Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin 13\u2018\u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131na yap\u0131lan ekleme ile \u00fclkemizde plans\u0131zl\u0131\u011f\u0131 planlama politikas\u0131na d\u00f6n\u00fc\u015ft\u00fcren yetki par\u00e7alanmas\u0131 yeni bir boyut kazanm\u0131\u015ft\u0131r.<\/div>\n<div> <\/div>\n<div>\u00a0<\/div>\n<div>Yap\u0131lan d\u00fczenleme ile Maliye Bakanl\u0131\u011f\u0131, Milli Emlak Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018n\u00fcn yetkileri aras\u0131na &#8220;Hazinenin \u00f6zel m\u00fclkiyetinde ve Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda bulunan ta\u015f\u0131nmazlar\u0131n imar planlar\u0131n\u0131 yapmak, yapt\u0131rmak, tadil etmek ve imar uygulamas\u0131n\u0131 ger\u00e7ekle\u015ftirmek&#8221; yetkileri de al\u0131nm\u0131\u015ft\u0131r.<\/div>\n<div><\/div>\n<div>Kamu ad\u0131na, ki\u015fi ve kurum ayr\u0131m\u0131 yap\u0131lmadan e\u015fitlik\u00e7i bir yakla\u015f\u0131mla \u00fcretilmesi gereken plan kararlar\u0131n\u0131n verilmesinde m\u00fclkiyet sahibinin yetkilendirilmesi anlam\u0131na gelen bu d\u00fczenleme, planlaman\u0131n temel ilkelerine a\u00e7\u0131k\u00e7a ayk\u0131r\u0131d\u0131r.\u00a0<\/div>\n<div><\/div>\n<div>Yap\u0131lan d\u00fczenleme, planlama yetkilerinde par\u00e7alanman\u0131n yanl\u0131\u015fl\u0131\u011f\u0131n\u0131n s\u0131k\u00e7a dile getirildi\u011fi, Kentle\u015fme \u015euras\u0131 ve \u015eura sonras\u0131 Resmi Gazete\u2018de yay\u0131mlanan ve t\u00fcm kurumlar a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131 bir strateji belgesi haline gelen KENTGES kararlar\u0131na a\u00e7\u0131k\u00e7a ayk\u0131r\u0131 oldu\u011fu kadar, bu yan\u0131yla iktidar a\u00e7\u0131s\u0131ndan a\u00e7\u0131k bir \u00e7eli\u015fkidir.<\/div>\n<div><\/div>\n<div>\u00c7evre ve Bay\u0131nd\u0131rl\u0131k Bakanl\u0131klar\u0131n\u0131n birle\u015ftirildi\u011fi, &#8220;\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8221;n\u0131n kuruldu\u011fu, \u00fclkemizde uzun s\u00fcredir devam eden \u00fcst \u00f6l\u00e7ekli plan onama yetkisi karma\u015fas\u0131n\u0131n sona erece\u011fine ili\u015fkin umutlar\u0131n ye\u015ferdi\u011fi bir d\u00f6nemde yap\u0131lm\u0131\u015f olan bu d\u00fczenleme umutlar\u0131m\u0131z\u0131 yeniden karartm\u0131\u015ft\u0131r.<\/div>\n<div><\/div>\n<div>Milli Emlak Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan yap\u0131lan, yapt\u0131r\u0131lan ve tadil edilen planlar\u0131n \u00fc\u00e7 ay i\u00e7inde ilgili yerel y\u00f6netim birimi taraf\u0131ndan onaylanmamas\u0131 durumunda, onama yetkisinin Milli Emlak Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018ne ge\u00e7mesine ili\u015fkin d\u00fczenleme, aslen yerel y\u00f6netimlere ait olan plan haz\u0131rlama ve onama yetkilerine, hazine arazileri y\u00f6n\u00fcnden el konulmas\u0131 anlam\u0131na gelmektedir.<\/div>\n<div><\/div>\n<div>D\u00fczenleme ile yerel y\u00f6netimler bask\u0131 alt\u0131na al\u0131nmakta, belediye meclislerinin ve il genel meclislerinin yasadan kaynakl\u0131 yetkileri g\u00f6rmezden gelinmekte ve yetkilerine el konulmakta, se\u00e7ilmi\u015f yerel organlara y\u00f6nelik merkezi dayatma sistemle\u015ftirilmektedir.\u00a0<\/div>\n<div><\/div>\n<div>Di\u011fer yandan yap\u0131lan d\u00fczenleme ile belde belediyelerinin hazine arazileri \u00fczerinde plan yapma\/yapt\u0131rma ve onama yetkileri t\u00fcm\u00fcyle ortadan kald\u0131r\u0131lm\u0131\u015f, Belediye Kanunu ve \u0130mar Kanunu h\u00fck\u00fcmlerine ayk\u0131r\u0131 bi\u00e7imde belde belediyelerinin s\u0131n\u0131rlar\u0131 i\u00e7inde hazine arazilerinin planlanmas\u0131 konusunda valilikler yetkilendirilmi\u015ftir.<\/div>\n<div><\/div>\n<div>Say\u0131lar\u0131 2000\u2018i a\u015fan ve se\u00e7imle gelen belde belediyelerinin yetkilerine t\u00fcm\u00fcyle el konulurken, belde s\u0131n\u0131rlar\u0131 i\u00e7inde hazine arazilerine ili\u015fkin tasarrufta bulunma hakk\u0131 merkezi idarenin uzant\u0131s\u0131 olan valiliklere devredilmek istenmekte belde belediyeleri yok say\u0131lmaktad\u0131r.\u00a0<\/div>\n<div><\/div>\n<div>Kararnamede yap\u0131lan bir ba\u015fka d\u00fczenleme ile hazine arazilerine y\u00f6nelik Milli Emlak Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan yap\u0131lan planlarda getirilen imar fonksiyonlar\u0131n\u0131n ilgili belediyeler ve valilikler taraf\u0131ndan 5 y\u0131l s\u00fcre ile de\u011fi\u015ftirilemeyece\u011fine yer verilmi\u015f, Yerel y\u00f6netimlerin Anayasa\u2018dan ve yasalardan kaynaklanan yetkileri 5 y\u0131l s\u00fcre ile k\u0131s\u0131tlanm\u0131\u015ft\u0131r.<\/div>\n<div><\/div>\n<div>Kamu m\u00fclklerinin de\u011ferinin plan kararlar\u0131yla artt\u0131r\u0131lmas\u0131 ve olu\u015fturulan de\u011ferin sat\u0131\u015f ve el de\u011fi\u015ftirme s\u00fcrecinde korunmas\u0131 mant\u0131\u011f\u0131na dayanan d\u00fczenleme, kentlerde sosyal ve teknik altyap\u0131 alanlar\u0131n\u0131n olu\u015fturulabilmesi a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck \u00f6neme sahip olan kamu arazilerinin t\u00fcm\u00fcyle elden \u00e7\u0131kar\u0131lmas\u0131n\u0131n yan\u0131 s\u0131ra, ge\u00e7mi\u015fte sosyal ve teknik altyap\u0131 tesisleri i\u00e7in d\u00fczenlenmi\u015f olan alanlar\u0131n da sat\u0131\u015fa haz\u0131rlanmas\u0131 anlam\u0131na gelmektedir.<\/div>\n<div><\/div>\n<div>Bu yakla\u015f\u0131m, k\u0131sa s\u00fcre i\u00e7inde kentlerimizin emlak de\u011feri y\u00fckselen b\u00f6lgelerindeki planl\u0131 ya da plans\u0131z bo\u015f kamu arazilerinin yan\u0131 s\u0131ra, m\u00fclkiyeti Maliye Hazinesi\u2018ne ait olan t\u00fcm tesislerin, okullar\u0131n, ye\u015fil alanlar\u0131n, sosyal ve k\u00fclt\u00fcrel tesislerin, sa\u011fl\u0131k tesislerinin, spor tesislerinin de planlar\u0131n\u0131n de\u011fi\u015ftirilerek sat\u0131lmas\u0131, kentlerimize alt\u0131ndan kalk\u0131lamayacak bir b\u00fcy\u00fck darbenin vurulmas\u0131 anlam\u0131na gelmektedir.<\/div>\n<div><\/div>\n<div>At\u0131lacak yanl\u0131\u015f ad\u0131mlarla kentlerimize vurulacak b\u00f6ylesi bir darbe, kentlerimizi bug\u00fcn bulundu\u011fu noktadan \u00e7ok daha geriye s\u00fcr\u00fckleyecektir.<\/div>\n<div><\/div>\n<div>Bu nedenle, g\u00f6reve yeni ba\u015flam\u0131\u015f olan H\u00fck\u00fcmetimizin, bir \u00f6nceki H\u00fck\u00fcmet d\u00f6neminde ger\u00e7ekle\u015ftirilmi\u015f olan Kentle\u015fme \u015euras\u0131 ve KENTGES kararlar\u0131na sahip \u00e7\u0131kmas\u0131n\u0131, kentlerimizi i\u00e7inden \u00e7\u0131k\u0131lmaz duruma s\u00fcr\u00fckleyen, plan onama yetkilerinde var olan par\u00e7al\u0131 yap\u0131ya yeni par\u00e7alar eklemekten ka\u00e7\u0131nmas\u0131n\u0131, var olan \u00e7ok par\u00e7al\u0131 yap\u0131y\u0131 ortadan kald\u0131racak ad\u0131mlar\u0131 atmas\u0131n\u0131 bekliyoruz.<\/div>\n<div><\/div>\n<div>Kamuoyuna sayg\u0131 ile
