Sanki \u00fclke b\u00fcy\u00fck bir matru\u015fka ve her an i\u00e7inden bir di\u011ferinin bir benzerini \u00e7\u0131karmaya haz\u0131r bekliyor. Cinayetin \u015fekli de ait oldu\u011fu d\u00f6nemin b\u00fct\u00fcn karakteristi\u011fini yans\u0131t\u0131yor. Yak, y\u0131k, yok et ve \u00fczerini \u00f6rt. Bunun son olarak bir kad\u0131n kimli\u011finde v\u00fccut bulmas\u0131 ayr\u0131ca insan olu\u015fumuz \u00fczerinden \u00e7ok daha y\u0131k\u0131c\u0131 ve yaralay\u0131c\u0131 \u00e7\u00fcnk\u00fc duyguda\u015fl\u0131k kurdu\u011fumuz \u015fey hayat\u0131m\u0131z. Yani ya\u015fama hakk\u0131n\u0131n \u00fczerine beton d\u00f6k\u00fclmesi. Bunu s\u00f6ylerken belirtmeden ge\u00e7emiyorum. Ne Dersim\u2019deki ke\u00e7inin, ne Eski\u015fehir\u2019deki geyi\u011fin, s\u00f6k\u00fcp at\u0131lan fidan\u0131n, ne kedinin, ne ku\u015fun, ne k\u00f6pe\u011fin ya\u015fam hakk\u0131ndan azade hayat\u0131m\u0131z. Ya\u015fam hakk\u0131n\u0131n kutsall\u0131\u011f\u0131n\u0131 da Sel\u00e7uk Koza\u011fa\u00e7l\u0131 \u00e7ok g\u00fczel anlatm\u0131\u015ft\u0131: <em>\u201cYa\u015fam\u0131n kendisi de\u011fil kutsal olan. Kutsal olan, adil ya\u015fam. Kutsal olan, onurlu bir ya\u015fam. Kutsal olan, g\u00fcvenli bir ya\u015fam. Kutsal olan, haysiyet sahibi bir ya\u015fam. Ya\u015fam\u0131n kendisi de\u011fil, s\u0131rf ya\u015famak de\u011fil kutsal olan.\u201d <\/em><\/p>\n<p>Her an \u00fclkenin herhangi bir yerinden k\u00fc\u00e7\u00fckl\u00fc b\u00fcy\u00fckl\u00fc iktidar temsili olaylara tan\u0131k oluyoruz. Davran\u0131\u015f bi\u00e7imlerinin hoyrat\u00e7a bir umursamazl\u0131kla birbirine benzemesi, kad\u0131n cinayetlerinin ya da erkek \u015fiddetinin politik oldu\u011funu ispatl\u0131yor bir yandan. <\/p>\n<p>Kad\u0131na y\u00f6nelik \u015fiddetin kad\u0131nlar ile erkekler aras\u0131ndaki e\u015fit olmayan g\u00fc\u00e7 ili\u015fkilerinden, toplumsal cinsiyet temelli ayr\u0131mc\u0131l\u0131ktan kaynakland\u0131\u011f\u0131n\u0131 kabul eden ve bu verili durumu temel alarak olu\u015fturulan bir s\u00f6zle\u015fme \u0130stanbul S\u00f6zle\u015fmesi. Bu s\u00f6zle\u015fme \u00f6ncelikle kad\u0131nlar\u0131n insan haklar\u0131ndan oldu\u011fu gibi yararlanmas\u0131n\u0131n \u00f6n\u00fcndeki en b\u00fcy\u00fck engel olan kad\u0131na y\u00f6nelik \u015fiddetin \u00f6nlenmesi ve g\u00fc\u00e7 ili\u015fkilerinin e\u015fitlenmesi i\u00e7in kad\u0131nlar\u0131n desteklenmesini ama\u00e7l\u0131yor. <\/p>\n<p><strong>Bu s\u00f6zle\u015fmeyi bu kadar \u00f6nemli k\u0131lan nedir?<\/strong><\/p>\n<p>Kad\u0131na Y\u00f6nelik \u015eiddet ve Ev \u0130\u00e7i \u015eiddetin \u00d6nlenmesi ve Bunlarla M\u00fccadeleye Dair Avrupa Konseyi S\u00f6zle\u015fmesi, 1 A\u011fustos 2014&#8217;te y\u00fcr\u00fcrl\u00fc\u011fe girdi. \u0130stanbul\u2019da imzaland\u0131\u011f\u0131 i\u00e7in \u0130stanbul S\u00f6zle\u015fmesi olarak an\u0131ld\u0131. Kad\u0131na y\u00f6nelik \u015fiddet konusunda devletleri ba\u011flay\u0131c\u0131 g\u00fcc\u00fc olan ilk uluslararas\u0131 s\u00f6zle\u015fme olup ilk imzac\u0131s\u0131 da T\u00fcrkiye\u2019dir. \u0130stanbul S\u00f6zle\u015fmesi \u00f6zetle \u015fu konular\u0131 garanti alt\u0131na al\u0131r: Kad\u0131nlara y\u00f6nelik her t\u00fcrl\u00fc \u015fiddetin \u00f6nlenmesi, durdurulmas\u0131, faillerin kovu\u015fturulmas\u0131, yarg\u0131lanmas\u0131 ve cezaland\u0131r\u0131lmas\u0131.<\/p>\n<p>Bu s\u00f6zle\u015fmenin amac\u0131 \u015f\u00f6yle s\u0131ralanm\u0131\u015ft\u0131r:<br \/>\n<em><br \/>\na- Kad\u0131nlar\u0131 her t\u00fcrl\u00fc \u015fiddete kar\u015f\u0131 korumak ve kad\u0131na kar\u015f\u0131 \u015fiddeti ve aile i\u00e7i \u015fiddeti \u00f6nlemek, kovu\u015fturmak ve ortadan kald\u0131rmak;<\/p>\n<p>b- Kad\u0131na kar\u015f\u0131 her t\u00fcrl\u00fc ayr\u0131mc\u0131l\u0131\u011f\u0131n ortadan kald\u0131r\u0131lmas\u0131na katk\u0131da bulunmak ve kad\u0131nlar\u0131 g\u00fc\u00e7lendirmek de dahil olmak \u00fczere, kad\u0131nlarla erkekler aras\u0131nda \u00f6nemli<br \/>\n\u00f6l\u00e7\u00fcde e\u015fitli\u011fi yayg\u0131nla\u015ft\u0131rmak;<\/p>\n<p>c- Kad\u0131na kar\u015f\u0131 \u015fiddet ve aile i\u00e7i \u015fiddetin t\u00fcm ma\u011fdurlar\u0131n\u0131n korunmas\u0131 ve bunlara yard\u0131m edilmesi i\u00e7in kapsaml\u0131 bir \u00e7er\u00e7eve, politika ve tedbirler tasarlamak;<\/p>\n<p>d- Kad\u0131na kar\u015f\u0131 \u015fiddeti ve aile i\u00e7i \u015fiddeti ortadan kald\u0131rma amac\u0131yla uluslararas\u0131 i\u015fbirli\u011fini<br \/>\nyayg\u0131nla\u015ft\u0131rmak;<\/p>\n<p>e- Kad\u0131na kar\u015f\u0131 \u015fiddet ve aile i\u00e7i \u015fiddetin ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in b\u00fct\u00fcnc\u00fcl bir yakla\u015f\u0131m\u0131n benimsenmesi maksad\u0131yla kurulu\u015flar\u0131n ve kolluk kuvvetleri birimlerinin birbiriyle etkili bir bi\u00e7imde i\u015fbirli\u011fi yapmalar\u0131na destek ve yard\u0131m sa\u011flamak.<\/em><\/p>\n<p>S\u00f6zle\u015fme kapsam\u0131nda \u2018kad\u0131na kar\u015f\u0131 \u015fiddet\u2019, \u2018aile i\u00e7i \u015fiddet\u2019, \u2018toplumsal cinsiyet\u2019, \u2018kad\u0131nlara kar\u015f\u0131 toplumsal cinsiyete dayal\u0131 \u015fiddet\u2019, \u2018ma\u011fdur\u2019 ve \u2018kad\u0131n\u2019 terimlerinin ne demek oldu\u011fu tan\u0131mlanm\u0131\u015ft\u0131r. Son g\u00fcnlerde \u0130stanbul S\u00f6zle\u015fmesi\u2019nden \u00e7ekilmenin tart\u0131\u015f\u0131lmaya ba\u015flanmas\u0131 y\u0131llar\u0131n kazan\u0131m\u0131 olan bir m\u00fccadelenin maalesef iktidar eliyle kad\u0131nlar\u0131n cinsiyet ayr\u0131mc\u0131l\u0131\u011f\u0131na tabi tutuldu\u011funun a\u00e7\u0131k beyan\u0131 olmu\u015ftur.<\/p>\n<p>B\u00fct\u00fcn bu tart\u0131\u015fmalar\u0131n oda\u011f\u0131nda olan s\u00f6zle\u015fmenin feshi iste\u011fi e\u015fcinselli\u011fe \u00f6zendirdi\u011fi, erke\u011fi evden uzakla\u015ft\u0131rarak aile yap\u0131s\u0131n\u0131 bozdu\u011fu, cinsiyet e\u015fitli\u011fi projesiyle sosyal yap\u0131m\u0131z\u0131 \u00e7\u00f6kertti\u011fi gibi tamamen erkek egemen ve heteroseksist bir dil, bak\u0131\u015f a\u00e7\u0131s\u0131 ve tutum ta\u015f\u0131yor.  Bu istek, kazan\u0131lm\u0131\u015f haklar\u0131n kad\u0131nlar\u0131n elinden al\u0131nmas\u0131 \u00fczerine kurulu yeni toplum dizayn\u0131nda kad\u0131n\u0131n sosyal hayat\u0131n d\u0131\u015f\u0131na itilmesine y\u00f6nelik bir tutumun izlerini ta\u015f\u0131r. \u00dcstelik bir hayat\u0131n b\u00fct\u00fcn unsurlar\u0131n\u0131 ayn\u0131 samimiyet ve haklarla ayakta tutmay\u0131 b\u00fcy\u00fctmek \u00fczerine a\u015fa\u011f\u0131daki gibi bir maddesi varken!<\/p>\n<p>Madde 4-\u2018te \u015f\u00f6yle der; <em>\u201cTaraflar bu S\u00f6zle\u015fme h\u00fck\u00fcmlerinin, \u00f6zellikle de ma\u011fdurlar\u0131n haklar\u0131n\u0131 korumaya y\u00f6nelik tedbirlerin, cinsiyet, toplumsal cinsiyet, \u0131rk, renk, dil, din, siyasi veya ba\u015fka t\u00fcr g\u00f6r\u00fc\u015f, ulusal veya sosyal k\u00f6ken, bir ulusal az\u0131nl\u0131kla ba\u011flant\u0131l\u0131 olma, m\u00fclk, do\u011fum, cinsel y\u00f6nelim, toplumsal cinsiyet kimli\u011fi, sa\u011fl\u0131k durumu, engellilik, medeni hal, g\u00f6\u00e7men veya m\u00fclteci stat\u00fcs\u00fc veya ba\u015fka bir stat\u00fc gibi, herhangi bir temele dayal\u0131 olarak ayr\u0131mc\u0131l\u0131k yap\u0131lmaks\u0131z\u0131n uygulanmas\u0131n\u0131 temin edeceklerdir. \u201c<\/em><\/p>\n<p><img decoding=\"async\" src=\"\/wp-content\/uploads\/2020\/07\/6284_1.jpg\" alt=\"\" width=\"650\" height=\"360\" class=\"aligncenter size-full wp-image-33552\" \/><\/p>\n<p>Yak\u0131n zamanda diyanetin \u015fiddet g\u00f6ren kad\u0131na, susup kocas\u0131na ak\u015fam g\u00fczel yemekler yapmas\u0131n\u0131 sal\u0131k vermesiyle bu s\u00f6zle\u015fmenin pek uyu\u015fmad\u0131\u011f\u0131 ortada. Kad\u0131na y\u00f6nelik \u015fiddetin b\u00fcy\u00fck k\u0131sm\u0131 e\u015fit olmayan g\u00fc\u00e7 ili\u015fkilerinden, toplumsal cinsiyet temelli ayr\u0131mc\u0131l\u0131ktan besleniyor. Kad\u0131na y\u00f6nelik \u015fiddetin \u00f6nlenmesi i\u00e7in en ba\u015fta kad\u0131nlar ile erkekler aras\u0131ndaki e\u015fitsizli\u011fi besleyen toplumsal cinsiyet rollerinin ve \u00f6nyarg\u0131lar\u0131n ortadan kald\u0131r\u0131lmas\u0131na y\u00f6nelik politikalar\u0131n hayata ge\u00e7irilmesi gerekiyor. Fakat devlet kurumlar\u0131 kad\u0131na y\u00f6nelik \u015fiddetin \u00f6n\u00fcne ge\u00e7ecek \u015fekilde failleri cezaland\u0131rm\u0131yor. T\u00f6re cinayetlerine kar\u015f\u0131 sus pus olunmas\u0131n\u0131n, cezai indirimlerin t\u0131pk\u0131 bir siyasi tutum olmas\u0131 gibi, yasalarla g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f haklar\u0131n siyasi iradeyle engellenmesi de s\u00f6z konusudur. B\u00f6ylelikle yeni toplum dizayn\u0131nda kad\u0131nlara yerleri g\u00f6sterilmektedir: <em>\u2018G\u00f6r\u00fcnmez ol, ba\u015f\u0131na bir \u015fey gelmesin. Yoksa ben yan\u0131nda de\u011filim.\u2019<\/em> Bize dikte edilen \u015fey kar\u015f\u0131s\u0131nda daha az g\u00fcvende hissedip daha fazla erkeklere ba\u011f\u0131ml\u0131 hale gelmemiz isteniyor. Anayasal haklar\u0131m\u0131za ra\u011fmen hayatta kalma garant\u00f6r\u00fcm\u00fcz\u00fcn de \u201cerkek\u201d olmas\u0131 bekleniyor ki bu b\u00fcy\u00fck ironidir. \u015eiddet vakalar\u0131na bakt\u0131\u011f\u0131n\u0131zda \u015fiddetin kad\u0131n\u0131n en yak\u0131nlar\u0131 taraf\u0131ndan uyguland\u0131\u011f\u0131n\u0131 kolayca g\u00f6rebiliriz. <\/p>\n<p>G\u00fcvenli ya\u015fam hakk\u0131m\u0131z uluslararas\u0131 bir s\u00f6zle\u015fmeyle g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f iken siyasi iktidar bu s\u00f6zle\u015fmeyi feshetmeyi konu\u015fuyor. <\/p>\n<p>Gitgide daha belirginle\u015fen di\u011fer bir olgu da siyasilerin dillerinin toplumda bir kar\u015f\u0131l\u0131k bulmas\u0131 ve bu dilden \u015fiddetin beslenmesi konusu. Medya eliyle yayg\u0131nla\u015ft\u0131r\u0131lan, yarg\u0131 eliyle aklanan bu dil gitgide \u015fiddet dinami\u011fini b\u00fcy\u00fctmekte ve neredeyse makbul davran\u0131\u015f haline d\u00f6n\u00fc\u015ft\u00fcrmektedir. Her \u015fiddet olay\u0131n\u0131n sonras\u0131nda haber diliyle ba\u015flayarak ilk sorgulanan\u0131n \u2018o esnada kad\u0131n\u0131n ne yapmakta oldu\u011fu\u2019 fikri hem \u015fiddetin hem de faili olan erke\u011fin aklanmas\u0131 \u00e7al\u0131\u015fmalar\u0131n\u0131n da ilk ad\u0131m\u0131 oluyor. <\/p>\n<p>B\u00fct\u00fcn bu iradi politik giri\u015fimlere sadece ahlaki boyutta bakmak \u00e7ok do\u011fru de\u011fil. Gitgide b\u00fcy\u00fcyen i\u015fsizlik, konut sorunu ve yoksulla\u015fman\u0131n beraberinde getirdi\u011fi ekonomik s\u0131k\u0131nt\u0131lar\u0131n giderilmesinde siyasi iktidar toplumun yar\u0131s\u0131 olan kad\u0131n\u0131 eve hapsederek, iradesini \u00e7alarak, \u2018i\u015f bulma, konut edinmesini sa\u011flama ve yoksullu\u011funu giderecek ekonomik tedbirler alma\u2019 sorumlulu\u011funu b\u0131rakarak ve hedefi ba\u015fka bir yana y\u00f6nlendirerek ka\u00e7maktad\u0131r. Erkeklerin i\u015fsizliklerinin nedeninin kad\u0131n istihdam\u0131n\u0131n artmas\u0131 olarak g\u00f6r\u00fclmesi gibi. Nitekim bir erkek \u015f\u00f6yle diyebilmektedir:<em> \u201cBenim \u00e7al\u0131\u015fmam gereken yerde kad\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u00e7in i\u015fsizim!\u201d<\/em><br \/>\nDi\u011fer yandan aile i\u00e7i \u015fiddete kar\u015f\u0131 kad\u0131n ve \u00e7ocuklar\u0131 koruyan programlar\u0131 uygulamak \u00fczere b\u00fct\u00e7e ay\u0131rmak yerine kad\u0131na \u015funu s\u00f6ylemektedir: <em>\u201cKocand\u0131r yapar.\u201d<\/em> Kad\u0131n\u0131n i\u015fsizli\u011fe mahkum edilip sonras\u0131nda \u015fiddet de g\u00f6rse ayr\u0131lamaz hale gelmesi de ayn\u0131 ekonomik yapt\u0131r\u0131mdan gelir. \u00c7al\u0131\u015fan kad\u0131nlar\u0131n \u00e7ocuklar\u0131na kre\u015fler a\u00e7arak \u00e7al\u0131\u015fmas\u0131n\u0131n desteklenmesi yerine kad\u0131n\u0131n \u00e7ok daha az kazanmas\u0131n\u0131 g\u00f6rmezden gelerek mecburen i\u015finden ayr\u0131l\u0131p \u00e7ocuklar\u0131na bakan hale gelmesi istenmektedir. Kad\u0131nlar\u0131n kanunlarla korunmas\u0131 gereken haklar\u0131 i\u00e7in yarg\u0131 organlar\u0131n\u0131n i\u015fini do\u011fru yapmas\u0131n\u0131n sa\u011flanmas\u0131 yerine devlet \u201cbaba\u201d olarak koruyuculu\u011fa soyunmaktad\u0131r. Sonu\u00e7 olarak kad\u0131nlar sadece kocas\u0131n\u0131n de\u011fil siyasi iktidar\u0131n da kullan\u0131\u015fl\u0131 k\u00f6leleri haline getirilmektedir. <\/p>\n<p>Bilin\u00e7li ve sistematik yollarla yolumuza ta\u015f konulmas\u0131, \u00e7elme tak\u0131lmas\u0131 kar\u015f\u0131s\u0131nda elbette bizim de birka\u00e7 s\u00f6z\u00fcm\u00fcz olacak.
