Yasa i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fine ili\u015fkin gerek g\u00fcvenceli \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n gerekse \u00e7al\u0131\u015fma ya\u015fam\u0131nda kamusal denetim mekanizmalar\u0131n\u0131n yarat\u0131lmas\u0131 gerekliliklerinden olduk\u00e7a uzak bir bi\u00e7imde haz\u0131rlanmas\u0131 sebebiyle bir \u00e7ok emek ve meslek \u00f6rg\u00fct\u00fcn\u00fcn tepkilerine yol a\u00e7t\u0131.<\/div>\n<div><\/div>\n<div>Son olarak yasayla ilgili de\u011ferlendirmelerini bir bas\u0131n a\u00e7\u0131klamas\u0131yla duyuran D\u0130SK, KESK, TMMOB ve TTB&#8217;nin 5 Temmuz 2012&#8217;de yapt\u0131\u011f\u0131 a\u00e7\u0131klama \u015fu \u015fekilde:\u00a0<\/div>\n<div><\/div>\n<div><strong><em>\u0130\u015e SA\u011eLI\u011eI VE G\u00dcVENL\u0130\u011e\u0130 YASASI, \u0130\u015e KAZALARINI VE MESLEK HASTALIKLARINI G\u00d6RMEZDEN GELEREK YASALA\u015eTI<\/em><\/strong><\/div>\n<div><\/div>\n<div><em>2003 y\u0131l\u0131nda 4857 say\u0131l\u0131 yasa ile haz\u0131rl\u0131klar\u0131 ba\u015flayan, \u00e7e\u015fitli y\u00f6netmelik, t\u00fcz\u00fck giri\u015fimleri ve nihayet 2006\u2018da &#8220;m\u00fcstakil bir i\u015f yasas\u0131&#8221; ad\u0131yla devam eden, son bir y\u0131lda h\u0131z kazanan yasa tasar\u0131s\u0131 Nisan 2012\u2018de Meclis\u2018e sunuldu. 30 Haziran 2012 itibariyle Resmi Gazete\u2018de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girdi. \u00d6ncelikle vurgulanmas\u0131 gereken Yasa\u2018n\u0131n sahiplerince s\u00fcrekli yeni ve \u00f6zg\u00fcn oldu\u011fu ifade edilmesine kar\u015f\u0131n asl\u0131nda hammaddesinin, neredeyse tamam\u0131n\u0131n ge\u00e7mi\u015f y\u00f6netmelik ve t\u00fcz\u00fckler oldu\u011fu; kimi noktalarda o d\u00fczenlemelerden de geriye gidildi\u011fidir. AB ve ILO\u2018nun normlar\u0131na &#8220;uyum&#8221;un gere\u011fi \u2018m\u00fcstakil\u2018 hale getirilmesinden ba\u015fka bir &#8220;yenili\u011fi&#8221; olmayan yasa, bu anlay\u0131\u015f ve bu i\u00e7erikle onar onar ger\u00e7ekle\u015fen i\u015f\u00e7i \u00f6l\u00fcmlerini engelleyebilecek dinamiklerin \u00f6n\u00fcn\u00fc a\u00e7mamaktad\u0131r. Yasa, \u00e7al\u0131\u015fan sa\u011fl\u0131k ve g\u00fcvenli\u011fi hizmetlerinin 50 ve daha az i\u015f\u00e7i \u00e7al\u0131\u015fan i\u015fyerlerini ve kamu \u00e7al\u0131\u015fanlar\u0131n\u0131 kapsamas\u0131 d\u0131\u015f\u0131nda \u00fclkemizin ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131layacak d\u00fczenlemenin \u00e7ok uza\u011f\u0131ndad\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Bu uzun s\u00fcre\u00e7te alandaki t\u00fcm yap\u0131larla birlikte emekten yana \u00f6rg\u00fctler, D\u0130SK, KESK, TMMOB ve TTB olarak b\u00fct\u00fcn toplant\u0131lara kat\u0131ld\u0131k. B\u00fct\u00fcn olumsuz ko\u015fullara, ele\u015ftirilerimizin hi\u00e7birinin dikkate al\u0131nmad\u0131\u011f\u0131 say\u0131s\u0131z toplant\u0131ya ra\u011fmen bu \u00e7al\u0131\u015fmalardan uzak durmad\u0131k, yaz\u0131lar yazd\u0131k, de\u011ferlendirdik, de\u011fi\u015fiklik \u00f6nerilerimizi sunduk. \u00dclkemize, \u00e7al\u0131\u015fanlar\u0131m\u0131z\u0131n sa\u011fl\u0131\u011f\u0131na-g\u00fcvenli\u011fine olan sorumlulu\u011fumuzu ger\u00e7ek anlamda olumlu bir sonuca d\u00f6n\u00fc\u015ft\u00fcrme umudunu s\u00fcrekli diri tutmaya \u00f6zen g\u00f6sterdik. Yasa\u2018n\u0131n haz\u0131rlanma s\u00fcrecinde g\u00f6r\u00fc\u015flerimizi kimi zaman yaz\u0131yla kimi zaman eylemle, defalarca, H\u00fck\u00fcmet kanad\u0131na belirtmemize ra\u011fmen, \u00f6ze ili\u015fkin de\u011ferlendirme ve \u00f6nerilerimizin hi\u00e7biri dikkate al\u0131nmam\u0131\u015ft\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Bilindi\u011fi \u00fczere, insanl\u0131k tarihinin ge\u00e7irdi\u011fi evreler sonucu \u00e7al\u0131\u015fma hakk\u0131, temel insan hakk\u0131 olarak kabul edilmi\u015ftir. Ancak, bu hakk\u0131n tek ba\u015f\u0131na soyut olarak kabul\u00fcn\u00fcn bir anlam ifade etmedi\u011fini de ya\u015fanan deneyimler g\u00f6stermi\u015ftir. Bu hakk\u0131n kullan\u0131m\u0131 ancak di\u011fer temel haklardan olan ya\u015fama hakk\u0131n\u0131n \u00f6z\u00fcn\u00fc ihlal etmeyecek bir ortam\u0131n sa\u011flanmas\u0131yla olanakl\u0131d\u0131r. Sa\u011fl\u0131kl\u0131 ve g\u00fcvenli ortamda ya\u015fama hakk\u0131 temel insan hakk\u0131 oldu\u011funa g\u00f6re \u00e7al\u0131\u015fma hakk\u0131n\u0131n kullan\u0131lmas\u0131nda, \u00e7al\u0131\u015fan\u0131n beden b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc ve sa\u011fl\u0131\u011f\u0131n\u0131 bozacak etkilerden i\u015fyerinin ar\u0131nd\u0131r\u0131lmas\u0131 esast\u0131r. Bu hakk\u0131n korunmas\u0131nda ve kullan\u0131lmas\u0131nda Devlet asli sorumludur.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Bizlerin \u00e7abas\u0131 ve m\u00fccadelesi, \u00e7al\u0131\u015fanlar\u0131n i\u015fyerindeki tehlikelerle kar\u015f\u0131la\u015fma ve onlara maruz kalma olas\u0131l\u0131\u011f\u0131n\u0131 en aza indirmek i\u00e7in olu\u015fturulacak \u00f6rg\u00fctlenme, normlar ve s\u00fcrekli g\u00f6zetimi m\u00fcmk\u00fcn k\u0131lan bir yap\u0131y\u0131 ortaya \u00e7\u0131karmakt\u0131r. Bu yap\u0131n\u0131n ger\u00e7ek ihtiyaca uygun sonu\u00e7 al\u0131c\u0131 dinami\u011fi \u00e7al\u0131\u015fanlar ve sendikalar\u0131, i\u015f g\u00fcvenli\u011fi m\u00fchendisleri ve i\u015fyeri hekimleridir. Bu dinami\u011fin \u00f6n\u00fcn\u00fcn a\u00e7\u0131lmas\u0131 ve taleplerinin kar\u015f\u0131lanmas\u0131, g\u00fcvenlik k\u00fclt\u00fcr\u00fcn\u00fcn geli\u015fimine ve yap\u0131n\u0131n tesisine g\u00fc\u00e7l\u00fc bir temel sa\u011flayacakt\u0131r. Bu nedenle, sendikalar\u0131, i\u015f g\u00fcvenli\u011fi m\u00fchendisi ve i\u015fyeri hekimini Yasa\u2018n\u0131n i\u00e7ine i\u015flevine uygun ana unsurlar olarak do\u011fru koymak gerekirdi.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Sonu\u00e7 olarak;<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>\u0130\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve i\u015f g\u00fcvenli\u011fi alan\u0131nda yeterli ve kal\u0131c\u0131 sonu\u00e7lara ula\u015fabilmek i\u00e7in, i\u015ften kaynaklanan ya da i\u015fle ba\u011flant\u0131l\u0131 olarak meydana gelen kazalar\u0131, hastal\u0131klar\u0131 ya da sa\u011fl\u0131kla ilgili di\u011fer sorunlar\u0131 \u00f6nlemeye d\u00f6n\u00fck ulusal d\u00fczeyde, sistematik bir politikan\u0131n ya\u015fama ge\u00e7irilmesi zorunludur. Tehlike ve riskleri minimum d\u00fczeye indirmeye \u00e7aba sarf edecek bu yakla\u015f\u0131m, kaza ve hastal\u0131klar\u0131n neden oldu\u011fu y\u0131k\u0131mlar\u0131 azaltacak, i\u015f ile ilgili ortam ve ko\u015fullar\u0131 iyile\u015ftirecektir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Yasa, sorunlu bir sistem \u00fczerinden, \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi alan\u0131nda ya\u015fanan sorunlar\u0131 \u00e7\u00f6zebilmesi ve arzu edilen normlara ula\u015fabilmesi hedefinden olduk\u00e7a uzak oldu\u011fu gibi, var olan sorunlar\u0131n daha da derinle\u015fmesine neden olaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnd\u00fcrmektedir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>\u00c7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunda piyasa ko\u015fullar\u0131na ba\u011fl\u0131 ekonomik ve faydac\u0131 yakla\u015f\u0131m terk edilerek, \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi yasas\u0131, sendikalar\u0131n, \u00fcniversitelerin, TTB ve TMMOB\u2018nin kat\u0131l\u0131m\u0131n\u0131n sa\u011fland\u0131\u011f\u0131 ve g\u00f6r\u00fc\u015flerinin yans\u0131t\u0131ld\u0131\u011f\u0131 bir \u00e7er\u00e7evede yeni bir d\u00fczenleme yap\u0131lmal\u0131d\u0131r.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>\u00c7al\u0131\u015fanlar\u0131n ve toplumun sa\u011fl\u0131k ve g\u00fcvenli\u011fi merkeze konulmal\u0131, sistemin en \u00f6nemli ayaklar\u0131n\u0131 olu\u015fturan i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n meslek kurulu\u015flar\u0131yla ba\u011flar\u0131 da g\u00fc\u00e7lendirilerek, i\u015flerini mesleki ba\u011f\u0131ms\u0131zl\u0131klar\u0131n\u0131 koruyarak yapabilecekleri bir g\u00fcvenceye kavu\u015fturulmalar\u0131 sa\u011flanmal\u0131d\u0131r. Ayr\u0131ca, b\u00fct\u00fcn bu \u00f6nerileri somut olarak hayata ge\u00e7irecek yeni bir sistem \u00e7abas\u0131 i\u00e7ine girilmeli ve taraflar\u0131n etkin kat\u0131l\u0131m\u0131na olanak sa\u011flayacak \u015fekilde d\u00fczenlenecek Ulusal Konsey, bu konuda etkin bir rol \u00fcstlenmelidir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>Ayr\u0131ca, hi\u00e7bir net \u00e7er\u00e7eve belirtilmeksizin pek \u00e7ok temel alan\u0131n y\u00f6netmeliklere b\u0131rak\u0131lmas\u0131 yasama yetkisinin devri oldu\u011fu gibi \u00e7al\u0131\u015fanlar\u0131n \u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131\u2018n\u0131n insaf\u0131na terk edilmi\u015ftir.<\/em><\/div>\n<div><em><br \/><\/em><\/div>\n<div><em>G\u00f6r\u00fclen o ki, kaybetti\u011fimiz onca cana ve yitirilen sa\u011fl\u0131\u011f\u0131m\u0131za ra\u011fmen \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi, sermayenin bask\u0131s\u0131na ve ta\u015feron firmalar\u0131n k\u00e2r h\u0131rs\u0131na kurban edilmi\u015ftir.
