Yasan\u0131n kapsam\u0131 &#8220;kamu ve \u00f6zel sekt\u00f6re ait b\u00fct\u00fcn i\u015fler ve i\u015fyerleri&#8221; olarak belirlenmekle birlikte bu kapsam kamu uygulamalar\u0131 i\u00e7in iki y\u0131l sonraya, k\u00fc\u00e7\u00fck i\u015fyerleri i\u00e7in bir ve iki y\u0131l sonraya ertelenerek daha ba\u015ftan s\u0131n\u0131rlanm\u0131\u015ft\u0131r.<\/strong><\/div>\n<div> <\/div>\n<div>\u00a0<\/div>\n<div>Oysa Odam\u0131zca yay\u0131mlanan &#8220;\u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Raporu&#8221;nda belirtildi\u011fi \u00fczere, resmi verileri a\u00e7\u0131klanm\u0131\u015f bulunan 2010 y\u0131l\u0131ndaki i\u015f kazalar\u0131n\u0131n y\u00fczde 56\u2018s\u0131, aktif sigortal\u0131lar\u0131n y\u00fczde 62\u2018sini, i\u015fyerlerinin de y\u00fczde 68\u2018sini olu\u015fturan, 1-49 aras\u0131 \u00e7al\u0131\u015fan\u0131 bulunan ve \u0130\u015fyeri Sa\u011fl\u0131k ve G\u00fcvenlik Birimi ile i\u015fyeri hekimi, i\u015f g\u00fcvenli\u011fi m\u00fchendisi, i\u015fyeri hem\u015firesi veya sa\u011fl\u0131k memuru istihdam zorunlulu\u011fu bulunmayan i\u015fyerlerinde ger\u00e7ekle\u015fmektedir. Yasa haz\u0131rlay\u0131c\u0131s\u0131 ve onaylay\u0131c\u0131lar\u0131, ne yaz\u0131k ki daha en ba\u015ftan, 50\u2018nin alt\u0131nda \u00e7al\u0131\u015fan\u0131 bulunan i\u015fyerlerinde ya\u015fanan i\u015f kazalar\u0131n\u0131n s\u00fcrmesini g\u00f6ze alm\u0131\u015ft\u0131r. Bu durum i\u015f kazas\u0131 ve cinayetlerinin s\u00fcrece\u011fini g\u00f6stermektedir.<\/div>\n<div><\/div>\n<div>Yasada ayr\u0131ca i\u015fverenlere &#8220;i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi uzman\u0131&#8221; olma olana\u011f\u0131 tan\u0131nmaktad\u0131r. Bu durum uluslararas\u0131 etik kurallara ba\u011flanan mesleki ba\u011f\u0131ms\u0131zl\u0131k kural\u0131na ayk\u0131r\u0131d\u0131r. \u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi \u00f6nlemlerinde kusurlu bir i\u015fveren acaba kendini Bakanl\u0131\u011fa \u015fikayet edecek midir? V.b. v.b.<\/div>\n<div><\/div>\n<div>Yasada i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fine Bakanl\u0131k\u00e7a sa\u011flanabilecek olan destek &#8220;ondan az \u00e7al\u0131\u015fan\u0131 bulunanlardan, \u00e7ok tehlikeli ve tehlikeli s\u0131n\u0131fta yer alan i\u015fyerleri&#8221; ile s\u0131n\u0131rlanmakta ve &#8220;ondan az \u00e7al\u0131\u015fan\u0131 bulunanlardan az tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinin de faydalanmas\u0131na&#8221; Bakanlar Kurulunun karar verebilece\u011fi belirtilmektedir. Oysa bilinmektedir ki, tehlike s\u0131n\u0131f\u0131ndan ba\u011f\u0131ms\u0131z olarak i\u015f kazalar\u0131 i\u015fyeri \u00f6l\u00e7e\u011fi k\u00fc\u00e7\u00fcld\u00fck\u00e7e artmaktad\u0131r ve en k\u00fc\u00e7\u00fck \u00f6l\u00e7ekli i\u015fletmeler ile \u00e7al\u0131\u015fanlar\u0131n\u0131n tamam\u0131 deste\u011fe muhta\u00e7t\u0131r.<\/div>\n<div><\/div>\n<div>Yasada i\u015fyeri hekimleri \u00a0ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n mesleki ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n nas\u0131l tesis edilece\u011fine, mesleki ba\u011f\u0131ms\u0131zl\u0131k ile hekim ve uzman\u0131n \u00fccretinin kim taraf\u0131ndan \u00f6dendi\u011fi aras\u0131ndaki ili\u015fki sorununa dair hi\u00e7bir \u015fey s\u00f6ylenmemektedir.<\/div>\n<div><\/div>\n<div>Yasada i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n gerekli \u00f6nlemleri almayan i\u015fvereni Bakanl\u0131\u011fa \u015fikayeti sorun savma yakla\u015f\u0131m\u0131yla belirlenmi\u015ftir. \u0130\u015fvereni \u015fikayet eden hekim ve uzman veya bu hizmeti d\u0131\u015far\u0131dan belirli bir \u00fccretle sa\u011flayan kurulu\u015fun s\u00f6zle\u015fmesine i\u015fverence son vermesi olas\u0131l\u0131\u011f\u0131na kar\u015f\u0131 i\u015fverene uygulanacak yapt\u0131r\u0131mlar belirlenmemi\u015ftir. Mesleki ba\u011f\u0131ms\u0131zl\u0131k ve i\u015f g\u00fcvencesi \u00a0ko\u015fullar\u0131 bulunmay\u0131\u015f\u0131 konunun, azami k\u00e2r ama\u00e7l\u0131 piyasan\u0131n insafs\u0131z i\u015fleyi\u015fine terk edilmesi ve meslekta\u015flar\u0131m\u0131z\u0131n ma\u011fduriyeti sonucunu yaratacakt\u0131r.\u00a0<\/div>\n<div><\/div>\n<div>Yasa i\u015fveren kesimini kay\u0131rmakta, i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n i\u00e7inde bulunduklar\u0131 a\u011f\u0131r ko\u015fullar\u0131 g\u00f6zetmemektedir. Zira i\u015f g\u00fcvenli\u011fi uzmanlar\u0131 ile i\u015fyeri hekimlerinin \u00e7al\u0131\u015fma ko\u015fullar\u0131 ve i\u015fyerlerindeki stat\u00fcleri olduk\u00e7a zay\u0131f ve korunmas\u0131zd\u0131r. \u0130\u015f g\u00fcvenli\u011fi uzmanlar\u0131 ve i\u015fyeri hekimleri i\u015fyerlerinde tam s\u00fcreli olarak \u00e7al\u0131\u015famamaktad\u0131r. \u0130\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n i\u015fyerlerinde yapt\u0131klar\u0131 i\u015f, asl\u0131nda bir dan\u0131\u015fmanl\u0131k hizmetidir. Uzmanlar\u0131n tespitlerinin i\u015fyerlerinde mutlaka yerine getirilmesi i\u00e7in bir yapt\u0131r\u0131m g\u00fcc\u00fc bulunmamaktad\u0131r.<\/div>\n<div><\/div>\n<div>Tespitleri ve \u00f6nerileri yerine getirilmeyen ancak i\u015f kazas\u0131 ve meslek hastal\u0131klar\u0131ndan sorumlu tutulan i\u015f g\u00fcvenli\u011fi uzmanlar\u0131 ile hekimlerin belgelerini ask\u0131ya almak m\u00fchendislik ve t\u0131p bilimlerini dikkate almamak ve cezaland\u0131rmak anlam\u0131na gelmektedir.<\/div>\n<div><\/div>\n<div>Yine yasa uyar\u0131nca kamu kurum ve kurulu\u015flar\u0131ndaki i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n asli g\u00f6revlerinin yan\u0131nda ayn\u0131 kurum i\u00e7inde veya di\u011fer kamu kurum ve kurulu\u015flar\u0131nda g\u00f6revlendirilmeleri, hekim ve uzmanlar\u0131n uzmanl\u0131klar\u0131n\u0131 belirli bir yetkinlikle uygulamalar\u0131n\u0131 ek i\u015f y\u00fck\u00fc ile \u00a0ortadan kald\u0131r\u0131c\u0131 bir uygulama olacakt\u0131r. \u0130\u015f g\u00fcvenli\u011fi uzmanlar\u0131 ve i\u015fyeri hekimleri b\u00f6ylece &#8220;kiral\u0131k i\u015f\u00e7i&#8221; durumuna d\u00fc\u015f\u00fcr\u00fclecektir. Yasa uzman\/nitelikli emek g\u00fcc\u00fcn\u00fc geli\u015ftirme yerine var olan\u0131 esnek bir bi\u00e7imde kullanarak uzman hizmetini niteliksizle\u015ftirme, yap\u0131lacak i\u015flerde eksiklik ve kaosa kap\u0131 aralamaktad\u0131r.<\/div>\n<div><\/div>\n<div>Yasada \u00e7al\u0131\u015fanlar\u0131n g\u00f6r\u00fc\u015flerinin al\u0131nmas\u0131 ve kat\u0131l\u0131mlar\u0131n\u0131n sa\u011flanmas\u0131ndan s\u00f6z edilmekte ancak buna y\u00f6nelik a\u00e7\u0131k ve pratik arg\u00fcmanlar bulunmamaktad\u0131r. \u0130\u015finden olma, g\u00fcvencesizlik v.b. kayg\u0131lar ile \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131n emek aleyhine \u00f6rg\u00fctlenmi\u015f olmas\u0131 bu konunun \u00f6n\u00fcndeki ba\u015fl\u0131ca engelleri olu\u015fturmakta, yasa bu konuda da zay\u0131f belirlemeler ile ge\u00e7i\u015ftirme yoluna ba\u015fvurmaktad\u0131r.<\/div>\n<div><\/div>\n<div>Yasa &#8220;Ulusal \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Konseyi&#8221;ni tavsiye ile s\u0131n\u0131rlam\u0131\u015ft\u0131r. Oysa tavsiyelerin yeterli olmad\u0131\u011f\u0131, fonksiyonel ve y\u00f6nlendirici kararlar gerekti\u011fi bilinmektedir.<\/div>\n<div><\/div>\n<div>Yasan\u0131n &#8220;\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurulu&#8221; \u00fczerine maddesinde &#8220;Elli ve daha fazla \u00e7al\u0131\u015fan\u0131n bulundu\u011fu ve alt\u0131 aydan fazla s\u00fcren s\u00fcrekli i\u015flerin yap\u0131ld\u0131\u011f\u0131 i\u015fyerlerinde i\u015fveren, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili \u00e7al\u0131\u015fmalarda bulunmak \u00fczere kurul olu\u015fturur&#8221; denilmektedir. Bu durumda 50\u2018den az \u00e7al\u0131\u015fan\u0131 bulunan ya da yap\u0131lacak i\u015f ve \u00e7al\u0131\u015fan say\u0131s\u0131n\u0131n ta\u015feron y\u00f6ntemiyle 50\u2018den az \u00e7al\u0131\u015fan\u0131 gerektirecek bi\u00e7imde par\u00e7aland\u0131\u011f\u0131 durumlarda \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kurulu kurulmayacak, k\u0131saca bu kurullar b\u00fct\u00fcn \u00e7al\u0131\u015fanlar ve b\u00fct\u00fcn i\u015fyerleri i\u00e7in ge\u00e7erli olmayacakt\u0131r.<\/div>\n<div><\/div>\n<div>Yasada belirlenen bir\u00e7ok \u00f6nemli husus ise yasa kapsam\u0131na al\u0131nmam\u0131\u015f ve &#8220;Bakanl\u0131k\u00e7a \u00e7\u0131kar\u0131lacak y\u00f6netmeliklerle d\u00fczenlenir&#8221; denilerek ge\u00e7i\u015ftirilmi\u015ftir. Mevzuat hiyerar\u015fisinde yer alan yasa, t\u00fcz\u00fck, y\u00f6netmelik, genelge, tebli\u011f zincirinde bu kez t\u00fcz\u00fck bulunmamaktad\u0131r.<\/div>\n<div><\/div>\n<div>Yasa ile \u0130\u015f Yasas\u0131n\u0131n bir\u00e7ok h\u00fckm\u00fc y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r. Bunlar aras\u0131nda &#8220;A\u011f\u0131r ve Tehlikeli \u0130\u015fler&#8221; kavram\u0131 ve i\u015fyerlerine i\u015fletme belgesi al\u0131nmas\u0131 zorunlulu\u011fu da bulunmaktad\u0131r. Bu durum \u00e7ocuklar\u0131n, gen\u00e7lerin, kad\u0131nlar\u0131n, korumas\u0131z olarak \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 ve \u00a0i\u015fyerlerinin daha az denetimi anlam\u0131na gelecektir. Daha az denetlemenin sonucu daha fazla kaza olacakt\u0131r. Yasa, b\u00fct\u00fcnl\u00fckl\u00fc bir i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi ulusal politikas\u0131ndan yoksun bir i\u00e7erikle haz\u0131rlanm\u0131\u015ft\u0131r. Yasa yine t\u00fcm \u00e7al\u0131\u015fanlar\u0131 kapsamamaktad\u0131r. Bakanl\u0131k y\u00f6netmelik d\u00fczenleme, para cezas\u0131 tahsilat\u0131 ve birka\u00e7 konu d\u0131\u015f\u0131nda i\u015flev \u00fcstlenmemi\u015f, anayasal ve mutlaka gerekli olan kamusal denetim g\u00f6revinden muaf tutulmu\u015f; b\u00fct\u00fcn sorumluluk i\u015f g\u00fcvenli\u011fi uzmanlar\u0131, i\u015fyeri hekimleri ve \u00e7al\u0131\u015fanlara y\u00fcklenmi\u015ftir. Yasan\u0131n ruhu, sermaye kesimini kollamak ve devletin kamusal denetim y\u00fck\u00fcml\u00fcl\u00fcklerinden uzakla\u015fmas\u0131yla belirlenmi\u015ftir. \u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi mevzuat\u0131n\u0131 art\u0131k sermaye \u00e7\u0131karlar\u0131 ve neo liberal politikalar belirlemektedir.<\/div>\n<div><\/div>\n<div>\u0130\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131 sorunu, sermayenin azami k\u00e2r h\u0131rs\u0131 ve \u00e7al\u0131\u015fma ya\u015fam\u0131na y\u00f6nelik politikalar\u0131n emek aleyhine olu\u015fmas\u0131ndan dolay\u0131 \u00f6nemini art\u0131rarak s\u00fcrecektir. K\u00fcreselle\u015fme ve neo liberal serbestle\u015ftirme, \u00f6zelle\u015ftirme, sendikas\u0131zla\u015ft\u0131rma, ta\u015feronla\u015ft\u0131rma, esnek istihdam politikalar\u0131 ile kamu idari yap\u0131s\u0131, personel rejimi ve kamusal denetim alanlar\u0131nda ger\u00e7ekle\u015fen d\u00f6n\u00fc\u015f\u00fcm ve tasfiye sonucu bu alanda say\u0131s\u0131z olumsuz geli\u015fme ve olay ya\u015fanacakt\u0131r.<\/div>\n<div><\/div>\n<div>Yasan\u0131n i\u015f kazalar\u0131, i\u015f cinayetleri ve meslek hastal\u0131klar\u0131n\u0131 \u00f6nleyici bir y\u00f6n\u00fc bulunmamaktad\u0131r.
