{"id":39510,"date":"2023-11-18T17:29:02","date_gmt":"2023-11-18T14:29:02","guid":{"rendered":"https:\/\/politeknik.org.tr\/?p=39510"},"modified":"2023-11-18T18:44:25","modified_gmt":"2023-11-18T15:44:25","slug":"istanbul-planlama-ajansindan-kentsel-donusum-yasasi-raporu-donusum-kimin-icin","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/istanbul-planlama-ajansindan-kentsel-donusum-yasasi-raporu-donusum-kimin-icin\/","title":{"rendered":"\u0130stanbul Planlama Ajans\u0131&#8217;ndan kentsel d\u00f6n\u00fc\u015f\u00fcm yasas\u0131 raporu: D\u00f6n\u00fc\u015f\u00fcm kimin i\u00e7in?"},"content":{"rendered":"<p><strong>\u0130stanbul Planlama Ajans\u0131, kentsel d\u00f6n\u00fc\u015f\u00fcm yasas\u0131ndaki yeni de\u011fi\u015fikliklerle ilgili rapor haz\u0131rlad\u0131.<\/strong><\/p>\n<p>\u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi\u2019ne ba\u011fl\u0131 \u0130stanbul Planlama Ajans\u0131, 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun ile Baz\u0131 Kanunlarda ve 375 Say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamede De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun de\u011fi\u015fikli\u011fi ile ilgili rapor haz\u0131rlad\u0131.<\/p>\n<p>\u015eehir Planc\u0131lar\u0131ndan al\u0131nan g\u00f6r\u00fc\u015flerle birlikte haz\u0131rlanan raporda 2012 y\u0131l\u0131nda \u00e7\u0131kar\u0131lan 6306 say\u0131l\u0131 Afet kanunuyla ge\u00e7irilen 11 y\u0131lda kentsel d\u00f6n\u00fc\u015f\u00fcm ad\u0131yla yap\u0131lan kent talan\u0131 vurgu yap\u0131ld\u0131. \u0130PA de\u011fi\u015fikli\u011fin, deprem nedeniyle tehlike alt\u0131ndaki yap\u0131lar\u0131n d\u00f6n\u00fc\u015f\u00fcm\u00fc yerine yine kent rant\u0131n\u0131 y\u00f6netme amac\u0131 ta\u015f\u0131d\u0131\u011f\u0131n\u0131 belirtiyor.<\/p>\n<p>Raporda, kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn sadece imar odakl\u0131 olamayaca\u011f\u0131, ulusal \u00e7apta konut politikas\u0131n\u0131 y\u00f6nlendirecek \u015fekilde ele alan bir yasaya ihtiya\u00e7 oldu\u011fu, konutun yat\u0131r\u0131m arac\u0131 de\u011fil, bar\u0131nma hakk\u0131na dayal\u0131 bir ara\u00e7 oldu\u011fu vurgulan\u0131yor.<\/p>\n<p>\u201cKentsel D\u00f6n\u00fc\u015f\u00fcm Yasa De\u011fi\u015fikli\u011fi: D\u00f6n\u00fc\u015f\u00fcm Kimin \u0130\u00e7in?\u201d ba\u015fl\u0131\u011f\u0131yla yay\u0131mlanan raporda yasan\u0131n eksikleri, bar\u0131nd\u0131rd\u0131\u011f\u0131 riskler s\u0131raland\u0131.<\/p>\n<h5 id=\"riskli-alanlarin-sadece-binde-35i-oncelikli-mudahale-alaninda\"><strong>Riskli alanlar\u0131n sadece binde 3,5\u2019i \u00f6ncelikli m\u00fcdahale alan\u0131nda<\/strong><\/h5>\n<p>6306 say\u0131l\u0131 Afet Yasas\u0131 sonras\u0131 ge\u00e7en 11 y\u0131lda 20,8 milyon metrekare riskli alan, 418 milyon metrekare rezerv alan ilan edildi.<\/p>\n<p>\u0130BB yapt\u0131\u011f\u0131 deprem g\u00fcvenli\u011fi \u00e7al\u0131\u015fmas\u0131yla 18 il\u00e7ede yakla\u015f\u0131k 142 adet \u00f6ncelikli m\u00fcdahale alan\u0131 tespit etti.<br \/>\n<img decoding=\"async\" class=\"alignnone wp-image-39513\" src=\"https:\/\/politeknik.org.tr\/wp-content\/uploads\/2023\/11\/kentsel-donusum-1.png\" alt=\"\" width=\"649\" height=\"458\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/11\/kentsel-donusum-1.png 838w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/11\/kentsel-donusum-1-425x300.png 425w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2023\/11\/kentsel-donusum-1-768x543.png 768w\" sizes=\"(max-width: 649px) 100vw, 649px\" \/><\/p>\n<p>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n 11 y\u0131lda Afet Yasas\u0131 kapsam\u0131nda ilan etti\u011fi riskli alanlar\u0131n sadece binde 3,5\u2019i (%0,35) \u00f6ncelikli m\u00fcdahale alan\u0131nda yer al\u0131yor.<\/p>\n<p>\u0130lan ettikleri rezerv alanlar\u0131n sadece on binde 7\u2019si (%0,07) \u00f6ncelikli m\u00fcdahale alan\u0131nda yer al\u0131yor. Deprem gerek\u00e7e g\u00f6sterilerek \u00e7\u0131kart\u0131lan yasa depreme haz\u0131rl\u0131k i\u00e7in kullan\u0131lmad\u0131. Riskli yap\u0131lar\u0131 veya ger\u00e7ekten riskli alanlar\u0131 de\u011fil, emlak de\u011feri y\u00fcksek yerleri hedef ald\u0131.<\/p>\n<p>\u0130stanbul\u2019daki toplam 1,2 milyon bina bulunuyor ve bunlar\u0131n yakla\u015f\u0131k 800 bini 2000 y\u0131l\u0131 \u00f6ncesine ait. Dolay\u0131s\u0131yla keyfiyetle uygulanacak rezerv yap\u0131 ilan\u0131 ile emlak rant\u0131 y\u00fcksek yerle\u015fim alanlar\u0131nda ya\u015fayan kentlilerin bar\u0131nma hakk\u0131 yok edilebilecek.<\/p>\n<p>Yeni yasa d\u00fczenlemesinin getirece\u011fi olumsuzluklar \u015f\u00f6yle s\u0131ralan\u0131yor:<\/p>\n<ul>\n<li>Rezerv yap\u0131 alan\u0131 ilanlar\u0131n\u0131n Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131 ad\u0131na bir \u201cgelir kayna\u011f\u0131\u201d haline getirilmesiyle kurumun amac\u0131 d\u0131\u015f\u0131nda yap\u0131lmas\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131lacak.<\/li>\n<li>Tescil d\u0131\u015f\u0131 alanlar ile ilgili Ba\u015fkanl\u0131\u011fa \u00e7ok geni\u015f bir yetki verilmesi kentlerdeki sosyal ve teknik altyap\u0131 alanlar\u0131n\u0131n b\u00fcy\u00fckl\u00fc\u011f\u00fc, konumu ve s\u00fcreklili\u011fi bak\u0131m\u0131ndan olumsuz sonu\u00e7lar do\u011furabilir.<\/li>\n<li>\u201cRezerv yap\u0131 alan\u0131\u201d ad\u0131 ile yeni yerle\u015fim alanlar\u0131 olu\u015fturarak konut ve i\u015fyeri arz\u0131n\u0131 art\u0131rmak mevcut riskli yap\u0131 stokunun d\u00f6n\u00fc\u015fmesine hizmet etmiyor. Aksine, mevcut riskli yap\u0131lar\u0131n ve riskli alanlar\u0131n k\u00f6hnele\u015fmesine neden olmas\u0131 daha kuvvetli bir ihtimal.<\/li>\n<li>\u0130mar planlar\u0131nda yol, ye\u015fil alan gibi kamunun (devletin) de\u011fil, herkesin m\u00fclk\u00fc olarak kabul edilen alanlar\u0131n kadastral parsele d\u00f6n\u00fc\u015ft\u00fcr\u00fclemez. Ancak kanuna eklenen madde ile tescil d\u0131\u015f\u0131 alanlar \u00f6nce hazine m\u00fclkiyetine ge\u00e7irilip sonra da s\u00fcre\u00e7 i\u00e7inde olu\u015facak imar haklar\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131na veriliyor. Bu alanlar genellikle imar uygulamas\u0131 sonucu vatanda\u015flardan bedelsiz olarak sa\u011flanm\u0131\u015f yerler. Dolay\u0131s\u0131yla bedelsiz olarak vatanda\u015flar\u0131n m\u00fclk\u00fcne kar\u015f\u0131l\u0131ks\u0131z el konulmas\u0131 yolu olu\u015fturuluyor.<\/li>\n<li>Planlar\u0131n ask\u0131ya \u00e7\u0131kar\u0131larak ilan edilmesi asl\u0131nda planlamaya kat\u0131l\u0131m\u0131n en \u00f6nemli arac\u0131d\u0131r. Dolay\u0131s\u0131yla bunu itiraz de\u011fil, kat\u0131l\u0131m s\u00fcreci olarak de\u011ferlendirmek daha do\u011fru olur. \u0130mar planlar\u0131n\u0131n ilan edilme s\u00fcresinin 1 aydan 15 g\u00fcne d\u00fc\u015f\u00fcr\u00fclmesi yani s\u00fcrenin yar\u0131 yar\u0131ya azalt\u0131larak kat\u0131l\u0131m s\u00fcrecinin k\u0131s\u0131tlanmas\u0131 ve bu d\u00fczenlemenin \u0130mar Kanununa ayk\u0131r\u0131 olmas\u0131 hukuksal bir de\u011ferlendirmeyi de gerektiriyor.<\/li>\n<li>Hak sahiplerinin s\u00fcrece kat\u0131lmas\u0131 ve bilgi edinmelerine y\u00f6nelik s\u00fcre\u00e7lerin 15 g\u00fcn ile s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ek olarak, kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131nda kirac\u0131lar\u0131n g\u00f6zetilmesi ve olas\u0131 hak kay\u0131plar\u0131na ili\u015fkin herhangi bir d\u00fczenleme yer almamaktad\u0131r.<\/li>\n<li>Yeni d\u00fczenleme \u0130BB taraf\u0131ndan payla\u015f\u0131lan t\u00fcm \u00f6neri ve sorunlara ra\u011fmen bar\u0131nma krizine \u00e7\u00f6z\u00fcm bulamayacak, hatta daha da b\u00fcy\u00fctecektir.
