{"id":3944,"date":"2012-11-12T13:13:11","date_gmt":"2012-11-12T10:13:11","guid":{"rendered":"http:\/\/politeknik.org.tr\/\/?p=3944"},"modified":"2019-01-28T18:34:46","modified_gmt":"2019-01-28T15:34:46","slug":"spo-dunya-sehircilik-gunu-bildirgesi","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/spo-dunya-sehircilik-gunu-bildirgesi\/","title":{"rendered":"\u015ePO D\u00fcnya \u015eehircilik G\u00fcn\u00fc Bildirgesi"},"content":{"rendered":"<p>Bu y\u0131l 8 Kas\u0131m D\u00fcnya \u015eehircilik G\u00fcn\u00fc`n\u00fc, t\u0131pk\u0131 yak\u0131n ge\u00e7mi\u015fte oldu\u011fu gibi, kentle\u015fmeye ve planlama ili\u015fkin politikalar\u0131n, kurallar\u0131n ve yasal d\u00fczenlemelerin de\u011fi\u015fime u\u011frat\u0131ld\u0131\u011f\u0131, tart\u0131\u015fmalar\u0131n yo\u011funla\u015ft\u0131\u011f\u0131 bir g\u00fcndem i\u00e7inde kutluyoruz. <\/p>\n<p>Bug\u00fcn geldi\u011fimiz noktada, yerel y\u00f6netimlerin yap\u0131s\u0131na ili\u015fkin yasal d\u00fczenlemelerden, imar yasas\u0131na, k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131na ili\u015fkin d\u00fczenlemelerden k\u0131y\u0131 yasas\u0131na ili\u015fkin d\u00fczenlemelere, yap\u0131 denetimine ili\u015fkin d\u00fczenlemelerden, afet riskine ili\u015fkin d\u00fczenlemelere ve d\u00f6n\u00fc\u015f\u00fcme kadar geni\u015f bir yelpaze i\u00e7inde planlamaya ili\u015fkin tart\u0131\u015fmalar t\u00fcm yo\u011funlu\u011fuyla s\u00fcrmektedir. <\/p>\n<p>Yap\u0131lmakta olan yasal d\u00fczenlemeler ve bu d\u00fczenlemelere ko\u015fut s\u00fcrd\u00fcr\u00fclen uygulamalar, yaln\u0131zca kentsel mek\u00e2n\u0131 de\u011fil, tar\u0131m alanlar\u0131n\u0131, orman alanlar\u0131n\u0131, meralar\u0131, yaylalar\u0131, say\u0131s\u0131z HES projeleri ile akarsular\u0131 etkilemekte, do\u011fal varl\u0131klar\u0131m\u0131z\u0131 geri d\u00f6n\u00fclmez bi\u00e7imde tahrip etmektedir.\u00a0\u00a0 <\/p>\n<p>Kentle\u015fme \u015euras\u0131 gibi ortak ak\u0131l aray\u0131\u015flar\u0131na, KENTGES belgesi gibi kamusal taahh\u00fctlere ra\u011fmen, ortak akl\u0131n \u00fcr\u00fcn\u00fc olan do\u011frularla \u00e7eli\u015fen d\u00fczenlemelerin yasala\u015ft\u0131r\u0131lmas\u0131na devam edilmektedir. Kentle\u015fmeye ili\u015fkin s\u00fcreklilik g\u00f6steren ve \u00e7o\u011fu zaman birbiriyle \u00e7eli\u015fen yasal d\u00fczenleme \u00e7al\u0131\u015fmalar\u0131, planlama alan\u0131nda kurals\u0131zl\u0131\u011f\u0131n egemenli\u011fini b\u00fcy\u00fctmektedir.\u00a0\u00a0\u00a0\u00a0 <\/p>\n<p>Kentlerimizin bilimin ve tekni\u011fin gerektirdi\u011fi nitelikte planlanabilmesini, afetler a\u00e7\u0131s\u0131ndan sak\u0131n\u0131m\u0131 \u00f6nceleyen planlama kararlar\u0131n geli\u015ftirilmesini sa\u011flayacak, \u00fclkemizin ger\u00e7ek anlamda ihtiyac\u0131n\u0131 kar\u015f\u0131layacak yasal d\u00fczenlemeler yap\u0131lamazken, 2004 y\u0131l\u0131ndan g\u00fcn\u00fcm\u00fcze uzanan s\u00fcre\u00e7te &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; kavram\u0131 \u00e7evresinde yo\u011funla\u015fan d\u00fczenlemeler birbiri ard\u0131na g\u00fcndeme ta\u015f\u0131nmaktad\u0131r. <\/p>\n<p>Ancak ya\u015fanan geli\u015fmelere bak\u0131ld\u0131\u011f\u0131nda, kentsel d\u00f6n\u00fc\u015f\u00fcm kavram\u0131n\u0131n tart\u0131\u015f\u0131lmaya ba\u015fland\u0131\u011f\u0131 ilk g\u00fcnden bu yana, yasada tan\u0131mlanan ve kamuoyu a\u00e7\u0131s\u0131ndan genel do\u011frulara kar\u015f\u0131l\u0131k gelen ama\u00e7 tan\u0131m\u0131yla da uyumlu olmayan uygulamalar\u0131n &#8220;deprem korkusu&#8221; da kullan\u0131larak dayat\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.\u00a0 <\/p>\n<p>\u00d6zellikle baz\u0131 belediyeler taraf\u0131ndan &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; ad\u0131yla s\u00fcrd\u00fcr\u00fclen proje \u00e7al\u0131\u015fmalar\u0131, yasada tan\u0131mlanan ama\u00e7la hi\u00e7 ba\u011fda\u015fmayan, de\u011ferli kent arazilerine ve burada olu\u015facak rantlara el koymaktan \u00f6te ba\u015fka bir amac\u0131 bulunmayan uygulamalar olarak dikkat \u00e7ekmektedir. \u00dclkemizde ger\u00e7ek anlamda afetlerden sak\u0131nan bir kentle\u015fme s\u00fcrecinin ya\u015fanabilmesi i\u00e7in, kentsel d\u00f6n\u00fc\u015f\u00fcm ad\u0131 alt\u0131nda ba\u015flat\u0131lm\u0131\u015f olan ve yasada tan\u0131mlanan ama\u00e7la ilgisi olmayan, yasal d\u00fczenlemelere kar\u015f\u0131 toplumun inanc\u0131n\u0131 t\u00fcketen projelerin uygulanmas\u0131 durdurulmal\u0131d\u0131r. <\/p>\n<p>T\u00fcm kentlerde d\u00f6n\u00fc\u015f\u00fcm a\u00e7\u0131s\u0131ndan \u00f6ncelikli, y\u00fcksek riskli alanlar ve yap\u0131lar toplumsal uzla\u015fma ile belirlenmeli, ger\u00e7ek anlamda risk ta\u015f\u0131yan alanlar ile riskli yap\u0131lar\u0131n yo\u011funla\u015ft\u0131\u011f\u0131 alanlar d\u0131\u015f\u0131nda, rant\u0131 \u00f6nceleyen projelerin geli\u015ftirilmesi engellenmelidir.\u00a0\u00a0 <\/p>\n<p>Ya\u015fam\u0131n ve bar\u0131nman\u0131n g\u00fcvence alt\u0131na al\u0131nmas\u0131, insan onuruna yara\u015f\u0131r,\u00a0 kentsel standartlar\u0131 y\u00fcksek ya\u015fam alanlar\u0131n\u0131n olu\u015fturulmas\u0131, kentsel hizmetlerden herkesin e\u015fit bir bi\u00e7imde yararlanmas\u0131 devletin \u00f6ncelikli g\u00f6revleri aras\u0131ndad\u0131r. Bu ama\u00e7la kentsel mek\u00e2n\u0131n sa\u011fl\u0131kl\u0131la\u015ft\u0131r\u0131lmas\u0131, standartlar\u0131n y\u00fckseltilmesi, jeolojik a\u00e7\u0131dan riskli alanlar\u0131n bo\u015falt\u0131larak buradaki halk\u0131n ya\u015fama elveri\u015fli alanlara ta\u015f\u0131nmas\u0131 amac\u0131yla projelerin geli\u015ftirilmesinin gereklili\u011fi tart\u0131\u015f\u0131lmazd\u0131r. <\/p>\n<p>Ancak bu ama\u00e7 arkas\u0131na gizlenen,\u00a0 hedefi ve vizyonu rant ile s\u0131n\u0131rl\u0131 d\u00f6n\u00fc\u015f\u00fcm projelerinin toplumsal a\u00e7\u0131dan me\u015fruiyeti tart\u0131\u015fmal\u0131d\u0131r. Bu y\u00f6n\u00fcyle kabul edilebilir olmayan d\u00f6n\u00fc\u015f\u00fcm projeleri, bilimsel ara\u015ft\u0131rmalara dayanmayan, plan b\u00fct\u00fcnl\u00fc\u011f\u00fcnden kopuk, in\u015faat \u015firketleri taraf\u0131ndan kazanc\u0131 y\u00fcksek yat\u0131r\u0131m alan\u0131 olarak g\u00f6r\u00fclen b\u00f6lgelerde y\u00fcr\u00fct\u00fclmekte, burada ya\u015fayan halk\u0131n bar\u0131nma hakk\u0131 hi\u00e7e say\u0131lmaktad\u0131r. Toplumsal kat\u0131l\u0131m ve sosyal adaletten yoksun bu projelere konu olan alanlarda g\u00fcn\u00fcm\u00fczde ya\u015fayanlar karar s\u00fcre\u00e7lerinin d\u0131\u015f\u0131nda tutulmakta, hak aray\u0131\u015flar\u0131 engellenmektedir.<\/p>\n<p>16 May\u0131s 2012 tarihinde yasala\u015fan Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Yasa, 2005 y\u0131l\u0131ndan bu yana s\u00fcrd\u00fcr\u00fclmekte olan Hukuk Devleti ve Sosyal Devlet ilkelerine ayk\u0131r\u0131 uygulamalar\u0131n ger\u00e7ekle\u015ftirilmesinde kolayla\u015ft\u0131r\u0131c\u0131 d\u00fczenlemelerin vard\u0131\u011f\u0131 son noktad\u0131r. <\/p>\n<p>Bug\u00fcne kadar ger\u00e7ekle\u015ftirilen ve aslen en temel insan haklar\u0131ndan olan bar\u0131nma hakk\u0131na ayk\u0131r\u0131 dayatmalar\u0131n ya\u015fand\u0131\u011f\u0131 pek \u00e7ok kentsel d\u00f6n\u00fc\u015f\u00fcm projesinin uygulanmas\u0131nda, yaln\u0131zca planlama ilkeleri de\u011fil, hukuk devleti ve sosyal devlet ilkeleri de ayaklar alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Ba\u015flam\u0131\u015f olan ve Hukuk Devleti ilkesi ile Sosyal Devlet ilkesine ayk\u0131r\u0131 oldu\u011fu belirlenen uygulamalar da derhal durdurulmal\u0131d\u0131r.\u00a0 <\/p>\n<p>Afet riski ta\u015f\u0131yan yap\u0131lar\u0131n zor kullan\u0131larak y\u0131k\u0131lmas\u0131, bu yap\u0131larda ya\u015fayan yurtta\u015flar\u0131m\u0131z\u0131n yeni ve g\u00fcvenli yap\u0131 yapt\u0131rmaya ya da sat\u0131n almaya zorlanmas\u0131na y\u00f6nelik uygulamalarda ekonomik a\u00e7\u0131dan g\u00fcvenceye sahip olan taraflar yaln\u0131zca yap\u0131mc\u0131 in\u015faat \u015firketleri ve kredi verecek bankalard\u0131r. <\/p>\n<p>Uzun y\u0131llar\u0131n birikimini aktararak ve a\u011f\u0131r bor\u00e7 y\u00fck\u00fc alt\u0131na girerek konut sahibi olabilmi\u015f yurtta\u015flar\u0131m\u0131z, yeniden benzer bir bor\u00e7 y\u00fck\u00fc alt\u0131na giremeyece\u011fi i\u00e7in kentlerimizde evsizlerin say\u0131s\u0131 artacak, yoksulla\u015fma daha da b\u00fcy\u00fcyecektir. B\u00f6ylesi bir sistemde kazanan in\u015faat sekt\u00f6r\u00fc ve bankalar, kaybeden toplumsal bar\u0131\u015f olacakt\u0131r. <\/p>\n<p>Bug\u00fcne kadar ba\u015flat\u0131lm\u0131\u015f olan uygulamalarda ya\u015fanan sorunlar ile benzer uygulamalar nedeniyle gelecekte ortaya \u00e7\u0131kmas\u0131 olas\u0131 sorun tespitlerinden yola \u00e7\u0131karak, kentsel d\u00f6n\u00fc\u015f\u00fcm projelerinin toplum yarar\u0131na ya\u015fama ge\u00e7mesini sa\u011flamak amac\u0131yla, TMMOB \u015eehir Planc\u0131lar\u0131 Odas\u0131 taraf\u0131ndan kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131na y\u00f6nelik temel ilkeler belirlenmi\u015ftir. <\/p>\n<p>\u0130lgili kurumlar taraf\u0131ndan ger\u00e7ekle\u015ftirilecek uygulamalarda belirlenen ilkelere uygun davran\u0131lmas\u0131, ge\u00e7mi\u015fte \u00f6rneklerini g\u00f6rd\u00fc\u011f\u00fcm\u00fcz anayasal hak ihlallerinin ve insan haklar\u0131na ayk\u0131r\u0131 uygulamalar\u0131n ortadan kald\u0131r\u0131lmas\u0131na \u00f6nemli katk\u0131 sa\u011flayacakt\u0131r.<\/p>\n<p><strong>KENTSEL<\/strong> <strong>D\u00d6N\u00dc\u015e\u00dcM\u00dcN<\/strong> <strong>TEMEL<\/strong> <strong>\u0130LKELER\u0130<\/strong><\/p>\n<p>Sa\u011fl\u0131kl\u0131 ve ya\u015fanabilir bir kentsel \u00e7evre olu\u015fturulabilmesi i\u00e7in, kent planlama disiplini i\u00e7inde geli\u015ftirilmi\u015f olan t\u00fcm planlama ilkeleri ve kurallar\u0131, planlama disiplininin bir par\u00e7as\u0131 olan kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 a\u00e7\u0131s\u0131ndan da vazge\u00e7ilmezdir. Bu nedenle, geli\u015ftirilen t\u00fcm projelerde, kamu yarar\u0131 ilkesine ve planlama ilkelerine ayr\u0131ms\u0131z bi\u00e7imde uyulmal\u0131d\u0131r.<\/p>\n<p>Geli\u015ftirilen projelerde ekonomik, toplumsal, fiziksel, do\u011fal ve \u00e7evresel ko\u015fullar birlikte ele al\u0131nmal\u0131, proje alanlar\u0131na y\u00f6nelik planlama kararlar\u0131 kent b\u00fct\u00fcn\u00fcne y\u00f6nelik kararlardan kopar\u0131lmamal\u0131, ayr\u0131\u015ft\u0131r\u0131lmamal\u0131, \u00fcst \u00f6l\u00e7ekli plan kararlar\u0131na ayk\u0131r\u0131 uygulamalardan ka\u00e7\u0131n\u0131lmal\u0131, projeler ba\u015fta ula\u015f\u0131m kararlar\u0131 olmak \u00fczere, olas\u0131 \u00e7evresel etkileri analiz edilerek, kent plan\u0131 ile b\u00fct\u00fcnle\u015fik olarak ele al\u0131nmal\u0131d\u0131r.<\/p>\n<p>Kentsel d\u00f6n\u00fc\u015f\u00fcme konu edilen alanlar ve yap\u0131lar a\u00e7\u0131s\u0131ndan, t\u00fcm tarihsel birikimi ve k\u00fclt\u00fcrel zenginli\u011fi ortadan kald\u0131racak y\u0131k\u0131m ve yeniden yapma d\u0131\u015f\u0131ndaki se\u00e7eneklerin; koruma, yenileme, iyile\u015ftirme, g\u00fc\u00e7lendirme ve canland\u0131rma se\u00e7eneklerinin \u00f6ncelikle ara\u015ft\u0131r\u0131lmas\u0131 ve tart\u0131\u015f\u0131lmas\u0131 sa\u011flanmal\u0131d\u0131r.\u00a0 <\/p>\n<p>D\u00f6n\u00fc\u015f\u00fcm projesine konu olan alanlar\u0131n yeniden yap\u0131lanmas\u0131nda; konut alanlar\u0131n\u0131n sa\u011fl\u0131kl\u0131 bir ya\u015fam alan\u0131 niteli\u011fine kavu\u015fmas\u0131 i\u00e7in, sosyal ve teknik altyap\u0131 tesisleri ile \u00e7al\u0131\u015fma alanlar\u0131na y\u00f6nelik kararlar birlikte ele al\u0131nmal\u0131, kentsel sosyal donat\u0131lar standartlara uygun olarak geli\u015ftirilmeli, teknik altyap\u0131n\u0131n ve sosyal donat\u0131 tesislerinin konutlarla e\u015f zamanl\u0131 bi\u00e7imde kullan\u0131ma ge\u00e7mesi sa\u011flanmal\u0131d\u0131r. <\/p>\n<p>Projeler temelde rant art\u0131\u015f\u0131n\u0131 de\u011fil, can g\u00fcvenli\u011finin sa\u011flanmas\u0131n\u0131 ve ya\u015fam d\u00fczeyinin y\u00fckseltilmesini ama\u00e7lamal\u0131, kentsel d\u00f6n\u00fc\u015f\u00fcm projeleri ayr\u0131cal\u0131kl\u0131 imar hakk\u0131 sa\u011flama arac\u0131 olarak kullan\u0131lmamal\u0131d\u0131r. Bu kapsamda t\u00fcm yap\u0131la\u015fmalara y\u00f6nelik g\u00fc\u00e7l\u00fc, kamusal yap\u0131 denetim sistemi ya\u015fama ge\u00e7irilmeli, uygulama sonucu olu\u015fan rant art\u0131\u015flar\u0131 do\u011frudan kamuya kazand\u0131r\u0131lmal\u0131d\u0131r. <\/p>\n<p>Projelerin uygulanmas\u0131 hi\u00e7bir ko\u015fulda ya\u015fayanlar a\u00e7\u0131s\u0131ndan sosyal bir y\u0131k\u0131ma neden olmamal\u0131, konut dokunulmazl\u0131\u011f\u0131 ve bar\u0131nma hakk\u0131 ilkeleri, kirac\u0131lar\u0131 da kapsayacak bi\u00e7imde kamusal g\u00fcvence alt\u0131na al\u0131nmal\u0131d\u0131r. Bar\u0131nma hakk\u0131 sahipli\u011fi; m\u00fclkiyet belgesinden ba\u011f\u0131ms\u0131z, sa\u011fl\u0131kl\u0131 bir ya\u015fam \u00e7evresi i\u00e7inde, \u00e7a\u011fda\u015f, ya\u015fanabilir konut hakk\u0131 olarak kabul edilmelidir. <\/p>\n<p>Projelere do\u011frudan kamusal kaynak aktar\u0131m\u0131 da yap\u0131larak, konut edinme ko\u015fullar\u0131 proje alan\u0131nda ya\u015fayanlar\u0131n \u00f6deme g\u00fcc\u00fc oran\u0131nda d\u00fczenlenmeli, uygulamalar\u0131n t\u00fcm kesimler a\u00e7\u0131s\u0131ndan d\u0131\u015flama ve tasfiyeye neden olmas\u0131 \u00f6nlenmeli, olas\u0131 geri \u00f6demeler isk\u00e2n sonras\u0131 ba\u015flat\u0131lmal\u0131d\u0131r. <\/p>\n<p>Proje alan\u0131nda ya\u015fayan ve projeden etkilenenlere mevcut konutundan daha k\u00fc\u00e7\u00fck, daha niteliksiz, daha d\u00fc\u015f\u00fck s\u0131n\u0131fta konut verilmemeli, di\u011fer yandan bu ama\u00e7la yap\u0131lacak d\u00fczenlemeler haks\u0131z bor\u00e7land\u0131rma gerek\u00e7esi yap\u0131lmamal\u0131d\u0131r.\u00a0 <\/p>\n<p>D\u00f6n\u00fc\u015f\u00fcm projelerinden etkilenen t\u00fcm kesimlere ayr\u0131ms\u0131z bi\u00e7imde, projenin ba\u015flang\u0131c\u0131ndan sonu\u00e7lanmas\u0131na dek, g\u00fcvenli ve sa\u011fl\u0131kl\u0131 ya\u015fam olanaklar\u0131na sahip ge\u00e7ici isk\u00e2n olanaklar\u0131 yarat\u0131lmal\u0131 ya da g\u00fcn\u00fcn ko\u015fullar\u0131na uygun kira yard\u0131m\u0131 yap\u0131lmal\u0131d\u0131r. <\/p>\n<p>Mevcut kullan\u0131c\u0131lar\u0131n ger\u00e7ekle\u015fecek d\u00f6n\u00fc\u015f\u00fcm sonucunda ayn\u0131 alanda ya\u015famlar\u0131n\u0131 s\u00fcrd\u00fcrebilmesini olanakl\u0131 k\u0131lacak, ortak giderleri kar\u015f\u0131lamaya y\u00f6nelik, s\u00fcrd\u00fcr\u00fclebilir, gelir yarat\u0131c\u0131 olanaklar yarat\u0131lmal\u0131d\u0131r. <\/p>\n<p>D\u00f6n\u00fc\u015f\u00fcm projelerinde, yerel kimli\u011fi ortadan kald\u0131ran tek tip mek\u00e2n \u00fcretiminden ka\u00e7\u0131n\u0131lmal\u0131, kentsel mek\u00e2n\u0131 par\u00e7alayan ve ayr\u0131\u015ft\u0131ran uygulamalara son verilmeli, yerelin \u00f6zellikleri ve \u00f6zg\u00fcnl\u00fckleri mutlaka korunmal\u0131, toplumsal ya\u015fam ve k\u00fclt\u00fcrel de\u011ferler dikkate al\u0131nmal\u0131d\u0131r. <\/p>\n<p>D\u00f6n\u00fc\u015f\u00fcm projeleri hi\u00e7bir ko\u015fulda do\u011fal, tarihi ve k\u00fclt\u00fcrel de\u011ferlere zarar vermemeli, ya\u015fam\u0131n ger\u00e7ek sigortas\u0131 olan ormanlar, meralar, sulak alanlar, k\u0131y\u0131lar ve tar\u0131m alanlar\u0131 gibi do\u011fal varl\u0131klar yap\u0131la\u015fma d\u0131\u015f\u0131 tutulmal\u0131 ve mutlak bi\u00e7imde korunmal\u0131d\u0131r.
