Baz\u0131 Alacaklar\u0131n Yeniden Yap\u0131land\u0131r\u0131lmas\u0131 ile Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu ve Di\u011fer Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Tasar\u0131s\u0131 ad\u0131 alt\u0131nda bir\u00e7ok kanunda de\u011fi\u015fiklik yap\u0131lmas\u0131ndan dolay\u0131 tasar\u0131 kamuoyunda &#8220;torba yasa&#8221; ya da &#8220;\u00e7orba yasa&#8221; diye an\u0131lmaktad\u0131r. 5 k\u0131s\u0131mdan olu\u015fan tasar\u0131 onlarca yasada de\u011fi\u015fiklik getirmekte olup, kamu alacaklar\u0131n\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131n\u0131n yan\u0131 s\u0131ra \u00e7al\u0131\u015fma hayat\u0131n\u0131 yeniden d\u00fczenleyen de\u011fi\u015fiklikleri i\u00e7ermektedir.<\/p>\n<p>&nbsp;<\/p>\n<p>AKP H\u00fck\u00fcmeti d\u00f6neminde, &#8220;biraz iyi, \u00e7ok\u00e7a k\u00f6t\u00fc&#8221; olan d\u00fczenlemelerin ayn\u0131 torba i\u00e7inde de\u011ferlendirilmesi y\u00f6ntemi Anayasa paketi oylamas\u0131nda da uygulanm\u0131\u015ft\u0131r. Torba yasan\u0131n olumsuz ele\u015ftiriler kar\u015f\u0131s\u0131nda &#8220;birka\u00e7 iyi madde&#8221; \u00fczerinden savunulmas\u0131 i\u015fin \u00f6z\u00fcn\u00fc \u00e7arp\u0131tmaya d\u00f6n\u00fckt\u00fcr. <\/p>\n<p>\u00c7al\u0131\u015fma ya\u015fam\u0131n\u0131 ilgilendiren; 5510 Say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu; 4857 Say\u0131l\u0131 \u0130\u015f Kanunu; 657 Say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu; 4046 Say\u0131l\u0131 \u00d6zelle\u015ftirme Uygulamalar\u0131 Hakk\u0131nda Kanun vb pek \u00e7ok kanunda yap\u0131lan d\u00fczenlemelerle, mevcut durumdan \u00e7ok daha k\u00f6t\u00fc ve geri d\u00fczenlemeler \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>Tasar\u0131da, emek\u00e7i s\u0131n\u0131flar\u0131n aleyhine d\u00fczenlemeler olduk\u00e7a fazlad\u0131r:<\/p>\n<p>Asgari \u00fccretlilerin ya\u015f s\u0131n\u0131r\u0131n\u0131n y\u00fckseltilmesi, k\u0131smi s\u00fcreli \u00e7al\u0131\u015fanlar\u0131n primlerini cebinden tamamlamak zorunda olmas\u0131, stajyer \u00e7al\u0131\u015ft\u0131rma \u00fczerinden ucuz emek s\u00f6m\u00fcr\u00fcs\u00fcn\u00fcn \u00f6n\u00fcn\u00fcn a\u00e7\u0131lmas\u0131, k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finin s\u00fcresi ve kapsam\u0131n\u0131n geni\u015fletilmesi \u0130\u015fsizlik Fonu\u2018nun y\u0131ll\u0131k gelirinin yar\u0131s\u0131na Bakanlar Kurulu\u2018nun el koyup i\u015fverenlere istihdam te\u015fviki olarak vermesi gibi emek\u00e7ilerin haklar\u0131n\u0131n gasp\u0131n\u0131 i\u00e7eren maddeler yer almaktad\u0131r.<\/p>\n<p>Tasar\u0131yla; esnek, kurals\u0131z ve g\u00fcvencesiz \u00e7al\u0131\u015fma bi\u00e7imleri getirilmektedir. 4857 say\u0131l\u0131 Kanun\u2018da, \u00e7a\u011fr\u0131l\u0131 \u00e7al\u0131\u015fma, par\u00e7a ba\u015f\u0131na \u00e7al\u0131\u015fma, s\u00f6zle\u015fmelilik, deneme s\u00fcreli i\u015f akitlerinin uzat\u0131lmas\u0131, ge\u00e7ici \u00e7al\u0131\u015fma bi\u00e7imlerinin yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131 gibi d\u00fczenlemeler yap\u0131lmaktad\u0131r. \u00d6zetle, g\u00fcvencesiz esnek \u00e7al\u0131\u015fma, \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131n esas\u0131 haline getirilmektedir.<\/p>\n<p>Tasar\u0131da 657 Say\u0131l\u0131 Yasa\u2018da da \u00f6nemli de\u011fi\u015fiklikler \u00f6ng\u00f6r\u00fclmektedir:<\/p>\n<p>AKP H\u00fck\u00fcmeti, &#8220;Kamu Personel Rejimi&#8221;, &#8220;Kamu Reformu&#8221; ad\u0131yla ge\u00e7mi\u015f y\u0131llarda da 657 say\u0131l\u0131 Yasa\u2018da de\u011fi\u015fiklik yapma \u00e7al\u0131\u015fmalar\u0131 yapm\u0131\u015ft\u0131. Performans sistemiyle, uzmanl\u0131kla ilgili maddelerin 2004 ve 2006 y\u0131l\u0131nda da &#8220;Kamu Personel Rejimi&#8221; ad\u0131yla g\u00fcndeme getirildi\u011fini belirtmeliyiz. \u00c7al\u0131\u015fma ya\u015fam\u0131nda neoliberal d\u00fczenlemeler bu ve bu t\u00fcr yasal d\u00fczenlemelerinin temel ruhudur ve bu AKP H\u00fck\u00fcmeti\u2018nin uzun y\u0131llard\u0131r program\u0131na ald\u0131\u011f\u0131 bir konudur.<\/p>\n<p>Tasar\u0131n\u0131n 657 say\u0131l\u0131 Yasa\u2018da yapmak istedi\u011fi de\u011fi\u015fikliklerle kamu hizmetinin ve dolay\u0131s\u0131yla kamu y\u00f6netimi \u00f6rg\u00fctlenmesinin kapsaml\u0131 ve s\u00fcrekli tasfiyesini ger\u00e7ekle\u015ftirmek amac\u0131yla haz\u0131rland\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. <\/p>\n<p>Tasar\u0131, kamu \u00e7al\u0131\u015fanlar\u0131 i\u00e7in g\u00fcvencesiz \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 getirmektedir. Do\u011fum izni, s\u00fct izni gibi k\u0131smi iyile\u015ftirmelerde bile 4-b ve 4-c kapsam\u0131nda \u00e7al\u0131\u015fanlar hari\u00e7 tutulmaktad\u0131r. Memuriyet-kariyer sistemi tasfiye edilerek, s\u00f6zle\u015fmeli personel sistemi esas al\u0131nmaktad\u0131r. <\/p>\n<p>Tasar\u0131yla, kamuda kadrola\u015fman\u0131n \u00f6n\u00fc tamamen a\u00e7\u0131lmaktad\u0131r. \u00dcst d\u00fczey kadrolara, \u00f6zel sekt\u00f6rden atama yap\u0131lmas\u0131n\u0131n \u00f6n\u00fcn\u00fcn a\u00e7\u0131lmas\u0131 siyasal kadrola\u015fmay\u0131 esas alan bir d\u00fczenlemedir. Ayn\u0131 zamanda, kamu yarar\u0131 \u00f6ncelikli olarak yeti\u015fen kamu personeli yerine k\u00e2r \u00f6nceli\u011fi olan \u015firket personeli mant\u0131\u011f\u0131n\u0131n kamuya ta\u015f\u0131nmas\u0131 da ama\u00e7lanmaktad\u0131r. <\/p>\n<p>Tasar\u0131da kamuda \u00e7al\u0131\u015fan personelin ge\u00e7ici g\u00f6revlendirilmesi ad\u0131yla s\u00fcrg\u00fcn uygulamalar\u0131na yasal bir zemin olu\u015fturulmak istenmektedir. Siyasal iktidarlar\u0131n y\u0131llard\u0131r s\u00fcrd\u00fcrd\u00fc\u011f\u00fc bask\u0131 ve sindirme politikalar\u0131 bu yasa tasar\u0131s\u0131yla kanun maddesi haline getirilmektedir.<\/p>\n<p>Ku\u015fkusuz 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2018nda de\u011fi\u015fikliklere ihtiya\u00e7 vard\u0131r. 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 Yasas\u0131 gere\u011fince, kamu g\u00f6revlileri sendikalar\u0131 ile h\u00fck\u00fcmetler aras\u0131nda yap\u0131lan g\u00f6r\u00fc\u015fmelerde 657 say\u0131l\u0131 Kanun\u2018da de\u011fi\u015fiklik \u00f6nerileri sendikalar taraf\u0131ndan dile getirilmi\u015ftir. Yap\u0131lmas\u0131 istenen \u00e7a\u011fda\u015f \u00e7al\u0131\u015fma ili\u015fkilerinin \u00e7al\u0131\u015fanlar lehine yasala\u015ft\u0131r\u0131lmas\u0131 iken bug\u00fcn h\u00fck\u00fcmet yapt\u0131\u011f\u0131 d\u00fczenlemeyle \u00e7al\u0131\u015fanlar\u0131n mevcut kazan\u0131mlar\u0131n\u0131 bile ortadan kald\u0131rmak istemektedir. Kamu \u00e7al\u0131\u015fanlar\u0131 de\u011fi\u015fimden daha ileri \u00e7\u00f6z\u00fcmler beklerken, tasar\u0131yla mevcudu arar hale getirilmi\u015ftir.<\/p>\n<p>\u00d6te yandan tasar\u0131, kamu hizmeti kavram\u0131n\u0131 s\u00f6zl\u00fcklerden \u00e7\u0131karacak bir nitelikte olmas\u0131 nedeniyle sadece 657 say\u0131l\u0131 Kanun\u2018a tabi \u00e7al\u0131\u015fanlar\u0131 de\u011fil, toplumun t\u00fcm emek\u00e7i kesimlerini olumsuz etkileyecek bir \u00f6zellik ta\u015f\u0131maktad\u0131r. Bu nedenle bu tasar\u0131ya kar\u015f\u0131 y\u00fcr\u00fct\u00fclecek m\u00fccadelenin t\u00fcm emek\u00e7ilerin ortak m\u00fccadelesi haline getirilmesi \u00f6zel \u00f6nem arz etmektedir. <\/p>\n<p>Tasar\u0131 toplumun t\u00fcm emek\u00e7i kesimlerini olumsuz etkileyecek maddelerle doludur.
