Odam\u0131z\u0131n tasar\u0131n\u0131n baz\u0131 y\u00f6nleri \u00fczerine yapt\u0131\u011f\u0131 \u00f6zet de\u011ferlendirmeler a\u015fa\u011f\u0131da kamuoyunun bilgisine sunulmaktad\u0131r. <\/p>\n<p>&nbsp;<\/p>\n<p>Gen\u00e7 i\u015f\u00e7i ve \u00e7\u0131rak s\u00f6m\u00fcr\u00fcs\u00fc yayg\u0131nla\u015ft\u0131r\u0131l\u0131yor: En son 20 ve \u00fcst\u00fc i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerleri i\u00e7in ge\u00e7erli olan staj uygulamas\u0131, 10 ve (Bakanlar Kurulu karar\u0131 ile) be\u015f i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerine geni\u015fletilmekte; e\u011fitim s\u00fcresince her ay 18 ya\u015f\u0131n\u0131 bitirenlere \u00f6denen asgari \u00fccretin 2\/3\u2018\u00fc oran\u0131nda belirlenen \u00fccret, asgari \u00fccretin net tutar\u0131n\u0131n 1\/3\u2018i oran\u0131na indirilmekte, yirmi ve daha fazla personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 halinde 2\/3\u2018\u00fc nispetinde \u00f6deme \u00f6ng\u00f6r\u00fclmektedir. Bu uygulamalar ucuz gen\u00e7 i\u015fg\u00fcc\u00fc s\u00f6m\u00fcr\u00fcs\u00fcn\u00fc yayg\u0131nla\u015ft\u0131racakt\u0131r. <\/p>\n<p>Slikozis i\u015f\u00e7ilerinin sorunlar\u0131 devam ediyor: Slikozis nedeniyle \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fc en az % 40 kaybeden i\u015f\u00e7ilere, 65 ya\u015f \u00fcst\u00fc muhta\u00e7, g\u00fc\u00e7s\u00fcz ve kimsesizlere ba\u011flanan ayl\u0131k oran\u0131nda \u00f6deme yap\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclmekte ve bu mesleki hastal\u0131k meslek hastal\u0131\u011f\u0131 stat\u00fcs\u00fcne al\u0131nmamaktad\u0131r.<\/p>\n<p>\u0130\u015fsizlik Fonundan H\u00fck\u00fcmetin kullanaca\u011f\u0131 oran art\u0131yor, kriz fakt\u00f6r\u00fc ve sermayeye te\u015fvik s\u00fcr\u00fcyor: H\u00fck\u00fcmete, sermayeye k\u0131sa s\u00fcreli esnek \u00e7al\u0131\u015fma y\u00f6ntemiyle k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi verebilmek i\u00e7in \u0130\u015fsizlik Fonunun bir \u00f6nceki y\u0131l prim gelirlerinin % 30\u2018unu kullanma ve % 50\u2018ye \u00e7\u0131karma yetkisi verilerek ilgili yasadaki tan\u0131m ve kapsam ihlal edilmekte; genel ekonomik krizler, zorlay\u0131c\u0131 sebepler ve sekt\u00f6rel ve b\u00f6lgesel kriz saptamas\u0131 ile krizin s\u00fcreklili\u011fi teyit edilmektedir. <\/p>\n<p>\u0130\u015fverenler sigorta prim gecikme zamm\u0131ndan kurtuldu\u011fu gibi gen\u00e7 i\u015f\u00e7i istihdam\u0131 yoluyla sigorta primi \u00f6demesinden muaf tutuluyor: \u0130\u015fverenlerin \u00f6demedi\u011fi primler i\u00e7in uygulanan gecikme zamm\u0131n\u0131n aff\u0131 yan\u0131nda 2015 y\u0131l\u0131 sonuna kadar \u00f6zel sekt\u00f6rde istihdam edilecek 18 ya\u015f\u0131ndan b\u00fcy\u00fck ve 29 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck erkekler ile 18 ya\u015f\u0131ndan b\u00fcy\u00fck kad\u0131nlar\u0131n sigorta primlerinin i\u015fveren pay\u0131n\u0131n \u0130\u015fsizlik Sigortas\u0131 Fonundan kar\u015f\u0131lanmas\u0131 deste\u011fi 29 ya\u015f \u00fcst\u00fc i\u015f\u00e7ilerin i\u015fe al\u0131nmamas\u0131 ya da \u00e7\u0131kar\u0131lmas\u0131na da yol a\u00e7acakt\u0131r. \u0130lk defa i\u015fe girenlerin deneme s\u00fcresinin 4 aya \u00e7\u0131kar\u0131lmas\u0131 vb. i\u015fsizli\u011fe a\u00e7\u0131k gen\u00e7 i\u015f\u00e7i piyasas\u0131 olu\u015fumunu te\u015fvik etmektedir. <\/p>\n<p>Kay\u0131t d\u0131\u015f\u0131 ekonomi ve istihdam te\u015fvik ediliyor: \u00c7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fma, evden \u00e7al\u0131\u015fma ve uzaktan \u00e7al\u0131\u015fma bi\u00e7imlerine y\u00f6nelik k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile birlikte s\u00f6zle\u015fmesiz \u00e7al\u0131\u015fma bi\u00e7imleri de yasalla\u015fmakta ve haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi 20 saat olarak belirlenmektedir. <\/p>\n<p>K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fanlara prim \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getiriliyor: Esnek istihdam\u0131n en g\u00f6r\u00fcn\u00fcr kesimine y\u00f6nelik 2012 y\u0131l\u0131 ba\u015f\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe girecek olan k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fanlar ile ev hizmetlerinde ay i\u00e7erisinde 30 g\u00fcnden az \u00e7al\u0131\u015fan sigortal\u0131lar\u0131n eksik g\u00fcnlerine ait genel sa\u011fl\u0131k sigortas\u0131 primlerini kendilerinin 30 g\u00fcne tamamlama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, kamu ve \u00f6zel sekt\u00f6r i\u015fverenlerini g\u00f6zeten bir d\u00fczenlemedir.<\/p>\n<p>&#8220;Denkle\u015ftirme&#8221; turizm i\u015fletme belgeli i\u015fyerlerinde 4 aya \u00e7\u0131k\u0131yor: Fazla mesai \u00fccreti \u00f6demeyerek \u00fccretsiz izne \u00e7\u0131karma uygulamas\u0131yla ilgili olan denkle\u015ftirme i\u015flemi, turizm i\u015fletme belgeli i\u015fyerlerinde d\u00f6rt aya \u00e7\u0131kar\u0131larak kurals\u0131z \u00e7al\u0131\u015ft\u0131rma yayg\u0131nla\u015ft\u0131r\u0131l\u0131yor. <\/p>\n<p>\u0130\u015f Mahkemelerini ilgilendiren i\u015f\u00e7i \u015fik\u00e2yetlerinde m\u00fcfetti\u015flik\/uzmanl\u0131k d\u0131\u015flan\u0131yor: \u0130\u015f s\u00f6zle\u015fmesi fiilen sona eren i\u015f\u00e7ilerin bireysel alacaklar\u0131na ili\u015fkin \u015fikayetlerini incelemede \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 b\u00f6lge m\u00fcd\u00fcrl\u00fc\u011f\u00fc memurlar\u0131n\u0131 devreye sokacak olan uygulama, mesleki yeterlili\u011fi bulunan i\u015f m\u00fcfetti\u015fleri nezdinde uzmanl\u0131\u011f\u0131 d\u0131\u015flamaktad\u0131r. <\/p>\n<p>Kamuda &#8220;g\u00f6rev yerine ba\u011fl\u0131 olmaks\u0131z\u0131n \u00e7al\u0131\u015fma&#8221; ve ge\u00e7ici g\u00f6revlendirme&#8221; ile s\u00fcrg\u00fcn vb. politikalar\u0131n \u00f6n\u00fc a\u00e7\u0131l\u0131yor: Bu g\u00f6revlendirme bi\u00e7imleriyle kamuda siyasi ve idari istismara a\u00e7\u0131k, s\u00fcrg\u00fcnleri te\u015fvik edecek bir uygulamaya ge\u00e7ilmektedir. <\/p>\n<p>Kad\u0131n kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n do\u011fum \u00f6ncesi ve sonras\u0131 &#8220;ayl\u0131kl\u0131&#8221; izinleri &#8220;anal\u0131k&#8221; iznine d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcyor: Kamu \u00e7al\u0131\u015fan\u0131 kad\u0131nlara do\u011fumdan \u00f6nce ve sonra 8\u2018er hafta ayl\u0131kl\u0131 izin verilmesine ili\u015fkin h\u00fck\u00fcm, anal\u0131k iznine \u00e7evrilerek \u00fccretli izin d\u0131\u015f\u0131 tutulmaktad\u0131r. <\/p>\n<p>Kamu \u00e7al\u0131\u015fanlar\u0131na piyasac\u0131 &#8220;performans&#8221; \u00f6l\u00e7\u00fctleri geliyor: Emsallerine g\u00f6re ba\u015far\u0131l\u0131 g\u00f6rev yoluyla te\u015fvik, ba\u015far\u0131, verimlilik vb. \u00f6l\u00e7mek \u00fczere de\u011ferlendirme \u00f6l\u00e7\u00fctleri belirleme y\u00f6nelimi, liyakat yakla\u015f\u0131m\u0131na ayk\u0131r\u0131 bir bi\u00e7imde piyasac\u0131 \u00f6l\u00e7\u00fctleri kamuya ta\u015f\u0131yacakt\u0131r. <\/p>\n<p>Kamuda &#8220;disiplin&#8221; olgusu, sicil\u2018in \u00f6n\u00fcne ge\u00e7iriliyor: Kamuda sicil notu, sicil amirlerinin teklifi, s\u0131ral\u0131 sicil amiri, sicil dosyas\u0131 vb. belirlemeler, disiplin notu, disiplin amirinin teklifi, \u00fcst disiplin amiri, \u00f6zl\u00fck dosyas\u0131 vb. ile de\u011fi\u015ftirilmekte; Vali ve Kaymakamlar\u0131n \u00fcst disiplin amiri olmas\u0131 ile kamu gelenekleri bozulmaktad\u0131r. <\/p>\n<p>Kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n sendika aidatlar\u0131 kamu taraf\u0131ndan \u00f6denecek: Kamu \u00e7al\u0131\u015fanlar\u0131 sendikalar\u0131na \u00fcye olanlar\u0131n \u00fccretlerinden kesilen sendika aidatlar\u0131na kar\u015f\u0131l\u0131k olarak devlet taraf\u0131ndan y\u0131lda d\u00f6rt kez 45 TL toplu s\u00f6zle\u015fme primi \u00f6denmesi kamu \u00e7al\u0131\u015fanlar\u0131n\u0131 ve sendikac\u0131l\u0131\u011f\u0131n\u0131 siyasi iktidara ba\u011flama \u00e7abas\u0131 olarak g\u00fcndeme gelmektedir.<\/p>\n<p>&#8220;Aile yard\u0131m\u0131 \u00f6dene\u011fi&#8221; kamuda k\u0131smi zamanl\u0131 \u00e7al\u0131\u015fanlar\u0131 kapsam\u0131yor: Aile yard\u0131m\u0131 \u00f6dene\u011fi vb. \u00f6demenin, k\u0131sa zamanl\u0131 \u00e7al\u0131\u015fan s\u00f6zle\u015fmeli personeli kapsamamas\u0131, Anayasal e\u015fitlik yakla\u015f\u0131m\u0131 ile devletin sosyal niteli\u011finin nas\u0131l a\u015f\u0131nd\u0131r\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.\u00a0 <\/p>\n<p>Kamu \u00e7al\u0131\u015fanlar\u0131na grev yasa\u011f\u0131 s\u00fcr\u00fcyor: Sendika kurma ve sendikalara \u00fcye olma hakk\u0131 tan\u0131nan s\u00f6zle\u015fmeli personelin, grev karar\u0131 vermesi, propaganda yapmas\u0131, herhangi bir greve veya te\u015febb\u00fcs\u00fcne kat\u0131lmas\u0131, desteklemesi yahut te\u015fvik etmesi yasa\u011f\u0131 ise s\u00fcrmektedir.<\/p>\n<p>Mahalli idarelerde &#8220;ihtiya\u00e7 fazlas\u0131&#8221; i\u015f\u00e7iler ba\u015fka kurumlara aktar\u0131larak hak kayb\u0131na u\u011frat\u0131lacak, ta\u015feronla\u015ft\u0131rma yay\u0131lacak: \u0130\u015f\u00e7ilere ba\u015fka kurumlarda g\u00f6rev ba\u015f\u0131 yapmalar\u0131 i\u00e7in tan\u0131nan 5 g\u00fcnl\u00fck s\u00fcre i\u00e7tihatlara ayk\u0131r\u0131 oldu\u011fu gibi; i\u015f\u00e7ilerin devirden \u00f6nce do\u011fmu\u015f ve devir tarihinde \u00f6denmesi gereken bor\u00e7lardan devralan kurumun sorumlu tutulamayaca\u011f\u0131, h\u00fckm\u00fc ciddi bir adaletsizlik durumu olu\u015fturacakt\u0131r.
