Bu alanda da benzer bir \u00e7al\u0131\u015fma yap\u0131lmas\u0131 hedeflerimiz aras\u0131ndad\u0131r. \u00dclkemizde \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131 d\u00fczenleyen yasa, t\u00fcz\u00fck ve y\u00f6netmelikler son y\u0131llarda yo\u011fun bir \u015fekilde de\u011fi\u015fmi\u015ftir. Esnek \u00e7al\u0131\u015fma, \u00f6zelle\u015ftirme, kamunun tasfiyesi mant\u0131\u011f\u0131yla hayat\u0131m\u0131z\u0131n her alan\u0131nda \u00f6nemli de\u011fi\u015fimler oluyor. TMMOB ve Makine M\u00fchendisleri Odas\u0131 bu d\u00fczenlemelere emekten ve insandan yana bir bak\u0131\u015f a\u00e7\u0131s\u0131yla kar\u015f\u0131 \u00e7\u0131km\u0131\u015ft\u0131r. Bu do\u011frultuda eme\u011fin, kamusal \u00e7\u0131karlar\u0131n ve insan\u0131n yan\u0131nda \u00f6nermeler getirmeye devam edecektir. \u00dccretli m\u00fchendisleri sa\u011fl\u0131kl\u0131 bir \u015fekilde bilgilendirebilmek i\u00e7in mevcut d\u00fczenlemeleri temel alarak haz\u0131rlad\u0131\u011f\u0131m\u0131z bu bro\u015f\u00fcr\u00fcn meslekta\u015flar\u0131m\u0131za faydal\u0131 olaca\u011f\u0131n\u0131 umuyoruz. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><strong><span style=\"font-size: 11pt; line-height: 150%; font-family: Arial;\">\u00d6ns\u00f6z<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><span style=\"font-size: 11pt; line-height: 150%; font-family: Arial;\">\u00dcretim insan\u0131n temel ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamaya y\u00f6nelik bilin\u00e7li bir faaliyettir. \u0130htiya\u00e7lar\u0131n \u00fcretilmesine y\u00f6nelik bilin\u00e7li \u00e7aba ise <strong>emek<\/strong>\u2019tir. \u00c7al\u0131\u015fma yetene\u011fi ise (fiziksel, zihinsel) emek g\u00fcc\u00fc\u2019d\u00fcr. Eme\u011fiyle ge\u00e7inen m\u00fchendisler de di\u011fer insanlar gibi, ya\u015famak i\u00e7in \u00e7al\u0131\u015fmak zorundad\u0131rlar. M\u00fchendisler \u00fcretim s\u00fcrecinin \u00f6nemli bir par\u00e7as\u0131d\u0131r. Aktif \u00e7al\u0131\u015fan m\u00fchendislerin yakla\u015f\u0131k % 80\u2019i ise \u00fccretli olarak \u00e7al\u0131\u015fmaktad\u0131r. \u00dccretli m\u00fchendisler, emek g\u00fc\u00e7leri kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret alarak ya\u015fam ara\u00e7lar\u0131n\u0131 temin eden nitelikli i\u015f\u00e7idir. M\u00fchendislik, bilim ve teknolojiyi insanla bulu\u015fturan, \u00f6znesinde insan\u0131n ve eme\u011fin oldu\u011fu bir meslektir. Kolektif emek\u00e7i kimli\u011fi i\u00e7inde de\u011ferlendirilen m\u00fchendislik eme\u011fi, \u00fcretimin niteli\u011finde ya\u015fanan de\u011fi\u015fimler kar\u015f\u0131s\u0131nda; tasarlayan olmaktan \u00e7ok denetleyen, denetleyen olmaktan \u00e7ok fiilen \u00fcreten bir niteli\u011fe b\u00fcr\u00fcnm\u00fc\u015ft\u00fcr. Ne \u00fcretti\u011finin, kimin i\u00e7in, ne zaman \u00fcretti\u011finin ve nas\u0131l \u00fcretti\u011finin bilgisine sahip olmas\u0131 ile di\u011fer i\u015f\u00e7ilerden ayr\u0131lmas\u0131na ra\u011fmen gelinen ko\u015fullarda m\u00fchendislerin \u00fcretim i\u00e7indeki ayr\u0131cal\u0131kl\u0131 konumlar\u0131 da son bulmu\u015ftur. Yitirilen bu ayr\u0131cal\u0131kl\u0131 konum gere\u011fi, hem ekonomik hem de toplumsal stat\u00fc kayb\u0131 m\u00fchendisi i\u015f\u00e7ile\u015ftirmi\u015ftir. Ancak m\u00fchendisleri i\u015fyerlerindeki di\u011fer \u00e7al\u0131\u015fanlardan farkl\u0131la\u015ft\u0131ran baz\u0131 olgular kafalar\u0131 kar\u0131\u015ft\u0131rmakta ve m\u00fchendisler genel olarak yararlanmalar\u0131 gereken \u00e7e\u015fitli haklardan yararlanamamaktad\u0131r. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><strong><span style=\"font-size: 11pt; line-height: 150%; font-family: Arial;\">M\u00fchendisler Ve \u00c7al\u0131\u015fma Ya\u015fam\u0131<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><span style=\"font-size: 11pt; line-height: 150%; font-family: Arial;\">M\u00fchendisler \u00e7al\u0131\u015fma hayat\u0131nda ekonomik demokratik haklar\u0131n\u0131 koruyacak, anayasan\u0131n, yasalar\u0131n \u00e7al\u0131\u015fma hayat\u0131yla ilgili haklar\u0131 kullanma konusunda en \u00f6rg\u00fcts\u00fcz kesimini olu\u015fturmaktad\u0131r. \u00c7o\u011fu zaman bu haklar\u0131n bilinmemesi ve bu haklar\u0131 koruyacak \u00f6rg\u00fctlenmenin yarat\u0131lamam\u0131\u015f olmas\u0131; m\u00fchendisleri i\u015fveren kar\u015f\u0131s\u0131nda yaln\u0131zla\u015ft\u0131rm\u0131\u015f ve yasalar\u0131n verdi\u011fi haklar\u0131n\u0131 bile \u00e7o\u011fu durumda alamaz noktas\u0131na getirmi\u015ftir. Haftal\u0131k 45 saati a\u015fan \u00e7al\u0131\u015fmalar fazla mesaidir ve %50 zaml\u0131 \u00fccrete tabidir. S\u00f6z konusu \u00e7al\u0131\u015fma ulusal bayram ve genel tatil g\u00fcnlerinde (Kurban ve Ramazan Bayram\u0131, 1 Ocak, 23 Nisan, 19 May\u0131s, 30 A\u011fustos, 29 Ekim) ve hafta tatili g\u00fcn\u00fcnde yap\u0131l\u0131yorsa %100 zaml\u0131 \u00fccret verilir. Yasal bir hak olmas\u0131na ra\u011fmen bir \u00e7ok i\u015fyerinde fiilen uygulanmamaktad\u0131r. Bu durumda i\u015ften \u00e7\u0131kar\u0131l\u0131rsan\u0131z i\u015ften \u00e7\u0131karma i\u015fleminin ge\u00e7erli bir nedene dayanmas\u0131 gerekir. Bu neden i\u015f k\u00fc\u00e7\u00fcltme, verimsiz \u00e7al\u0131\u015fma gibi bir neden olabilir ve ispat sorumlulu\u011fu i\u015fverene aittir. E\u011fer ge\u00e7erli bir nedene dayanarak de\u011fil de hak arama, daha d\u00fc\u015f\u00fck \u00fccretle \u00e7al\u0131\u015facak eleman alma veya sendikala\u015fma gibi bir nedenle \u00e7\u0131kart\u0131l\u0131yorsan\u0131z o zaman dava a\u00e7arak i\u015fe geri d\u00f6nme hakk\u0131n\u0131z var. Bu da ihbar tazminat\u0131n\u0131z\u0131n 3 kat\u0131 kadard\u0131r. K\u0131dem tazminat\u0131 1 y\u0131l\u0131 ge\u00e7mi\u015f \u00e7al\u0131\u015fanlar i\u00e7in \u00e7al\u0131\u015f\u0131lan her tam y\u0131l i\u00e7in 1 ayl\u0131k br\u00fct giydirilmi\u015f \u00fccret kadard\u0131r. Yani br\u00fct \u00fccretin \u00fcst\u00fcne ikramiye, yol paras\u0131, yemek paras\u0131, devaml\u0131l\u0131k g\u00f6steren sosyal yard\u0131mlar vb. nin eklenmesiyle bulunan miktar\u0131n \u00e7al\u0131\u015f\u0131lan y\u0131l say\u0131s\u0131yla \u00e7arp\u0131lmas\u0131yla bulunur. Y\u0131l\u0131 ge\u00e7en aylar da 1 y\u0131la oranlanarak hesaba dahil edilirler.Ayr\u0131ca ihbar \u00f6neli vard\u0131r. Yani i\u015fveren sizi i\u015ften \u00e7\u0131karmadan \u00f6nce size i\u015f s\u00f6zle\u015fmesini feshedece\u011fini bildirmeli ve i\u015f arama izni vermelidir. E\u011fer i\u015fteki k\u0131deminize g\u00f6re de\u011fi\u015fen bu s\u00fcrelere uymaz ise bu d\u00f6nemin \u00fccretini size \u00f6demelidir. \u0130hbar \u00f6neli her iki taraf i\u00e7in de ge\u00e7erlidir. Yasaya g\u00f6re i\u015fyerindeki t\u00fcm sendika \u00fcyeleri ve sendika \u00fcyesi olmayanlar dayan\u0131\u015fma aidat\u0131 \u00f6deyerek, T\u0130S\u2019ten yararlanmak\u00fczere ba\u015fvurabilir ve T\u0130S\u2019ten yararlan\u0131r. \u0130\u015f\u00e7i sendikalar\u0131 t\u00fcm \u00e7al\u0131\u015fanlar\u0131n s\u00f6zle\u015fmeden yararlanma g\u00f6r\u00fc\u015f\u00fcn\u00fc savundu\u011fu halde bu yakla\u015f\u0131m i\u015fverenler taraf\u0131ndan kabul edilmemektedir.
