Deprem bekleyen \u0130stanbul\u2019da halk\u0131n tedirginli\u011fi de, \u00e7are aray\u0131\u015f\u0131 da h\u0131zlan\u0131yor.<\/p>\n<p>AKP iktidar\u0131 20 y\u0131lda, T\u00fcrkiye bir deprem \u00fclkesi olmas\u0131na ra\u011fmen yap\u0131lar\u0131n deprem g\u00fcvenli\u011fini sa\u011flamad\u0131. Deprem g\u00fcndemini kentlerde rant\u0131 y\u00fcksek yerle\u015fim alanlar\u0131nda in\u015faat patronlar\u0131na rant yaratacak bi\u00e7imde kulland\u0131. \u0130stanbul\u2019da milyonlarca insan deprem g\u00fcvenli\u011fi olmayan \u00e7\u00fcr\u00fck yap\u0131larda ya\u015famaya devam ediyor. Bug\u00fcn \u0130stanbul\u2019da \u0130BB verilerine g\u00f6re 90 bine yak\u0131n yap\u0131n\u0131n acilen y\u0131k\u0131lmas\u0131 gerekiyor.<\/p>\n<p>Peki yap\u0131s\u0131n\u0131 g\u00fcvenli hale getirmek isteyenleri ne bekliyor? Mevcut yasalar \u00f6l\u00e7e\u011finde yap\u0131lar\u0131n\u0131n durumunu merak eden, yap\u0131s\u0131n\u0131 yenilemeyi d\u00fc\u015f\u00fcnen konut sahiplerinin haklar\u0131n\u0131 derledik.<\/p>\n<p><strong>D\u00f6n\u00fc\u015f\u00fcm i\u00e7in ba\u011flay\u0131c\u0131 yasa AKP\u2019nin Afet Yasas\u0131<\/strong><\/p>\n<p>Riskli yap\u0131lar\u0131 ve riskli alan tespitini, riskli yap\u0131lar\u0131n y\u0131kt\u0131r\u0131lmas\u0131n\u0131, yap\u0131lacak planlamay\u0131, d\u00f6n\u00fc\u015ft\u00fcrmeye tabi tutulacak ta\u015f\u0131nmazlar\u0131n de\u011ferinin tespitini, hak sahibi olacaklarla yap\u0131lacak anla\u015fmay\u0131 ve yap\u0131lacak yard\u0131mlar\u0131, yeniden yap\u0131lacak yap\u0131lara dair uygulama kurallar\u0131n\u0131 2012 y\u0131l\u0131nda \u00e7\u0131kar\u0131lan 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun belirliyor.<\/p>\n<h5 id=\"\"><img decoding=\"async\" class=\"alignnone wp-image-38963\" src=\"https:\/\/politeknik.org.tr\/wp-content\/uploads\/2023\/03\/202206020951452-img-1024x682.jpeg\" alt=\"\" width=\"650\" height=\"433\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/202206020951452-img-1024x682.jpeg 1024w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/202206020951452-img-450x300.jpeg 450w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/202206020951452-img-768x512.jpeg 768w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/202206020951452-img-1536x1023.jpeg 1536w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/202206020951452-img.jpeg 1600w\" sizes=\"(max-width: 650px) 100vw, 650px\" \/><\/h5>\n<h5 id=\"1-yapinin-risk-tespiti\">1. Yap\u0131n\u0131n risk tespiti<\/h5>\n<p>Deprem durumunda yap\u0131n\u0131n g\u00fcvenli kal\u0131p kalamayaca\u011f\u0131n\u0131 belirlemek ilk a\u015famad\u0131r.<br \/>\nBir yap\u0131da ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme sahip bir ki\u015fi (konut sahibi-malik) yap\u0131s\u0131n\u0131n deprem g\u00fcvenli\u011fi ile ilgili kendi ba\u015f\u0131na ba\u015fvuru yapabilmektedir. \u0130lk ad\u0131m yap\u0131n\u0131n risk tespitidir.<\/p>\n<p>Mevcut yap\u0131n\u0131z\u0131n risk tespitini yapt\u0131rman\u0131n yollar\u0131 \u015funlard\u0131r:<\/p>\n<p>Yap\u0131n\u0131z\u0131n risk tespiti i\u00e7in bir y\u00f6ntem yasa kapsam\u0131nda \u00c7evre \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n yetkilendirdi\u011fi kurulu\u015flara ba\u015fvurmak. Yap\u0131da oturan herhangi bir malik \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n belgelendirdi\u011fi risk tespit kurulu\u015flar\u0131ndan birine tapusu ve kimli\u011fiyle birlikte ba\u015fvurur.<\/p>\n<p>Arsa payl\u0131 tapu var ise 23\/6\/1965 tarihli ve 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu uyar\u0131nca arsa \u00fczerinde fiilen bulunan yap\u0131n\u0131n riskli yap\u0131 tespiti, yaln\u0131zca yap\u0131n\u0131n sahibi olan arsa pay\u0131 sahibince yapt\u0131r\u0131l\u0131r.<\/p>\n<p>Risk tespiti yapacak kurulu\u015f yap\u0131n\u0131n ta\u015f\u0131y\u0131c\u0131 sisteminde bulunan elemanlar\u0131, beton numunesini (karot), zemin ko\u015fullar\u0131n\u0131 inceleyerek risk tespit raporu haz\u0131rlar. Bu risk tespit raporu, 10 g\u00fcn i\u00e7inde yetki verilmi\u015f ilgili belediyeye g\u00f6nderilir. Yap\u0131n\u0131n deprem a\u00e7\u0131s\u0131ndan riskli \u00e7\u0131kmas\u0131 durumunda tapuya \u201cRiskli Yap\u0131 \u015eerhi\u201d d\u00fc\u015f\u00fcl\u00fcr.<\/p>\n<p>Riskli yap\u0131 tespitine kar\u015f\u0131 yap\u0131 malikleri veya kanun\u00ee temsilcilerince on be\u015f g\u00fcn i\u00e7inde itiraz edebilir. \u0130tirazlar dilek\u00e7e ile \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n il m\u00fcd\u00fcrl\u00fc\u011f\u00fcne veya Bakanl\u0131k\u00e7a yetki devri yap\u0131lm\u0131\u015f belediyeye yap\u0131l\u0131r. \u0130tiraz \u00fczerine teknik heyet itirazlar\u0131 inceleyerek karara ba\u011flar. \u0130tiraz\u0131n reddedilmesi veya riskli yap\u0131 tespitine itiraz edilmemesi durumunda riskli yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131n\u0131 s\u00fcreci ba\u015flar.<\/p>\n<p>\u0130lgili tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce tapu k\u00fct\u00fc\u011f\u00fcne i\u015flenen riskli yap\u0131 \u015ferhinin bildirimi maliklere ve ilgili belediyeye yap\u0131l\u0131r, riskli yap\u0131n\u0131n verilecek s\u00fcre i\u00e7inde y\u0131kt\u0131r\u0131lmas\u0131 i\u00e7in s\u00fcre\u00e7 b\u00f6ylelikle ba\u015flar.<\/p>\n<p>Yap\u0131n\u0131n tahliyesi ve riskli yap\u0131n\u0131n y\u0131k\u0131lmas\u0131 i\u00e7in maliklere 60 g\u00fcn s\u00fcre verilir. Yap\u0131n\u0131n bu s\u00fcre i\u00e7inde maliklerce y\u0131kt\u0131r\u0131lmamas\u0131 durumunda ilgili belediye elektrik, su ve do\u011falgaz hizmetlerini sonland\u0131r\u0131r. Maliklere verilen ek 30 g\u00fcnl\u00fck s\u00fcre i\u00e7inde de yap\u0131 y\u0131k\u0131lmaz ise yetkili idare (belediye) taraf\u0131ndan y\u0131k\u0131l\u0131r.<\/p>\n<p>Afet Yasas\u0131 kapsam\u0131nda yap\u0131lan yap\u0131 risk tespiti s\u00fcreci, yap\u0131 sahiplerini h\u0131zl\u0131 davranmaya zorlar ve kamusal g\u00fcvence vermeksizin m\u00fcteahhitlerle yap\u0131 sahiplerini ba\u015f ba\u015fa b\u0131rak\u0131r. Son 10 y\u0131lda yap\u0131 sahipleri ve m\u00fcteahhitler aras\u0131nda s\u0131k\u00e7a anla\u015fmazl\u0131klar meydana gelirken \u00c7evre \u015eehircilik Bakanl\u0131\u011f\u0131 yap\u0131lar\u0131n g\u00fcvenli d\u00f6n\u00fc\u015f\u00fcm\u00fcyle ilgili inisiyatif almad\u0131 ve vatanda\u015flar\u0131 yaln\u0131z b\u0131rakt\u0131. Bu nedenle 6306 say\u0131l\u0131 yasa kapsam\u0131nda yap\u0131lan yap\u0131 risk tespiti s\u00fcreci; yap\u0131n\u0131n riskli \u00e7\u0131kmas\u0131 durumunda yap\u0131n\u0131n y\u0131k\u0131lmas\u0131yla sonu\u00e7lan\u0131r.<\/p>\n<p><strong>Riskli yap\u0131 tespitinin di\u011fer y\u00f6ntemi yerel y\u00f6netimlere ba\u015fvurmak<\/strong><\/p>\n<p>Yap\u0131s\u0131n\u0131n deprem dayan\u0131m\u0131n\u0131 test ettirmek isteyen ancak 6306 say\u0131l\u0131 yasan\u0131n h\u0131zl\u0131 y\u0131k\u0131m s\u00fcrecinden ve haz\u0131rl\u0131ks\u0131z bir bi\u00e7imde evsiz kalmaktan \u00e7ekinenler riskli yap\u0131 tespiti i\u00e7in yerel y\u00f6netimlere ba\u015fvurabiliyor.<\/p>\n<p>\u0130stanbullular i\u00e7in de en iyi se\u00e7enek yap\u0131 risk tespitini yasan\u0131n d\u0131\u015f\u0131nda bir kapsamla yapan \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi\u2019ne ba\u015fvurmakt\u0131r.<\/p>\n<p>\u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi\u2019ne ba\u015fvuru yaparak yap\u0131n\u0131z\u0131n deprem g\u00fcvenli\u011fini test ettirebilirsiniz. Ba\u015fvuruyu herhangi bir karar ve uzla\u015f\u0131 gerekmeksizin ba\u011f\u0131ms\u0131z olarak <a href=\"https:\/\/binatespiti.ibb.istanbul\" target=\"_blank\" rel=\"noopener\">internet sitesi \u00fczerinden yapabilirsiniz<\/a>.<\/p>\n<p>\u0130BB yap\u0131n\u0131z\u0131, h\u0131zl\u0131 tarama teknikleri ile beton, donat\u0131, ta\u015f\u0131y\u0131c\u0131 sistem ve mevcut zemin verileri \u00fczerinden de\u011ferlendirir. Maliki oldu\u011funuz yap\u0131, depreme dayan\u0131ks\u0131z raporu al\u0131rsa yani \u2018\u2019Y\u00fcksek ve \u00c7ok Y\u00fcksek Riskli\u2019\u2019 grubunda yer al\u0131rsa \u0130BB durumu il\u00e7e belediyesiyle payla\u015f\u0131r. \u0130BB, yap\u0131n\u0131n gerekli deprem g\u00fcvenlik seviyesini kar\u015f\u0131layacak \u015fekilde g\u00fc\u00e7lendirilmesini veya yenilenmesini \u00f6nerir.<\/p>\n<p>\u0130l\u00e7e belediyeleri riskli yap\u0131lara tahliye i\u00e7in ihbar \u00e7eker. Ancak \u0130BB ya da il\u00e7e belediyesinin yap\u0131ya sadece bu rapora istinaden y\u0131k\u0131m karar\u0131 \u00e7\u0131karma yetkisi olmay\u0131p m\u00fch\u00fcrleme ve tahliye yetkisi bulunmaktad\u0131r. Bug\u00fcne kadar il\u00e7e belediyeler taraf\u0131ndan, yaln\u0131zca hi\u00e7bir deprem olmaks\u0131z\u0131n kendili\u011finden y\u0131k\u0131laca\u011f\u0131 s\u00f6ylenen 318 bina i\u00e7in tahliye karar\u0131 uyguland\u0131.<\/p>\n<h5 id=\"-2\"><img decoding=\"async\" class=\"alignnone wp-image-38961\" src=\"https:\/\/politeknik.org.tr\/wp-content\/uploads\/2023\/03\/donusm-2-1024x804.jpeg\" alt=\"\" width=\"667\" height=\"524\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/donusm-2-1024x804.jpeg 1024w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/donusm-2-382x300.jpeg 382w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/donusm-2-768x603.jpeg 768w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/03\/donusm-2.jpeg 1200w\" sizes=\"(max-width: 667px) 100vw, 667px\" \/><\/h5>\n<h5 id=\"2-yapinin-yenilenmesi-sureci\">2. Yap\u0131n\u0131n yenilenmesi s\u00fcreci<\/h5>\n<p>Riskli yap\u0131n\u0131n nas\u0131l, kim taraf\u0131ndan, hangi ko\u015fullarda, hangi planla, ne kadarl\u0131k s\u00fcre\u00e7te d\u00f6n\u00fc\u015fece\u011fi konusu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliklerinin tamam\u0131n\u0131 ilgilendiren ba\u015fl\u0131klard\u0131r ve anla\u015fmas\u0131 esast\u0131r. Yap\u0131n\u0131n d\u00f6n\u00fc\u015f\u00fcm\u00fcn\u00fcn nas\u0131l ger\u00e7ekle\u015fece\u011fi konusunda maliklerde 2\/3 \u00e7o\u011funluk gerekir.\u00a0Yap\u0131 riskli \u00e7\u0131kmas\u0131na ra\u011fmen d\u00f6n\u00fc\u015f\u00fcm karar\u0131na imza atmayan maliklere noterden ihtarname \u00e7ekilerek 15 g\u00fcn s\u00fcre tan\u0131n\u0131r.<\/p>\n<p>Yap\u0131n\u0131n nas\u0131l d\u00f6n\u00fc\u015ft\u00fcr\u00fclece\u011fine dair se\u00e7enekler \u015funlard\u0131r.<\/p>\n<p>a. \u0130stanbul\u2019da \u0130BB\u2019ye ba\u011fl\u0131 K\u0130PTA\u015e yap\u0131lar\u0131n d\u00f6n\u00fc\u015f\u00fcm\u00fc i\u00e7in in\u015faat maliyeti kar\u015f\u0131l\u0131\u011f\u0131nda ya da imar planlar\u0131nda yer alan kat say\u0131s\u0131 vb. k\u0131s\u0131tlar izin verirse yeni \u00fcretilecek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm kar\u015f\u0131l\u0131\u011f\u0131nda (kat kar\u015f\u0131l\u0131\u011f\u0131nda) d\u00f6n\u00fc\u015f\u00fcm yapt\u0131\u011f\u0131 i\u00e7in K\u0130PTA\u015e\u2019a ba\u015fvuru yap\u0131labilir. \u0130BB de yenilenme s\u00fcrecini 6306 say\u0131l\u0131 yasa kapsam\u0131nda yap\u0131yor.<\/p>\n<p>b. M\u00fcteahhit ya da in\u015faat \u015firketi olarak adland\u0131r\u0131lan \u00f6zel \u015firketlere in\u015faat bedeli ya da imar planlar\u0131nda yer alan kat say\u0131s\u0131 vb. k\u0131s\u0131tlar izin verirse yeni \u00fcretilecek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm kar\u015f\u0131l\u0131\u011f\u0131nda (kat kar\u015f\u0131l\u0131\u011f\u0131nda) anla\u015fma yap\u0131l\u0131r. Bu s\u00fcre\u00e7 6306 say\u0131l\u0131 yasa kapsam\u0131nda ilerletilir. \u0130n\u015faat \u015firketleri karl\u0131l\u0131\u011f\u0131 esas ald\u0131\u011f\u0131 i\u00e7in K\u0130PTA\u015e\u2019takine benzer nitelik elde etmek pek m\u00fcmk\u00fcn g\u00f6r\u00fcnm\u00fcyor.<\/p>\n<h5 id=\"3-yapinin-donusumu-icin-kurum-veya-muteahhit-ile-sozlesme\">3. Yap\u0131n\u0131n d\u00f6n\u00fc\u015f\u00fcm\u00fc i\u00e7in kurum veya m\u00fcteahhit ile s\u00f6zle\u015fme<\/h5>\n<p>D\u00f6n\u00fc\u015f\u00fcm\u00fc yapacak kurum\/\u015firket belirlenirken malikler; m2 b\u00fcy\u00fckl\u00fckleri, teminat, in\u015faat gecikirse rayi\u00e7 kiran\u0131n \u00f6denmesi, teslim ve iskan ko\u015fullar\u0131, fesih hallerinde i\u015fin ak\u0131beti vb. imalat s\u00fcreciyle ilgili ayr\u0131nt\u0131lar\u0131 2\/3 \u00e7o\u011funlu\u011funun uzla\u015fmas\u0131yla belirleyebilir.<\/p>\n<p>S\u00f6zle\u015fme m\u00fczakerelerinin sonucunda \u00e7o\u011funlu\u011fu sa\u011flayarak anla\u015fan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm malikleri in\u015faat\u0131n\u0131 yapacak kurum ya da m\u00fcteahhit ile noterde veya tapuda s\u00f6zle\u015fme imzalar.<br \/>\nOrtak karara kat\u0131lmayan maliklerin in\u015faat s\u00f6zle\u015fmesini imzalamas\u0131 i\u00e7in noterden ihtarname \u00e7ekilir. Bu ihtarda imzalamayan malike 15 g\u00fcn s\u00fcre tan\u0131n\u0131r. \u0130mzalamamas\u0131 durumunda \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc veya yetki verilmi\u015f ilgili belediye taraf\u0131ndan a\u00e7\u0131k artt\u0131rma d\u00fczenlenir. Karara kat\u0131lmayan maliklerin hisseleri, sadece yap\u0131daki di\u011fer maliklerin ve hazinenin kat\u0131labilece\u011fi a\u00e7\u0131k artt\u0131rmada sat\u0131l\u0131r.<\/p>\n<h5 id=\"4-yeni-yapim-nasil-olacak\">4. Yeni yap\u0131m nas\u0131l olacak?<\/h5>\n<p>Y\u0131k\u0131lacak yap\u0131n\u0131n yerine yeni yap\u0131lacak yap\u0131n\u0131n mimari projesinin nas\u0131l olaca\u011f\u0131n\u0131 maliklerin talepleri do\u011frultusunda in\u015faat projesini \u00fcstlenecek kurum\/ki\u015fi\/\u015firket belirler.<br \/>\nYeni yap\u0131n\u0131n m2\u2019si, bulundu\u011fu arsaya oturma alan\u0131, konumlan\u0131\u015f\u0131, kat say\u0131s\u0131, y\u00fckseklik s\u0131n\u0131r\u0131 gibi de\u011fi\u015fkenleri ilgili belediyenin imar planlar\u0131 belirler. G\u00fcncel imar planlar\u0131ndaki kat\/y\u00fckseklik s\u0131n\u0131r\u0131 ne ise d\u00f6n\u00fc\u015f\u00fcm de o eksende yap\u0131l\u0131r.<\/p>\n<h5 id=\"5-insaat-sureci\">5. \u0130n\u015faat s\u00fcreci<\/h5>\n<p>Anla\u015fma ile tahliye edilen uygulama alan\u0131ndaki yap\u0131lar\u0131n maliklerine tahliye veya y\u0131k\u0131m tarihinden itibaren bakanl\u0131k\u00e7a kararla\u015ft\u0131r\u0131lacak ayl\u0131k kira yard\u0131m\u0131 yap\u0131labilir. Yard\u0131m s\u00fcresi 18 ayd\u0131r. Ayl\u0131k kira bedeli bakanl\u0131k\u00e7a belirlenir. \u0130n\u015faat halinde olup i\u00e7inde ikamet edilen yap\u0131larda kira yard\u0131m\u0131 veya faiz deste\u011finden, sadece in\u015faat halindeki yap\u0131da ikamet edilen ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin malik, kirac\u0131 ve s\u0131n\u0131rl\u0131 ayni sahipleri faydalan\u0131r. Anla\u015fma ile tahliye edilen yap\u0131lar\u0131n maliklerine m\u00fcmk\u00fcn olmas\u0131 h\u00e2linde, kira yard\u0131m\u0131 yerine tahliye tarihinden itibaren konut ve i\u015fyerlerinin teslim tarihine kadar ge\u00e7ici konut veya i\u015fyeri tahsisi yap\u0131labilir.<\/p>\n<p>Maliklerin anla\u015ft\u0131\u011f\u0131 kurum ya da m\u00fcteahhit in\u015faat ruhsat\u0131 al\u0131r ve in\u015faat\u0131 tamamlar. Tamamlan\u0131nca teslimler anla\u015fma gere\u011fi yap\u0131l\u0131r ve iskan al\u0131n\u0131r.
