{"id":35852,"date":"2021-07-01T07:19:32","date_gmt":"2021-07-01T04:19:32","guid":{"rendered":"http:\/\/politeknik.org.tr\/?p=35852"},"modified":"2021-07-01T12:39:57","modified_gmt":"2021-07-01T09:39:57","slug":"besiktas-jandarma-dikimevi-arazisi-bakanliktan-astasa-imar-kiyagi","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/besiktas-jandarma-dikimevi-arazisi-bakanliktan-astasa-imar-kiyagi\/","title":{"rendered":"Be\u015fikta\u015f Jandarma Dikimevi arazisi: Bakanl\u0131k&#8217;tan Asta\u015f&#8217;a imar k\u0131ya\u011f\u0131"},"content":{"rendered":"<p><strong>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131, daha \u00f6nce Asta\u015f \u015firketine satt\u0131\u011f\u0131 \u0130stanbul Be\u015fikta\u015f Balmumcu\u2019daki Jandarma Dikimevi arazisinde imar plan\u0131 de\u011fi\u015fikli\u011fi yapt\u0131. \u0130mara a\u00e7\u0131lan 30 d\u00f6n\u00fcml\u00fck kamusal alanda kat y\u00fcksekli\u011fi 5\u2019ten 8\u2019e \u00e7\u0131kar\u0131l\u0131yor. \u0130stanbullular talan\u0131 durdurmak i\u00e7in 5 Temmuz\u2019a kadar imar plan\u0131na itiraz ediyor.<\/strong><\/p>\n<p>15 Temmuz sonras\u0131nda kent merkezlerinde yer alan askeri alanlar\u0131 satarak imar planlar\u0131 haz\u0131rlayan, kamusal alanlar\u0131 apar topar in\u015faat \u015firketlerine pazarlayan AKP iktidar\u0131 \u015fimdi de \u015firketlerin imar rant\u0131n\u0131 artt\u0131rmak i\u00e7in bu alanlarda imar de\u011fi\u015fiklikleri yap\u0131yor. <\/p>\n<p>2018 y\u0131l\u0131nda TOK\u0130&#8217;nin imzalad\u0131\u011f\u0131 protokol ile Jandarma Genel Komutanl\u0131\u011f\u0131\u2019ndan devrald\u0131\u011f\u0131 Be\u015fikta\u015f Barbaros Bulvar\u0131\u2019ndaki Jandarma Dikimevi\u2019nin bulundu\u011fu yakla\u015f\u0131k 30 d\u00f6n\u00fcml\u00fck askeri arazi 2018 y\u0131l\u0131nda plan de\u011fi\u015fikli\u011fi yap\u0131larak konut imar\u0131na a\u00e7\u0131lm\u0131\u015f, yap\u0131lara be\u015f kat s\u0131n\u0131r\u0131 getirilmi\u015fti. Bakanl\u0131k imar plan\u0131 sonras\u0131nda Dikimevi arazisini i\u00e7indeki yap\u0131lar\u0131yla birlikte 472 milyon TL\u2019ye Asta\u015f \u015firketine satm\u0131\u015ft\u0131.<\/p>\n<p>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131, araziyi alan ve mevcut planlarla yeterince rant elde edemeyece\u011fini belirten Asta\u015f\u2019\u0131n talebi \u00fczerine yeni imar plan\u0131 haz\u0131rlayarak kat say\u0131s\u0131n\u0131 5\u2019ten 8\u2019e \u00e7\u0131kard\u0131. <\/p>\n<p>Ask\u0131ya \u00e7\u0131kan ve 5 Temmuz\u2019a kadar itiraz edilebilecek planlar durdurulamazsa ye\u015fil alan niteli\u011fi de bulunan Dikimevi arazisi yok olacak ve \u015firketin kar\u0131 katlanm\u0131\u015f olacak.<br \/>\n<img decoding=\"async\" src=\"http:\/\/politeknik.org.tr\/wp-content\/uploads\/2021\/07\/img-4945-1024x768.jpg\" alt=\"\" width=\"1024\" height=\"768\" class=\"alignnone size-large wp-image-35856\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2021\/07\/img-4945-1024x768.jpg 1024w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2021\/07\/img-4945-300x225.jpg 300w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2021\/07\/img-4945-768x576.jpg 768w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2021\/07\/img-4945-1536x1152.jpg 1536w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2021\/07\/img-4945-2048x1536.jpg 2048w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2021\/07\/img-4945-scaled.jpg 2560w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/p>\n<p><strong>Kamusal alan\u0131 yok et, imar oyunlar\u0131yla \u015firketin kar\u0131n\u0131 katla<\/strong><\/p>\n<p>Askeriyeye ait alan\u0131 kamusal olmaktan \u00e7\u0131kararak 1\/5000 o\u0308lc\u0327ekli naz\u0131m ve 1\/1000 o\u0308lc\u0327ekli uygulama imar plan\u0131 ile Askeri Alan kullan\u0131m\u0131, Konut Alan\u0131, Park Alan\u0131, Cami Alan\u0131 ve Yol Alan\u0131 \u015fekline d\u00f6n\u00fc\u015ft\u00fcren \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n bu giri\u015fimine 2019 y\u0131l\u0131nda TMMOB S\u0327eh\u0131\u0307r Planc\u0131lar\u0131 Odas\u0131 I\u0307stanbul S\u0327ubes\u0131\u0307 dava a\u00e7t\u0131. \u015eehir planc\u0131lar\u0131 imar planlar\u0131n usul ve hukuka ayk\u0131r\u0131 oldug\u0306unu belirtti.<\/p>\n<p>Mahkemenin ret karar\u0131 verdi\u011fi ve \u015fehir planc\u0131lar\u0131n\u0131n \u00fcst mahkemeye ta\u015f\u0131d\u0131\u011f\u0131 davada bilirki\u015filer \u201c<em>Dava konusu alanda konut kullan\u0131m\u0131na bag\u0306l\u0131 olarak hesaplanacak toplam esas al\u0131nan ins\u0327aat alan\u0131 bu\u0308yu\u0308klu\u0308g\u0306u\u0308nu\u0308n, o\u0308ngo\u0308ru\u0308len 17505 m2 toplam konut alan\u0131 yerine 29760,50 m2 olacag\u0306\u0131, dig\u0306er bir anlat\u0131mla, alan\u0131n tu\u0308mu\u0308nu\u0308n konut alan\u0131 o\u0308ngo\u0308ru\u0308lmu\u0308s\u0327 gibi ele al\u0131nacag\u0306\u0131, bu durumda, so\u0308z konusu plan notunun, imar plan\u0131 kararlar\u0131n\u0131 tamamlay\u0131c\u0131 ve plan ile bu\u0308tu\u0308nlu\u0308k olus\u0327turma nitelig\u0306ini kaybettig\u0306i, plan kararlar\u0131n\u0131n yerine gec\u0327tig\u0306i, dig\u0306er bir anlat\u0131mla, alanda o\u0308ngo\u0308ru\u0308len park, ibadet alan\u0131 ve yol alan\u0131 gibi sosyal donat\u0131 alanlar\u0131, so\u0308z konusu plan notu ile konut alan\u0131 kullan\u0131m\u0131na do\u0308nu\u0308s\u0327tu\u0308ru\u0308ldu\u0308g\u0306u\u0308, bu durumun, plan deg\u0306is\u0327iklig\u0306i ic\u0327inde o\u0308rtu\u0308k bir plan deg\u0306is\u0327iklig\u0306i oldug\u0306u ve sosyal donat\u0131 alan kullan\u0131mlar\u0131n\u0131n plan notu ile konut alan\u0131na do\u0308nu\u0308s\u0327tu\u0308ru\u0308lmesi anlam\u0131na geldig\u0306i, bu tutumu, yukar\u0131da belirtildig\u0306i gibi, Planl\u0131 Alanlar I\u0307mar Yo\u0308netmelig\u0306i\u2019ne 5. maddesinde belirtilen \u201cTaban alan\u0131 ve emsal hesab\u0131; net imar parseli alan\u0131 u\u0308zerinden yap\u0131l\u0131r\u201d ilkesine ayk\u0131r\u0131 oldug\u0306u gibi, plan notunu o\u0308nceleyen, plan notunun plan karar\u0131 yerine gec\u0327en, bu anlamda plan notunun esas is\u0327levini kaybettig\u0306i, o\u0308rtu\u0308k bir plan deg\u0306is\u0327iklig\u0306i arac\u0131na do\u0308nu\u0308s\u0327tu\u0308g\u0306u\u0308 bir yaklas\u0327\u0131ma kars\u0327\u0131l\u0131k geldig\u0306i, planlama alan\u0131n\u0131n konum o\u0308zellikleri yo\u0308nu\u0308nden yap\u0131lan deg\u0306erlendirme ac\u0327\u0131s\u0131ndan; dava konusu plan deg\u0306is\u0327ikliklerinin o\u0308zu\u0308nde Askeri Alan kullan\u0131m\u0131n\u0131n bas\u0327ka bir kullan\u0131ma do\u0308nu\u0308s\u0327tu\u0308ru\u0308lmesiyle ilgili oldug\u0306u, ancak, dava konusu plan deg\u0306is\u0327iklikleri ile gerc\u0327ekles\u0327en arazi kullan\u0131m deg\u0306is\u0327iminin, dig\u0306er yandan kentte bu\u0308yu\u0308me ve genis\u0327 alan kaplayan kamu kurum alanlar\u0131 ile sosyal donat\u0131 alanlar\u0131n\u0131n zamanla kentin yap\u0131las\u0327m\u0131s\u0327 alan\u0131nda kalmas\u0131 ve yap\u0131las\u0327ma bask\u0131s\u0131 ile yu\u0308z yu\u0308ze gelmesiyle ilgili oldug\u0306u<\/em>\u201d ifadelerini kullanarak plan de\u011fi\u015fikli\u011finin planlama ilkeleri ve s\u0327ehircilik esaslar\u0131na uygunluk go\u0308stermedig\u0306ini vurgulad\u0131. Ancak mahkeme \u015fehir planc\u0131lar\u0131n\u0131n talebini reddederek imar rant\u0131na yol vermi\u015f oldu.<\/p>\n<p><strong>Askeri araziler kupon arazilere d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc<\/strong><\/p>\n<p>AKP iktidar\u0131 15 Temmuz&#8217;u ayn\u0131 zamanda kent merkezinde kalm\u0131\u015f askeri arazileri sat\u0131\u015fa \u00e7\u0131kararak da f\u0131rsata \u00e7evirmi\u015f oldu.
