Maddesi kapsam\u0131nda \u00c7ED s\u00fcrecinin ba\u015flat\u0131ld\u0131\u011f\u0131 biliniyor. Ancak, \u00c7ED s\u00fcrecinin devam edebilmesi i\u00e7in, \u00c7evre ve \u0130mar Mevzuat\u0131 uyar\u0131nca proje alan\u0131n\u0131n plan \u00fczerinde g\u00f6sterilmesi gerekiyor. Karaman illerini, Adana Alt B\u00f6lgesinin ise D\u00fczey-3 s\u0131n\u0131fland\u0131r\u0131lmas\u0131nda Adana &#8211; Mersin illerini kapsad\u0131\u011f\u0131 dolay\u0131s\u0131yla bu iki ilin istatistiki d\u00fczey b\u00f6lgesinde bir arada yer almad\u0131\u011f\u0131 gibi her iki ilin ayn\u0131 su havzas\u0131nda bulunmad\u0131\u011f\u0131, plan a\u00e7\u0131klama raporunda \u00fc\u00e7 ilin birlikte planlanmas\u0131n\u0131n gerek\u00e7elerinin a\u00e7\u0131k\u00e7a ayr\u0131nt\u0131l\u0131 ve tatmin edici bir \u015fekilde ortaya konulmad\u0131\u011f\u0131, ortaya konan gerek\u00e7elerin ise bilirki\u015fi raporu ile aksinin belirlendi\u011fi g\u00f6r\u00fcld\u00fc\u011f\u00fcnden, dava konu\u015fu plan\u0131n Mersin-Karaman illerini kapsar \u015feklinde planlanmas\u0131n\u0131n uygun olmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Di\u011fer taraftan, dava konusu \u00c7evre D\u00fczeni Plan\u0131n\u0131n ekolojik kararlar\u0131n birarada d\u00fc\u015f\u00fcn\u00fclmesine olanak veren ve strateji ve politika olu\u015fturan bir plan niteli\u011finde bulunmad\u0131\u011f\u0131, sa\u011fl\u0131kl\u0131 \u00e7evrenin olu\u015fturulmas\u0131na y\u00f6nelik, hedef, ilke ve strateji \u00fcretmedi\u011fi, bir strateji plan\u0131ndan daha \u00e7ok, alt \u00f6l\u00e7ekli planlar\u0131n konusuna girebilecek alanlar\u0131n plana yans\u0131t\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fcld\u00fc\u011f\u00fcnden an\u0131lan plan bu a\u00e7\u0131dan mevzuata uygun bulunmam\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Ayr\u0131ca niteli\u011fi ve y\u00f6netmelik h\u00fck\u00fcmleri ba\u011flam\u0131nda dava konusu \u00c7evre D\u00fczeni Plan\u0131n\u0131n vizyonunun, amac\u0131n\u0131n, hedeflerinin, stratejilerinin, ilkelerinin ve politikalar\u0131n\u0131n a\u00e7\u0131kland\u0131\u011f\u0131 ve bunlar do\u011frultusunda belirlenen projeksiyon n\u00fcfusuna, sekt\u00f6rel yap\u0131ya, alan b\u00fcy\u00fckl\u00fcklerine, plan kararlar\u0131na, plan uygulama ara\u00e7lar\u0131na, kurumsal yap\u0131ya ve denetime ili\u015fkin gerek\u00e7eli a\u00e7\u0131klamalar\u0131n yap\u0131ld\u0131\u011f\u0131, bir plan raporu ve a\u00e7\u0131klama raporunun bulunmad\u0131\u011f\u0131, plan a\u00e7\u0131klama raporunda belirtilen saptamalar\u0131n dava konusu \u00c7evre d\u00fczeni plan\u0131n\u0131 farkl\u0131 kurumlar\u0131n yetki ve sorumluluklar\u0131 \u00e7er\u00e7evesinde ald\u0131klar\u0131 kararlar\u0131n aktar\u0131ld\u0131\u011f\u0131 ve k\u0131s\u0131tl\u0131 d\u00fczenlemelerin yap\u0131ld\u0131\u011f\u0131 \u00e7evre odakl\u0131 de\u011fil de \u00e7evresel etkiler konusunda duyarl\u0131l\u0131\u011f\u0131n saptanmaya \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131 bir plan bi\u00e7imine getirdi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan, dava konusu i\u015flem bu a\u00e7\u0131dan da mevzuata uygun de\u011fildir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Bu durumda dava konusu Mersin &#8211; Karaman Planlama B\u00f6lgesi 1\/1000.000 \u00f6l\u00e7ekli \u00c7evre D\u00fczeni Plan\u0131nda &#8221; mevzuata, \u015fehircilik ilkelerine, planlama esaslar\u0131na ve kamu yarar\u0131na uyarl\u0131k g\u00f6r\u00fclmemi\u015ftir&#8221; gerek\u00e7esiyle y\u00fcr\u00fct\u00fclmesinin durdurulmas\u0131na karar verilmi\u015ftir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Bu itibarla davaya konu alan\u0131 kapsayan 1\/100.000 \u00f6l\u00e7ekli Mersin &#8211; Karaman Planlama B\u00f6lgesi \u00c7evre D\u00fczeni Plan\u0131n\u0131n tesis edildi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>\u00c7evre D\u00fczeni Planlar\u0131na Dair Y\u00f6netmelikte &#8220;Havza&#8221;; bir akarsu kayna\u011f\u0131n\u0131 besleyen y\u00fczey ve yer alt\u0131 su kaynaklar\u0131n\u0131n tabii su toplama alan\u0131n\u0131 kapsayacak bi\u00e7imde, Devlet Su \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce belirlenmi\u015f alanlar, &#8220;B\u00f6lge&#8221;; co\u011frafi, sosyal, ekonomik, fiziksel nitelikleri a\u00e7\u0131s\u0131ndan benzerlik g\u00f6steren alan ve\/veya Devlet Planlama Te\u015fkilat\u0131nca belirlenmi\u015f olan istatistiki b\u00f6lge (d\u00fczey 2) birimleri olarak tan\u0131mlanm\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>\u00c7evre D\u00fczeni Planlar\u0131na Dair Y\u00f6netmeli\u011fin 4. maddesi (\u00e7) bendinde, \u00c7evre d\u00fczeni plan\u0131 a\u00e7\u0131klama raporu: \u00c7evre d\u00fczeni plan\u0131n\u0131n vizyonunun, amac\u0131n\u0131n, hedeflerinin, stratejilerinin, ilkelerinin ve politikalar\u0131n\u0131n a\u00e7\u0131kland\u0131\u011f\u0131 ve bunlar do\u011frultusunda belirlenen projeksiyon n\u00fcfusuna, sekt\u00f6rel yap\u0131ya, alan b\u00fcy\u00fckl\u00fcklerine, plan kararlar\u0131na, plan uygulama ara\u00e7lar\u0131na, kurumsal yap\u0131ya ve denetime ili\u015fkin gerek\u00e7eli a\u00e7\u0131klamalar\u0131n yap\u0131ld\u0131\u011f\u0131 ve \u00e7evre d\u00fczeni plan\u0131 ile b\u00fct\u00fcn olan rapor, (d) bendinde; \u00e7evre d\u00fczeni plan\u0131 ara\u015ft\u0131rma raporu: Planlama alan\u0131na ili\u015fkin gelece\u011fe y\u00f6nelik projeksiyonlar\u0131n yap\u0131labilmesi, plan kararlar\u0131n\u0131n, koruma ve geli\u015fme politika ve stratejilerinin ve plan h\u00fck\u00fcmlerinin belirlenebilmesi i\u00e7in 7 nci madde kapsam\u0131nda toplanan verilerin planlama \u00e7al\u0131\u015fmas\u0131nda kullan\u0131lacak bi\u00e7imde analiz ve sentezinin yap\u0131ld\u0131\u011f\u0131, alana y\u00f6nelik f\u0131rsatlar\u0131n, tehditlerin, g\u00fc\u00e7l\u00fc y\u00f6nler ve zay\u0131fl\u0131klar\u0131n belirlenerek ilgisine g\u00f6re farkl\u0131 disiplinlerden uzmanlarca haz\u0131rlanan rapor olarak tan\u0131mlanm\u0131\u015f, \u00e7evre d\u00fczeni plan\u0131n\u0131n niteliklerinin belirlendi\u011fi 5. maddesi (e) bendinde, &#8220;planlamaya temel olu\u015fturan verilerin farkl\u0131l\u0131\u011f\u0131ndan dolay\u0131 farkl\u0131 mesleklerden uzmanlar\u0131n fiili kat\u0131l\u0131m\u0131 ile haz\u0131rlanan \u00fcst \u00f6l\u00e7ekli bir plan oldu\u011fu&#8221; vurgulanm\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Y\u00f6netmeli\u011fin &#8220;Planlama alan\u0131n\u0131n tespiti&#8221; ba\u015fl\u0131kl\u0131 6. maddesinin 1\/a bendinde Planlama alan\u0131; \u00c7evre ve Orman Bakanl\u0131\u011f\u0131 Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun ve \u00c7evre Kanunu kapsam\u0131nda; Devlet Su \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan belirlenen b\u00fcy\u00fck akarsu havzalar\u0131 veya Devlet Planlama Te\u015fkilat\u0131 M\u00fcste\u015farl\u0131\u011f\u0131 taraf\u0131ndan belirlenmi\u015f istatistik\u00ee b\u00f6lge birimleri (d\u00fczey 2) ile birlikte idari s\u0131n\u0131rlar\u0131 da dikkate al\u0131narak, en az iki il s\u0131n\u0131r\u0131n\u0131 i\u00e7erecek \u015fekilde belirlenir h\u00fckm\u00fc yer alm\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Di\u011fer yandan Devlet Planlama Te\u015fkilat\u0131 taraf\u0131ndan 2003 y\u0131l\u0131nda yay\u0131mlanan istatistiki B\u00f6lge Birimleri S\u0131n\u0131fland\u0131r\u0131lmas\u0131 D\u00fczey &#8211; 1 Sosyo &#8211; Ekonomik Geli\u015fmi\u015flik s\u0131ralamas\u0131na g\u00f6re Adana ve Konya B\u00f6lgesi D\u00fczey (2) i\u00e7erisinde bulunmakta, Konya alt b\u00f6lgesinin d\u00fczey (3) s\u0131ralamas\u0131nda Konya &#8211; Karaman illerini, Adana alt b\u00f6lgesinin ise Adana-Mersin ilerini kapsad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>03.09.2009 tarihli i\u015flemle onaylanan Mersin- Karaman Planlama B\u00f6lgesi 1\/100.000 \u00f6l\u00e7ekli \u00c7evre D\u00fczeni Plan\u0131n\u0131n t\u00fcm\u00fcne kar\u015f\u0131 a\u00e7\u0131lan E:2010\/1642, E:2009\/15536 say\u0131l\u0131 dosyalar da, dava konusu plan\u0131n ilgili mevzuatla belirlenen esaslara, \u015fehircilik ilkelerine, planlama esaslar\u0131na ve kamu yarar\u0131na uygun olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi amac\u0131yla Naip \u00dcye Habibe \u00dcnal taraf\u0131ndan resen se\u00e7ilen Prof. Dr. Ali T\u00fcre, Prof. Dr. Ha\u015fan Yaz\u0131c\u0131gil ve Prof. Dr. Ayda Erayd\u0131n\u2018\u0131n kat\u0131l\u0131m\u0131yla mahallinde yap\u0131lan ke\u015fif ve bilirki\u015fi incelemesi sonucunda d\u00fczenlenen bilirki\u015fi raporunun de\u011ferlendirilmesi sonucunda, Dairemizin 01.11.2011 g\u00fcnl\u00fc, E:2010\/1642 say\u0131l\u0131 karar\u0131yla; Yukar\u0131da yer alan mevzuat h\u00fck\u00fcmleri kar\u015f\u0131s\u0131nda \u00fclkemizin sahip oldu\u011fu do\u011fal, tarihi ve k\u00fclt\u00fcrel zenginli\u011fin korunarak kalk\u0131nma planlar\u0131 ve varsa b\u00f6lge planlar\u0131 temel al\u0131narak, ekonomik kararlarla ekolojik kararlar\u0131n bir arada d\u00fc\u015f\u00fcn\u00fclmesine imkan veren, genel arazi kullan\u0131m kararlar\u0131 ile bunlara ili\u015fkin strateji ve politikalar\u0131 olu\u015fturmak ve \u00e7evre kirlili\u011fini \u00f6nlemek amac\u0131yla naz\u0131m ve uygulama imar planlar\u0131na esas te\u015fkil etmek \u00fczere 1\/50.000-1\/100.000 \u00f6l\u00e7ekteki \u00e7evre d\u00fczeni planlar\u0131n\u0131n havza veya b\u00f6lge baz\u0131nda haz\u0131rlanmas\u0131 gerekti\u011fi, b\u00f6lgenin ise co\u011frafi, sosyal, ekonomik, fiziksel nitelikler a\u00e7\u0131s\u0131ndan benzerlik g\u00f6steren alan ve veya DPT taraf\u0131ndan belirlenmi\u015f olan istatistiki b\u00f6lge (D\u00fczey 2)\u2018yi ifade etti\u011fi, havzan\u0131n ise bir akarsu kayna\u011f\u0131n\u0131 besleyen d\u00fczey ve yeralt\u0131 su kaynaklar\u0131n\u0131n tabii su toplama alan\u0131n\u0131 kapsayacak bi\u00e7imde Devlet Su \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2018nce belirlenmi\u015f alanlar oldu\u011fu, bu ba\u011flamda 1\/100.000 \u00f6l\u00e7ekli \u00c7evre D\u00fczeni Planlar\u0131n\u0131n b\u00f6lge ve havza b\u00fct\u00fcnl\u00fc\u011f\u00fcnde haz\u0131rlanmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Bu ba\u011flamda, bilirki\u015fi raporunda belirtildi\u011fi gibi Mersin-Karaman illerini kapsayan alan\u0131n co\u011frafi, sosyal, ekonomik, fiziksel \u00f6zellikler a\u00e7\u0131s\u0131ndan benzerlik g\u00f6stermedi\u011fi, istatistiki b\u00f6lge D\u00fczey-2 s\u0131n\u0131flamas\u0131nda Konya ve Adana alt b\u00f6lgelerinin yer ald\u0131\u011f\u0131, Konya alt b\u00f6lgesinin D\u00fczey 3. s\u0131n\u0131fland\u0131rmas\u0131nda Konya &#8211;
