Adeta bir robot kiralar gibi i\u015f\u00e7i kiralayacaklar, sorun olursa yenisiyle de\u011fi\u015ftirecekler. Onlar i\u015f\u00e7iye emir verecek, ama i\u015f\u00e7i onlardan hak talep edemeyecek, a\u011fz\u0131n\u0131 a\u00e7amayacak<\/p>\n<p>Yeni \u00f6zel istihdam b\u00fcrolar\u0131 y\u00f6netmeli\u011fi 11 Ekim 2016 tarihli Resmi Gazete\u2019de yay\u0131mland\u0131. B\u00f6ylece May\u0131s 2016\u2019da 6715 say\u0131l\u0131 yasa ile kabul edilen kiral\u0131k i\u015f\u00e7ili\u011fin uygulamaya ge\u00e7mesinin \u00f6n\u00fcnde engel kalmad\u0131. \u00d6zel istihdam b\u00fcrolar\u0131 arac\u0131l\u0131\u011f\u0131yla i\u015f\u00e7i simsarl\u0131\u011f\u0131 d\u00f6nemi resmen ba\u015flam\u0131\u015f oldu. Yeni y\u00f6netmelikle birlikte \u00f6zel istihdam b\u00fcrolar\u0131 i\u015f bulmaya arac\u0131l\u0131k faaliyetinin yan\u0131 s\u0131ra i\u015f\u00e7i de kiralayabilecek. Hatta \u00f6zel istihdam b\u00fcrolar\u0131n\u0131n as\u0131l faaliyetinin bu olaca\u011f\u0131n\u0131 tahmin etmek zor de\u011fil.<\/p>\n<p>Y\u00f6netmelik yasada \u00f6ng\u00f6r\u00fclen normlara ili\u015fkin usul ve esaslar\u0131 d\u00fczeliyor. Bir alt hukuk normu olarak y\u00f6netmelikler yasalara ayk\u0131r\u0131 h\u00fck\u00fcmler i\u00e7eremezler; fakat yasalarda belirsiz olan, soru i\u015fareti uyand\u0131ran konulara a\u00e7\u0131kl\u0131k getirebilir. Ancak \u00f6zel istihdam b\u00fcrolar\u0131 y\u00f6netmeli\u011fi yasada i\u015f\u00e7iler aleyhine var olan belirsizlikleri gidermiyor, tersine peki\u015ftiriyor.<\/p>\n<p>Y\u00f6netmeli\u011fe g\u00f6re kiral\u0131k i\u015f\u00e7inin i\u015fvereni, talimat\u0131 alt\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fveren de\u011fil, \u00f6zel istihdam b\u00fcrosu olacak. B\u00f6ylece \u00e7al\u0131\u015fma ili\u015fkilerinde yeni bir d\u00f6nem ba\u015fl\u0131yor: \u0130\u015f\u00e7inin kiraya verilmesi ve bu kiralama i\u015flemi \u00fczerinden kazan\u00e7 elde edilmesi. Bunu emek komisyonculu\u011fu olarak adland\u0131rmak m\u00fcmk\u00fcn.<\/p>\n<p>Kiral\u0131k i\u015f\u00e7ilik istisnai bir \u00e7al\u0131\u015fma bi\u00e7imi de\u011fil \u00e7al\u0131\u015fma hayat\u0131n\u0131n \u00f6nemli bir unsuru haline gelebilecek. Mevsimlik tar\u0131m i\u015fleri ve ev hizmetlerinde s\u00fcre s\u0131n\u0131r\u0131 olmaks\u0131z\u0131n kiral\u0131k i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek. Di\u011fer i\u015flerde ise kiral\u0131k i\u015f\u00e7i s\u00f6zle\u015fmesi d\u00f6rt ay s\u00fcreyle kurulabilecek ancak sekiz ay\u0131 a\u015fmamak \u00fczere iki kez yenilenebilecek. Alt\u0131 ay sonra ayn\u0131 i\u015fte yeniden kiral\u0131k i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek. B\u00f6ylece bir i\u015fletmenin de\u011fi\u015fik b\u00f6l\u00fcmlerinde s\u00fcrekli olarak kiral\u0131k i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek.<\/p>\n<p>Kiral\u0131k i\u015f\u00e7i konusunda say\u0131sal, oransal s\u0131n\u0131rlama yok gibi. Kiral\u0131k i\u015f\u00e7i say\u0131s\u0131 i\u015fletmenin mal ve hizmet \u00fcretim kapasitesinin \u00f6ng\u00f6r\u00fclmeyen \u015fekilde artmas\u0131 durumunda i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131n\u0131n d\u00f6rtte birini, 10 ve daha az i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerinde ise be\u015fi ge\u00e7emeyecek. Bu haller d\u0131\u015f\u0131nda ise say\u0131 s\u0131n\u0131r\u0131 olmaks\u0131z\u0131n ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek. \u00d6rne\u011fin \u015firket d\u00f6nemsellik arz eden i\u015f art\u0131\u015flar\u0131 h\u00e2linde veya kadrolu i\u015f\u00e7ilerin izin kulland\u0131\u011f\u0131 d\u00f6nemde istedi\u011fi kadar kiral\u0131k i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rabilecek. Ayr\u0131ca i\u015fletmenin g\u00fcnl\u00fck i\u015flerinden say\u0131lmayan ve aral\u0131kl\u0131 olarak g\u00f6rd\u00fcr\u00fclen i\u015flerde de say\u0131 s\u0131n\u0131r\u0131 olmaks\u0131z\u0131n kiral\u0131k i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek. Tamir ve bak\u0131m i\u015flerin bu i\u015fler aras\u0131nda yer alabilir.<\/p>\n<p><strong>\u2018Hak yok, vazife var\u2019!<\/strong><\/p>\n<p>Y\u00f6netmelikte kiral\u0131k i\u015f\u00e7ilerin bo\u015fta ge\u00e7en s\u00fcreleri i\u00e7in \u00f6deme yap\u0131lmas\u0131na ili\u015fkin h\u00fck\u00fcm yok. B\u00f6ylece \u00f6zel istihdam b\u00fcrosu kiralayamad\u0131\u011f\u0131 i\u015f\u00e7iye bo\u015fta ge\u00e7en zamanlar i\u00e7in \u00fccret \u00f6demeyecek. Kiral\u0131k i\u015f\u00e7ilerin k\u0131dem tazminat\u0131 haklar\u0131 da belirsizli\u011fini koruyor. E\u015fit i\u015flem ilkesine ili\u015fkin belirsizlik de s\u00fcr\u00fcyor. Kiral\u0131k i\u015f\u00e7iler \u00e7al\u0131\u015ft\u0131klar\u0131 d\u00f6nemde i\u015fyerindeki sadece sosyal hizmetlerden e\u015fit i\u015flem ilkesine g\u00f6re yaralanacaklar. Kiral\u0131k i\u015f\u00e7ilerin yerlerine \u00e7al\u0131\u015ft\u0131klar\u0131 i\u015f\u00e7ilerle e\u015fit \u00fccret almalar\u0131 m\u00fcmk\u00fcn g\u00f6z\u00fckm\u00fcyor.<\/p>\n<p>Y\u00f6netmelikte kiral\u0131k i\u015f\u00e7ilerin sendikal haklar\u0131 konusunda tek d\u00fczenleme, i\u015f s\u00f6zle\u015fmesine sendikaya \u00fcye olup olmama y\u00f6n\u00fcnde bir h\u00fck\u00fcm konulamayaca\u011f\u0131 y\u00f6n\u00fcnde. Bu zaten Anayasa\u2019da ve 6356 say\u0131l\u0131 yasada var olan bir h\u00fck\u00fcm. Kiral\u0131k i\u015f\u00e7ilerin sendikal haklar\u0131n\u0131 kullanmalar\u0131n\u0131n \u00f6n\u00fcnde \u00e7ok daha b\u00fcy\u00fck engeller var. Bu engellerin bir k\u0131sm\u0131 mevzuattaki bo\u015fluktan bir k\u0131sm\u0131 ise \u00e7al\u0131\u015fma bi\u00e7iminin kendisinden kaynaklan\u0131yor.<\/p>\n<p>Kiral\u0131k i\u015f\u00e7ilerin, \u00f6zel istihdam b\u00fcrosunun faaliyet y\u00fcr\u00fctt\u00fc\u011f\u00fc b\u00fcro ve genel i\u015fler i\u015fkolunda kurulu sendikalara \u00fcye olabilece\u011fi anla\u015f\u0131yor.<\/p>\n<p>B\u00f6ylece i\u015f\u00e7iler fiilen \u00e7al\u0131\u015ft\u0131klar\u0131 i\u015fe g\u00f6re de\u011fil, \u00f6zel istihdam b\u00fcrolar\u0131na g\u00f6re \u00f6rg\u00fctlenmeye \u00e7al\u0131\u015facaklar. On binlerce i\u015f\u00e7isi olan ve esnek, da\u011f\u0131n\u0131k, belirsiz ko\u015fullarda faaliyet y\u00fcr\u00fcten b\u00fcrolarda sendikala\u015fmak fiilen imk\u00e2ns\u0131z hale gelecek. Nitekim sendikalar\u0131n g\u00fc\u00e7l\u00fc oldu\u011fu bat\u0131 Avrupa \u00fclkelerinde dahi kiral\u0131k i\u015f\u00e7ilerin sendikala\u015fmas\u0131 y\u00fczde 1-2 mertebesini ge\u00e7miyor. Kiral\u0131k i\u015f\u00e7ilerin toplu pazarl\u0131k ve grev haklar\u0131n\u0131 kullanabilmeleri ise mucize olacak.<\/p>\n<p><strong>E\u011freti, robotik i\u015fg\u00fcc\u00fc<\/strong><\/p>\n<p>Kiral\u0131k i\u015f\u00e7ilik uygulamas\u0131 ile birlikte i\u015fverenler, sadece i\u015f\u00e7ilerin bireysel i\u015f hukukundan do\u011fan haklar\u0131yla u\u011fra\u015fmaktan kurtulmuyor; sendikas\u0131z, toplu s\u00f6zle\u015fmesiz ve grev yapmas\u0131 fiilen m\u00fcmk\u00fcn olmayan yeni bir rezerv i\u015fg\u00fcc\u00fc ordusuna kavu\u015fuyor.<\/p>\n<p>\u0130\u015fletmelerin ta\u015feron i\u015f\u00e7i uygulamas\u0131 yoluyla yard\u0131mc\u0131 i\u015flerin t\u00fcm\u00fcnde ve as\u0131l i\u015fin ise bir b\u00f6l\u00fcm\u00fcnde yo\u011fun olarak ta\u015feron i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 biliniyor. Kiral\u0131k i\u015f\u00e7ilik uygulamas\u0131 ile birlikte i\u015f\u00e7isiz i\u015fletmeler g\u00fcndeme gelmeye ba\u015flayacak. \u015eirketler kadrolu, \u00e7ekirdek i\u015f\u00e7i say\u0131s\u0131n\u0131 en aza indirerek kiral\u0131k ve ta\u015feron i\u015f\u00e7i mekanizmas\u0131yla i\u015f\u00e7ilerin haklar\u0131yla ve talepleriyle u\u011fra\u015fmaktan kurtulmu\u015f olacaklar.<\/p>\n<p>Ta\u015feron i\u015f\u00e7ilerin yan\u0131na kiral\u0131k i\u015f\u00e7iler ekleniyor ve i\u015f\u00e7i s\u0131n\u0131f\u0131n\u0131n ana g\u00f6vdesi i\u00e7in g\u00fcvencesiz, e\u011freti \u00e7al\u0131\u015fma (precarity) temel \u00e7al\u0131\u015fma bi\u00e7imi oluyor. Asl\u0131nda \u201cprekarya\u201d diye yeni bir s\u0131n\u0131f do\u011fmuyor, i\u015f\u00e7i s\u0131n\u0131f\u0131n\u0131n 19. y\u00fczy\u0131ldaki \u00e7al\u0131\u015fma ko\u015fullar\u0131 yeni bi\u00e7imlerde ortaya \u00e7\u0131k\u0131yor.<\/p>\n<p>Bunu yeni bir proleterle\u015fme\/m\u00fclks\u00fczle\u015fme\/g\u00fcvencesizle\u015fme dalgas\u0131 olarak ifade etmek m\u00fcmk\u00fcn.<\/p>\n<p>Bir t\u00fcr robotik i\u015fg\u00fcc\u00fcne kavu\u015fuyor i\u015fverenler. Adeta bir robot kiralar gibi i\u015f\u00e7i kiralayacaklar, sorun olursa yenisiyle de\u011fi\u015ftirecekler. B\u00f6ylece i\u015fverenler talimat verebildikleri ama y\u00fck\u00fcml\u00fc olmad\u0131klar\u0131, muhatap olmad\u0131klar\u0131 bir i\u015f\u00e7i kitlesine kavu\u015fmu\u015f oluyor. Ankara SBF Sosyal Politika Ara\u015ft\u0131rma ve Uygulama Merkezi taraf\u0131ndan d\u00fczenlenen kongrede lisans ve lisans\u00fcst\u00fc \u00f6\u011frenimi g\u00f6ren gen\u00e7ler sosyal politikay\u0131 \u00e7e\u015fitli y\u00f6nleriyle ele alan tebli\u011fler sunacak.<\/p>\n<p>Kongre s\u0131ras\u0131nda bir ba\u015fka geleneksel etkinlik de ger\u00e7ekle\u015fecek. \u00dclkemizde sosyal politika disiplininin \u00f6nc\u00fclerinden olan Prof. Dr. Cahit Talas ad\u0131na 2012 y\u0131l\u0131ndan bu yana doktora ve y\u00fcksek lisans tezlerine Prof. Dr. Cahit Talas Sosyal Politika \u00d6d\u00fcl\u00fc veriliyor.
