{"id":3368,"date":"2011-08-26T23:11:24","date_gmt":"2011-08-26T20:11:24","guid":{"rendered":"http:\/\/politeknik.org.tr\/\/?p=3368"},"modified":"2019-01-28T18:37:04","modified_gmt":"2019-01-28T15:37:04","slug":"648-sayili-kanun-hukmunde-kararname-degerlendirmesi-sehir-plancilari-odasi","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/648-sayili-kanun-hukmunde-kararname-degerlendirmesi-sehir-plancilari-odasi\/","title":{"rendered":"648 Say\u0131l\u0131 \u201cKanun H\u00fckm\u00fcnde Kararname\u201d De\u011ferlendirmesi &#8211; \u015eehir Planc\u0131lar\u0131 Odas\u0131"},"content":{"rendered":"<p><strong>1.\u00a0\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018n\u0131n Kurulmas\u0131 ve Kararnameler S\u00fcreci<\/strong><\/p>\n<p>\u00dclkemizde \u00fcst \u00f6l\u00e7ekli planlama yetkisini kullanan bakanl\u0131klar aras\u0131nda var olan tart\u0131\u015fmalar uzunca bir s\u00fcredir g\u00fcndem olu\u015fturmaktad\u0131r. \u00d6zellikle koalisyon h\u00fck\u00fcmetleri d\u00f6neminde bakanl\u0131klar aras\u0131nda genelgeler yoluyla kavgaya d\u00f6n\u00fc\u015fen bu s\u00fcre\u00e7ten duyulan rahats\u0131zl\u0131k \u00e7\u00f6z\u00fcm aray\u0131\u015flar\u0131n\u0131 g\u00fcndeme ta\u015f\u0131m\u0131\u015f, sorunun varl\u0131\u011f\u0131 ve \u00e7\u00f6z\u00fcm \u00f6nerileri, AKP \u0130ktidar\u0131 d\u00f6neminde Bay\u0131nd\u0131rl\u0131k ve \u0130sk\u00e2n Bakanl\u0131\u011f\u0131 taraf\u0131ndan ger\u00e7ekle\u015ftirilen Kentle\u015fme \u015euras\u0131\u2018na ve \u015eura sonu\u00e7lar\u0131ndan yola \u00e7\u0131k\u0131larak haz\u0131rlanan 2010 y\u0131l\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe giren KENTGES, &#8220;B\u00fct\u00fcnle\u015fik Kentsel Geli\u015fme Strateji Belgesi&#8221;ne de yans\u0131m\u0131\u015ft\u0131r.<\/p>\n<p>Bakanl\u0131klar\u0131n yeniden d\u00fczenlendi\u011fi bir a\u015famada, \u00fcst \u00f6l\u00e7ekli planlama yetkisini kullanan bakanl\u0131klar\u0131n birle\u015ftirilmesini, \u00fcst \u00f6l\u00e7ekli plan konusunda ya\u015fanan karma\u015fan\u0131n giderilmesini, planlama ve yap\u0131la\u015fma s\u00fcrecinin kurallara ba\u011flanmas\u0131n\u0131 ve uygulamalar\u0131n denetimini de sa\u011flayacak bir yeni bakanl\u0131\u011f\u0131n olu\u015fturulmas\u0131na ili\u015fkin tart\u0131\u015fmalar yo\u011funla\u015f\u0131rken, bu konudaki beklentiler de artm\u0131\u015ft\u0131r.<\/p>\n<p>12 Haziran 2011 tarihinde ger\u00e7ekle\u015ftirilmi\u015f olan Genel Se\u00e7imler \u00f6ncesinde, 6 Nisan 2011 tarihinde TBMM\u2018de kabul edilen ve 3 May\u0131s 2011 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 6223 say\u0131l\u0131 &#8220;Yetki Kanunu&#8221; ile Bakanlar Kurulu\u2018na 6 ay s\u00fcre ile kanun h\u00fckm\u00fcnde kararname (KHK) \u00e7\u0131karma yetkisi verilmi\u015ftir. <\/p>\n<p>6223 say\u0131l\u0131 Kanun ile verilen yetkiye dayan\u0131larak haz\u0131rlanan 636 say\u0131l\u0131 &#8220;\u00c7evre, Orman ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK&#8221; 8 Haziran 2011 tarihinde Resmi Gazete\u2018nin m\u00fckerrer say\u0131s\u0131nda yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f, Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131 ile \u00c7evre ve Orman Bakanl\u0131\u011f\u0131\u2018n\u0131n birle\u015ftirilmesi yolunda ilk ad\u0131m at\u0131lm\u0131\u015ft\u0131r. Genel se\u00e7imlerin yap\u0131lmas\u0131ndan yaln\u0131zca 4 g\u00fcn \u00f6nce yay\u0131nlanan bu Kararname gere\u011fince bakanl\u0131k birle\u015ftirmeleri ger\u00e7ekle\u015femeden, se\u00e7imler sonras\u0131nda yeni bir kararname haz\u0131rlanm\u0131\u015ft\u0131r.<\/p>\n<p>Bakanlar Kurulu taraf\u0131ndan 29 Haziran 2011 tarihinde kabul edilen ve 4 Temmuz 2011\u2018de Resmi Gazete\u2018de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren 644 say\u0131l\u0131 Kararname ile &#8220;\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8221;, 645 say\u0131l\u0131 Kararname ile de &#8220;Orman ve Su \u0130\u015fleri Bakanl\u0131\u011f\u0131&#8221; kurulmu\u015f, se\u00e7imler \u00f6ncesinde birle\u015ftirilen iki bakanl\u0131k yeniden ayr\u0131\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Ayr\u0131\u015fma a\u015famas\u0131nda planlamaya y\u00f6nelik yetkiler tek bir bakanl\u0131k b\u00fcnyesinde toplanm\u0131\u015f olsa da, birbiriyle \u00e7eli\u015fen \u00fcst \u00f6l\u00e7ekli plan t\u00fcrlerinin t\u00fcm\u00fcyle korunmas\u0131, karma\u015fan\u0131n s\u00fcrece\u011fini g\u00f6stermi\u015ftir. <\/p>\n<p>Kamuoyunda yo\u011fun tepkilere neden olan 644 say\u0131l\u0131 Kararname, bakanl\u0131k g\u00f6revine eski TOK\u0130 ba\u015fkan\u0131 Erdo\u011fan Bayraktar\u2018\u0131n getirilmesi sonras\u0131nda yeniden ele al\u0131nm\u0131\u015f, yeni bakan ve ekibinin istekleri do\u011frultusunda haz\u0131rland\u0131\u011f\u0131 anla\u015f\u0131lan 648 say\u0131l\u0131 KHK Bakanlar Kurulu taraf\u0131ndan 8 A\u011fustos 2011 tarihinde kabul edilmi\u015f ve \u00fclkemizde en b\u00fcy\u00fck deprem ac\u0131s\u0131n\u0131n ya\u015fand\u0131\u011f\u0131 G\u00f6lc\u00fck Depremi\u2018nin 12. y\u0131ld\u00f6n\u00fcm\u00fcnde 17 A\u011fustos 2011 tarihinde Resmi Gazete\u2018de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>2.\u00a0648 Say\u0131l\u0131 KHK\u2018nin \u0130\u00e7eri\u011fi Hakk\u0131nda Genel De\u011ferlendirme<\/strong> <\/p>\n<p>Kanun yapma tekni\u011fine t\u00fcm\u00fcyle ayk\u0131r\u0131 bi\u00e7imde, hi\u00e7bir kamu kurumunun, sivil toplum \u00f6rg\u00fct\u00fcn\u00fcn, meslek odalar\u0131n\u0131n, muhalefet partilerinin g\u00f6r\u00fc\u015fleri al\u0131nmadan, TBMM komisyonlar\u0131nda ve Genel Kurulu\u2018nda tart\u0131\u015f\u0131lmadan, kapal\u0131 kap\u0131lar arkas\u0131nda haz\u0131rlanan kanun h\u00fckm\u00fcnde kararnameler ile ger\u00e7ekle\u015ftirilmeye \u00e7al\u0131\u015f\u0131lan bakanl\u0131k birle\u015ftirme ve g\u00f6rev tan\u0131mlamalar\u0131na ili\u015fkin s\u00fcre\u00e7te ya\u015fanan olumsuzluklar, birbiri ard\u0131na kararnamelerin \u00e7\u0131kar\u0131lmas\u0131na neden olmu\u015ftur. 648 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname bu s\u00fcrecin son ad\u0131m\u0131 olarak d\u00fczenlenmi\u015ftir.<\/p>\n<p>648 say\u0131l\u0131 &#8220;\u00c7evre Ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat Ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname \u0130le Baz\u0131 Kanun Ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun H\u00fckm\u00fcnde Kararname&#8221;, genel olarak \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018n\u0131n kurulmas\u0131na ili\u015fkin 644 say\u0131l\u0131 Kararnamenin eksikliklerinin giderilmesi amac\u0131yla \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Ancak Kararnamenin, 644 say\u0131l\u0131 Kararname ile kurgulanan yeni yap\u0131n\u0131n eksikliklerinin giderilmesi, hatalar\u0131n\u0131n d\u00fczeltilmesine ili\u015fkin d\u00fczenlemelerin yan\u0131 s\u0131ra, bakanl\u0131k g\u00f6revine 644 say\u0131l\u0131 Kararname sonras\u0131 getirilmi\u015f olan say\u0131n Erdo\u011fan Bayraktar\u2018\u0131n istekleri do\u011frultusunda yap\u0131lan yeni d\u00fczenlemeleri de i\u00e7erecek bi\u00e7imde haz\u0131rland\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. <\/p>\n<p>648 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018de de\u011fi\u015fiklikler yap\u0131lmas\u0131n\u0131n yan\u0131 s\u0131ra, 3194 say\u0131l\u0131 \u0130mar Kanunu, 4708 say\u0131l\u0131 Yap\u0131 Denetimi Hakk\u0131nda Kanun, 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nda da, \u00f6nemli olumsuz sonu\u00e7lara neden olacak de\u011fi\u015fiklikler yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>636 ve 644 say\u0131l\u0131 kararnamelerde var olan TMMOB ve ba\u011fl\u0131 odalar\u0131n\u0131n mevzuat\u0131na ve yetkilerine y\u00f6nelik d\u00fczenleme arzusu 648 say\u0131l\u0131 Kararnamede de sonuna kadar korunurken, ilk iki kararnamede y\u00f6netmeliklere b\u0131rak\u0131lan m\u00fcdahale aray\u0131\u015flar\u0131ndan bir b\u00f6l\u00fcm\u00fcn\u00fcn bu kez do\u011frudan Kararname i\u00e7inde d\u00fczenlendi\u011fi g\u00f6r\u00fclmektedir. Bu kapsamda; yap\u0131 denetim konusunda aslen TMMOB\u2018ye ba\u011fl\u0131 meslek odalar\u0131na ait olmas\u0131 gereken g\u00f6rev ve yetkilerin, Kararname ile Bakanl\u0131k g\u00f6rev ve yetkileri aras\u0131na kat\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.\u00a0 <\/p>\n<p>648 say\u0131l\u0131 Kararnameye bir b\u00fct\u00fcn olarak bak\u0131ld\u0131\u011f\u0131nda, Kararnamenin \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018n\u0131n aslen yerel y\u00f6netimlere ait olan plan yapma, yapt\u0131rma, onaylama yetkilerinin yan\u0131 s\u0131ra proje onay\u0131, yap\u0131 ruhsat\u0131 ve yap\u0131 kullanma izin belgesi verilmesi gibi g\u00f6rev ve yetkilere, parsel \u00f6l\u00e7e\u011finde ve ayr\u0131cal\u0131kl\u0131 bi\u00e7imde, diledi\u011fince el koyma yetkisini tan\u0131mlad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu yan\u0131yla 648 say\u0131l\u0131 Kararname Anayasan\u0131n e\u015fitlik ilkesine, Avrupa Yerel Y\u00f6netimler \u00d6zerklik \u015eart\u0131\u2018na ve \u00fclkemizde kent planlama konusunda bug\u00fcne kadar genel kabul g\u00f6rm\u00fc\u015f t\u00fcm ilkelere ayk\u0131r\u0131d\u0131r.<\/p>\n<p>Aslen yerle\u015fme ve yap\u0131la\u015fmaya ili\u015fkin kurallar\u0131 belirleyen, koordinasyonu ve denetimi sa\u011flayan bir merkezi kurum olmas\u0131 gereken \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018n\u0131n, Kararname ile yerel d\u00fczeyde uygulamaya y\u00f6nelik ald\u0131\u011f\u0131 yetkilerle &#8220;T\u00fcrkiye Belediyesi&#8221; olmaya y\u00f6neldi\u011fi g\u00f6r\u00fclmektedir. Benzer bi\u00e7imde, kentsel d\u00f6n\u00fc\u015f\u00fcm konusunda kurallar\u0131 d\u00fczenlemek, uygulamalar\u0131 izlemek, halk\u0131n kat\u0131l\u0131m\u0131n\u0131 kolayla\u015ft\u0131racak, d\u00f6n\u00fc\u015f\u00fcm\u00fcn tasfiyeye d\u00f6n\u00fc\u015fmesine neden olacak geli\u015fmeleri engellemek ad\u0131na \u00e7al\u0131\u015fmalar yapmas\u0131 gereken Bakanl\u0131\u011f\u0131n, do\u011frudan uygulamaya ve konut yap\u0131m\u0131na y\u00f6nelerek &#8220;\u0130kinci TOK\u0130&#8221; olmaya heveslendi\u011fi de g\u00f6r\u00fclmektedir. <\/p>\n<p>Kararname ile Bakanl\u0131\u011f\u0131n yetki alan\u0131 i\u00e7ine, \u00fclkemizdeki t\u00fcm korunmas\u0131 gerekli do\u011fa alanlar\u0131 ve tabiat varl\u0131klar\u0131 kat\u0131lm\u0131\u015f, Bakanl\u0131k, \u00f6zel \u00e7evre koruma b\u00f6lgeleri, milli parklar, tabiat parklar\u0131 ve tabiat\u0131 koruma alanlar\u0131n\u0131n yan\u0131 s\u0131ra do\u011fal sit alanlar\u0131n\u0131n da sorumlulu\u011funu \u00fcstlenmi\u015ftir. Bu konuda yap\u0131lan d\u00fczenlemelere b\u00fct\u00fcn olarak bak\u0131ld\u0131\u011f\u0131nda, gelecek nesiller ad\u0131na korunmas\u0131 gereken bu alanlara y\u00f6nelik d\u00fczenlemelerin endi\u015fe verici oldu\u011fu g\u00f6r\u00fclmektedir. <\/p>\n<p>Kararname ile \u0130mar Kanunu\u2018nda yap\u0131lan de\u011fi\u015fikliklerle genel olarak \u00fclkemizde planlamaya ve yap\u0131la\u015fmaya ili\u015fkin kurallarda, kamu yarar\u0131na, b\u00fct\u00fcnc\u00fcl planlama ve g\u00fcvenli yap\u0131la\u015fma ilkelerine ayk\u0131r\u0131 d\u00fczenlemeler ger\u00e7ekle\u015ftirilmi\u015f, plans\u0131z ve ruhsats\u0131z yap\u0131la\u015fmalar\u0131n \u00fclke \u00e7ap\u0131nda yayg\u0131nla\u015fmas\u0131na neden olacak somut ad\u0131mlar at\u0131lm\u0131\u015ft\u0131r. \u0130mar Kanunu\u2018da yap\u0131lan di\u011fer baz\u0131 de\u011fi\u015fikliklerle de, tar\u0131m alanlar\u0131nda, meralarda, yaylalarda talan ve yap\u0131la\u015fman\u0131n \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Kararname ile Yap\u0131 Denetim Kanunu\u2018nda yap\u0131lan de\u011fi\u015fiklikle de \u00fclkemizde denetim d\u0131\u015f\u0131 b\u0131rak\u0131lan yap\u0131lar\u0131n say\u0131s\u0131, t\u00fcr\u00fc ve da\u011f\u0131l\u0131m\u0131nda \u00f6nemli de\u011fi\u015fimler ya\u015fanm\u0131\u015ft\u0131r. Yap\u0131lan d\u00fczenleme ile \u00fclkemizdeki t\u00fcm k\u00f6ylerin yan\u0131 s\u0131ra, belediyelerin yakla\u015f\u0131k olarak % 70\u2018ini olu\u015fturan, n\u00fcfusu 5000 ki\u015finin alt\u0131ndaki belediyelerin s\u0131n\u0131rlar\u0131 i\u00e7inde ve m\u00fccavir alanlar\u0131ndaki yap\u0131la\u015fmalar da yap\u0131 denetim sistemi d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Bu haliyle yap\u0131lan d\u00fczenleme, teknik eleman a\u00e7\u0131s\u0131ndan son derece yetersiz olan bu yerle\u015fmelerde, yap\u0131 g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, sonu\u00e7lar\u0131 \u00f6n\u00fcm\u00fczdeki y\u0131llarda ac\u0131 bi\u00e7imde ortaya \u00e7\u0131kacak \u00e7ok \u00f6nemli bir gerileme anlam\u0131na gelmektedir. <\/p>\n<p>1999 y\u0131l\u0131nda ger\u00e7ekle\u015fen ve \u00fclkemizin ya\u015fad\u0131\u011f\u0131 en b\u00fcy\u00fck afetlerden biri olan G\u00f6lc\u00fck Depreminin 12. Y\u0131ld\u00f6n\u00fcm\u00fcnde 17 A\u011fustos 2011 tarihinde Resmi Gazete\u2018de yay\u0131mlanan 648 say\u0131l\u0131 Kararname, olas\u0131 sonu\u00e7lar\u0131 a\u00e7\u0131s\u0131ndan, 1999 depreminden \u00e7ok daha b\u00fcy\u00fck kay\u0131plara neden olabilecektir.\u00a0 <\/p>\n<p>Kararname ile 2863 Say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nda yap\u0131lan de\u011fi\u015fiklikler ile koruma ama\u00e7l\u0131 imar planlar\u0131n\u0131n yap\u0131lmas\u0131na ili\u015fkin zorlay\u0131c\u0131 d\u00fczenlemede \u00f6nemli bir geri ad\u0131m at\u0131larak, k\u00fclt\u00fcr varl\u0131klar\u0131m\u0131z\u0131n tahribat\u0131na neden olacak yeni bir s\u00fcrece girilmi\u015ftir. D\u00fczenleme ile koruma ama\u00e7l\u0131 imar planlar\u0131n\u0131n yap\u0131lmas\u0131n\u0131n zorla\u015ft\u0131r\u0131lmas\u0131n\u0131n yan\u0131 s\u0131ra, sit alanlar\u0131nda plans\u0131z bi\u00e7imde yap\u0131la\u015fman\u0131n da \u00f6n\u00fc a\u00e7\u0131lmaktad\u0131r.<\/p>\n<p>Kararname ile 2863 say\u0131l\u0131 Kanunda yap\u0131lan de\u011fi\u015fikliklerle AKP iktidar\u0131 taraf\u0131ndan 2004 y\u0131l\u0131nda ba\u015flat\u0131lan, aslen \u00f6zerk olmas\u0131 gereken koruma kurullar\u0131n\u0131 ele ge\u00e7irme, kontrol alt\u0131na alma giri\u015fiminde son ad\u0131m at\u0131lm\u0131\u015f, koruma b\u00f6lge kurullar\u0131n\u0131 bakanl\u0131\u011f\u0131n s\u00f6z\u00fcnden \u00e7\u0131kmayacak yap\u0131ya kavu\u015fturan bir d\u00fczenleme ger\u00e7ekle\u015ftirilmi\u015ftir. Kurullara y\u00f6nelik di\u011fer d\u00fczenlemelerle meslek odalar\u0131n\u0131n Koruma B\u00f6lge Kurullar\u0131\u2018na g\u00f6zlemci olarak kat\u0131lma haklar\u0131n\u0131 k\u0131s\u0131tlayan d\u00fczenlemelerin yan\u0131 s\u0131ra, koruma b\u00f6lge kurulu kararlar\u0131na itirazlar\u0131 engellemeye y\u00f6nelik d\u00fczenlemeler de ger\u00e7ekle\u015ftirilmi\u015ftir.\u00a0 <\/p>\n<p>&nbsp;<\/p>\n<p><strong>3.\u00a0\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018n\u0131n G\u00f6rev ve Yetkilerine \u0130li\u015fkin De\u011fi\u015fiklikler<\/strong> <\/p>\n<p><strong>3.1.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 1 inci maddesi ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018nin 2 inci maddesinin (\u00e7) bendinde yap\u0131lan de\u011fi\u015fiklikle; m\u00fclkiyeti kamuya ait olan araziler \u00fczerinde yap\u0131lacak her t\u00fcr yap\u0131ya ili\u015fkin, her t\u00fcr ve \u00f6l\u00e7ekte \u00e7evre d\u00fczeni, naz\u0131m ve uygulama imar planlar\u0131n\u0131 ve de\u011fi\u015fikliklerini, parselasyon planlar\u0131n\u0131 ve de\u011fi\u015fikliklerini resen yapmak, yapt\u0131rmak, onaylamak ve iki ay i\u00e7inde yetkili idarelerce ruhsatland\u0131rma yap\u0131lmamas\u0131 halinde resen ruhsat ve yap\u0131 kullanma izni vermek yetkileri \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na verilmi\u015ftir.<\/p>\n<p>Bu d\u00fczenleme, bir yandan yerel y\u00f6netimlerin yetkilerine, ayr\u0131ms\u0131z ve diledi\u011fince el konulmas\u0131 anlam\u0131na gelirken, di\u011fer yandan kentlerin plan b\u00fct\u00fcnl\u00fc\u011f\u00fcnden ayr\u0131\u015f\u0131k bi\u00e7imde, parsel \u00f6l\u00e7e\u011finde plan karar\u0131 \u00fcretilmesi ve yap\u0131la\u015fma karar\u0131 verilmesi, kentlerin planlar\u0131nda var olan dengenin ve b\u00fct\u00fcnl\u00fc\u011f\u00fcn bozulmas\u0131 anlam\u0131na gelmektedir. Kamu m\u00fclklerine y\u00f6nelik ayr\u0131mc\u0131l\u0131k getiren bu d\u00fczenleme Anayasan\u0131n e\u015fitlik ilkesine, hukuk devleti ilkesine, Avrupa Yerel Y\u00f6netimler \u00d6zerklik \u015eart\u0131na, kamu yarar\u0131na, \u00fclkemizde bug\u00fcne kadar genel kabul g\u00f6rm\u00fc\u015f \u015fehircilik ilkelerine ve planlama esaslar\u0131na ayk\u0131r\u0131 nitelikler ta\u015f\u0131maktad\u0131r.\u00a0\u00a0 <\/p>\n<p><strong>3.2.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 1 inci maddesi ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018nin 2 inci maddesine eklenen yeni (h) bendi ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na; &#8220;Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda bulunan veya m\u00fclkiyeti Hazineye, kamu kurum veya kurulu\u015flar\u0131na ya da ki\u015filere ait olan ta\u015f\u0131nmazlar \u00fczerinde yap\u0131lacak yat\u0131r\u0131mlara ili\u015fkin olarak ilgilileri taraf\u0131ndan haz\u0131rlanan veya haz\u0131rlatt\u0131r\u0131lan ancak yetkili idarelerce \u00fc\u00e7 ay i\u00e7erisinde onaylanmayan et\u00fct, harita, her t\u00fcr ve \u00f6l\u00e7ekte \u00e7evre d\u00fczeni, naz\u0131m ve uygulama imar planlar\u0131n\u0131, parselasyon planlar\u0131n\u0131 ve de\u011fi\u015fikliklerini ilgili idarelerin ba\u015fvurusu \u00fczerine yapmak, yapt\u0131rmak, onaylamak ve ba\u015fvuru tarihinden itibaren \u00fc\u00e7 ay i\u00e7inde yetkili idarelerce ruhsatland\u0131rma yap\u0131lmamas\u0131 halinde resen ruhsat ve yap\u0131 kullanma izni vermek&#8221; yetkisi tan\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n<p>Yap\u0131lan bu d\u00fczenleme, son y\u0131llarda \u00fclkemizde imar ve planlama konusunda at\u0131lm\u0131\u015f en olumsuz ad\u0131mlardan biri olarak dikkat \u00e7ekmektedir. D\u00fczenleme ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na bir \u00f6nceki maddede tan\u0131mlanm\u0131\u015f olan kamu m\u00fclklerine ili\u015fkin yetkiyi de a\u015fan, \u00fclke genelinde t\u00fcm parsellerde ayr\u0131cal\u0131kl\u0131 plan onama ve ruhsat verme yetkisi tan\u0131nmaktad\u0131r. <\/p>\n<p>B\u00f6ylesi bir yetki d\u00fczenlemesi ile korunan, kollanan kesimlere ayr\u0131cal\u0131kl\u0131 imar rantlar\u0131 aktarman\u0131n yolu sonuna kadar a\u00e7\u0131lm\u0131\u015ft\u0131r. \u00dclkemiz kentlerini daha da i\u00e7inden \u00e7\u0131k\u0131lmaz ve ya\u015fanmaz duruma getirecek somut ad\u0131mlardan biri olan bu d\u00fczenleme ile denetlenemez bir merkezile\u015fme ger\u00e7ekle\u015ftirilerek, \u00fclkemizdeki t\u00fcm yerel y\u00f6netimlerin yetkilerine Bakanl\u0131\u011f\u0131n keyfi bi\u00e7imde el koymas\u0131n\u0131n yolu a\u00e7\u0131lmaktad\u0131r. <\/p>\n<p><strong>3.3.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 1 inci maddesi ile de\u011fi\u015ftirilen 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018nin 2 inci maddesine eklenen (i) bendi ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na; &#8220;Depreme kar\u015f\u0131 dayan\u0131ks\u0131z yap\u0131lar ile imar mevzuat\u0131na, plan, proje ve eklerine ayk\u0131r\u0131 yap\u0131lar\u0131n ve bunlar\u0131n bulundu\u011fu alanlar\u0131n d\u00f6n\u00fc\u015f\u00fcm projelerini ve uygulamalar\u0131n\u0131 yapmak veya yapt\u0131rmak&#8221; yetkisi verilmi\u015ftir. <\/p>\n<p>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018n\u0131 yerel \u00f6l\u00e7ekte yap\u0131m konusunda yetkilendirerek, &#8220;T\u00fcrkiye belediyesi&#8221; ya da &#8220;ikinci bir TOK\u0130&#8221; niteli\u011fine b\u00fcr\u00fcnd\u00fcren bu d\u00fczenleme, 4 Kas\u0131m 2010 tarihinde Resmi Gazete\u2018de yay\u0131mlanan ve t\u00fcm kurumlar i\u00e7in ba\u011flay\u0131c\u0131 olan &#8220;B\u00fct\u00fcnle\u015fik Kentsel Geli\u015fme Stratejisi ve Eylem Plan\u0131&#8221;nda (KENTGES) belirlenen; Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131\u2018n\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131n\u0131 ve &#8220;yerle\u015fme ve yap\u0131la\u015fmaya ili\u015fkin kentle\u015fme ve imar konular\u0131nda usul ve esaslar\u0131 belirleyen&#8221;, &#8220;koordinasyonu sa\u011flayan&#8221; bir bakanl\u0131\u011fa d\u00f6n\u00fc\u015fmesini \u00f6ng\u00f6ren strateji ile \u00e7eli\u015fmektedir. <\/p>\n<p>\u00dclkemizde konu ile ilgili uzmanlar\u0131n, kurumlar\u0131n geni\u015f kat\u0131l\u0131m\u0131 ile ger\u00e7ekle\u015ftirilen Kentle\u015fme \u015euras\u0131 sonucunda elde edilen KENTGES-B\u00fct\u00fcnle\u015fik Kentsel Geli\u015fme Stratejisi ve Eylem Plan\u0131, bir y\u0131l bile dolmadan ge\u00e7ersiz k\u0131l\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p><strong>3.4.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 3 \u00fcnc\u00fc maddesi ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018nin 6 nc\u0131 maddesine eklenen (g) bendi ile &#8220;Tabiat Varl\u0131klar\u0131n\u0131 Koruma Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8221; olu\u015fturulmu\u015ftur. Ge\u00e7mi\u015fte var olan &#8220;\u00d6zel \u00c7evre Koruma Kurumu&#8221; ile &#8220;Do\u011fa Koruma ve Milli Parklar Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8221;n\u00fcn g\u00f6revlerinin yan\u0131 s\u0131ra \u00fclkemizde y\u0131llardan bu yana \u00f6nemli do\u011fa alanlar\u0131n\u0131n imar ve rant bask\u0131s\u0131ndan korunmas\u0131n\u0131 sa\u011flam\u0131\u015f olan &#8220;do\u011fal sit alanlar\u0131&#8221; da bu kurumun g\u00f6revleri aras\u0131na kat\u0131lmaktad\u0131r.\u00a0 <\/p>\n<p>2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu kapsam\u0131nda g\u00f6rev yapan koruma b\u00f6lge kurullar\u0131 taraf\u0131ndan koruma alt\u0131na al\u0131nm\u0131\u015f olan, uzmanl\u0131klar\u0131 olmad\u0131\u011f\u0131 i\u00e7in yetkileri ellerinden al\u0131nan bu kurullar\u0131n yerine \u00f6ng\u00f6r\u00fclen yeni yap\u0131n\u0131n do\u011fal sitler a\u00e7\u0131s\u0131ndan endi\u015fe verici oldu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p><strong>3.5.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 4 \u00fcnc\u00fc maddesi ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018nin 7 nci maddesinin birinci maddesine eklenen yeni (e) bendi ile (h) bendinde belirtilen konularla ilgili olarak; &#8220;2985 say\u0131l\u0131 Toplu Konut Kanununun ek 7 nci maddesi \u00e7er\u00e7evesinde uygulama yapmak veya yapt\u0131rmak, bu uygulamalara y\u00f6nelik olarak kentsel d\u00f6n\u00fc\u015f\u00fcm, yenileme ve transfer alanlar\u0131 geli\u015ftirmek, bu alanlar\u0131n her \u00f6l\u00e7ekteki imar plan\u0131 ve imar uygulamalar\u0131n\u0131, kentsel tasar\u0131m projelerini yapmak, yapt\u0131rmak ve onaylamak, bu \u00e7er\u00e7evede payl\u0131 m\u00fclkiyetleri ay\u0131rmak, birle\u015ftirmek, arsa ve arazi d\u00fczenlemeleri yapmak, imar hakk\u0131 transfer etmek, kamula\u015ft\u0131rma ve gerekti\u011finde usul\u00fcne uygun olarak acele kamula\u015ft\u0131rma yoluna gitmek, yap\u0131 ruhsat\u0131 ve yap\u0131 kullanma izinlerini vermek ve kat m\u00fclkiyeti tesis ve tescilini sa\u011flamak&#8221; konular\u0131nda \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 yetkilendirilmi\u015ftir. <\/p>\n<p>Yap\u0131lan bu d\u00fczenleme ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 &#8220;Kentsel D\u00f6n\u00fc\u015f\u00fcm Uygulamalar\u0131&#8221; konusunda geni\u015f bir yetkiye kavu\u015fturulmu\u015f, KENTGES stratejileri ile a\u00e7\u0131k\u00e7a \u00e7eli\u015fen uygulamaya y\u00f6nelik bu yetkilendirme ile Bakanl\u0131\u011f\u0131n, koordinat\u00f6r bir kurum yerine t\u00fcm yetkileri elinde tutan ve se\u00e7imle g\u00f6reve gelmi\u015f yerel y\u00f6netimlerin g\u00f6revlerini gasp eden bir kurum olma niteli\u011fi peki\u015ftirilmi\u015ftir.<\/p>\n<p><strong>3.6.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 10 uncu maddesi ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018nin 13 \u00fcnc\u00fc maddesinden sonra gelmek \u00fczere eklenen 13\/A maddesi ile Tabiat Varl\u0131klar\u0131n\u0131 Koruma Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018n\u00fcn g\u00f6revleri tan\u0131mlanm\u0131\u015f ve ge\u00e7mi\u015fte Do\u011fa Koruma ve Milli Parklar Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018ne ait olan yetkiler bu kuruma devredilmi\u015ftir. <\/p>\n<p>Yap\u0131lan d\u00fczenleme ile do\u011fal de\u011ferlerimizin korunmas\u0131na y\u00f6nelik yap\u0131lan &#8220;Uzun Devreli Geli\u015fme Plan\u0131&#8221; kavram\u0131 terk edilirken, bu kavram\u0131n yerini \u00e7evre d\u00fczeni plan\u0131 ve imar plan\u0131 kavramlar\u0131 alm\u0131\u015f, koruma alanlar\u0131na y\u00f6nelik &#8220;imar planlar\u0131n\u0131n yap\u0131lmas\u0131 ve onaylanmas\u0131&#8221; yetkilerinin yan\u0131 s\u0131ra, milli park vb. do\u011fal koruma alanlar\u0131 ile tarihi, arkeolojik ve kentsel sit alanlar\u0131n\u0131n \u00e7ak\u0131\u015ft\u0131\u011f\u0131 yerlerde de planlama yetkileri Bakanl\u0131\u011fa verilmi\u015ftir. <\/p>\n<p>Korunmas\u0131 gereken do\u011fal de\u011ferlerin yan\u0131 s\u0131ra, k\u00fclt\u00fcrel alanlar\u0131 da planlanarak yap\u0131la\u015fmaya a\u00e7\u0131lacak alanlar olarak g\u00f6ren bir yakla\u015f\u0131mla ele al\u0131nm\u0131\u015f olan d\u00fczenleme ile, ba\u015fta do\u011fal sit alanlar\u0131 olmak \u00fczere, orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131nda kalan korunmas\u0131 gerekli do\u011fa alanlar\u0131n\u0131n tahsis edilmesine ili\u015fkin yetki de Bakanl\u0131\u011fa verilmi\u015ftir. <\/p>\n<p>Kararnamede yer alan bu y\u00f6ndeki d\u00fczenlemelere bir b\u00fct\u00fcn olarak bak\u0131ld\u0131\u011f\u0131nda; ba\u015fta do\u011fal sit alanlar\u0131 olmak \u00fczere, bug\u00fcne kadar korunabilmi\u015f olan do\u011fa alanlar\u0131n\u0131n, milli parklar\u0131n, tabiat parklar\u0131n\u0131n ve tabiat\u0131 koruma alanlar\u0131n\u0131n, planlama ad\u0131 alt\u0131nda k\u0131sa s\u00fcre i\u00e7inde tahrip edilmesine neden olabilecek bir yakla\u015f\u0131m\u0131n var oldu\u011fu, koruma kavram\u0131 i\u00e7inden do\u011fal alanlar\u0131n d\u0131\u015fland\u0131\u011f\u0131 dikkat \u00e7ekmektedir.<\/p>\n<p>\u00d6zellikle Koruma B\u00f6lge Kurullar\u0131 taraf\u0131ndan al\u0131nan ve Karadeniz\u2018in do\u011fal dengesini bozmas\u0131 ka\u00e7\u0131n\u0131lmaz olan HES Projelerini engelledi\u011fi d\u00fc\u015f\u00fcn\u00fclen &#8220;Do\u011fal Sit Alan\u0131&#8221; kararlar\u0131 sonras\u0131nda, KHK ile s\u00fcrecin yeniden de\u011ferlendirilecek olmas\u0131, niyetleri a\u00e7\u0131k\u00e7a ortaya koymaktad\u0131r. Madde i\u00e7eri\u011finde yer ald\u0131\u011f\u0131 gibi, korunmas\u0131 gerekli do\u011fal sit alanlar\u0131nda yap\u0131 yasa\u011f\u0131 getirmenin b\u00fcrokratik yollar\u0131 artt\u0131r\u0131larak, yat\u0131r\u0131mlar\u0131n \u00f6n\u00fcnde engel olarak g\u00f6r\u00fclen bu kararlar ortadan kald\u0131r\u0131lacak, do\u011fa harikas\u0131 alanlar\u0131m\u0131z t\u00fcm\u00fcyle yat\u0131r\u0131mc\u0131 \u015firketlerin inisiyatifine b\u0131rak\u0131lacakt\u0131r.\u00a0 <\/p>\n<p><strong>3.7.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 17 nci maddesi ile 644 say\u0131l\u0131 \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda KHK\u2018ye eklenen Ge\u00e7ici 6 nc\u0131 madde ile de \u00f6zellikle do\u011fal sit alanlar\u0131na y\u00f6nelik mevcut stat\u00fclerin de\u011ferlendirilmesine ili\u015fkin d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re; kararnamenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihte, do\u011fal sit alan\u0131 ve tabiat varl\u0131\u011f\u0131 olarak tespit ve tescil edilmi\u015f alan\u00a0ve varl\u0131klara ili\u015fkin her t\u00fcrl\u00fc belgenin, bu alan ve varl\u0131klar\u0131n stat\u00fclerinin yeniden de\u011ferlendirilmesi i\u00e7in en ge\u00e7 alt\u0131 ay i\u00e7inde \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131na devredilmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>De\u011fi\u015fiklikle, Bakanl\u0131k taraf\u0131ndan &#8220;konunun uzmanlar\u0131ndan&#8221; olu\u015fturulan bir komisyon taraf\u0131ndan yeniden tespit edilecek stat\u00fclerin \u00c7evre ve \u015eehircilik Bakan\u0131\u2018n\u0131n onay\u0131 ile, yap\u0131 yasa\u011f\u0131 \u00f6ng\u00f6r\u00fclen stat\u00fclerin ise Bakanlar Kurulunca onayland\u0131ktan sonra tescil edilmesi d\u00fczenlenmi\u015ftir.<\/p>\n<p>Buna g\u00f6re \u00fclkemizde bug\u00fcne kadar &#8220;k\u0131smen \u00f6zerk&#8221; koruma kurullar\u0131 taraf\u0131ndan &#8220;do\u011fal sit alan\u0131&#8221; olarak tescil edilmi\u015f ve korunabilmi\u015f olan alanlar\u0131n gelece\u011fi t\u00fcm\u00fcyle \u00c7evre ve \u015eehircilik Bakan\u0131n\u0131n inisiyatifine terk edilmektedir. Do\u011frudan Bakan taraf\u0131ndan atamas\u0131 yap\u0131lacak uzmanlar taraf\u0131ndan yap\u0131lacak bir irdeleme ve ancak Bakan onay\u0131 ile y\u00fcr\u00fcrl\u00fc\u011fe girecek bir stat\u00fc belirlemesinin objektifli\u011finden s\u00f6z etmek olanakl\u0131 olmayacakt\u0131r. <\/p>\n<p>Yap\u0131lan d\u00fczenleme ile do\u011fal sit alanlar\u0131 \u00fczerinde ba\u015flat\u0131lan bu yeni s\u00fcrecin, T\u00fcrkiye tarihinin bug\u00fcne kadar g\u00f6rd\u00fc\u011f\u00fc\/g\u00f6rece\u011fi en b\u00fcy\u00fck rant aktarma operasyonu olaca\u011f\u0131 a\u00e7\u0131k\u00e7a g\u00f6r\u00fcnmektedir.\u00a0 <\/p>\n<p>&nbsp;<\/p>\n<p><strong>4.\u00a03194 say\u0131l\u0131 \u0130mar Kanunu\u2018nda Yap\u0131lan De\u011fi\u015fiklikler<\/strong><\/p>\n<p><strong>4.1.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 22 nci maddesi ile 3194 say\u0131l\u0131 \u0130mar Kanunu\u2018nun 27 nci maddesinde de\u011fi\u015fiklik yap\u0131lm\u0131\u015ft\u0131r. Yap\u0131lan d\u00fczenleme ile k\u00f6y yerle\u015fik alanlar\u0131nda, civar\u0131nda ve mezralarda yap\u0131lacak konutlar ile tar\u0131m ve hayvanc\u0131l\u0131k ama\u00e7l\u0131 yap\u0131lar\u0131n yan\u0131 s\u0131ra bakkal, manav, berber, k\u00f6y f\u0131r\u0131n\u0131, k\u00f6y kahvesi, k\u00f6y lokantas\u0131 gibi ticari ama\u00e7l\u0131 yap\u0131lar i\u00e7in de &#8220;yap\u0131 ruhsat\u0131 aranmaz&#8221; ko\u015fulu getirilmi\u015ftir. Bu uygulama, deprem vb. afetler a\u00e7\u0131s\u0131ndan k\u00f6ylerde ya\u015fayan halk\u0131n t\u00fcm\u00fcyle g\u00f6zden \u00e7\u0131kar\u0131lmas\u0131, denetimsiz ve niteliksiz yap\u0131la\u015fman\u0131n yayg\u0131nla\u015fmas\u0131 anlam\u0131na gelmektedir.<\/p>\n<p>Ayn\u0131 maddede yap\u0131lan bir ba\u015fka d\u00fczenleme ile k\u00f6y yerle\u015fik alanlar\u0131 &#8220;imar plan\u0131&#8221; kapsam\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lm\u0131\u015f, T\u00fcrkiye k\u00f6ylerinde &#8220;yol istikamet plan\u0131&#8221; benzeri bir uygulama ba\u015flat\u0131larak, 1950\u2018li y\u0131llara geri d\u00f6n\u00fc\u015f karar\u0131 al\u0131nm\u0131\u015ft\u0131r. Planlamay\u0131 d\u0131\u015flayan kararlar\u0131n bir arada yer ald\u0131\u011f\u0131 27 nci madde de\u011fi\u015fikli\u011finde yap\u0131lan bir ba\u015fka d\u00fczenleme ile de k\u00f6y yerle\u015fik alan s\u0131n\u0131r\u0131 i\u00e7erisinde, 5403 say\u0131l\u0131 Toprak Koruma ve Arazi Kullan\u0131m\u0131 Kanunu h\u00fck\u00fcmleri uygulama d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015f ve tar\u0131m topraklar\u0131nda yeni bir talan\u0131n \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>27 nci madde de\u011fi\u015fikli\u011fi kapsam\u0131nda yap\u0131lm\u0131\u015f olan ve sonu\u00e7lar\u0131 a\u00e7\u0131s\u0131ndan en vahim d\u00fczenlemelerden bir di\u011feri ile de k\u00f6y yerle\u015fik alan\u0131 s\u0131n\u0131rlar\u0131 i\u00e7inde ilk ve orta \u00f6\u011fretim tesisi, ibadet yeri, sa\u011fl\u0131k tesisi, g\u00fcvenlik tesisi gibi halk\u0131n toplu olarak bulundu\u011fu, plan kararlar\u0131yla d\u00fczenlenmesi kamu yarar\u0131 a\u00e7\u0131s\u0131ndan zorunlu olan yap\u0131lar i\u00e7in imar plan\u0131 yap\u0131lmas\u0131 \u015fart\u0131 ortadan kald\u0131r\u0131lm\u0131\u015f, k\u0131rsal alanda plans\u0131z yap\u0131la\u015fman\u0131n \u00f6n\u00fc t\u00fcm\u00fcyle a\u00e7\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>3194 say\u0131l\u0131 \u0130mar Kanunu\u2018nun 27 nci maddesinde yap\u0131lan de\u011fi\u015fikli\u011fe bir b\u00fct\u00fcn olarak bak\u0131ld\u0131\u011f\u0131nda, iktidar\u0131n planlaman\u0131n yan\u0131 s\u0131ra ruhsatl\u0131, denetimli ve g\u00fcvenli yap\u0131la\u015fma kurallar\u0131ndan vazge\u00e7ti\u011fi, k\u00f6ylerde ya\u015fayan halk\u0131n kaderlerine terk edilmesini tercih etti\u011fi alg\u0131s\u0131 olu\u015fmaktad\u0131r. <\/p>\n<p><strong>4.2. <\/strong>648 say\u0131l\u0131 KHK\u2018nin 23 nc\u00fc maddesi ile 3194 say\u0131l\u0131 \u0130mar Kanunu\u2018na Ek Madde-4 eklenmi\u015f ve \u00fclkemizin t\u00fcm meralar\u0131 ve yaylalar\u0131nda yeni bir talan s\u00fcrecinin \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. Eklenen madde ile; mera, yaylak ve k\u0131\u015flaklar\u0131n tahsis amac\u0131 de\u011fi\u015ftirilerek tapuda Hazine ad\u0131na tescillerinin yap\u0131lmas\u0131, bu alanlar\u0131n belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde ilgili belediyelerine, di\u011fer alanlarda ise il \u00f6zel idarelerine veya \u00f6zel kanunlarla belirlenen ilgili idarelere tahsis edilmesi d\u00fczenlenmi\u015ftir. <\/p>\n<p>Yap\u0131lan bu d\u00fczenleme ile mera, yaylak ve k\u0131\u015flaklar\u0131n ilgili kurumlar taraf\u0131ndan 29 y\u0131ll\u0131\u011f\u0131na talep sahiplerine tahsis edilmesi ve yap\u0131la\u015fmaya a\u00e7\u0131lmas\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. Her ne kadar k\u0131s\u0131tlama getirilir gibi g\u00f6r\u00fcnse de, 200 metrekare b\u00fcy\u00fckl\u00fc\u011f\u00fcnde belirlenen yap\u0131la\u015fma ko\u015fulu, bu alanlar\u0131n yeni villa alanlar\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclece\u011finin en somut g\u00f6stergelerinden biridir. <\/p>\n<p>Ayn\u0131 d\u00fczenleme i\u00e7inde, Turizmi Te\u015fvik Kanunu uyar\u0131nca ilan edilen turizm merkezleri ile k\u00fclt\u00fcr ve turizm geli\u015fim b\u00f6lgeleri kapsam\u0131nda kalan k\u0131s\u0131mlar\u0131n\u0131n da K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 taraf\u0131ndan yat\u0131r\u0131mc\u0131lara tahsis edilmesinin de \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015f, bir ba\u015fka b\u00fcy\u00fck talan s\u00fcreci ba\u015flat\u0131lm\u0131\u015ft\u0131r.\u00a0 <\/p>\n<p>B\u00fct\u00fcn olarak bak\u0131ld\u0131\u011f\u0131nda madde kapsam\u0131nda yap\u0131lan d\u00fczenlemeler, T\u00fcrkiye\u2018nin meralar\u0131n\u0131n ve yaylalar\u0131n\u0131n yap\u0131la\u015fmalarla &#8220;yasa destekli&#8221; talan edilmesinin en \u00f6nemli ad\u0131m\u0131 olarak g\u00f6r\u00fcnmektedir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>5. 4708 Say\u0131l\u0131 Yap\u0131 Denetimi Hakk\u0131nda Kanun\u2018da Yap\u0131lan De\u011fi\u015fiklikler<\/strong><\/p>\n<p><strong>5.1.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 24 nc\u00fc maddesi ile 4708 say\u0131l\u0131 Yap\u0131 Denetimi Hakk\u0131nda Kanun\u2018un 1 inci maddesinin ikinci f\u0131kras\u0131nda de\u011fi\u015fiklik yap\u0131lm\u0131\u015f, Yap\u0131 Denetimi kapsam\u0131 daralt\u0131lm\u0131\u015f, denetimsiz yap\u0131la\u015fman\u0131n yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131n\u0131 sa\u011flayacak d\u00fczenlemeler yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Yap\u0131lan de\u011fi\u015fiklikle ge\u00e7mi\u015fte yaln\u0131zca kamuya ait yap\u0131 ve tesisler ile k\u00f6y yerle\u015fik alanlar\u0131nda yap\u0131lan konutlar ve b\u00fcy\u00fckl\u00fc\u011f\u00fc 200 metrekareyi ge\u00e7meyen iki katl\u0131 yap\u0131lar\u0131 denetim d\u0131\u015f\u0131 b\u0131rakan d\u00fczenlemede denetimsiz yap\u0131la\u015fman\u0131n s\u0131n\u0131rlar\u0131 geni\u015fletilmi\u015f, k\u00f6y yerle\u015fik alanlar\u0131ndaki konutlar\u0131n yan\u0131 s\u0131ra ticari tesisler de dahil her t\u00fcrl\u00fc yap\u0131la\u015fma, tar\u0131m ve hayvanc\u0131l\u0131k ama\u00e7l\u0131 yap\u0131lar\u0131n tamam\u0131 yap\u0131 denetimi d\u0131\u015f\u0131nda b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Ge\u00e7mi\u015fte yaln\u0131zca k\u0131rsal alanlara y\u00f6nelik s\u0131n\u0131rl\u0131 bir denetimsizlik s\u00f6z konusuyken, yap\u0131lan yeni d\u00fczenleme ile yukar\u0131da say\u0131lanlara ek olarak, n\u00fcfusu 5000\u2018in alt\u0131nda olan belediyelerin belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde, bodrum ve \u00e7at\u0131 aras\u0131nda yap\u0131lan\u00a0d\u00fczenleme ile 4-5 kata ula\u015fan yap\u0131larda, bodrum kat d\u0131\u015f\u0131nda in\u015faat alan\u0131 500 metrekareye ula\u015fan konut yap\u0131lar\u0131 da yap\u0131 denetimi kapsam\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>Yap\u0131lan yeni d\u00fczenleme ile teknik kadro a\u00e7\u0131s\u0131ndan da son derece yetersiz durumda olan ve T\u00fcrkiye\u2018deki belediyelerin % 70\u2018ini olu\u015fturan, n\u00fcfusu 5000\u2018in alt\u0131nda olan belediyelerin s\u0131n\u0131rlar\u0131 i\u00e7indeki yap\u0131la\u015fmalar yap\u0131mc\u0131lar\u0131n insaf\u0131na, bu yerle\u015fmelerde ve yap\u0131larda ya\u015fayanlar kaderine terk edilmi\u015ftir.<\/p>\n<p><strong>5.2.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 27 nci maddesi ile 4708 say\u0131l\u0131 Yap\u0131 Denetimi Hakk\u0131nda Kanun\u2018un 5 inci maddesinde de\u011fi\u015fiklik ger\u00e7ekle\u015ftirilmi\u015ftir. Yap\u0131lan d\u00fczenleme ile yap\u0131 denetim \u00fccretleri oransal olarak yar\u0131 yar\u0131ya azalt\u0131lm\u0131\u015f, ge\u00e7mi\u015fte sabit yap\u0131 yakla\u015f\u0131k maliyetinin % 3\u2018\u00fc olan bedel, yeni d\u00fczenlemede en az % 1,5 olarak yenilenmi\u015f ve yap\u0131 denetim firmas\u0131 ile yap\u0131mc\u0131 aras\u0131nda pazarl\u0131k s\u00fcrecinin \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>Di\u011fer yandan yap\u0131lan yeni d\u00fczenleme ile bu bedelin % 1\u2018inin ruhsat\u0131 veren idareye, % 1\u2018inin de Bakanl\u0131k b\u00fcnyesinde bulunan d\u00f6ner sermayeye aktar\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Buna g\u00f6re, bir yandan yap\u0131 denetim firmalar\u0131n\u0131n alaca\u011f\u0131 \u00fccretlerde yar\u0131 yar\u0131ya azaltmaya gidilirken, di\u011fer yandan \u00fclke genelinde toplanan t\u00fcm yap\u0131 denetim \u00fccretlerinin % 1\u2018inin d\u00f6ner sermaye arac\u0131l\u0131\u011f\u0131yla Bakanl\u0131\u011f\u0131n kullan\u0131m\u0131na aktar\u0131lmas\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><strong>5.3.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 28 inci maddesi ile 4708 say\u0131l\u0131 Yap\u0131 Denetimi Hakk\u0131nda Kanun\u2018un 12 nci maddesinde yap\u0131lan de\u011fi\u015fiklikle, aslen TMMOB\u2018ye ba\u011fl\u0131 ilgili meslek odalar\u0131n\u0131n g\u00f6revi olan; yap\u0131 denetim kurulu\u015flar\u0131n\u0131n sahip olmas\u0131 gereken asgari niteliklerin, \u00e7al\u0131\u015fma usul ve esaslar\u0131n\u0131n, asgari hizmet bedellerinin belirlenmesi, yap\u0131lara sertifika verilmesi ve meslek i\u00e7i e\u011fitim konular\u0131nda Bakanl\u0131k yetkilendirilmi\u015ftir. <\/p>\n<p>Bu yan\u0131yla yap\u0131lan d\u00fczenleme TMMOB ve ba\u011fl\u0131 meslek odalar\u0131n\u0131n zay\u0131flat\u0131lmas\u0131na y\u00f6nelik amac\u0131n yan\u0131 s\u0131ra, yap\u0131 denetim piyasas\u0131n\u0131n denetlenmesi ad\u0131 alt\u0131nda yanda\u015f kesimlerin kayr\u0131lmas\u0131na d\u00f6n\u00fc\u015fecek bir s\u00fcrecin ilk ad\u0131m\u0131 olarak g\u00f6r\u00fcnmektedir.\u00a0<\/p>\n<p>&nbsp;<\/p>\n<p><strong>6. Maliye Bakanl\u0131\u011f\u0131n\u0131n G\u00f6revlerine \u0130li\u015fkin Yap\u0131lan De\u011fi\u015fiklikler<\/strong><\/p>\n<p><strong>6.1.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 40 \u0131nc\u0131 maddesi ile 178 say\u0131l\u0131 Maliye Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin 13 \u00fcnc\u00fc maddesinde de\u011fi\u015fiklik yap\u0131lm\u0131\u015f ve k\u0131sa s\u00fcre \u00f6nce Maliye Bakanl\u0131\u011f\u0131\u2018na verilen hazine arazilerine ili\u015fkin planlama yetkileri \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na aktar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Buna g\u00f6re; Hazinenin \u00f6zel m\u00fclkiyetinde ve Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda bulunan ta\u015f\u0131nmazlar\u0131n yan\u0131 s\u0131ra, ki\u015filerin m\u00fclkiyetinde bulunan ve Bakanl\u0131k taraf\u0131ndan sat\u0131n al\u0131nan, kamula\u015ft\u0131r\u0131lan, ya da toplula\u015ft\u0131r\u0131lan arazilere ili\u015fkin her t\u00fcr ve \u00f6l\u00e7ekteki et\u00fct, harita, plan, imar plan\u0131, imar plan\u0131 de\u011fi\u015fikli\u011fi ve imar uygulamalar\u0131 konusunda \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 yetkilendirilmi\u015ftir. Yak\u0131n d\u00f6nem i\u00e7inde benzer bi\u00e7imde bir kararname ile yap\u0131lan yanl\u0131\u015f\u0131 ortadan kald\u0131rmaya y\u00f6nelik de\u011fi\u015fiklikle bir ba\u015fka yanl\u0131\u015f ya\u015fama ge\u00e7irilmi\u015ftir.<\/p>\n<p><strong>7. K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nda Yap\u0131lan De\u011fi\u015fiklikler<\/strong> <\/p>\n<p><strong>7.1.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 42 nci maddesi ile 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nun 17 nci maddesinde de\u011fi\u015fikli\u011fe gidilmi\u015f ve koruma ama\u00e7l\u0131 imar planlar\u0131n\u0131n yap\u0131lmas\u0131na ili\u015fkin zorlay\u0131c\u0131 d\u00fczenlemede \u00f6nemli bir geri ad\u0131m at\u0131larak, k\u00fclt\u00fcr varl\u0131klar\u0131m\u0131z\u0131n tahribat\u0131na neden olacak yeni bir s\u00fcrece girilmi\u015ftir.<\/p>\n<p>De\u011fi\u015fiklik \u00f6ncesinde, sit alan\u0131 olarak koruma alt\u0131na al\u0131nan alanlarda iki y\u0131l i\u00e7inde koruma ama\u00e7l\u0131 imar plan\u0131 yap\u0131lmas\u0131, zorunlu durumlarda bu s\u00fcrenin koruma b\u00f6lge kurulu taraf\u0131ndan bir y\u0131l uzat\u0131labilece\u011fi d\u00fczenlenmi\u015f durumdayken, bu s\u00fcre d\u00fczenlemede do\u011frudan \u00fc\u00e7 y\u0131l olarak d\u00fczenlenmi\u015f ve koruma b\u00f6lge kurullar\u0131na bu s\u00fcreyi s\u0131n\u0131rs\u0131z bi\u00e7imde uzatma yetkisi tan\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Bu durum, de\u011fi\u015fiklik \u00f6ncesinde koruma ama\u00e7l\u0131 imar plan\u0131 yap\u0131lmas\u0131n\u0131 \u00f6zendiren, belirlenen s\u00fcrenin sonunda ge\u00e7ersiz hale gelen &#8220;ge\u00e7i\u015f d\u00f6nemi koruma esaslar\u0131 ve kullanma \u015fartlar\u0131&#8221;n\u0131n s\u00fcrekli uygulanmas\u0131n\u0131 olanakl\u0131 hale getirmektedir. B\u00f6ylesi bir d\u00fczenleme, koruma ama\u00e7l\u0131 imar planlar\u0131n\u0131n yap\u0131lmas\u0131n\u0131 engellemenin yan\u0131 s\u0131ra, sit alanlar\u0131nda plans\u0131z bi\u00e7imde yap\u0131la\u015fman\u0131n da \u00f6n\u00fcn\u00fc a\u00e7acakt\u0131r.<\/p>\n<p>Ayn\u0131 madde i\u00e7inde yap\u0131lan bir ba\u015fka d\u00fczenleme ile Ankara Ulus \u00f6rne\u011finde oldu\u011fu gibi, yarg\u0131 kararlar\u0131yla koruma ama\u00e7l\u0131 imar plan\u0131 durdurulmu\u015f ya da iptal edilmi\u015f alanlarda da koruma b\u00f6lge kurulu kararlar\u0131yla yeni yap\u0131la\u015fmalar\u0131n \u00f6n\u00fcn\u00fc a\u00e7maya y\u00f6nelik d\u00fczenlemeye gidilmi\u015ftir. Bu haliyle yap\u0131lan d\u00fczenleme yarg\u0131 kararlar\u0131n\u0131 devre d\u0131\u015f\u0131 b\u0131rakmay\u0131 ama\u00e7layan, sit alanlar\u0131nda koruma b\u00f6lge kurulu i\u015fbirli\u011fi ile ger\u00e7ekle\u015ftirilecek talan\u0131n \u00f6n\u00fcn\u00fc a\u00e7an bir d\u00fczenleme olma niteli\u011fi ta\u015f\u0131maktad\u0131r.<\/p>\n<p><strong>7.2.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 45 inci maddesi ile 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nun 51 inci maddesinde de\u011fi\u015fikli\u011fe gidilmi\u015f ve baz\u0131 belediyelerin ve merkezi kurumlar\u0131n, koruma b\u00f6lge kurullar\u0131nda kabul ettiremedikleri baz\u0131 kararlar\u0131n merkezi olarak olu\u015fturulan ve b\u00fcy\u00fck \u00e7o\u011funlu\u011fu merkezi idarenin b\u00fcrokratlar\u0131ndan olu\u015fan Koruma Y\u00fcksek Kurulu taraf\u0131ndan g\u00f6r\u00fc\u015f\u00fclmesi, karara ba\u011flanmas\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>Yap\u0131lan d\u00fczenlemede, al\u0131nan bu t\u00fcrden kararlar\u0131n yeniden koruma b\u00f6lge kurulu taraf\u0131ndan g\u00f6r\u00fc\u015f\u00fclemeyece\u011fi de d\u00fczenlenerek, k\u00fclt\u00fcr varl\u0131klar\u0131m\u0131z ve sit alanlar\u0131m\u0131z \u00fczerinde koruma b\u00f6lge kurulu kontrol\u00fcn\u00fc kald\u0131racak, koruma b\u00f6lge kurullar\u0131n\u0131 fiili olarak devre d\u0131\u015f\u0131 b\u0131rakacak, olas\u0131 bir talan-tahribat s\u00fcrecinin ilk ad\u0131m\u0131 at\u0131lm\u0131\u015ft\u0131r.\u00a0 <\/p>\n<p><strong>7.3.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 47 nci maddesi ile 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nun 55 inci maddesinde de\u011fi\u015fikli\u011fe gidilmi\u015f ve AKP iktidar\u0131 taraf\u0131ndan 2004 y\u0131l\u0131nda ba\u015flat\u0131lan, aslen \u00f6zerk olmas\u0131 gereken koruma kurullar\u0131n\u0131 ele ge\u00e7irme, kontrol alt\u0131na alma giri\u015fiminde sona gelinmi\u015ftir.<\/p>\n<p>AKP iktidar\u0131 \u00f6ncesinde 3\u2018\u00fc Bakanl\u0131k, 2\u2018si Y\u00d6K taraf\u0131ndan atanan 5 ki\u015fiden olu\u015fan, kararlar\u0131n\u0131 ilgili kurum temsilcisinin de kat\u0131l\u0131m\u0131yla alan, Bakanl\u0131k taraf\u0131ndan kontrol alt\u0131na al\u0131namayan yap\u0131ya ilk darbe 2004 y\u0131l\u0131nda vurulmu\u015f, \u00fcye say\u0131s\u0131 5\u2018ten 7\u2018ye \u00e7\u0131kar\u0131l\u0131rken, Bakanl\u0131k taraf\u0131ndan atanan \u00fcye say\u0131s\u0131 5\u2018e \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>Yap\u0131lan bu d\u00fczenlemenin de kurullar\u0131n kontrol\u00fcn\u00fc t\u00fcm\u00fcyle ele ge\u00e7irmeyi sa\u011flamad\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnden olsa gerek, yap\u0131lan yeni de\u011fi\u015fiklikle koruma b\u00f6lge kurullar\u0131na Y\u00d6K taraf\u0131ndan \u00fcye atanmas\u0131 uygulamas\u0131na da son verilmi\u015f ve t\u00fcm atamalar\u0131n Bakanl\u0131k taraf\u0131ndan yap\u0131lmas\u0131na y\u00f6nelik de\u011fi\u015fiklik yap\u0131lm\u0131\u015f, koruma b\u00f6lge kurullar\u0131 \u00f6zerklikten t\u00fcm\u00fcyle uzakla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r.\u00a0 <\/p>\n<p><strong>7.4.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 49 uncu maddesi ile 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nun 58 inci maddesinde de\u011fi\u015fikli\u011fe gidilmi\u015f ve Koruma B\u00f6lge Kurullar\u0131\u2018na g\u00f6zlemci olarak kat\u0131lma hakk\u0131na sahip olan meslek odalar\u0131n\u0131n kat\u0131l\u0131m\u0131n\u0131 engellemeye y\u00f6nelik d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>2004 y\u0131l\u0131nda yap\u0131lan d\u00fczenlemede \u0130lgili meslek odalar\u0131 koruma b\u00f6lge kurulu toplant\u0131lar\u0131na g\u00f6zlemci olarak kat\u0131labilirler denilirken, yap\u0131lan de\u011fi\u015fiklikle &#8220;koruma b\u00f6lge kurulu m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn daveti&#8221; \u015fart\u0131 getirilmi\u015ftir. B\u00f6ylesi bir de\u011fi\u015fikli\u011fin, koruma b\u00f6lge kurullar\u0131nda g\u00f6r\u00fc\u015f\u00fclecek olan ve sivil toplumun, meslek odalar\u0131n\u0131n tepkisini \u00e7ekecek olan konular\u0131n g\u00f6r\u00fc\u015f\u00fclmesinin gizli olarak yap\u0131labilmesini sa\u011flamay\u0131, kat\u0131l\u0131m\u0131 engellemeyi, kararlar\u0131n gizlenmesini ama\u00e7lad\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r.\u00a0 <\/p>\n<p><strong>7.5.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 50 nci maddesi ile de 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018nun 61 inci maddesinde de\u011fi\u015fikli\u011fe gidilmi\u015f ve koruma b\u00f6lge kurulu kararlar\u0131na itiraz haklar\u0131na k\u0131s\u0131tlama ve Bakanl\u0131k denetimi getirilmi\u015ftir. <\/p>\n<p>Yap\u0131lan itirazlar\u0131n Bakanl\u0131k\u00e7a de\u011ferlendirilmesi ve &#8220;gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc takdirde&#8221; Koruma Y\u00fcksek Kurulu g\u00fcndemine al\u0131naca\u011f\u0131na ili\u015fkin d\u00fczenleme, itiraz haklar\u0131n\u0131n k\u0131s\u0131tlanmas\u0131n\u0131n yan\u0131 s\u0131ra, itiraz konusu ve itirazc\u0131lara ba\u011fl\u0131 olarak ayr\u0131mc\u0131l\u0131k yap\u0131lmas\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7acak bir d\u00fczenleme niteli\u011fine sahiptir.\u00a0 <\/p>\n<p><strong>7.6.<\/strong> 648 say\u0131l\u0131 KHK\u2018nin 51 nci maddesi ile 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018na Ek Madde-4 eklenmi\u015f ve tabiat varl\u0131klar\u0131 ve do\u011fal sit alanlar\u0131 ile ilgili g\u00f6rev ve yetkiler \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na devredilmi\u015f, Tabiat Varl\u0131klar\u0131n\u0131 Koruma Merkez Komisyonu ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma B\u00f6lge Komisyonlar\u0131n\u0131n kurulu\u015fu d\u00fczenlenmi\u015ftir. Yap\u0131lan d\u00fczenlemede komisyonlarda farkl\u0131 meslek alanlar\u0131ndan uzmanlar\u0131n yer almas\u0131na ili\u015fkin d\u00fczenleme yap\u0131l\u0131rken, planlama meslek alan\u0131 t\u00fcm\u00fcyle d\u0131\u015flanm\u0131\u015ft\u0131r.<\/p>\n<p><strong>7.7.<\/strong>\u00a0648 say\u0131l\u0131 KHK\u2018nin 52 nci maddesi ile 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu\u2018na iki ge\u00e7ici madde eklenmesine karar verilirken, Ge\u00e7ici Madde 10 ile T\u00fcrkiye genelinde var olan t\u00fcm koruma b\u00f6lge kurullar\u0131n\u0131n \u00fcyelerinin g\u00f6revlerine son verilmi\u015f, koruma b\u00f6lge kurullar\u0131n\u0131n Bakanl\u0131k kontrol\u00fcnde yeniden bi\u00e7imlendirilmesinin \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>&nbsp;<\/p>\n<p><strong>8.\u00a0Sonu\u00e7<\/strong><\/p>\n<p>17 A\u011fustos 2011 tarihinde Resmi Gazete\u2018de yay\u0131mlanan 648 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname, olas\u0131 sonu\u00e7lar\u0131 a\u00e7\u0131s\u0131ndan, 12 y\u0131l \u00f6nce 1999 y\u0131l\u0131nda ayn\u0131 g\u00fcn ger\u00e7ekle\u015fen ve \u00fclkemizin ya\u015fad\u0131\u011f\u0131 en b\u00fcy\u00fck afetlerden biri olan G\u00f6lc\u00fck Depreminden daha y\u0131k\u0131c\u0131 etkilere, daha b\u00fcy\u00fck kay\u0131plara, ac\u0131lara neden olabilecek bir niteli\u011fe sahiptir.<\/p>\n<p>Kararname ile s\u0131n\u0131rlar\u0131 t\u00fcm T\u00fcrkiye olan, merkezi konumda bir &#8220;Belediye&#8221; ya da ikinci bir &#8220;TOK\u0130&#8221; olmaya niyetlenen \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131, tan\u0131mlanan yetkilere y\u00f6nelik yeni d\u00fczeltmeler yap\u0131lmamas\u0131 durumunda, s\u0131n\u0131r tan\u0131mayan yetkileriyle k\u0131sa s\u00fcrede kontrol edilemez bir \u0130mar Krall\u0131\u011f\u0131\u2018na d\u00f6n\u00fc\u015febilecektir. <\/p>\n<p>Planlaman\u0131n, kontroll\u00fc, denetimli ve ruhsatl\u0131 yap\u0131la\u015fman\u0131n d\u0131\u015flanmas\u0131n\u0131n yan\u0131 s\u0131ra, \u00fclkemizin rant bask\u0131s\u0131 alt\u0131nda direnen do\u011fal ve k\u00fclt\u00fcrel de\u011ferlerinin de g\u00f6zden \u00e7\u0131kar\u0131lmas\u0131 anlam\u0131na gelen d\u00fczenlemeler, hi\u00e7 zaman kaybetmeden geri al\u0131nmal\u0131d\u0131r.<\/p>\n<p>Ba\u015fta \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2018na tan\u0131mlanan yetkiler olmak \u00fczere, \u00fclkemizde planlama, imar ve kentle\u015fme alan\u0131nda tan\u0131mlanm\u0131\u015f olan kurallar\u0131n ve yetkilerin tamam\u0131n\u0131n Kentle\u015fme \u015euras\u0131 ve KENTGES kararlar\u0131 dikkate al\u0131narak yeniden d\u00fczenlenmesi, TBMM \u00e7at\u0131s\u0131 alt\u0131nda, en geni\u015f kat\u0131l\u0131m olanaklar\u0131 yarat\u0131larak tart\u0131\u015f\u0131lmas\u0131 sa\u011flanmal\u0131d\u0131r.
