Yine Ana Y\u00f6netmeli\u011fi\u2018nde odam\u0131z\u0131n ama\u00e7lar\u0131 kapsam\u0131nda &#8220;Meslek, \u00fclke ve \u00fcye \u00e7\u0131karlar\u0131n\u0131 korumak i\u00e7in resmi makamlar ve \u00f6teki ilgili kurulu\u015flarla i\u015fbirli\u011fi yapmak, \u00f6nerilerde ve giri\u015fimlerde bulunmak, gerekti\u011finde \u00e7al\u0131\u015fma alan\u0131na ili\u015fkin olarak kanuni yollara ba\u015fvurmak&#8221; yer almaktad\u0131r.<\/p>\n<p> EMO, elektrik hizmetinin kamu hizmeti anlay\u0131\u015f\u0131yla planlanmas\u0131,\u00a0 yerli ve yenilenebilir enerji kaynaklar\u0131m\u0131z\u0131n kesintisiz, kaliteli, verimli, ucuz bir \u015fekilde halka sunulmas\u0131 gerekti\u011fini d\u00fc\u015f\u00fcnmektedir. Ne yaz\u0131k ki son 20 y\u0131ll\u0131k d\u00f6nemde elektrik enerjisi alan\u0131nda dayat\u0131lan b\u00f6l\u00fcnme, serbestle\u015ftirme, \u00f6zelle\u015ftirme politikalar\u0131 bu ama\u00e7lar\u0131 ger\u00e7ekle\u015ftirmekten uzak oldu\u011fu gibi tersi sonu\u00e7lara yol a\u00e7maktad\u0131r. Bug\u00fcn elektrik enerjisi alan\u0131, kamunun yat\u0131r\u0131m yapmas\u0131 4628 say\u0131l\u0131 Elektrik Piyasas\u0131 Yasas\u0131\u2018n\u0131n ard\u0131ndan engellendi\u011fi i\u00e7in, tamamen \u00f6zel sekt\u00f6r\u00fcn keyfine b\u0131rak\u0131lm\u0131\u015f, gerekli yat\u0131r\u0131mlar yap\u0131lamam\u0131\u015f, \u00fclkemiz enerji a\u00e7\u0131\u011f\u0131 riskiyle kar\u015f\u0131 kar\u015f\u0131ya b\u0131rak\u0131lm\u0131\u015ft\u0131r. Elektrik enerjisinde ne arz g\u00fcvenli\u011fi ne de fiyat istikrar\u0131 sa\u011flanabilmi\u015ftir. Halk\u0131m\u0131z, elektrik talebinde rekor d\u00fc\u015f\u00fc\u015f\u00fcn ya\u015fand\u0131\u011f\u0131 2009 y\u0131l\u0131nda bile elektrik fiyatlar\u0131na yap\u0131lan zamla kar\u015f\u0131la\u015fm\u0131\u015f, 2010 y\u0131l\u0131nda maliyetlerdeki d\u00fc\u015f\u00fc\u015f nedeniyle yap\u0131lacak indirim ise \u00f6zelle\u015ftirme \u00f6ncesinde al\u0131c\u0131 \u015firketlere kar garantisi sunulabilmesi i\u00e7in bizzat h\u00fck\u00fcmetin yapt\u0131\u011f\u0131 m\u00fcdahale ile engellenmi\u015ftir. T\u00fcm bu s\u00fcre\u00e7ler h\u00fck\u00fcmetin uygulad\u0131\u011f\u0131 enerji politikalar\u0131nda kamu yarar\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a g\u00f6stermektedir.<\/p>\n<p>Bu saptamalar\u0131m\u0131z, temelleri olmayan, ideolojik kabuller de\u011fil, bizzat ya\u015fam i\u00e7erisinde de bug\u00fcn do\u011frulanm\u0131\u015f ger\u00e7ekler olup, Ba\u015fbakan Recep Tayyip Erdo\u011fan\u2018\u0131n a\u00e7\u0131klamalar\u0131na, al\u0131c\u0131 \u015firketlerin deme\u00e7lerine, k\u00f6\u015fe yazarlar\u0131n\u0131n makalelerine dahi yans\u0131m\u0131\u015ft\u0131r. Enerji ve Tabii Kaynaklar Bakan\u0131 ise &#8220;akl\u0131na estik\u00e7e mahkemeye gidenlerle u\u011fra\u015fmam\u0131z laz\u0131m&#8221; a\u00e7\u0131klamas\u0131nda bulunmu\u015ftur. \u0130nsanlar\u0131n, kurumlar\u0131n yarg\u0131ya ba\u015fvurma hakk\u0131n\u0131 engellemeye d\u00f6n\u00fck a\u00e7\u0131klamalar yapan bir Bakan\u2018a, miting meydanlar\u0131nda Dan\u0131\u015ftay\u2018\u0131 yuhalatt\u0131ran bir Ba\u015fbakan\u2018a sahip siyasal iktidar\u0131n anayasa de\u011fi\u015fikli\u011fi giri\u015fimi de demokratik de\u011fil, tam tersine antidemokratik bir ad\u0131m olarak ortaya \u00e7\u0131km\u0131\u015ft\u0131r.<\/p>\n<p>Siyasal iktidar\u0131n yanda\u015f medyas\u0131 da kervana kat\u0131lm\u0131\u015f, EMO\u2018yu 4 da\u011f\u0131t\u0131m b\u00f6lgesinin ihalesine dava a\u00e7aca\u011f\u0131na ili\u015fkin a\u00e7\u0131klamas\u0131 nedeniyle Sabah ve Takvim gazetelerinin d\u00fcnk\u00fc (12.08.2010) &#8220;Elektrikte Oda Ter\u00f6r\u00fc&#8221;, &#8220;Odadan Tehdit&#8221; ba\u015fl\u0131klar\u0131yla man\u015fetinden hedef g\u00f6stermeye kalkm\u0131\u015ft\u0131r. Elektrik M\u00fchendisleri Odas\u0131, kamu yarar\u0131na ayk\u0131r\u0131 oldu\u011funu d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc konularla ilgili, \u00f6ncelikle \u00e7e\u015fitli y\u00f6ntemlerle kamuoyunu ayd\u0131nlatmaya \u00e7al\u0131\u015fmakta, ikinci a\u015famada da s\u00fcre\u00e7leri yarg\u0131ya ta\u015f\u0131yarak, i\u015flemlerin idari yarg\u0131n\u0131n denetiminden ge\u00e7mesini sa\u011flamaya \u00e7al\u0131\u015fmaktad\u0131r. EMO bug\u00fcne kadar yap\u0131lan 12 da\u011f\u0131t\u0131m \u00f6zelle\u015ftirmesine ili\u015fkin olarak da dava a\u00e7m\u0131\u015f olup; bu davalar farkl\u0131 a\u015famalarda bulunmakla birlikte yarg\u0131 s\u00fcreci devam etmektedir. Son yap\u0131lan 4 da\u011f\u0131t\u0131m b\u00f6lgesi ihalesini de hukuki incelemelerin tamamlanmas\u0131n\u0131n ard\u0131ndan yarg\u0131ya ta\u015f\u0131yacakt\u0131r. \u0130darenin her t\u00fcrl\u00fc i\u015flem ve eylemi yarg\u0131 denetimine a\u00e7\u0131kt\u0131r. Bu kapsamda, \u00f6zelle\u015ftirme i\u015flemlerinin de yarg\u0131ya ta\u015f\u0131nmas\u0131 do\u011fal, yasal bir s\u00fcre\u00e7tir. B\u00f6yle bir s\u00fcrecin &#8220;tehdit&#8221;, &#8220;ter\u00f6r&#8221; gibi nitelendirmelerle tan\u0131mlanmas\u0131 en hafif deyimiyle hukuk devletine kar\u015f\u0131 bir tav\u0131r olarak a\u00e7\u0131klanabilir. EMO, kimseyi tehdit etmemekte, sadece Anayasa ve yasalardan ald\u0131\u011f\u0131 yetki ve sorumlulukla, yarg\u0131ya ba\u015fvuraca\u011f\u0131n\u0131 a\u00e7\u0131klamaktad\u0131r. Odam\u0131z, yaln\u0131zca siyasi iktidarlar\u0131n yanl\u0131\u015f tercihleri dolay\u0131s\u0131yla s\u00fcrekli faturas\u0131 kabaran vatanda\u015f\u0131n hakk\u0131n\u0131 savunmaktad\u0131r. Yarg\u0131ya ba\u015fvuraca\u011f\u0131n\u0131 a\u00e7\u0131klayan bir meslek \u00f6rg\u00fct\u00fcn\u00fcn, &#8220;tehdit&#8221; ve &#8220;ter\u00f6r&#8221; gibi kavramlarla sindirilmeye \u00e7al\u0131\u015f\u0131lmas\u0131, bir ad\u0131m \u00f6tesinde, ba\u015fvuruyu de\u011ferlendirecek mahkemeleri de bask\u0131 alt\u0131na alma \u00e7abas\u0131d\u0131r. Haberin i\u00e7eri\u011fine bak\u0131ld\u0131\u011f\u0131nda, Ba\u015fbakan\u2018\u0131n a\u00e7\u0131klamalar\u0131ndan derlenen kutu haberle &#8220;Dan\u0131\u015ftay\u2018\u0131n \u00fclkeye faturas\u0131 2.6 milyar dolar&#8221; ba\u015fl\u0131\u011f\u0131yla Dan\u0131\u015ftay\u2018\u0131n da hedef al\u0131nd\u0131\u011f\u0131 a\u00e7\u0131k\u00e7a g\u00f6r\u00fclebilecektir.<\/p>\n<p>Bu haberin do\u011fru okunmas\u0131 i\u00e7in yurtta\u015flar\u0131m\u0131z\u0131n bilmesi gereken ger\u00e7eklerin alt\u0131n\u0131 \u00e7izmek zorunday\u0131z. S\u00f6z konusu iki gazetenin sahibi \u00c7al\u0131k Grubu olup, EMO\u2018nun dava a\u00e7t\u0131\u011f\u0131 ihalelerin kat\u0131l\u0131mc\u0131s\u0131, Ye\u015fil\u0131rmak Elektrik Da\u011f\u0131t\u0131m A.\u015e\u2018nin al\u0131c\u0131s\u0131 konumundad\u0131r. Dolay\u0131s\u0131yla kamunun haber alma \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc temsil etmesi gereken ve bu anlamda kamu yarar\u0131 do\u011frultusunda haber yapmas\u0131 beklenen bir bas\u0131n kurulu\u015funun dar bir \u00e7\u0131kar grubu olan \u015firket taraf\u0131n\u0131 temsil etti\u011fi a\u00e7\u0131kt\u0131r. Bu bas\u0131n kurulu\u015fu ile siyasal iktidar aras\u0131ndaki ve siyasal iktidar\u0131n bug\u00fcn en \u00f6nemli g\u00fcndem maddesi olan anayasa de\u011fi\u015fikli\u011fi paketi aras\u0131ndaki girift ili\u015fki ise yurtta\u015flar taraf\u0131ndan iyi de\u011ferlendirilmelidir. Bu medya kurulu\u015funun sahibi olan \u015firketin Genel M\u00fcd\u00fcr\u00fc Ba\u015fbakan Recep Tayyip Erdo\u011fan\u2018\u0131n damad\u0131d\u0131r. AKP H\u00fck\u00fcmeti, Anayasa de\u011fi\u015fikli\u011fi ile Dan\u0131\u015ftay\u2018\u0131n kamu yarar\u0131 kapsam\u0131nda siyasal iktidar\u0131n i\u015flemlerine y\u00f6nelik hukuki denetim yetkisine m\u00fcdahale etmek istemektedir. 1990\u2018lar\u0131n sonunda yap\u0131lan elektrik da\u011f\u0131t\u0131m ihalelerinde medya kurulu\u015flar\u0131n\u0131n kamu ihalelerine giri\u015fi yasak oldu\u011fu i\u00e7in EMO\u2018nun a\u00e7t\u0131\u011f\u0131 davalarda ihale iptalleri ger\u00e7ekle\u015fmi\u015fti. Bu t\u00fcr kamu yarar\u0131n\u0131 korumaya d\u00f6n\u00fck d\u00fczenlemeler ne yaz\u0131k ki neoliberal politikalar do\u011frultusunda son 20 y\u0131l i\u00e7erisinde t\u0131rpanlanm\u0131\u015f, Anayasam\u0131z da bu anlamda uluslararas\u0131 tahkim gibi d\u00fczenlemelerle daha da geriye g\u00f6t\u00fcr\u00fclm\u00fc\u015ft\u00fcr. \u015eimdi g\u00fcndeme getirilen Anayasa de\u011fi\u015fikli\u011fi paketi de bu anlamda demokratik bir hukuk devleti i\u00e7in at\u0131lan ad\u0131mlar\u0131 i\u00e7ermemekte, tersine yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ve tarafs\u0131zl\u0131\u011f\u0131n\u0131 olumsuz etkileyecek d\u00fczenlemelerin \u00fczerine oturmaktad\u0131r.<\/p>\n<p>Kamu yarar\u0131na enerji politikalar\u0131n\u0131n uygulanmas\u0131n\u0131 talep etti\u011fi, bunun i\u00e7in partilerin dar \u00e7\u0131kar anlay\u0131\u015flar\u0131ndan uzak kamunun \u00f6zerk yap\u0131lanmas\u0131 i\u00e7erisinde elektrik hizmetinin sunulmas\u0131n\u0131 istedi\u011fi i\u00e7in EMO\u2018nun bask\u0131 alt\u0131na al\u0131nmaya \u00e7al\u0131\u015f\u0131lmas\u0131 demokrasi anlay\u0131\u015f\u0131yla ba\u011fda\u015fmamaktad\u0131r. Ki\u015fi ve kurumlar\u0131n iktidar\u0131n ekonomik modelini ve uygulamalar\u0131n\u0131 onaylamak i\u00e7in zorlanmas\u0131, hatta daha da ileri gidilerek hedef g\u00f6sterilmesi, tehdit edilmesi kabul edilemez. Bug\u00fcne kadar EMO, \u00f6zelle\u015ftirme gibi enerji alan\u0131na y\u00f6nelik uygulamalar hakk\u0131nda \u00e7e\u015fitli siyasal iktidarlar d\u00f6neminde de yarg\u0131 yoluna ba\u015fvurmu\u015f, \u015fimdiye kadar hi\u00e7bir d\u00f6nemde hukuki yollara ba\u015fvurdu\u011fu i\u00e7in &#8220;ter\u00f6rist&#8221; ilan edilmemi\u015ftir. Ayn\u0131 gazeteler bug\u00fcnk\u00fc say\u0131lar\u0131nda &#8220;Hasan Bal\u0131k\u00e7\u0131 niye \u00f6ld\u00fc&#8221;, &#8220;Oda ter\u00f6r\u00fcne b\u00fcy\u00fck tepki&#8221;, &#8220;\u00d6zelle\u015ftirmelere yarg\u0131 engeli yetki alan\u0131 tart\u0131\u015fmas\u0131 ba\u015flatt\u0131&#8221; ba\u015fl\u0131klar\u0131 alt\u0131nda sunduklar\u0131 haberlerde EMO\u2018yu ve \u00f6zelle\u015ftirme kar\u015f\u0131t\u0131 m\u00fccadele y\u00fcr\u00fctenleri karalamaya devam etmektedir. Hasan Bal\u0131k\u00e7\u0131, kay\u0131p-ka\u00e7ak elektrik kullan\u0131m\u0131na kar\u015f\u0131 verdi\u011fi m\u00fccadelede hain bir sald\u0131r\u0131 sonucu ya\u015fam\u0131n\u0131 yitirmi\u015f bir \u00fcyemiz ve EMO y\u00f6neticilerimizdendir. Gazete, &#8220;Bal\u0131k\u00e7\u0131\u2018n\u0131n ya\u015farken \u00fcyesi oldu\u011fu EMO ise \u015fimdi elektrik \u00f6zelle\u015ftirmelerinde kamu yarar\u0131 yok diye iptal davas\u0131 a\u00e7\u0131yor. Merak ediyoruz EMO hangi kamunun yarar\u0131n\u0131n pe\u015finde?&#8221; diye soruyor. Gazetenin bilmedi\u011fi, bilse de kendi \u00e7\u0131karlar\u0131 do\u011frultusunda yok sayd\u0131\u011f\u0131 ger\u00e7ek \u015fudur ki, Hasan Bal\u0131k\u00e7\u0131 \u00f6zelle\u015ftirmelere kar\u015f\u0131 da m\u00fccadele etmi\u015f, \u00c7EA\u015e \u00f6zelle\u015ftirmesine kar\u015f\u0131 bizzat ki\u015fisel olarak kendisi dava a\u00e7m\u0131\u015ft\u0131r. EMO y\u0131llarca Bal\u0131k\u00e7\u0131 ile birlikte m\u00fccadele etmi\u015f, Bal\u0131k\u00e7\u0131\u2018n\u0131n katledilmesinin ard\u0131ndan da dava s\u00fcrecinin her a\u015famas\u0131nda takip\u00e7isi olmu\u015f, bug\u00fcn de Bal\u0131k\u00e7\u0131\u2018n\u0131n m\u00fccadelesinin ayd\u0131nlatt\u0131\u011f\u0131 yol da EMO g\u00f6revini yapmaya devam etmektedir.\u00a0 Kay\u0131p ve ka\u00e7aklarla m\u00fccadelenin yolu \u00f6zelle\u015ftirmelerden de\u011fil, kamusal bilin\u00e7 ve toplumsal politikalar\u0131n yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131ndan ge\u00e7mektedir. Yine ayn\u0131 gazetelerde &#8220;\u0130\u015f D\u00fcnyas\u0131ndan EMO\u2018ya Sert Tepki&#8221; ba\u015fl\u0131\u011f\u0131 alt\u0131nda verilen haber, s\u00f6z konusu ihalelerin al\u0131c\u0131s\u0131 konumundaki \u015firketlerin g\u00f6r\u00fc\u015flerinden olu\u015fturulmu\u015ftur. Bu durumu da gazetecilik eti\u011fi a\u00e7\u0131s\u0131ndan sorgulamaya b\u0131rak\u0131yoruz. T\u00fcm bu bask\u0131lara kar\u015f\u0131 EMO do\u011fru bildi\u011fi yoldan d\u00f6nmeyecek, kamu yarar\u0131 \u00f6nceli\u011fi do\u011frultusunda da\u011f\u0131t\u0131m \u00f6zelle\u015ftirilmelerinin de hukuk s\u00fczgecinden ge\u00e7mesi m\u00fccadelesini s\u00fcrd\u00fcrecektir.<\/p>\n<p>Anayasa de\u011fi\u015fikli\u011fi paketinin &#8220;EMO olarak kamu yarar\u0131 a\u00e7\u0131s\u0131ndan yarg\u0131 \u00f6n\u00fcne ta\u015f\u0131d\u0131\u011f\u0131m\u0131z pek \u00e7ok idari i\u015flemin iptali ile sonu\u00e7lanan s\u00fcre\u00e7lere y\u00f6nelik olarak yarg\u0131 yetkisini k\u0131s\u0131tlamaya d\u00f6n\u00fck bir m\u00fcdahale i\u00e7erdi\u011fini&#8221; saptam\u0131\u015f bulunuyoruz. Bu durum EMO olarak anayasa de\u011fi\u015fiklik paketini ayr\u0131nt\u0131l\u0131 olarak incelememiz zorunlulu\u011funu yaratm\u0131\u015ft\u0131r. Bu incelememizi &#8220;Kontrols\u00fcz G\u00fc\u00e7 Aray\u0131\u015f\u0131nda \u0130ktidar\u0131n Halk Oyunu&#8221; ba\u015fl\u0131\u011f\u0131yla haz\u0131rlad\u0131\u011f\u0131m\u0131z kitap\u00e7\u0131k arac\u0131l\u0131\u011f\u0131yla kamuoyu ile payla\u015f\u0131yoruz. Anayasa de\u011fi\u015fiklik paketine ili\u015fkin olarak temel tespitlerimizi \u015f\u00f6yle s\u0131ralayabiliriz:<\/p>\n<p>\u2022-Anayasa\u2018n\u0131n 125. maddesinde yap\u0131lmak istenen de\u011fi\u015fiklikle yarg\u0131 yetkisinin yerindelik denetimi \u015feklinde kullan\u0131lamayaca\u011f\u0131 Anayasa\u2018ya eklenmektedir. Oysa ki mevcut Anayasal d\u00fczenleme de yarg\u0131n\u0131n hukuka uygunluk denetiminin s\u0131n\u0131rlar\u0131n\u0131 \u00e7izerek, yerindelik denetimi yap\u0131lmas\u0131na izin vermemekte, hatta mevcut \u0130dari Yarg\u0131lama Usul Kanunu\u2018nda a\u00e7\u0131k\u00e7a yerindelik denetimi yasaklanm\u0131\u015f bulunmaktad\u0131r. Yarg\u0131n\u0131n yetki s\u0131n\u0131rlar\u0131n\u0131n d\u0131\u015f\u0131na ta\u015ft\u0131\u011f\u0131 ele\u015ftirileri kadar denetim yetkisini idare lehine kulland\u0131\u011f\u0131 ele\u015ftirileri de yap\u0131lmaktad\u0131r. Burada yerindelik bahanesi ile yarg\u0131n\u0131n hukuka uygunluk denetimi s\u0131n\u0131rland\u0131r\u0131lmak istenmektedir. D\u00fczenlemenin gerek\u00e7esi de, AKP\u2018nin bas\u0131n a\u00e7\u0131klamalar\u0131 ve miting meydanlar\u0131ndaki konu\u015fmalar da ger\u00e7ek amac\u0131 ortaya koymu\u015ftur. AKP\u2018nin 25 Nisan 2010 tarihli bilgilendirme notunda &#8220;Kamu yarar\u0131 gibi subjektif bir kavramla bir\u00e7ok \u00f6zelle\u015ftirme karar\u0131 iptal edilmi\u015f, k\u00fcresel sermayenin T\u00fcrkiye\u2018de yat\u0131r\u0131m yapmas\u0131 ile ilgili bir\u00e7ok zorluk \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r&#8221; denilmektedir. Bir i\u015flemin kamu yarar\u0131na uygun olup olmad\u0131\u011f\u0131n\u0131n denetlenmesi yerindelik denetimi de\u011fil, hukuka uygunluk denetimidir ve idare hukukunun do\u011fdu\u011fu g\u00fcnden bu yana uygulanmaktad\u0131r. Kamu yarar\u0131n\u0131n &#8220;subjektif&#8221; bir kavram oldu\u011funu ileri s\u00fcren AKP\u2018nin, \u00fclkeyi y\u00f6netirken yapt\u0131\u011f\u0131 i\u015flemleri hangi kavramlara dayand\u0131rarak ger\u00e7ekle\u015ftirdi\u011fi merak konusudur.<\/p>\n<p>\u2022-\u00dclkede \u00fcretime y\u00f6nelik hi\u00e7bir yat\u0131r\u0131m yap\u0131lmadan, kamunun elinde bulunan ve yurtta\u015flar\u0131n ortak ihtiya\u00e7lar\u0131n\u0131n sa\u011flanmas\u0131na y\u00f6nelik kamu hizmetleri piyasaya a\u00e7\u0131l\u0131rken, kamu yarar\u0131 kavram\u0131 da ortadan kald\u0131r\u0131lmaktad\u0131r. Art\u0131k &#8220;\u00f6zel \u00e7\u0131karlar&#8221;, &#8220;sermaye gruplar\u0131n\u0131n \u00e7\u0131karlar\u0131&#8221;, &#8220;iktidardakilerin \u00e7\u0131karlar\u0131&#8221; \u00f6n plana al\u0131nmaktad\u0131r. &#8220;Kamu yarar\u0131&#8221; kavram\u0131 istenmeyen bir kavram haline getirilmi\u015f, siyasi iktidar\u0131n hizmet \u00f6l\u00e7\u00fctleri aras\u0131ndan \u00e7\u0131kart\u0131lm\u0131\u015ft\u0131r. Ayn\u0131 \u015fekilde yarg\u0131 organlar\u0131n\u0131n da bu \u00f6l\u00e7\u00fcte bakmamas\u0131 talep edilmeye ba\u015flanm\u0131\u015ft\u0131r. \u015eimdi de yarg\u0131 \u00fczerinde bu y\u00f6nde kurulan bask\u0131 Anayasa h\u00fckm\u00fc haline getirilmek istenmektedir.<\/p>\n<p>\u2022-Tarihsel bir perspektif i\u00e7erisinde bak\u0131ld\u0131\u011f\u0131nda darbe d\u00f6nemlerinin anayasalar\u0131ndan daha da \u00f6teye gidilmek suretiyle, idari yarg\u0131 prati\u011fine m\u00fcdahale anlam\u0131n\u0131 ta\u015f\u0131yan bir h\u00fck\u00fcmle y\u00fcr\u00fctme organ\u0131n\u0131n yarg\u0131sal denetimi daha da s\u0131n\u0131rland\u0131r\u0131lmaktad\u0131r. 12 Mart Askeri Muht\u0131ras\u0131\u2018n\u0131n ard\u0131ndan 1961 Anayasas\u0131\u2018ndaki idarenin eylem ve i\u015flemlerine y\u00f6nelik yarg\u0131sal denetim, y\u00fcr\u00fctme g\u00f6revini s\u0131n\u0131rlayacak tarzda kullan\u0131lamayaca\u011f\u0131 y\u00f6n\u00fcnde daralt\u0131lm\u0131\u015ft\u0131r. 1982 Anayasas\u0131 ile de idarenin takdir yetkisini kald\u0131racak \u015fekilde yarg\u0131 karar\u0131 verilemeyece\u011fi h\u00fckm\u00fc getirilmi\u015f, Cumhurba\u015fkan\u0131 ve Y\u00fcksek Askeri \u015eura (YA\u015e) kararlar\u0131 yarg\u0131 denetimi d\u0131\u015f\u0131nda b\u0131rak\u0131lm\u0131\u015ft\u0131r. 1999 y\u0131l\u0131nda yap\u0131lan Anayasa de\u011fi\u015fikli\u011fi ile imtiyaz anla\u015fma ve s\u00f6zle\u015fmeleri \u00fczerinde Dan\u0131\u015ftay\u2018\u0131n inceleme yetkisi kald\u0131r\u0131lm\u0131\u015f, bu yetki g\u00f6r\u00fc\u015f bildirme d\u00fczeyine indirgenmi\u015f, kamu hizmetleri ile ilgili imtiyaz \u015fartla\u015fma ve s\u00f6zle\u015fmelerindeki uyu\u015fmazl\u0131klar i\u00e7in uluslararas\u0131 tahkim yolu a\u00e7\u0131lm\u0131\u015ft\u0131r. Referanduma sunulan Anayasa de\u011fi\u015fiklik paketinde ise YA\u015e\u2018\u0131n yaln\u0131zca disiplinsizlik ya da irticai davran\u0131\u015flar\u0131ndan dolayl\u0131 ili\u015fi\u011fi kesilen askeri personel ile ilgili kararlar\u0131 i\u00e7in yarg\u0131 yolu a\u00e7\u0131lmakta, di\u011fer kararlar\u0131 i\u00e7in yarg\u0131sal denetim yasa\u011f\u0131 s\u00fcrmektedir. Cumhurba\u015fkan\u0131\u2018n\u0131n tek ba\u015f\u0131na yapaca\u011f\u0131 i\u015flemler i\u00e7in de yarg\u0131 yolu kapal\u0131 tutulmaya devam edilmektedir.<\/p>\n<p>\u2022-Ba\u015fbakan\u2018\u0131n miting meydanlar\u0131nda referanduma evet oyu isterken Telekom\u2018un \u00f6zelle\u015ftirilmesine ili\u015fkin verdi\u011fi \u00f6rnek ise ger\u00e7eklerin \u00e7arp\u0131t\u0131lmas\u0131ndan ibarettir. AKP, y\u0131llar i\u00e7inde T\u00fcrk Telekom\u2018un de\u011ferinin d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc ve \u00f6zelle\u015ftirilmesine y\u00f6nelik engellemeler nedeniyle T\u00fcrkiye\u2018nin zarar etti\u011fini iddia etmektedir. T\u00fcrk Telekom\u2018un ihalesinden 10 g\u00fcn \u00f6nce y\u00fczde 26 oran\u0131ndaki hissesi \u00f6zelle\u015ftirilen Pakistan Telekom\u2018un y\u00fczde 100 hissesi 10 milyar dolara tekab\u00fcl edecek \u015fekilde sat\u0131lm\u0131\u015ft\u0131r. Pakistan Telekom, T\u00fcrk Telekom\u2018un d\u00f6rtte biri b\u00fcy\u00fckl\u00fc\u011f\u00fcnde bir \u015firkettir. Bu k\u0131yaslama bile T\u00fcrk Telekom\u2018un \u00f6zelle\u015ftirildi\u011fi tarihteki piyasa de\u011ferinin 40 milyar dolar seviyelerinde oldu\u011funu g\u00f6stermektedir. AKP H\u00fck\u00fcmeti bizzat kendi eliyle belirledi\u011fi de\u011fer tespiti nedeniyle, T\u00fcrkiye\u2018nin 15-20 milyar dolar zarar etmesine neden olmu\u015ftur. Kamu hizmeti imtiyaz s\u00f6zle\u015fmelerine konulan tahkim ko\u015fullar\u0131 nedeniyle T\u00fcrkiye y\u00fcz milyonlarca dolar tazminata mahkum olmu\u015f ve milyar dolarlara ula\u015fan y\u00fcksek mebla\u011flar i\u00e7eren bir \u00e7ok tahkim davas\u0131 da halen devam etmektedir. E\u011fer ger\u00e7ekten ekonomik kay\u0131plar g\u00f6z \u00f6n\u00fcne al\u0131nm\u0131\u015f olsayd\u0131, bug\u00fcn referanduma g\u00f6t\u00fcr\u00fclen Anayasa paketi i\u00e7erisinde, 1999 y\u0131l\u0131nda eklenen tahkimle ilgili d\u00fczenlemelerin iptali s\u00f6z konusu olurdu.<\/p>\n<p>\u2022-Gerek EMO olarak a\u00e7t\u0131\u011f\u0131m\u0131z gerekse ba\u015fkaca demokratik kitle \u00f6rg\u00fctleri taraf\u0131ndan siyasi iktidarlar\u0131n keyfi \u00f6zelle\u015ftirme i\u015flemlerine kar\u015f\u0131 a\u00e7\u0131lan davalarla, b\u00fcy\u00fck miktarlarda kamu zarar\u0131n\u0131n \u00f6nlenmesi s\u00f6z konusu olmu\u015ftur. \u00d6rne\u011fin T\u00fcrk Telekom\u2018un GSM i\u015fletmecisi \u015firketlerle imzalam\u0131\u015f oldu\u011fu araba\u011flant\u0131 anla\u015fmas\u0131 EMO taraf\u0131ndan yarg\u0131 \u00f6n\u00fcne g\u00f6t\u00fcr\u00fclerek, AKP\u2018nin ho\u015funa gitmedi\u011fi anla\u015f\u0131lan kamu yarar\u0131 gerek\u00e7esiyle iptali sa\u011flanm\u0131\u015ft\u0131r. GSM i\u015fletmecisi \u015firketlerden EMO\u2018nun a\u00e7t\u0131\u011f\u0131 dava sonucunda faiziyle birlikte yakla\u015f\u0131k 3.5 katrilyon lira (eski para birimi ile) 2004 y\u0131l\u0131nda Hazine\u2018ye aktar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u2022-Yarg\u0131 kararlar\u0131, AKP\u2018nin iddia etti\u011finin tersine \u00f6rneklerle doludur. \u00d6rne\u011fin T\u00dcPRA\u015e \u00f6zelle\u015ftirmesinde Petrol \u0130\u015f Sendikas\u0131\u2018n\u0131n a\u00e7t\u0131\u011f\u0131 dava \u00fczerine Dan\u0131\u015ftay\u2018\u0131n iptal etti\u011fi ihalede y\u00fczde 66\u2018s\u0131 i\u00e7in 1.3 milyar dolar verilen T\u00dcPRA\u015e\u2018\u0131n y\u00fczde 51 hissesi i\u00e7in 8 ay sonra yap\u0131lan ihalede 4 milyar 140 milyon dolar fiyat verilmi\u015ftir. Dolay\u0131s\u0131yla Dan\u0131\u015ftay\u2018\u0131n \u00f6zelle\u015ftirme i\u015flemlerini hukuka ve kamu yarar\u0131na uygun yap\u0131lmad\u0131\u011f\u0131 i\u00e7in iptal etmesiyle zarara neden oldu\u011fu iddias\u0131 ger\u00e7eklikle ba\u011fda\u015fmamaktad\u0131r. Kald\u0131 ki ortada ekonomik bir zarar varsa bu zarar\u0131n sorumlusu da hukuki denetim yapan yarg\u0131 de\u011fil, hukuka ve kamu yarar\u0131na ayk\u0131r\u0131 i\u015flem yapan ilgili idarelerdir. Ayr\u0131ca kamu yarar\u0131, iktidar\u0131n alg\u0131lad\u0131\u011f\u0131 gibi yaln\u0131zca ekonomik getiri ile \u00f6l\u00e7\u00fclecek bir kavrama da indirgenemez. AKP H\u00fck\u00fcmeti, kendi hukuksuz i\u015flemlerinin sorumlulu\u011funu yarg\u0131ya y\u0131kmakta, yarg\u0131sal denetimin \u00f6n\u00fcn\u00fc keserek, iddia ettikleri gibi &#8220;milletin egemenli\u011fini&#8221; de\u011fil, kendi keyfi y\u00f6netimini egemen k\u0131lmak istemektedir.<\/p>\n<p>Temel de\u011ferlendirmelerimizi burada sizinle payla\u015fmakla birlikte kitap\u00e7\u0131\u011f\u0131m\u0131zda Anayasa paketinin t\u00fcm d\u00fczenlemeleri tek tek ele al\u0131narak b\u00fct\u00fcnc\u00fcl bir de\u011ferlendirme yap\u0131lmaya \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Anayasa de\u011fi\u015fikleri bir b\u00fct\u00fcn olarak ele al\u0131nd\u0131\u011f\u0131nda, \u00f6ncelikli olarak yarg\u0131n\u0131n hedef al\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Demokratik i\u015fleyi\u015fin temeli olan kuvvetler ayr\u0131m\u0131 ilkesine m\u00fcdahale anlam\u0131na gelen bu de\u011fi\u015fiklikler ile iktidar\u0131n kontrols\u00fcz bir g\u00fc\u00e7 aray\u0131\u015f\u0131nda oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Temel hak ve \u00f6zg\u00fcrl\u00fcklerin \u00f6ncelikli olarak g\u00fcvencesi hukuk devleti ilkesidir.<\/p>\n<p>Yarg\u0131ya y\u00f6nelik d\u00fczenlemeler d\u0131\u015f\u0131ndaki anayasa de\u011fi\u015fikli\u011fi paketinde yer alan di\u011fer h\u00fck\u00fcmler ise mevcut haklar\u0131n bile g\u00fcvence i\u00e7erisinde ya\u015famda yer bulamad\u0131\u011f\u0131 bir ortamda anlaml\u0131 olamamaktad\u0131r. TBMM\u2018de grubu bulunan partilerin itiraz etmedi\u011fi, simgesel de olsa iyile\u015ftirmeler sa\u011flayan de\u011fi\u015fikliklerin \u00e7o\u011fu zaten uygulamada olan veya yasalarla g\u00fcvence alt\u0131na al\u0131nmas\u0131 gereken temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkindir. Bu nedenle ileri ad\u0131mlar olarak nitelendirilen bu maddelerin b\u00fcy\u00fck k\u0131sm\u0131n\u0131n Anayasa\u2018ya i\u015flenmesi reform olarak de\u011ferlendirilemez. Anayasa paketine bu maddeler dolay\u0131s\u0131yla &#8220;evet&#8221; oyu verilmesi ise yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 etkileyen ve iktidarlar\u0131n faaliyetlerinin denetlenememesine yol a\u00e7acak de\u011fi\u015fikleri de hayata ge\u00e7irecektir. Bu durum ise getirilen olumlu d\u00fczenlemelerin ya\u015fam i\u00e7erisinde yer bulabilmesi \u00f6n\u00fcnde ba\u015fl\u0131 ba\u015f\u0131na bir engel olu\u015fturmaktad\u0131r. Dolay\u0131s\u0131yla b\u0131rak\u0131n verilen haklar\u0131n g\u00fcvence alt\u0131na al\u0131nmas\u0131n\u0131, mevcut haklar\u0131n g\u00fcvencesini olu\u015fturan hukuk devleti \u00fczerinde ciddi bir tahribata yol a\u00e7acak, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 daha da olumsuz noktalara g\u00f6t\u00fcrecek olan bu anayasa de\u011fi\u015fiklik paketine &#8220;evet&#8221; denilmesi m\u00fcmk\u00fcn de\u011fildir. 12 Eyl\u00fcl darbesinin yaratmaya \u00e7al\u0131\u015ft\u0131\u011f\u0131 &#8220;denetlenemeyen, sorgulanamayan iktidar&#8221; kavram\u0131na kar\u015f\u0131 bug\u00fcne kadar y\u00fcr\u00fct\u00fclen m\u00fccadelenin sona erdi\u011fini tescilleyecek olan bu de\u011fi\u015fiklikleri reddetmek, t\u00fcm yurtta\u015flar\u0131n birincil g\u00f6revidir.
