulamay\u0131 yapan idareler aleyhine  sonu\u00e7lanmas\u0131 muhtemel hukuksal sorun ve sorumluluklardan kurtulmak iste\u011fi,  mevcut ve potansiyel kentsel d\u00f6n\u00fc\u015f\u00fcm alanlar\u0131nda var oldu\u011fu d\u00fc\u015f\u00fcn\u00fclen rant\u0131n  b\u00fcy\u00fckl\u00fc\u011f\u00fc ve h\u0131zla se\u00e7im ortam\u0131na girildi\u011fi g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda, bu i\u015fleri  yapmak i\u00e7in kald\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclen zaman\u0131n darl\u0131\u011f\u0131 olsa gerekir.<\/p>\n<p><strong>\u015eehir  Planc\u0131lar\u0131, 21&#8217;inci y\u00fczy\u0131l gecekondula\u015fmas\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7an, &#8220;ye\u015fil alanda villa&#8221;  pe\u015finde ko\u015fanlar\u0131 yarg\u0131n\u0131n elinden \u00e7ekip almay\u0131 hedefleyen d\u00fczenlemeyi asla  unutmayacakt\u0131r.<\/strong> <\/p>\n<p>Konunun uzmanlar\u0131 olan biz \u015eehir Planc\u0131lar\u0131,  kendileri ve yanda\u015flar\u0131n\u0131n haks\u0131z bi\u00e7imde zenginle\u015fmesinden ve kentin ortak mal\u0131  olan ye\u015fil alanlar\u0131 talan ederek, bu alanlarda &#8220;havuzlu villa&#8221; hayali kuranlar\u0131n  hayallerini ger\u00e7ekle\u015ftirmekten ba\u015fka &#8220;vesile&#8221; olaca\u011f\u0131 &#8220;hay\u0131r&#8221; bulunmayan bu  b\u00fcy\u00fck yanl\u0131\u015f\u0131 yasalar\u0131m\u0131za ta\u015f\u0131yanlar\u0131 hi\u00e7bir zaman unutmayaca\u011f\u0131z ve yap\u0131lan  yanl\u0131\u015f\u0131 bug\u00fcn oldu\u011fu gibi gelecekte de y\u00fczlerine vurmaya devam  edece\u011fiz.<\/p>\n<p>Meclis g\u00f6r\u00fc\u015fmeleri 12 saati a\u015fan de\u011fi\u015fiklik tart\u0131\u015fmalar\u0131nda,  iktidar\u0131 yapmak istedi\u011fi yanl\u0131\u015ftan geri d\u00f6nd\u00fcrmeye \u00e7al\u0131\u015fan t\u00fcm muhalefet  partilerine, bu partilerin s\u00f6zc\u00fclerine \u00e7abalar\u0131 i\u00e7in te\u015fekk\u00fcr etmeyi bir bor\u00e7  bilirken, yasa de\u011fi\u015fikli\u011finin yarataca\u011f\u0131 sorunlar\u0131 g\u00f6re g\u00f6re kabul\u00fc i\u00e7in el  kald\u0131ranlar\u0131 da k\u0131n\u0131yoruz.<\/p>\n<p><strong>TBMM\u2019de kabul edilen de\u011fi\u015fiklik, kent  topraklar\u0131nda &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; ad\u0131 alt\u0131nda ba\u015flat\u0131lm\u0131\u015f &#8220;organize talan&#8221;  projesinin geldi\u011fi son a\u015famad\u0131r.<\/strong><\/p>\n<p>Ankara B\u00fcy\u00fck\u015fehir Belediyesi  taraf\u0131ndan kabul edilerek onaylanm\u0131\u015f olan ve hedef y\u0131l\u0131 Cumhuriyetimizin 100nc\u00fc  y\u0131l\u0131 olan &#8220;Ankara-2023&#8221; Naz\u0131m \u0130mar Plan\u0131nda ye\u015fil alan, a\u011fa\u00e7land\u0131r\u0131lacak alan,  tar\u0131m alan\u0131 olarak tan\u0131mlanan, de\u011feri d\u00fc\u015f\u00fcr\u00fclen ve sat\u0131n al\u0131nmas\u0131  kolayla\u015ft\u0131r\u0131lan bo\u015f alanlarda ilan edilen kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131 kararlar\u0131n\u0131n  &#8220;haks\u0131z rant&#8221; aray\u0131\u015f\u0131ndan ba\u015fka bir amac\u0131 yoktur. <\/p>\n<p>Kentsel topraklarda  talan\u0131 &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; ad\u0131 alt\u0131nda yasalla\u015ft\u0131rmaya, me\u015frula\u015ft\u0131rmaya ve bu  yolla b\u00fcy\u00fck kazan\u00e7lar elde etmeye \u00e7al\u0131\u015fanlar\u0131n kimli\u011fi, bu alanlar ye\u015fil alanken  ger\u00e7ekle\u015fmi\u015f olan sat\u0131\u015flar incelendi\u011finde \u00e7ok a\u00e7\u0131k ortaya \u00e7\u0131kacakt\u0131r. Planl\u0131  bi\u00e7imde ger\u00e7ekle\u015fen bu eylem kent su\u00e7u oldu\u011fu kadar, buna arac\u0131l\u0131k eden kamu  g\u00f6revlileri a\u00e7\u0131s\u0131ndan da g\u00f6revi k\u00f6t\u00fcye kullanma su\u00e7udur. Ne yaz\u0131k ki bu su\u00e7a  TBMM de alet edilmi\u015ftir. <\/p>\n<p>Kentlerimizde ba\u015flayan, bir b\u00f6l\u00fcm\u00fc direnen halk  kesimleri taraf\u0131ndan, bir b\u00f6l\u00fcm\u00fc de meslek odalar\u0131 taraf\u0131ndan yarg\u0131da durdurulan  bu talan\u0131 s\u00fcrd\u00fcrmekte kararl\u0131 olanlar ortaya \u00e7\u0131kar\u0131lacak, g\u00fcn\u00fc geldi\u011finde  &#8220;kand\u0131r\u0131lanlar&#8221; &#8220;kand\u0131ranlara&#8221; bunun hesab\u0131n\u0131  soracakt\u0131r.<\/p>\n<p><strong>Yasala\u015ft\u0131r\u0131lan haliyle, &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221;\u00fcn bug\u00fcnden  sonraki bir ba\u015fka anlam\u0131 da; &#8220;cebren talep yaratma&#8221; olacakt\u0131r.  <br \/><\/strong><br \/>Yap\u0131lan de\u011fi\u015fiklik, konut talebini yeniden canland\u0131rmak, zor  duruma d\u00fc\u015fm\u00fc\u015f olan in\u015faat \u015firketlerini bu durumdan kurtarmak amac\u0131n\u0131 da g\u00f6zeten  bir anlay\u0131\u015f\u0131n \u00fcr\u00fcn\u00fcd\u00fcr. Ancak yap\u0131lan d\u00fczenlemeye bak\u0131ld\u0131\u011f\u0131nda, in\u015faat  \u015firketlerini kurtarmak i\u00e7in se\u00e7ilen y\u00f6ntemin mevcutta bar\u0131nacak bir konutu var  olan insanlar\u0131n, bor\u00e7land\u0131r\u0131larak yeni bir konut almaya mecbur b\u0131rak\u0131lmas\u0131ndan  ba\u015fka bir \u015fey olmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.\u00a0\u00a0 <\/p>\n<p>Kentsel d\u00f6n\u00fc\u015f\u00fcm  yoluyla vatanda\u015f\u0131n evi, arsas\u0131 d\u00fc\u015f\u00fck fiyatlarla elinden al\u0131n\u0131p, yeni bir konut  kendisine daha y\u00fcksek bir fiyatla sat\u0131labilirse, bu operasyon ba\u015far\u0131ya ula\u015fm\u0131\u015f,  ba\u015far\u0131l\u0131 bir kentsel d\u00f6n\u00fc\u015f\u00fcm ger\u00e7ekle\u015ftirilmi\u015f, in\u015faat \u015firketleri kurtulmu\u015f,  garantisiz ve sendikas\u0131z da olsa bir k\u0131s\u0131m i\u015fsize i\u015f bulunmu\u015f, artan konut  kredisi talebinden dolay\u0131 bankac\u0131l\u0131k sistemi canlanm\u0131\u015f  olacakt\u0131r.&#8221;<\/p>\n<p><strong>Kentsel rantlarla semirmeye al\u0131\u015fm\u0131\u015f, g\u00f6z\u00fc d\u00f6nm\u00fc\u015f bir  grubun, vatanda\u015f\u0131n yaln\u0131zca elindeki de\u011fil, ilerde kazanmay\u0131 hayal etti\u011fi  paras\u0131na dahi g\u00f6z koymu\u015f oldu\u011fu g\u00f6r\u00fclmektedir. Bilim ve teknik, rant h\u0131rs\u0131  kar\u015f\u0131s\u0131nda yine kaybetmi\u015ftir. <br \/><\/strong><br \/>M\u00fclkiyet hakk\u0131n\u0131 yok eden ve  bir\u00e7ok a\u00e7\u0131dan Anayasaya ayk\u0131r\u0131l\u0131klar ta\u015f\u0131yan bu d\u00fczenleme sonras\u0131nda, yap\u0131lacak  Kentsel D\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 ile m\u00fclkiyet dokusu b\u00fcy\u00fck oranda de\u011fi\u015fecek, kent  topra\u011f\u0131n\u0131n tasarruf hakk\u0131 b\u00fcy\u00fck \u00f6l\u00e7\u00fcde belediyeler ve onlarla i\u015fbirli\u011fi  i\u00e7erisindeki yanda\u015f m\u00fcteahhitler elinde toplanacakt\u0131r. Konut sahibiyken  konutundan olan vatanda\u015f yeniden konut sahibi olabilmek i\u00e7in b\u00fcy\u00fck bedeller  \u00f6demek zorunda kalacak, bu kesimlerden yanda\u015f kesime ciddi miktarda sermaye  aktar\u0131m\u0131 ger\u00e7ekle\u015ftirilmi\u015f olacakt\u0131r.<\/p>\n<p><strong>Kentleri &#8220;gecekondulardan  temizleme&#8221; etiketiyle pazarlanan d\u00fczenleme, kamuya ait t\u00fcm arazilere el koyarak,  \u00e7a\u011fda\u015f gecekondular \u00fcretilmesini ama\u00e7lamaktad\u0131r.<br \/><\/strong><br \/>Kentsel  topraklarda var olan kamu m\u00fclklerinin \u00f6nemli bir b\u00f6l\u00fcm\u00fc, kentlerimizde  gereksinim duyulan sosyal ve teknik altyap\u0131lar i\u00e7in kullan\u0131lmas\u0131 gerekirken,  iktidarlar taraf\u0131ndan sat\u0131larak elden \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Yap\u0131lan yeni d\u00fczenleme ile  elde kalan son m\u00fclklerinde yanda\u015f m\u00fcteahhitler eliyle pazarlanmas\u0131  ama\u00e7lanmaktad\u0131r.<\/p>\n<p>Di\u011fer yandan bu d\u00fczenleme, b\u00fcy\u00fck\u015fehir belediye  ba\u015fkanlar\u0131n\u0131n kar\u015f\u0131 kar\u015f\u0131ya geldi\u011fi il\u00e7e belediyelerine kar\u015f\u0131 ve di\u011fer kamu  kurumlar\u0131na kar\u015f\u0131 kullanabilece\u011fi \u00e7ok tehlikeli bir silah olarak tasarlanm\u0131\u015ft\u0131r.  <\/p>\n<p><strong>Devam eden davalara m\u00fcdahale amac\u0131ndan ba\u015fka amac\u0131 olmayan  Ge\u00e7ici Madde ile TBMM\u2019de yarg\u0131 yerlerine kar\u015f\u0131 gece yar\u0131s\u0131 darbesi  yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><\/strong>Yasala\u015fan teklifin gece yar\u0131s\u0131 kabul edilen ge\u00e7ici  maddesi, de\u011fi\u015fiklik y\u00fcr\u00fcrl\u00fc\u011fe girmeden \u00f6nce, Ankara B\u00fcy\u00fck\u015fehir Belediyesine  kar\u015f\u0131 a\u00e7\u0131lm\u0131\u015f onlarca davada oldu\u011fu gibi, belediye ve kentsel d\u00f6n\u00fc\u015f\u00fcm ad\u0131  alt\u0131nda ba\u015flat\u0131lm\u0131\u015f talan projelerine kar\u015f\u0131 al\u0131nm\u0131\u015f durdurma kararlar\u0131n\u0131 ortadan  kald\u0131rmay\u0131, bu uygulamay\u0131 yapan idareleri ve karar\u0131 uygulayan yetkilileri yasal  sorumluluktan kurtarmay\u0131 ama\u00e7lamaktad\u0131r. <\/p>\n<p><strong>73&#8217;\u00fcnc\u00fc maddede  ger\u00e7ekle\u015fen de\u011fi\u015fiklikle;<\/strong> <\/p>\n<p>Ankara\u2019da Sakl\u0131kent Kentsel D\u00f6n\u00fc\u015f\u00fcm  Projesi ve G\u00f6ksu Kentsel D\u00f6n\u00fc\u015f\u00fcm Projesi \u00f6rneklerinde oldu\u011fu gibi, yanda\u015f  kesimlerin ve bir grup milletvekilinin kentin naz\u0131m imar plan\u0131nda ye\u015fil alan  olan, bu nedenle &#8220;ucuza kapatt\u0131klar\u0131&#8221; alanlarda hayalini kurduklar\u0131 villalar,  al\u0131\u015fveri\u015f merkezleri ve &#8220;residence&#8221; projelerinin \u00f6n\u00fcndeki yarg\u0131 engelleri  kald\u0131r\u0131lm\u0131\u015f olacakt\u0131r. <br \/>Vatanda\u015flar\u0131m\u0131z kendi m\u00fclk\u00fc ile ilgili al\u0131nan ve  m\u00fclkiyet hakk\u0131n\u0131n kullanmas\u0131n\u0131 b\u00fcy\u00fck oranda engelleyecek Kentsel D\u00f6n\u00fc\u015f\u00fcm Alan\u0131  ilan\u0131yla ilgili meclis kararlar\u0131ndan haberdar olmas\u0131 ve bu kararlara itiraz\u0131n  b\u00fcy\u00fck \u00f6l\u00e7\u00fcde engellenecektir. <\/p>\n<p>\u0130darenin her t\u00fcrl\u00fc eylem ve i\u015flemine kar\u015f\u0131  yarg\u0131 yolunu a\u00e7an Anayasan\u0131n 125. maddesi h\u00fckm\u00fcne ra\u011fmen, kentsel d\u00f6n\u00fc\u015f\u00fcm  alanlar\u0131nda idarenin hukuk d\u0131\u015f\u0131 uygulamalar\u0131na kar\u015f\u0131 idari yarg\u0131 yolu kapat\u0131lm\u0131\u015f  olacakt\u0131r. <\/p>\n<p>\u0130. Melih G\u00f6k\u00e7ek\u2019in r\u00fcyalar\u0131n\u0131 s\u00fcsleyen d\u00fczene ilk ad\u0131m  at\u0131lm\u0131\u015ft\u0131r. \u0130l\u00e7e belediyelerin planlama ve imar uygulama konusundaki t\u00fcm  yetkileri ve bu kapsamda verdikleri hizmetlere ba\u011fl\u0131 olarak elde ettikleri t\u00fcm  gelirler ellerinden al\u0131nabilecektir. <\/p>\n<p>Kentlerimizde belediyeler  taraf\u0131ndan g\u00f6z dikilen, di\u011fer kamu kurumlar\u0131na ait de\u011ferli gayrimenkullerin  bulundu\u011fu alanlar potansiyel kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131 olmaktan  kurtulamayacakt\u0131r.<\/p>\n<p>\u00d6zel \u015fah\u0131slara ait gayrimenkullerin  kamula\u015ft\u0131r\u0131lmas\u0131nda, m\u00fclkiyet hakk\u0131n\u0131 b\u00fct\u00fcn\u00fcyle ortadan kald\u0131ran bir anlay\u0131\u015fla,  vatanda\u015f\u0131n itiraz yollar\u0131 neredeyse b\u00fct\u00fcn\u00fcyle ortadan kald\u0131r\u0131lmakta, tapu  delinmekte ve de\u011fersiz bir ka\u011f\u0131t haline d\u00f6n\u00fc\u015ft\u00fcr\u00fclmektedir. <\/p>\n<p>Kentsel  d\u00f6n\u00fc\u015f\u00fcm alan\u0131nda evi ba\u015f\u0131na y\u0131k\u0131larak soka\u011fa at\u0131lacak vatanda\u015f, kendi mal\u0131n\u0131  belediyenin belirledi\u011fi fiyattan, belediyeden tekrar sat\u0131n almak zorunda  b\u0131rak\u0131lacakt\u0131r. <br \/>Kentte diledi\u011fi yerde t\u00fcm konutlar\u0131 yapma, yapt\u0131rma  konusunda tekel haline gelecek belediyelere, konut yap\u0131m maliyetleri ve sat\u0131\u015f  fiyatlar\u0131n\u0131 belirleme konusunda hi\u00e7bir k\u0131s\u0131tlama ve denetim \u00f6ng\u00f6r\u00fclmemektedir.
