Cumhuriyet\u2018in kurulu\u015f a\u015famas\u0131nda ve i\u015fgalci emperyalizme kar\u015f\u0131 verilen ba\u011f\u0131ms\u0131zl\u0131k sava\u015f\u0131 d\u00f6nemi d\u00e2hil, 1921 ve 1924 Anayasalar\u0131nda b\u00f6yle bir uygulamaya ve h\u00fck\u00fcmetlerin yetki talebine rastlanmamaktad\u0131r. Anayasa tarihimizde &#8220;demokratik ve \u00f6zg\u00fcrl\u00fck\u00e7\u00fc&#8221; kabul edilen 1961 Anayasas\u0131nda da KHK yoktur. 12 Mart 1971 darbesinde bile zay\u0131f bir \u015fekilde uygulanm\u0131\u015ft\u0131r. Fakat as\u0131l &#8220;12 Eyl\u00fclc\u00fcler&#8221;, bu yetkiyi geni\u015fletmi\u015f ve bolca kullanm\u0131\u015flard\u0131r. 1982 Anayasas\u0131n\u0131n 87. maddesi ile, &#8220;Bakanlar Kuruluna belli konularda kanun h\u00fckm\u00fcnde kararname \u00e7\u0131karma yetkisi&#8221; vermek, TBMM\u2018nin g\u00f6rev ve yetkileri aras\u0131nda ge\u00e7mi\u015f ve Anayasan\u0131n 91. maddesinde de KHK \u00e7\u0131karma yetkisi d\u00fczenlenmi\u015ftir. 1971-1985 y\u0131llar\u0131 aras\u0131nda \u00e7\u0131kar\u0131lan yakla\u015f\u0131k 200 KHK\u2018den 34\u2018\u00fc 12 Eyl\u00fcl 1980\u2018den \u00f6nceki h\u00fck\u00fcmetlere ait oldu\u011fu halde, geriye kalan 166 adet KHK, 12 Eyl\u00fcl 1980 &#8211; 1 Ocak 1985 tarihleri aras\u0131nda \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Yani yakla\u015f\u0131k 10 y\u0131l i\u00e7inde 34 KHK \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 halde, sonraki 5 y\u0131ll\u0131k s\u00fcrede 166 KHK yay\u0131nlanm\u0131\u015ft\u0131r. 1991\u2018e kadar \u00e7\u0131kar\u0131lan KHK say\u0131s\u0131 ise 400\u2018den fazlad\u0131r. \u00d6zetle g\u00f6r\u00fclmesi gereken \u015fu ki; KHK uygulamas\u0131, \u00f6z\u00fc itibariyle anti-demokratik olan 12 Mart ve 12 Eyl\u00fcl darbe d\u00f6nemlerinde \u00e7ok\u00e7a ba\u015fvurulmu\u015f bir uygulamad\u0131r.<\/div>\n<div> <\/div>\n<div>\u00a0<\/div>\n<div>12 Haziran Genel Se\u00e7imlerinin hemen \u00f6ncesinde, siyasal iktidar, darbe d\u00f6nemlerini an\u0131msatan b\u00f6yle bir uygulamaya imza att\u0131. &#8220;3046 say\u0131l\u0131 Kanun ile Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun H\u00fckm\u00fcnde Kararname&#8221;, 8 Haziran 2011\u2018de yasala\u015ft\u0131. Bu KHK\u2018nin kapsam\u0131nda, bakanl\u0131klar\u0131n yap\u0131lan\u0131\u015f\u0131n\u0131 ve organizasyonunu de\u011fi\u015ftirmek, ba\u011fl\u0131 kurulu\u015flar\u0131n ilgilerini yeniden belirlemek ve bunlar\u0131n g\u00f6rev, yetki, te\u015fkilat ve kadrolar\u0131n\u0131 d\u00fczenlenmek gibi h\u00fck\u00fcmler getirildi. \u00c7\u0131kart\u0131lan KHK uyar\u0131nca, 6 yeni Bakanl\u0131k ihdas edildi. 2 bakanl\u0131k birle\u015ftirilip tek bakanl\u0131k yap\u0131ld\u0131. 2 bakanl\u0131k ise d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc. Olu\u015fturulan yeni bakanl\u0131klardan biri, &#8220;\u00c7evre, Orman ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8221; idi. Fakat aradan bir ay bile ge\u00e7meden ve siyasal iktidar Bakanlar Kurulu\u2018nu kurmak \u00fczere iken, yeni bir KHK ile, \u00c7evre, Orman ve \u015eehircilik Bakanl\u0131\u011f\u0131 &#8220;b\u00f6l\u00fcnerek \u00e7o\u011fald\u0131&#8221; ve &#8220;\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8221; ile &#8220;Orman ve Su \u0130\u015fleri Bakanl\u0131\u011f\u0131&#8221; olarak ikiye ayr\u0131ld\u0131. Bu son de\u011fi\u015fikli\u011fin gerek\u00e7esi kamuoyunda yine anla\u015f\u0131lamad\u0131!<\/div>\n<div><\/div>\n<div>Haziran 2011 tarihli s\u00f6z konusu yeni d\u00fczenlemeler, siyasal iktidar\u0131n, \u00f6zerk ve kamu t\u00fczel ki\u015fili\u011fi olan demokratik meslek kurulu\u015flar\u0131 \u00fczerinde &#8220;s\u0131k\u0131&#8221; denetim ve bask\u0131 olu\u015fturmak istedi\u011fini g\u00f6stermektedir. Zira bu KHK\u2018ye dayal\u0131 olarak &#8220;\u00c7evre, Orman ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8221;n\u0131n g\u00f6revleri aras\u0131nda &#8220;&#8230;ilgili mesleki hizmetlerin ve bu meslek mensuplar\u0131n\u0131n kay\u0131tl\u0131 olduklar\u0131 meslek odalar\u0131n\u0131n mevzuat\u0131n\u0131, norm ve standartlar\u0131n\u0131 haz\u0131rlamak, geli\u015ftirmek, uygulanmas\u0131n\u0131 sa\u011flamak, ilgililerin kay\u0131tlar\u0131n\u0131 tutmak&#8221; \u015feklinde d\u00fczenlemeye gidildi. Ayr\u0131ca, Bakanl\u0131k b\u00fcnyesinde kurulan &#8220;Mesleki Hizmetler Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8221;n\u00fcn g\u00f6revleri aras\u0131na &#8220;Bakanl\u0131\u011f\u0131n g\u00f6rev alan\u0131na giren konularla ilgili olarak mimarl\u0131k ve m\u00fchendislik meslek kurulu\u015flar\u0131na ili\u015fkin mevzuat d\u00fczenlemelerini yapmak ve denetlemek&#8221; h\u00fckm\u00fc konuldu. Aradan bir ay bile ge\u00e7meden 4 Temmuz 2011 tarihinde yap\u0131lan yeni d\u00fczenlemede ise, Bakanl\u0131\u011f\u0131n g\u00f6revleri aras\u0131ndan &#8220;meslek odalar\u0131n\u0131n mevzuat\u0131n\u0131 haz\u0131rlama&#8221; ifadesi \u00e7\u0131kar\u0131ld\u0131. Ancak, yeni kurulan Mesleki Hizmetler Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018n\u00fcn g\u00f6revleri aras\u0131nda &#8220;Bakanl\u0131\u011f\u0131n g\u00f6rev alan\u0131na giren konularla ilgili olarak mimarl\u0131k ve m\u00fchendislik meslek kurulu\u015flar\u0131na ili\u015fkin mevzuat\u0131 haz\u0131rlamak ve bunlar\u0131 denetlemek&#8221; \u015feklinde bir de\u011fi\u015fiklik yer ald\u0131. Oysa y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lan Bay\u0131nd\u0131rl\u0131k ve \u0130sk\u00e2n Bakanl\u0131\u011f\u0131\u2018n\u0131n g\u00f6revleri aras\u0131nda, b\u00f6ylesi m\u00fcdahale i\u00e7eren bir g\u00f6rev tan\u0131m\u0131na yer verilmemi\u015fti.<\/div>\n<div><\/div>\n<div>Yap\u0131lan d\u00fczenleme Bakanl\u0131\u011f\u0131n \u00f6zerk ve kamu t\u00fczel ki\u015fili\u011fi olan, b\u00fct\u00e7esi kendi \u00fcyeleri taraf\u0131ndan olu\u015fturulan ve organlar\u0131 kendi \u00fcyeleri taraf\u0131ndan demokratik yollarla olu\u015fturulan meslek odalar\u0131n\u0131n yerine ge\u00e7erek, onlar ad\u0131na mevzuat d\u00fczenleme anlam\u0131n\u0131 i\u00e7eren ve vesayet ili\u015fkisini \u00e7ok a\u015fan, hiyerar\u015fik bir ili\u015fkiye kar\u015f\u0131l\u0131k gelmektedir. KHK ile getirilen de\u011fi\u015fiklik, Meslek Odalar\u0131n\u0131n kurulu\u015fu ile ilgili Anayasa\u2018n\u0131n 135. maddesi ve 6235 say\u0131l\u0131 TMMOB Yasas\u0131 ile yine Anayasan\u0131n 123. ve 124. maddeleri \u00e7er\u00e7evesinde de\u011ferlendirildi\u011finde, Anayasa ve \u0130dare Hukuk ilkelerine a\u00e7\u0131k\u00e7a ayk\u0131r\u0131l\u0131k ta\u015f\u0131maktad\u0131r. Ayr\u0131ca bu d\u00fczenlemenin s\u00f6z konusu KHK\u2018nin yetki \u00e7er\u00e7evesi i\u00e7erisinde olmad\u0131\u011f\u0131 hususu da bir di\u011fer ayk\u0131r\u0131l\u0131k konusudur. Bu yakla\u015f\u0131m\u0131n TMMOB\u2018nin &#8220;kamu t\u00fczelki\u015fili\u011fi&#8221; ve &#8220;\u00f6zerklik&#8221; unsurlar\u0131n\u0131 yok etmek anlam\u0131 ta\u015f\u0131d\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/div>\n<div><\/div>\n<div>Sorulmas\u0131 ve irdelenmesi gereken soru a\u00e7\u0131k ve nettir. Siyasal iktidarca \u00f6zg\u00fcrl\u00fcklerin ve demokrasinin geli\u015ftirilmesi i\u00e7in her y\u00f6nde \u00e7aba verildi\u011fi ifade edilen bir s\u00fcre\u00e7te(!), yasalarla kurulmu\u015f ve bu yetkisi i\u00e7erisinde \u00e7al\u0131\u015fmalar\u0131n\u0131 s\u00fcrd\u00fcren, demokratik ve \u00f6zerk yap\u0131s\u0131yla \u00fclkenin ayd\u0131nl\u0131k y\u00fcz\u00fc olan TMMOB\u2018nin bakanl\u0131k b\u00fcnyesinde bir genel m\u00fcd\u00fcrl\u00fc\u011fe d\u00f6n\u00fc\u015ft\u00fcr\u00fclme u\u011fra\u015f\u0131 nedir\/nedendir? Evet, ger\u00e7ekte sorulmas\u0131 gereken soru budur. Yakla\u015f\u0131k 400 bin m\u00fchendis, mimar ve \u015fehir planc\u0131s\u0131n\u0131n \u00fcyesi olduklar\u0131 demokratik meslek kurulu\u015fu ile neden u\u011fra\u015f\u0131lmak istenmektedir?<\/div>\n<div><\/div>\n<div>TMMOB, kurulu\u015fundan bu yana yar\u0131m asr\u0131 ge\u00e7en bir d\u00f6nemde emekten, halktan ve toplumdan yana, \u00f6zg\u00fcr ve ba\u011f\u0131ms\u0131z bir T\u00fcrkiye i\u00e7in bilimin \u0131\u015f\u0131\u011f\u0131nda ve akl\u0131n yol g\u00f6stericili\u011finde \u00fclkenin kalk\u0131nmas\u0131 ve geli\u015fmesi y\u00f6n\u00fcnde onurlu ve dik y\u00fcr\u00fcmektedir. TMMOB, 24 Ocak 1980 ekonomik kararlar\u0131 ile 12 Eyl\u00fcl 1980 darbe sonras\u0131 T\u00fcrkiye\u2018nin reformlar ad\u0131 alt\u0131nda uygulamaya konulan programlar sonucu neo-liberal politikalar ile nas\u0131l d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fcn bilinci i\u00e7erisindedir. TMMOB, bu d\u00f6n\u00fc\u015f\u00fcm ve yeniden yap\u0131lanma ile, emperyalist s\u00f6m\u00fcr\u00fc, yeni sermaye ve ranta dayal\u0131 \u00e7\u0131kar gruplar\u0131n\u0131n istekleri do\u011frultusunda, serbestle\u015ftirme ve \u00f6zelle\u015ftirmeler sonucu T\u00fcrkiye\u2018nin; tar\u0131mda, sanayide, kentle\u015fmede, orman, mera ve k\u0131y\u0131 alanlar\u0131nda, k\u00fclt\u00fcr varl\u0131klar\u0131 ve sit alanlar\u0131nda, do\u011fada, k\u0131sacas\u0131 ya\u015fam\u0131n her alan\u0131nda her ge\u00e7en g\u00fcn derinle\u015fen bir \u00e7\u0131kmaza s\u00fcr\u00fcklendi\u011finin bilincindedir.<\/div>\n<div><\/div>\n<div>TMMOB, \u00fclkemizde ya\u015fan\u0131lmakta olan bu olumsuz geli\u015fmeleri, meslek alanlar\u0131m\u0131zdan hareketle olu\u015fturulan bilimsel ve teknik raporlar ile \u00fcyelerine ve kamuoyuna a\u00e7\u0131klamaktad\u0131r. Gerekti\u011finde yine kamu ve toplum yarar\u0131 ad\u0131na yarg\u0131ya gitmektedir. Yarg\u0131dan \u00e7\u0131kan iptal kararlar\u0131 iktidarlarca be\u011fenilmemektedir. TMMOB ve meslek odalar\u0131, bu y\u00fczden sevilmeyen &#8220;k\u00f6t\u00fc \u00e7ocuk&#8221;tur. Disiplin ve zapturapt alt\u0131na al\u0131nmas\u0131 gereklidir. \u0130zlenecek yol da bellidir.<\/div>\n<div><\/div>\n<div>Bu \u00fclkenin ayd\u0131nl\u0131k ve g\u00fclen y\u00fcz\u00fc olan TMMOB ve ba\u011fl\u0131 Odalar\u0131, d\u00fcn oldu\u011fu gibi bug\u00fcn de onurlu y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fc ve hakl\u0131 m\u00fccadelesini her platformda s\u00fcrd\u00fcrecektir. Bask\u0131lar bizi y\u0131ld\u0131ramayacakt\u0131r. Bilim ve ak\u0131l sus(turula)mayacakt\u0131r.
