Tasar\u0131yla mahkemelerin \u00f6zelle\u015ftirme davalar\u0131nda verdi\u011fi y\u00fcr\u00fctmeyi durdurma ve iptal kararlar\u0131n\u0131n uygulanmamas\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nmaktad\u0131r. Yani mahkemelerin varl\u0131k gerek\u00e7esi ortadan kald\u0131r\u0131lmaktad\u0131r. Kamuoyuna &#8220;vergi, sigorta aff\u0131&#8221; gibi &#8220;\u015firin g\u00f6r\u00fcnen&#8221; s\u00f6ylemlerle duyurulan tasar\u0131, AKP\u2018nin &#8220;kontrols\u00fcz g\u00fc\u00e7&#8221; dayatmas\u0131n\u0131n \u00f6rne\u011fi olarak tarihe ge\u00e7ecektir. <\/p>\n<p>&nbsp;<\/p>\n<p>Elektrik M\u00fchendisleri Odas\u0131, referandum s\u00fcrecinde Anayasa de\u011fi\u015fikli\u011fine &#8220;hay\u0131r&#8221; demi\u015f; temel gerek\u00e7esini de \u00f6zelle\u015ftirme i\u015flemlerindeki yasa ve Anayasa\u2018ya ayk\u0131r\u0131l\u0131klara kar\u015f\u0131 yarg\u0131 denetiminin &#8220;yerindelik denetimi&#8221; bahanesiyle ortadan kald\u0131r\u0131lmak istenmesine dayand\u0131rm\u0131\u015ft\u0131r. Anayasa de\u011fi\u015fikli\u011finin ard\u0131ndan iktidar se\u00e7im \u00f6ncesinde kendisini ve yanda\u015flar\u0131n\u0131 garanti alt\u0131na alma gayreti i\u00e7erisinde pervas\u0131zl\u0131\u011f\u0131n\u0131n boyutunu daha da \u00f6teye ta\u015f\u0131m\u0131\u015ft\u0131r. Gelinen noktada AKP, demokrasinin gere\u011fi olarak se\u00e7menlerden ald\u0131\u011f\u0131 y\u00fcr\u00fctme yetkisini ideolojik ve partizan bir anlay\u0131\u015fla kullanmaktan \u00e7ekinmedi\u011fi gibi yasamaya da sirayet eden bu antidemokratik y\u00f6netim yetkisiyle yetinmemektedir. Askeri vesayeti kald\u0131rmak, derin devleti yarg\u0131lamak gibi s\u00f6ylemler ile tabular \u00fczerinden kendisine zemin yaratan ve kendi iktidar\u0131n\u0131n ele\u015ftirilmesine tahamm\u00fcl\u00fc olmayan AKP iktidar\u0131, yeni tabular yaratmakta, insanlar\u0131n yarg\u0131 yoluyla haklar\u0131n\u0131 aramas\u0131n\u0131n bile \u00f6n\u00fcne engel olu\u015fturmaktad\u0131r. <\/p>\n<p>Halk\u0131n vergileriyle kurulmu\u015f kamu varl\u0131klar\u0131n\u0131n \u00f6zel ellere aktar\u0131m\u0131 olan \u00f6zelle\u015ftirme kar\u015f\u0131 \u00e7\u0131k\u0131lamaz bir tabu haline getirilmi\u015f, \u00f6zelle\u015ftirme uygulamalar\u0131ndaki yanda\u015f \u00e7\u0131karlar\u0131n\u0131n korunmas\u0131na y\u00f6nelik hukuka ayk\u0131r\u0131 uygulamalar\u0131 dile getiren, yarg\u0131ya ba\u015fvuran kurum ve kurulu\u015flar yaftalanm\u0131\u015ft\u0131r. EMO, \u00f6zelle\u015ftirme i\u015flemlerine dava a\u00e7t\u0131\u011f\u0131 i\u00e7in ter\u00f6rist bile ilan edilmi\u015f, ayakba\u011f\u0131 olmakla su\u00e7lanm\u0131\u015ft\u0131r. Bug\u00fcn de hukuka ayk\u0131r\u0131 \u00f6zelle\u015ftirmelere ili\u015fkin mahkemelerin verdi\u011fi iptal kararlar\u0131n\u0131n uygulanmayaca\u011f\u0131 ilan edilmektedir. S\u00f6z konusu d\u00fczenleme ile AKP adeta kendisi ve yanda\u015flar\u0131 i\u00e7in saltanatl\u0131k kurmaktad\u0131r. <\/p>\n<p>\u00d6zelle\u015ftirme i\u015flemlerine ili\u015fkin mahkeme karar\u0131yla ilgili idarenin i\u015flem tesis etmemesini ve a\u00e7\u0131lan davalardan feragat edilmesini \u00f6ng\u00f6ren maddenin gerek\u00e7esinde AKP, \u00e7ok ulvi niyetlerini de &#8220;fiilen geri d\u00f6n\u00fclemeyecek yap\u0131n\u0131n ortaya \u00e7\u0131km\u0131\u015f olmas\u0131&#8221;, &#8220;\u00f6zelle\u015ftirme gelirinden daha fazla geri alma bedeli \u00f6denme ihtimali ve kamunun daha fazla zarara u\u011frayaca\u011f\u0131&#8221;, &#8220;ulusal ve uluslararas\u0131 ticari \u00e7evrelerde \u00f6zelle\u015ftirme uygulamalar\u0131na olan g\u00fcvenirlilik&#8221; olarak ortaya koymaktad\u0131r. \u00d6ncelikle gerek\u00e7edeki fiilen geri d\u00f6n\u00fclemeyecek yap\u0131n\u0131n olu\u015ftu\u011fu iddias\u0131 do\u011fru de\u011fildir. Do\u011frusu, AKP\u2018nin yasaya ve Anayasa\u2018ya ayk\u0131r\u0131 uygulamalar\u0131ndan geri d\u00f6nmeye niyeti olmad\u0131\u011f\u0131, yanda\u015flar\u0131na sa\u011flad\u0131\u011f\u0131 \u00e7\u0131karlar\u0131 geri almak istemedi\u011fidir. <\/p>\n<p>Gerek\u00e7ede birka\u00e7 sermayedara teslim edilmi\u015f olan kamu varl\u0131klar\u0131n\u0131n yarg\u0131 karar\u0131 gere\u011fi olarak geri al\u0131nmas\u0131n\u0131n yarataca\u011f\u0131 mali k\u00fclfetten s\u00f6z edilmektedir. Terazinin bir kefesi sermayedarlar lehine doldurulmu\u015f, kamu taraf\u0131ndaki kefe ise bo\u015f b\u0131rak\u0131lmaktad\u0131r. B\u00f6yle bir hesab\u0131n yap\u0131labilmesi i\u00e7in \u00f6ncelikle s\u00f6z konusu \u015firketlerin yasalara ayk\u0131r\u0131 olarak kamu varl\u0131klar\u0131n\u0131 elinde bulundurdu\u011fu d\u00f6nemde elde etti\u011fi kazan\u00e7lar hesap edilmelidir. \u00d6zelle\u015ftirme uygulamalar\u0131na y\u00f6nelik olarak ulusal ve uluslararas\u0131 \u00e7evrelerde g\u00fcvenin sars\u0131laca\u011f\u0131 iddialar\u0131na gelince, s\u00f6z konusu sermaye \u00e7evreleri \u00fclkedeki yasalar\u0131n san\u0131r\u0131z ki fark\u0131ndad\u0131rlar, dolay\u0131s\u0131yla mali bir riski kendileri bilerek, isteyerek \u00fcstlenmi\u015flerdir. Bir yurtta\u015f, kamu d\u00fczeni i\u00e7indeki bir kural\u0131 bilmedi\u011fi i\u00e7in k\u00fc\u00e7\u00fck bir su\u00e7 i\u015fledi\u011finde, nas\u0131l ki cezas\u0131n\u0131 \u00f6demek zorunda kal\u0131yorsa, sermaye \u00e7evreleri de \u00fcstlendikleri riske katlanmak zorundad\u0131rlar.<\/p>\n<p>Bir \u00f6rnek \u00fczerinden bu d\u00fczenlemenin yol a\u00e7aca\u011f\u0131 sonu\u00e7lar\u0131 irdeleyelim. Seydi\u015fehir Eti Al\u00fcminyum Tesisleri Temmuz 2005\u2018de AKP\u2018ye yak\u0131nl\u0131\u011f\u0131yla bilinen Cengiz \u0130n\u015faat\u2018a (Ce-Ka) devredilmi\u015ftir. \u00d6zelle\u015ftirme \u00f6ncesinde Eti Al\u00fcminyum\u2018a elektrik sa\u011flayan Oymap\u0131nar HES tesise ba\u011flanarak, bedavaya Ce-Ka\u2018ya verilmi\u015ftir. Dan\u0131\u015ftay 13. Dairesi 27 Kas\u0131m 2007 tarihinde \u00f6zelle\u015ftirme i\u015flemini iptal etmi\u015ftir. AKP H\u00fck\u00fcmeti yarg\u0131 karar\u0131n\u0131 \u015firkete tebli\u011f etmi\u015f, tesisi geri alamad\u0131\u011f\u0131 i\u00e7in dostlar al\u0131\u015fveri\u015fte g\u00f6rs\u00fcn misali yeniden yarg\u0131ya ba\u015fvurdu\u011funu a\u00e7\u0131klam\u0131\u015ft\u0131r. Yani askeri vesayeti kald\u0131ran, orduya kafa tutan AKP H\u00fck\u00fcmeti, bir yarg\u0131 karar\u0131n\u0131n uygulanmas\u0131nda bir tanecik sermaye sahibine s\u00f6z ge\u00e7irememi\u015f, idarenin takdir yetkisini kullanmakla su\u00e7lad\u0131\u011f\u0131 yarg\u0131n\u0131n kap\u0131s\u0131n\u0131 bir kere de ben \u00e7alay\u0131m demi\u015ftir.<\/p>\n<p>Yarg\u0131 karar\u0131 3 y\u0131ld\u0131r uygulanamazken, AKP H\u00fck\u00fcmeti \u015firket kar\u0131na kar kats\u0131n diye bak\u0131n neler yap\u0131lm\u0131\u015ft\u0131r. EPDK karar\u0131yla Ce-Ka \u015firketi, Oymap\u0131nar\u2018dan y\u00fcksek fiyata elektrik satabilsin diye otoprod\u00fckt\u00f6r lisans\u0131na sahip olan santrallar\u0131n piyasaya sat\u0131\u015f hakk\u0131 2009 y\u0131lsonuna kadar y\u00fczde 20\u2018den y\u00fczde 50\u2018ye \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Sadece 1 y\u0131ll\u0131k kar olana\u011f\u0131 da yeterli g\u00f6r\u00fcnmemi\u015f, karar\u0131n geriye d\u00f6n\u00fck olarak 2007 ve 2008 y\u0131l\u0131n\u0131 da kapsamas\u0131 sa\u011flanm\u0131\u015ft\u0131r. <\/p>\n<p>\u015eirket s\u00f6z konusu santral\u0131n yat\u0131r\u0131m maliyetini \u00fcstlenmemi\u015f, haz\u0131r santrala hi\u00e7 para \u00f6demeden sahip olmu\u015ftur. \u015eirketin DUY\u2018daki ortalama sat\u0131\u015f fiyat\u0131 \u00fczerinden \u00fcretti\u011fi elektri\u011fin parasal kar\u015f\u0131l\u0131\u011f\u0131 hesapland\u0131\u011f\u0131nda, yaln\u0131zca 2 y\u0131l i\u00e7inde 326 milyon TL (y\u00fczde 50 sat\u0131\u015f s\u0131n\u0131r\u0131n\u0131 a\u015fan ve bedeli kamuya aktar\u0131lan sat\u0131\u015f hari\u00e7) kazand\u0131\u011f\u0131 ortaya \u00e7\u0131kmaktad\u0131r. Hidroelektrik santrallar\u0131 yat\u0131r\u0131m maliyeti y\u00fcksek, ancak yak\u0131t gideri olmayan dolay\u0131s\u0131yla i\u015fletme maliyeti 0.065 sent gibi olduk\u00e7a d\u00fc\u015f\u00fck olan santral tipidir. \u00dcstelik Ce-Ka\u2018n\u0131n 2006 ve 2007 y\u0131l\u0131ndaki elektrik \u00fcretiminden kazand\u0131\u011f\u0131 paralar ve Eti Al\u00fcminyum tesisiyle ilgili veriler de bu hesaba dahil de\u011fildir. Ce-Ka \u015firketinin Eti Al\u00fcminyum Tesisi i\u00e7in \u00f6dedi\u011fi para 305 milyon dolard\u0131r. Yani \u015firket \u00f6dedi\u011fi paray\u0131 sadece elektrik sat\u0131\u015f\u0131yla geri alm\u0131\u015f bulunmaktad\u0131r. Ce-Ka, santral \u00fczerinden sa\u011flad\u0131\u011f\u0131 karlar\u0131 kamuya iade ederse, kamu da \u015firketin ihalede verdi\u011fi 305 milyon dolar\u0131 zaten \u00f6deyebilecektir.<\/p>\n<p>Yok, \u015firketin kazand\u0131\u011f\u0131 para da cebine kals\u0131n deniyorsa, o zaman \u00d6\u0130B\u2018nin 19 grup HES ihalelerinde toplam 141 megavatl\u0131k 52 santral i\u00e7in 432.8 milyon dolar teklif edildi\u011fini, Oymap\u0131nar\u2018\u0131n kurulu g\u00fcc\u00fcn\u00fcn ise 540 megavat oldu\u011funu hat\u0131rlatal\u0131m. Yani \u015firketin bedavaya ald\u0131\u011f\u0131 HES\u2018in bug\u00fcnk\u00fc ihale sonu\u00e7lar\u0131na g\u00f6re de\u011feri 1 milyar 657 milyon dolard\u0131r. Ne yaz\u0131k ki kamu zarar\u0131n\u0131n boyutu yaln\u0131zca santral\u0131n de\u011feriyle s\u0131n\u0131rl\u0131 de\u011fildir. Ce-Ka \u015firketinin sahibi oldu\u011fu Oymap\u0131nar Santral\u0131, T\u00fcrkiye\u2018nin elektrik sisteminin s\u0131k\u0131nt\u0131ya girdi\u011fi 2006 y\u0131l\u0131nda TE\u0130A\u015e\u2018\u0131n y\u00fck al talimat\u0131na uymam\u0131\u015f, elektrik vermeyi reddetmi\u015ftir. Sistem \u00e7\u00f6km\u00fc\u015f ve 13 ilimizde 6 saat gibi uzun s\u00fcren bir kesinti ya\u015fanm\u0131\u015ft\u0131r. Yani 6 saat boyunca sanayi \u00fcretimi durmu\u015f, turizm fel\u00e7 olmu\u015f, insanlar evlerinde karanl\u0131kta kalm\u0131\u015ft\u0131r. Af tasar\u0131s\u0131nda \u00f6zelle\u015ftirme ile ilgili yarg\u0131 karar\u0131 gere\u011fi geri alma i\u015fleminin kamuya mali k\u00fclfet do\u011furaca\u011f\u0131n\u0131 iddia edenler bunun zarar\u0131n\u0131 da hesaba katm\u0131\u015flar m\u0131d\u0131r?<\/p>\n<p>Hesap ortadad\u0131r. Halk\u0131n hesab\u0131yla AKP\u2018nin hesab\u0131 birbirini tutmamaktad\u0131r. B\u00f6yle bir yasal d\u00fczenlemenin g\u00fcndeme getirilmi\u015f olabilmesi dahi derin kayg\u0131 ve \u00fcz\u00fcnt\u00fc vericidir. S\u00f6z konusu d\u00fczenleme kabul edilirse, sadece Eti Al\u00fcminyum ve Oymap\u0131nar gibi kamu varl\u0131klar\u0131 de\u011fil, hen\u00fcz dava s\u00fcre\u00e7leri sonu\u00e7lanmam\u0131\u015f, ama \u015firketlere devir i\u015flemleri yap\u0131lm\u0131\u015f olan Telekom, elektrik da\u011f\u0131t\u0131m kurulu\u015flar\u0131, santrallar gibi pek \u00e7ok \u00f6zelle\u015ftirme i\u015flemi i\u00e7in a\u00e7\u0131lan davalardan al\u0131nacak kararlar\u0131n da h\u00fckm\u00fc kalmayacakt\u0131r. AKP, s\u00f6z konusu d\u00fczenlemenin kabul edilece\u011fi tarihten geriye d\u00f6n\u00fck olarak yapm\u0131\u015f oldu\u011fu t\u00fcm \u00f6zelle\u015ftirme i\u015flemlerindeki usuls\u00fczl\u00fcklerin, yasa ve Anayasa\u2018ya ayk\u0131r\u0131l\u0131klar\u0131n \u00fczerine s\u00fcnger \u00e7ekecektir. Bu d\u00fczenleme, Anayasa\u2018n\u0131n &#8220;G\u00f6r\u00fclmekte olan bir dava hakk\u0131nda Yasama Meclisinde yarg\u0131 yetkisinin kullan\u0131lmas\u0131 ile ilgili soru sorulamaz, g\u00f6r\u00fc\u015fme yap\u0131lamaz veya herhangi bir beyanda bulunulamaz.
