{"id":23490,"date":"2016-11-30T11:05:22","date_gmt":"2016-11-30T08:05:22","guid":{"rendered":"http:\/\/politeknik.org.tr\/\/?p=23490"},"modified":"2019-01-28T20:40:23","modified_gmt":"2019-01-28T17:40:23","slug":"iscilikten-kolelige-donus-murat-ozveri-evrensel","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/iscilikten-kolelige-donus-murat-ozveri-evrensel\/","title":{"rendered":"\u0130\u015f\u00e7ilikten k\u00f6leli\u011fe d\u00f6n\u00fc\u015f &#8211; Murat \u00d6zveri (Evrensel)"},"content":{"rendered":"<p>Hukuken i\u015f\u00e7iyle k\u00f6lenin fark\u0131, i\u015f\u00e7inin hak sahibi olmas\u0131yla a\u00e7\u0131klan\u0131r.<\/p>\n<p>K\u00f6le ile k\u00f6le sahibi aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 hak ve bor\u00e7lara dayal\u0131 bir hukuki ili\u015fki bulunmaz. \u0130\u015f\u00e7i ile i\u015fveren aras\u0131nda ise kar\u015f\u0131l\u0131kl\u0131 haklar ve bor\u00e7lar vard\u0131r. i\u015f s\u00f6zle\u015fmesi hem i\u015f\u00e7iye hem i\u015fverene bor\u00e7 y\u00fckleyen iki tarafl\u0131 s\u00f6zle\u015fmedir.<\/p>\n<p>\u0130\u015f s\u00f6zle\u015fmesinde i\u015f\u00e7inin temel borcu i\u015f g\u00f6rmektir. \u0130\u015f\u00e7inin bu borcuna i\u015f g\u00f6rme edimi denilir. \u0130\u015f\u00e7i i\u015f g\u00f6rme edimini yerine getirirken \u201cy\u00fcklendi\u011fi i\u015fi \u00f6zenle yapmak ve i\u015fverenin hakl\u0131 menfaatlerinin korunmas\u0131nda sadakatle davranmak zorundad\u0131r\u201d (T\u00fcrk Bor\u00e7lar Yasas\u0131  madde 396).<\/p>\n<p>\u0130\u015fveren ise s\u00f6zle\u015fmesi ile i\u015f\u00e7iye \u00fccret \u00f6deme borcu alt\u0131na girer. \u0130\u015fverenin i\u015f\u00e7iye i\u015f kar\u015f\u0131l\u0131\u011f\u0131 \u00f6demek zorunda oldu\u011fu \u00fccret bir l\u00fctuf de\u011fil, bor\u00e7tur. \u0130\u015f\u00e7i a\u00e7\u0131s\u0131ndan ise hakt\u0131r.<\/p>\n<p>\u0130\u015fverenin i\u015f s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 sadece \u00fccret \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ile s\u0131n\u0131rl\u0131 de\u011fildir. \u0130\u015fveren i\u015f\u00e7inin yasayla belirlenmi\u015f \u00e7al\u0131\u015fma s\u00fcrelerine sayg\u0131 g\u00f6stermek zorundad\u0131r. Bu nedenle i\u015fveren i\u015f\u00e7inin r\u0131zas\u0131 olmadan haftada 45 saatten fazla \u00e7al\u0131\u015fmaya i\u015f\u00e7iyi zorlayamaz. \u0130\u015fveren sadece g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcrelerine de\u011fil ayn\u0131 zamanda i\u015f g\u00fcn\u00fcn\u00fcn ortas\u0131nda, i\u015f g\u00fcn\u00fcn\u00fcn uzunlu\u011funa g\u00f6re belirlenen ara dinlenmelerine, hafta tatillerine, y\u0131ll\u0131k izin haklar\u0131na da sayg\u0131l\u0131 olmak i\u015f\u00e7ilere bu haklar\u0131 kulland\u0131rmak zorundad\u0131r.<br \/>\n\u0130\u015f\u00e7inin ara dinlenmeleri, hafta tatilleri, y\u0131ll\u0131k izinleri i\u015f\u00e7i a\u00e7\u0131s\u0131ndan hak, i\u015fveren a\u00e7\u0131s\u0131ndan da bor\u00e7tur.<\/p>\n<p>\u0130\u015fverenin bor\u00e7lar\u0131 sadece \u00fccret, \u00e7al\u0131\u015fma s\u00fcrelerine uyma, i\u015f\u00e7inin dinlenme hakk\u0131na sayg\u0131 g\u00f6stermeyle de s\u0131n\u0131rl\u0131 de\u011fildir. \u0130\u015fveren ayn\u0131 zamanda i\u015f\u00e7iyi \u00e7al\u0131\u015ft\u0131r\u0131rken i\u015f\u00e7inin ki\u015fili\u011fini korumak, ki\u015fili\u011fine sayg\u0131 g\u00f6stermek, i\u015f\u00e7ilerin psikolojik ve cinsel tacize u\u011framalar\u0131n\u0131 engellemek, i\u015fyerinde d\u00fcr\u00fcstl\u00fck kurallar\u0131na uygun bir i\u015f d\u00fczeni sa\u011flamak, i\u015fyerinde i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011finin gerektirdi\u011fi her t\u00fcrl\u00fc \u00f6nlemi zorundad\u0131r (T\u00fcrk Bor\u00e7lar Yasas\u0131  madde 417).<\/p>\n<p>\u0130\u015f\u00e7inin \u00f6zen ve sadakat borcunun kar\u015f\u0131l\u0131\u011f\u0131 i\u015fverenin i\u015f\u00e7iyi g\u00f6zetme borcu ile dengelenmi\u015ftir.<\/p>\n<p>\u00c7ok \u00f6zet olarak \u00e7izdi\u011fimiz bu \u00e7er\u00e7eve i\u00e7erisinde y\u00fcr\u00fcyen bir \u00e7al\u0131\u015fma ya\u015fam\u0131 \u00e7ok uzun s\u00fcredir ad\u0131m ad\u0131m ortadan kald\u0131r\u0131lm\u0131\u015ft\u0131r.<br \/>\n\u00c7al\u0131\u015fma ya\u015fam\u0131nda i\u015f\u00e7i. bor\u00e7lar\u0131n\u0131 yerine getirmesine kar\u015f\u0131n haklar\u0131na ula\u015famamaktad\u0131r. \u0130\u015f\u00e7inin haklar\u0131na ula\u015fmas\u0131 i\u015fverenin insaf\u0131na kalm\u0131\u015ft\u0131r. \u0130\u015fveren \u00fccret borcu dahil i\u015f\u00e7iye olan t\u00fcm bor\u00e7lar\u0131n\u0131 i\u015f\u00e7inin i\u015fsiz kalma korkusunu s\u00f6m\u00fcrerek keyfine g\u00f6re belirleyebilmektedir. \u0130\u015f\u00e7inin haklar\u0131 hak olmaktan \u00e7\u0131km\u0131\u015f i\u015fverenin l\u00fctfuna ba\u011fl\u0131 hale gelmi\u015ftir. Bu durumda g\u00f6r\u00fcnen ili\u015fki i\u015f\u00e7i i\u015fveren ili\u015fkisi olsa da ger\u00e7ek de k\u00f6le efendi ili\u015fkisi kurulmu\u015f demektir. <\/p>\n<p>Dolay\u0131s\u0131yla da haklar\u0131 elinden al\u0131narak i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131, hukuken i\u015f\u00e7inin k\u00f6lele\u015ftirilmesi demektir.<\/p>\n<p>Somut \u00f6rnek vermek gerekirse: \u00dccretin asgari \u00fccret tutar\u0131 bankaya gerisi elden i\u015f\u00e7iye belgesiz \u00f6denmektedir.  \u0130\u015fveren i\u015f\u00e7inin \u00fccreti \u00fczerinden SGK primi ve vergi ka\u00e7\u0131rmaktad\u0131r. <\/p>\n<p>Haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin 45 saat olmas\u0131 ka\u011f\u0131t \u00fczerinde kalm\u0131\u015f durumdad\u0131r.<\/p>\n<p>\u0130\u015f\u00e7iler, \u201cM\u00fc\u015fteri velinimetimizdir yasas\u0131n\u0131n 2. maddesine g\u00f6re bu i\u015fyerinde ara dinlenmesi yasakt\u0131r\u201d diye ara dinlenmeleri ile alay edecek hale gelmi\u015flerdir. Baz\u0131 i\u015fyerlerinde ara dinlenmelerinde i\u015fyerini terk etmek yasaklanm\u0131\u015ft\u0131r. <\/p>\n<p>Hafta tatili sipari\u015flerin olmad\u0131\u011f\u0131 d\u00f6nemlere indirgenmi\u015ftir.<\/p>\n<p>Uzun \u00e7al\u0131\u015fma saatleri, en basitinden i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 i\u015f g\u00fcvenli\u011fine ayk\u0131r\u0131 y\u00fck ta\u015f\u0131ma, itme, \u00e7ekme hareketleri nedeniyle on y\u0131l k\u0131demini dolduran i\u015f\u00e7ilerin bir \u00e7o\u011funda boyun, bel f\u0131t\u0131\u011f\u0131 gibi omurga hastal\u0131klar\u0131 s\u0131radanla\u015fm\u0131\u015ft\u0131r.<\/p>\n<p>Omurga hastal\u0131klar\u0131ndan birisine yakalanan i\u015f\u00e7ilerin, tedavi g\u00f6rd\u00fckleri i\u00e7in, rahat e\u011filip do\u011frulamad\u0131klar\u0131 i\u00e7in, hastaland\u0131ktan en fazla bir y\u0131l sonra \u00fcstelik verimsiz oldu\u011fu gerek\u00e7esiyle i\u015ften \u00e7\u0131kart\u0131lmalar\u0131n\u0131n rutin haline geldi\u011fi bir \u00e7al\u0131\u015fma ya\u015fam\u0131 do\u011fmu\u015ftur.Omurga hastal\u0131klar\u0131n\u0131 meslek hastal\u0131\u011f\u0131 olarak kabul etmeyen bir sosyal g\u00fcvenlik sistemi i\u015flemektedir.<\/p>\n<p>Bu birka\u00e7 \u00f6rnek dahi, i\u015f\u00e7ilikten k\u00f6lele\u015fmeye do\u011fru gidi\u015fi net olarak ortaya koymaya yetmektedir. <\/p>\n<p>\u00c7al\u0131\u015fma ya\u015fam\u0131na ku\u015f bak\u0131\u015f\u0131 g\u00f6z gezdirmek dahi bize art\u0131k sorunun tek tek i\u015f\u00e7ilerin yasal haklar\u0131 olmaktan \u00e7\u0131kt\u0131\u011f\u0131n\u0131, sorunun hak sahibi i\u015f\u00e7i mi, k\u00f6le mi a\u015famas\u0131na geldi\u011fimizi g\u00f6stermektedir.<\/p>\n","protected":false},"excerpt":{"rendered":"Hukuken i\u015f\u00e7iyle k\u00f6lenin fark\u0131, i\u015f\u00e7inin hak sahibi olmas\u0131yla a\u00e7\u0131klan\u0131r.
