Bununla birlikte yak\u0131nda a\u00e7\u0131lmas\u0131 planlanan al\u0131\u015fveri\u015f merkezi, yan\u0131ndaki tescilli bina Serkil Doryan\u2019\u0131n neredeyse iki kat\u0131 y\u00fcksekli\u011fe ula\u015ft\u0131. Binan\u0131n y\u00fcksekli\u011finin medyada yank\u0131 uyand\u0131rmas\u0131yla, in\u015faatta incelemeler yapan \u0130stanbul 2 No\u2019lu Yenileme Kurulu \u00fcyeleri, \u201cDemir\u00f6ren AVM in\u015faat\u0131n\u0131n 2863 say\u0131l\u0131 yasaya ayk\u0131r\u0131 olarak s\u00fcrd\u00fc\u011f\u00fcn\u00fc, onaylanan projeye ayk\u0131r\u0131 unsurlar tespit edildi\u011fini\u201d karar ba\u011flad\u0131 ve \u201cgerekli \u00f6nlemlerin al\u0131nmas\u0131 i\u00e7in\u201d K\u00fclt\u00fcr Bakanl\u0131\u011f\u0131, \u0130stanbul Valili\u011fi ve Beyo\u011flu Belediyesi\u2019ne g\u00f6nderdi.<\/div>\n<div><\/div>\n<div>\u0130stanbul Yenileme Alanlar\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131n Koruma B\u00f6lge Kurulu 8.11.2010 tarihinde yap\u0131lan toplant\u0131da; \u201c346 ada, 15 (eski 1-2-3)13, 14 parsellerde uygulaman\u0131n durdurulmas\u0131na, yap\u0131lan uygulamalar\u0131n 26.12.2008 g\u00fcn ve 564 say\u0131l\u0131 karar ile onaylanan tadilat projesine uymamas\u0131 sebebiyle 2863 say\u0131l\u0131 yasan\u0131n 65. maddesi gere\u011fi yapanlar hakk\u0131nda su\u00e7 duyurusunda bulunulmas\u0131na, yap\u0131n\u0131n kot-kesit, kontur gabarisinin ve kat planlar\u0131n\u0131n onayl\u0131 tadilat projesine ayk\u0131r\u0131 oldu\u011fu tespit edildi\u011finden, mevcut durumu g\u00f6steren kot-kesit ve kontur gabari belgesinin ilgili belediyesinden istenmesine, onayl\u0131 projeye ayk\u0131r\u0131 olan kat ve cephe bile\u015fenlerinin y\u0131k\u0131lmas\u0131na ve yap\u0131n\u0131n onayl\u0131 projesine uygun hale getirilmesine, 14.11.2008 g\u00fcn ve 484 say\u0131l\u0131 karar ile tevhidi uygun bulunmayan tescilli 14 parselde 14.05.2009 g\u00fcn ve 743 say\u0131l\u0131 karar ile onayl\u0131 rekonstr\u00fcksiyon projesine ayk\u0131r\u0131 olarak tespit edilen uygulaman\u0131n (kat d\u00f6\u015femelerinin 15 ve 13 parsellerin kat d\u00f6\u015femeleriyle e\u015fitlenerek birle\u015ftirilmesi) 2863 say\u0131l\u0131 yasan\u0131n 65. maddesi gere\u011fi, yapanlar hakk\u0131nda su\u00e7 duyurusunda bulunulmas\u0131na\u201d karar verdi.<\/div>\n<div><\/div>\n<div>Bu karar\u0131n ard\u0131ndan \u015fantiyenin, b\u00f6yle bir karar hi\u00e7 al\u0131nmam\u0131\u015f gibi devam etmesi nedeniyle, Mimarlar Odas\u0131 \u0130stanbul B\u00fcy\u00fckkent \u015eubesi, 17 Ocak 2011 tarihinde \u0130stanbul Yenileme Alanlar\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131n Koruma B\u00f6lge Kurulu\u2019ndan konuyla ilgili geli\u015fmeler hakk\u0131nda bilgilendirme istedi. Bilgilendirme talebine yan\u0131t gelmemesi nedeniyle, 17 \u015eubat 2011 tarihinde yinelenen dilek\u00e7eye verilen yan\u0131tta; kurul taraf\u0131ndan yap\u0131lan dosya incelemesi sonucunda, Beyo\u011flu Belediyesi\u2019nden kurul karar\u0131 ve sonras\u0131ndaki uygulamaya ili\u015fkin \u00e7at\u0131 gabarisi, cephe y\u00fcksekli\u011fi ve parsel kullan\u0131mlar\u0131na ili\u015fkin tespit raporu istendi\u011fi, s\u00f6z konusu rapor, \u0130stanbul Yenileme Alanlar\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131n Koruma B\u00f6lge Kurulu M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019ne ula\u015ft\u0131ktan sonra ilgili yasalar \u00e7er\u00e7evesinde de\u011ferlendirilece\u011fi belirtildi.<\/div>\n<div><\/div>\n<div>Mimarlar Odas\u0131 \u0130stanbul B\u00fcy\u00fckkent \u015eubesi, 15 Mart 2011 tarihinde, \u0130stanbul Yenileme Alanlar\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131n Koruma B\u00f6lge Kurulu\u2019na yazd\u0131\u011f\u0131 yaz\u0131yla; Demir\u00f6ren AVM in\u015faat\u0131yla, tescilli 13 ve 14 parsellerdeki yap\u0131lar\u0131n ortadan kald\u0131r\u0131ld\u0131\u011f\u0131 ve 15 parseldeki onayl\u0131 proje kapsam\u0131ndaki kot-kesit, kontur gabari ve planlar\u0131na ayk\u0131r\u0131l\u0131k tespit edilmesi nedeniyle uygulaman\u0131n durdurulmas\u0131 ve ilgililer hakk\u0131nda su\u00e7 duyurusunda bulunulmas\u0131na karar verildi\u011fini hat\u0131rlatarak; kendilerinden gelen yaz\u0131da belirtilen tespit tutana\u011f\u0131n\u0131n, bu tespitler zaten daha \u00f6nceki d\u00f6nemlerde yap\u0131lm\u0131\u015f oldu\u011fundan dolay\u0131 beklenilmesine gerek olmad\u0131\u011f\u0131n\u0131 bildirmi\u015f, binay\u0131 a\u00e7\u0131l\u0131\u015f a\u015famas\u0131na getiren uygulamalar\u0131n hangi projeye g\u00f6re s\u00fcrd\u00fcr\u00fcld\u00fc\u011f\u00fcne ili\u015fkin bilgilendirmeyi talep etmi\u015ftir.<\/div>\n<div><\/div>\n<div>Mimarlar Odas\u0131 \u0130stanbul B\u00fcy\u00fckkent \u015eubesi taraf\u0131ndan yaz\u0131lan yaz\u0131da; onayl\u0131 projeye ayk\u0131r\u0131 olan kat ve cephe bile\u015fenlerinin neden aradan ge\u00e7en s\u00fcreye kar\u015f\u0131n y\u0131k\u0131lmad\u0131\u011f\u0131 sorularak, 5 parselde tevhidi bulunmayan ancak, 15 parselde in\u015faat s\u0131ras\u0131nda yok edilen tescilli 13-14 parseller ile ilgili uygulamalar nedeniyle bulunulmas\u0131 gereken su\u00e7 duyurusuyla ilgili savc\u0131l\u0131k ve soru\u015fturma numaras\u0131n\u0131n bildirilmesi istenmi\u015ftir.<\/div>\n<div><\/div>\n<div>T\u00fcm bu s\u00fcre\u00e7lere ra\u011fmen \u00a0Demir\u00f6ren AVM , \u00a0g\u00f6revini unutan T.C. K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131n\u0131n, \u00a0k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 korumakla yetkilendirilmi\u015f \u00a0T.C.
