Bu sa\u011fl\u0131ks\u0131z kentle\u015fmenin ac\u0131 sonu\u00e7lar\u0131, son olarak 1999 D\u00fczce ve G\u00f6lc\u00fck, 2012 Van depremlerinde en a\u011f\u0131r \u015fekilde ya\u015fanm\u0131\u015ft\u0131r.<\/strong><\/p>\n<p>Bir deprem \u00fclkesi olma ger\u00e7e\u011finden hareketle, Devletin anayasal g\u00f6revlerinden birisi olan sa\u011fl\u0131kl\u0131, g\u00fcvenli ve ya\u015fanabilir kentler kurabilmek ve ya\u015fanabilir \u00e7evre olu\u015fturabilmek i\u00e7in sa\u011fl\u0131kl\u0131 yap\u0131 \u00fcretiminin zorunlulu\u011fu herkesin \u00fczerinde ortakla\u015ft\u0131\u011f\u0131 bir konudur.<\/p>\n<p>\u0130ktidarda bulunduklar\u0131 onca y\u0131lda T\u00fcrkiye\u2018de \u00e7arp\u0131k yap\u0131la\u015fmaya, plans\u0131z kentle\u015fmeye kar\u015f\u0131 hi\u00e7bir somut ad\u0131m atmayan AKP H\u00fck\u00fcmeti, Van depremi sonras\u0131 h\u0131zla, afet ve risk maskesiyle t\u00fcm \u00fclke topraklar\u0131n\u0131 hi\u00e7bir kurala ve ko\u015fula ba\u011fl\u0131 olmaks\u0131z\u0131n ranta a\u00e7an &#8220;Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun&#8221;u \u00e7\u0131karm\u0131\u015f, kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131na, Kanunun gerek\u00e7esi olarak g\u00f6sterilen riskin b\u00fcy\u00fck oldu\u011fu bilinen k\u0131s\u0131mlarda de\u011fil, rant\u0131n y\u00fcksek oldu\u011fu yerlerde ya da kamuya ait lojman alanlar\u0131nda ba\u015flam\u0131\u015ft\u0131r.<\/p>\n<p>Bunun yan\u0131nda &#8220;B\u00fcy\u00fck\u015fehir Belediyesi Kanunu De\u011fi\u015fikli\u011fi\u00a0 Tasar\u0131s\u0131&#8221;nda oldu\u011fu gibi, her f\u0131rsatta,\u00a0 ka\u00e7ak yap\u0131lm\u0131\u015f ve salt bu nedenle dahi &#8220;riskli yap\u0131&#8221; niteli\u011fine sahip olan yap\u0131lara af getirilmek istenmesi ise, AKP H\u00fck\u00fcmeti\u2018nin samimiyetsizli\u011fini bir kez daha g\u00f6stermi\u015ftir.<\/p>\n<p>\u00dcretimden vazge\u00e7erek, ekonomi politikalar\u0131n\u0131 kentsel rantlar \u00fczerinde temellendiren AKP iktidar\u0131n\u0131n tamamen ranta odakl\u0131 &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; anlay\u0131\u015f\u0131n\u0131n, &#8220;sa\u011fl\u0131kl\u0131 ya\u015fanabilir bir kentsel \u00e7evre&#8221;yi olu\u015fturmay\u0131 ama\u00e7layan, planlama, imar, kentle\u015fme, yap\u0131 ve afet alanlar\u0131nda bilimsel, sosyal ve b\u00fct\u00fcnl\u00fck\u00e7\u00fc bir yakla\u015f\u0131m\u0131 gerektiren &#8220;kentsel yenileme&#8221; ve &#8220;kentsel sa\u011fl\u0131kla\u015ft\u0131rma&#8221; olmad\u0131\u011f\u0131 \u00e7ok a\u00e7\u0131kt\u0131r.<\/p>\n<p>M\u00fchendislik, mimarl\u0131k ve \u015fehir planlama disiplinlerinin teknik, bilimsel ve yasal gereklilikleri ile teknik ilkelerini g\u00f6rmezden gelerek; ormanlar\u0131, k\u0131y\u0131lar\u0131, do\u011fal kaynaklar\u0131 hi\u00e7e sayan; kent tarihini, k\u00fclt\u00fcr\u00fcn\u00fc yok eden; hak arama h\u00fcrriyetini gasp eden; toplumu ayr\u0131\u015ft\u0131ran, toplumsal dayan\u0131\u015fma anlay\u0131\u015f\u0131n\u0131 zedeleyen, toplumu ve kentleri kimliksizle\u015ftiren bir &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; anlay\u0131\u015f\u0131n\u0131n bizce kabul edilmesi m\u00fcmk\u00fcn de\u011fil.<\/p>\n<p>Devletin anayasal g\u00f6revlerinden birisi olan sa\u011fl\u0131kl\u0131, g\u00fcvenli ve ya\u015fanabilir kentler kurmak i\u00e7in; do\u011fal varl\u0131klar\u0131, ekolojik, tarihi, k\u00fclt\u00fcrel, toplumsal de\u011ferleri koruyan, ya\u015fatan, geli\u015ftiren bir arazi kullan\u0131m\u0131 ve yerle\u015fim politikas\u0131 temelinde b\u00fct\u00fcnc\u00fcl planlama yakla\u015f\u0131m\u0131 ile \u00e7evreyi g\u00f6zeten, d\u00f6n\u00fc\u015f\u00fcm alanlar\u0131nda ya\u015fayanlar\u0131n ihtiya\u00e7lar\u0131n\u0131 g\u00f6z \u00f6n\u00fcne alan, &#8220;insan\u0131 ve insanca ya\u015fam\u0131&#8221; temel hedefine koyan bir planlama s\u00fcreci acil olarak ba\u015flat\u0131lmal\u0131d\u0131r.<\/p>\n<p>Bu nedenle kamuoyunu do\u011frudan ilgilendiren, mek\u00e2nsal d\u00f6n\u00fc\u015f\u00fcmle birlikte toplumsal d\u00f6n\u00fc\u015f\u00fcm\u00fcne de yol a\u00e7an &#8220;kentsel d\u00f6n\u00fc\u015f\u00fcm&#8221; konusunda,\u00a0 m\u00fchendis, mimar ve \u015fehir planc\u0131lar\u0131n\u0131n \u00f6rg\u00fct\u00fc T\u00fcrk M\u00fchendis ve Mimar Odalar\u0131 Birli\u011fi olarak &#8220;Kentsel d\u00f6n\u00fc\u015f\u00fcm olmal\u0131, ama nas\u0131l olmal\u0131?&#8221; sorusuna verdi\u011fimiz yan\u0131tlar\u0131 kamuoyuyla payla\u015fma gere\u011fi duyuyoruz.<br \/>\u00a0<br \/><strong><br \/>TMMOB Kentsel D\u00f6n\u00fc\u015f\u00fcm\u00fcn Temel \u0130lkeleri<\/strong><\/p>\n<p>1.\u00a0 Sa\u011fl\u0131kl\u0131 ve ya\u015fanabilir bir kentsel \u00e7evre olu\u015fturulabilmesi i\u00e7in, kent planlama disiplini i\u00e7inde geli\u015ftirilmi\u015f olan t\u00fcm planlama ilkeleri ve kurallar\u0131 ile m\u00fchendislik ve mimarl\u0131\u011f\u0131n bilimsel ve teknik gereklilikleri planlama disiplininin bir par\u00e7as\u0131 olan kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 a\u00e7\u0131s\u0131ndan da vazge\u00e7ilmezdir. Bu nedenle, geli\u015ftirilen t\u00fcm projelerde, kamu yarar\u0131 ilkesine ve m\u00fchendislik, mimarl\u0131k ve planlama ilkelerine ayr\u0131ms\u0131z bi\u00e7imde uyulmal\u0131d\u0131r.<\/p>\n<p>2. Kentsel d\u00f6n\u00fc\u015f\u00fcm, kentsel yenileme ve sa\u011fl\u0131kla\u015ft\u0131rma \u00e7al\u0131\u015fmalar\u0131 i\u00e7in, m\u00fchendislik, mimarl\u0131k ve \u015fehir planlama disiplinlerinin teknik, bilimsel ve yasal gereklilikleri ile teknik ilkelerini esas alan, genel ilkeler belirlenmelidir. &#8220;Kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131&#8221; ilan edilmeden \u00f6nce, &#8220;kentsel yenileme&#8221;, &#8220;kentsel sa\u011fl\u0131kla\u015ft\u0131rma&#8221; gibi hangi m\u00fcdahale bi\u00e7iminin uygulanaca\u011f\u0131n\u0131n belirlenebilmesi i\u00e7in; \u00f6ncelikle, deprem, yap\u0131 niteli\u011fi, ta\u015fk\u0131n, heyelan vb risk alt\u0131ndaki alanlar; yap\u0131 g\u00fcvensizli\u011fi olan ve eskimi\u015f (kentsel mek\u00e2n\u0131n niteliksizli\u011fi) kent b\u00f6lgeleri; do\u011fal, tarihi, arkeolojik, k\u00fclt\u00fcrel niteli\u011fe sahip alanlar; kent kimli\u011fi a\u00e7\u0131s\u0131ndan \u00f6nemli alanlar belirlenmelidir.<\/p>\n<p>3. Kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131yla fiziksel, sosyal ve ekonomik a\u00e7\u0131dan sa\u011fl\u0131kl\u0131 ve ya\u015fanabilir bir \u00e7evre olu\u015fturulabilmesi ama\u00e7lar\u0131n\u0131n b\u00fct\u00fcnsel olarak ger\u00e7ekle\u015ftirilebilmesi i\u00e7in \u00f6ncelikle s\u00fcrece kat\u0131lacak t\u00fcm akt\u00f6rlerin yer ald\u0131\u011f\u0131 \u00f6rg\u00fctlenme bi\u00e7imi olu\u015fturulmal\u0131 ve finans kaynaklar\u0131 tarif edilmelidir.<\/p>\n<p>4. Geli\u015ftirilen projelerde toplumsal, fiziksel, do\u011fal, \u00e7evresel ve ekonomik ko\u015fullar birlikte ele al\u0131nmal\u0131, proje alanlar\u0131na y\u00f6nelik planlama kararlar\u0131 kent b\u00fct\u00fcn\u00fcne y\u00f6nelik kararlardan kopar\u0131lmamal\u0131, ayr\u0131\u015ft\u0131r\u0131lmamal\u0131, \u00fcst \u00f6l\u00e7ekli plan kararlar\u0131na ayk\u0131r\u0131 uygulamalardan ka\u00e7\u0131n\u0131lmal\u0131, projeler ba\u015fta ula\u015f\u0131m kararlar\u0131 olmak \u00fczere, olas\u0131 \u00e7evresel etkileri analiz edilerek, kent plan\u0131 ile b\u00fct\u00fcnle\u015fik olarak ele al\u0131nmal\u0131d\u0131r.<\/p>\n<p>5. D\u00f6n\u00fc\u015f\u00fcm, sa\u011fl\u0131kla\u015ft\u0131rma ve\/veya yenileme \u00f6ng\u00f6r\u00fclen alanlar, kentin gelecekteki niteli\u011fini belirleyen planlar\u0131yla uyumlu, plan ana kararlar\u0131n\u0131 g\u00f6zeten b\u00fct\u00fcnc\u00fcl bir bak\u0131\u015f a\u00e7\u0131s\u0131na sahip olmal\u0131 ve planlama, programlama, projelendirme ve parasal konulara dair s\u00fcre\u00e7, \u00e7\u00f6z\u00fcm ve uygulama ara\u00e7lar\u0131 ile bir b\u00fct\u00fcn olarak ele al\u0131nmal\u0131d\u0131r.<\/p>\n<p>6. Sa\u011fl\u0131kl\u0131 ve g\u00fcvenilir bir \u00e7evre olu\u015fturulmas\u0131nda kritik \u00f6neme sahip yap\u0131 denetim sisteminde kamu denetimini etkinle\u015ftirmek i\u00e7in, kentsel d\u00f6n\u00fc\u015f\u00fcm alanlar\u0131n\u0131n belirlenmesinde ve uygulaman\u0131n her a\u015famas\u0131nda TMMOB\u2018ye ba\u011fl\u0131 meslek odalar\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fc ve \u00f6nerileri al\u0131nmal\u0131 ve meslek odalar\u0131 denetim s\u00fcrecinde etkin olarak yer almal\u0131d\u0131r.<\/p>\n<p>7.\u00a0 Projeler temelde rant art\u0131\u015f\u0131n\u0131n de\u011fil, can g\u00fcvenli\u011finin sa\u011flanmas\u0131n\u0131 ve ya\u015fam d\u00fczeyinin y\u00fckseltilmesini ama\u00e7lamal\u0131, kentsel d\u00f6n\u00fc\u015f\u00fcm projeleri ayr\u0131cal\u0131kl\u0131 imar hakk\u0131 sa\u011flama arac\u0131 olarak kullan\u0131lmamal\u0131d\u0131r. Bu kapsamda t\u00fcm yap\u0131la\u015fmalara y\u00f6nelik g\u00fc\u00e7l\u00fc, kamusal yap\u0131 denetim sistemi ya\u015fama ge\u00e7irilmeli, uygulama sonucu olu\u015fan rant art\u0131\u015flar\u0131 do\u011frudan kamuya kazand\u0131r\u0131lmal\u0131d\u0131r.<\/p>\n<p>8. D\u00f6n\u00fc\u015f\u00fcm projesine konu olan alanlar\u0131n yeniden yap\u0131lanmas\u0131nda; konut alanlar\u0131n\u0131n sa\u011fl\u0131kl\u0131 bir ya\u015fam alan\u0131 niteli\u011fine kavu\u015fmas\u0131 i\u00e7in, sosyal ve teknik altyap\u0131 tesisleri ile \u00e7al\u0131\u015fma alanlar\u0131na y\u00f6nelik kararlar birlikte ele al\u0131nmal\u0131, kentsel sosyal donat\u0131lar insanca ya\u015fama \u015fartlar\u0131n\u0131 sa\u011flayacak standartlara uygun olarak geli\u015ftirilmeli, teknik altyap\u0131n\u0131n ve sosyal donat\u0131 tesislerinin konutlarla e\u015f zamanl\u0131 bi\u00e7imde kullan\u0131ma ge\u00e7mesi sa\u011flanmal\u0131d\u0131r.<\/p>\n<p>9. Afet tehlikesi kar\u015f\u0131s\u0131nda al\u0131nabilecek tek \u00f6nlemin &#8220;yap\u0131 d\u00fczeyinde&#8221; g\u00fc\u00e7lendirme ve yenileme oldu\u011fu d\u00fc\u015f\u00fcncesinden vazge\u00e7ilmelidir. Yap\u0131lar, kentsel ve\/veya b\u00f6lgesel d\u00fczeyde ele al\u0131narak, afete duyarl\u0131 planlanma yakla\u015f\u0131m\u0131 esas al\u0131nmal\u0131d\u0131r. \u0130mar planlar\u0131 risk azaltma \u00f6nlemlerini kapsayacak \u015fekilde yeniden yap\u0131land\u0131r\u0131lmal\u0131d\u0131r. Kentsel d\u00f6n\u00fc\u015f\u00fcm projelerinde kent b\u00fct\u00fcn\u00fcne ili\u015fkin risk fakt\u00f6rleri belirlenmeli ve bu verilere g\u00f6re risk azaltma planlar\u0131 haz\u0131rlanmal\u0131d\u0131r.<\/p>\n<p>10. Kentsel d\u00f6n\u00fc\u015f\u00fcme konu edilen alanlar ve yap\u0131lar a\u00e7\u0131s\u0131ndan, t\u00fcm tarihsel birikimi ve k\u00fclt\u00fcrel zenginli\u011fi ortadan kald\u0131racak y\u0131k\u0131m ve yeniden yapma d\u0131\u015f\u0131ndaki se\u00e7eneklerin; koruma, yenileme, iyile\u015ftirme, g\u00fc\u00e7lendirme ve canland\u0131rma se\u00e7eneklerinin \u00f6ncelikle ara\u015ft\u0131r\u0131lmas\u0131 ve tart\u0131\u015f\u0131lmas\u0131 sa\u011flanmal\u0131d\u0131r.<\/p>\n<p>11. D\u00f6n\u00fc\u015f\u00fcm projelerinde, kentleri ve k\u0131rsal alanlar\u0131 estetikten yoksun kimliksiz hale getiren, yerel kimli\u011fi ortadan kald\u0131ran tek tip mek\u00e2n \u00fcretiminden vazge\u00e7ilmeli, kentsel mek\u00e2n\u0131 par\u00e7alayan ve ayr\u0131\u015ft\u0131ran uygulamalara son verilmeli, gerek yerle\u015fim b\u00fct\u00fcn\u00fcnde gerekse tek yap\u0131 \u00f6l\u00e7e\u011finde yerelin \u00f6zellikleri, k\u0131rsal dokusu, tarihi ve k\u00fclt\u00fcrel birikimi ve \u00f6zg\u00fcnl\u00fckleri mutlaka korunmal\u0131, \u00f6zg\u00fcn niteli\u011fini devam ettirecek toplumsal ya\u015fam ve k\u00fclt\u00fcrel de\u011ferleri dikkate alan yakla\u015f\u0131m benimsenmelidir.<\/p>\n<p>12. D\u00f6n\u00fc\u015f\u00fcm projeleri hi\u00e7bir ko\u015fulda tarihi ve k\u00fclt\u00fcrel de\u011ferlere zarar vermemeli, bu niteli\u011fe sahip alanlarda ger\u00e7ekle\u015ftirilecek d\u00f6n\u00fc\u015f\u00fcm projeleri tarihi ve k\u00fclt\u00fcrel miras\u0131n korunmas\u0131 ve geli\u015ftirilmesi \u00e7abas\u0131n\u0131n bir par\u00e7as\u0131 olarak ele al\u0131nmal\u0131d\u0131r.<\/p>\n<p>13. D\u00f6n\u00fc\u015f\u00fcm projelerinde; ya\u015fam\u0131n ger\u00e7ek sigortas\u0131 olan ormanlar, meralar, sulak alanlar, k\u0131y\u0131lar, gibi do\u011fal varl\u0131klar ile ulusal veya uluslararas\u0131 \u00f6zg\u00fcn nitelikleri nedeniyle do\u011fal sit, \u00d6\u00c7K (\u00d6zel \u00c7evre Koruma B\u00f6lgesi), milli park, tabiat park\u0131, sulak alan gibi do\u011fa koruma stat\u00fcs\u00fc verilmi\u015f alanlar, toplumun g\u0131da kaynaklar\u0131 olan verimli tar\u0131m alanlar\u0131, zeytinlikler gibi \u00f6zel \u00fcr\u00fcn alanlar\u0131 hi\u00e7bir ko\u015fulda yap\u0131la\u015fmaya a\u00e7\u0131lmamal\u0131 ve mutlak bi\u00e7imde korunmal\u0131d\u0131r.<\/p>\n<p>14. Zemin yap\u0131s\u0131 nedeniyle risk ta\u015f\u0131mayan, yaln\u0131zca yap\u0131 g\u00fcvensizli\u011fi ve kentsel mek\u00e2n\u0131n niteliksizli\u011fi nedeniyle d\u00f6n\u00fc\u015f\u00fcm projesine konu olan yerlerde, proje alan\u0131nda ya\u015fayanlar\u0131n uygulama sonras\u0131 yine ayn\u0131 b\u00f6lgede ya\u015famas\u0131 sa\u011flanmal\u0131d\u0131r.<\/p>\n<p>15. Zemin yap\u0131s\u0131 nedeniyle risk ta\u015f\u0131yan ve yap\u0131la\u015fmaya kapat\u0131lmas\u0131 gereken b\u00f6lgelerde ya\u015fayanlar\u0131n, i\u015f olanaklar\u0131 ve ula\u015f\u0131m ko\u015fullar\u0131 dikkate al\u0131narak, gerek ge\u00e7ici isk\u00e2n a\u015famas\u0131nda ve gerekse uygulama sonras\u0131nda yak\u0131n \u00e7evrede iskan edilmesi sa\u011flanmal\u0131d\u0131r.<\/p>\n<p>16. Yenileme, sa\u011fl\u0131kla\u015ft\u0131rma ve d\u00f6n\u00fc\u015f\u00fcm s\u00fcre\u00e7leri \u015feffaf olmal\u0131, karar s\u00fcre\u00e7leri ilgili toplum kesimleriyle payla\u015f\u0131lmal\u0131; s\u00fcrecin tamam\u0131nda projeden etkilenen toplum kesimlerinin bilgiye kolayca eri\u015febilme olana\u011f\u0131 yarat\u0131lmal\u0131; bu kapsamda d\u00f6n\u00fc\u015f\u00fcme konu olan sakinlerinin sosyal a\u00e7\u0131dan zarara u\u011framamas\u0131 ve yerinde d\u00f6n\u00fc\u015f\u00fcm ilkesi\u00a0 en \u00f6nemli hedeflerden birisi olmal\u0131d\u0131r.<\/p>\n<p>17. Projelerin uygulanmas\u0131 hi\u00e7bir ko\u015fulda ya\u015fayanlar a\u00e7\u0131s\u0131ndan sosyal ayr\u0131\u015fmaya\/toplumsal k\u0131r\u0131lmaya\/sosyal bir y\u0131k\u0131ma neden olmamal\u0131; kent hakk\u0131, konut dokunulmazl\u0131\u011f\u0131 ve bar\u0131nma hakk\u0131 ilkeleri, kirac\u0131lar\u0131 da kapsayacak bi\u00e7imde kamusal g\u00fcvence alt\u0131na al\u0131nmal\u0131d\u0131r.<\/p>\n<p>18. \u0130dari dava a\u00e7ma hakk\u0131, hak arama h\u00fcrriyeti temelinde d\u00fczenlenmelidir. M\u00fclkiyet hakk\u0131 g\u00fcvencesi anayasa temelinde korunmal\u0131d\u0131r.<\/p>\n<p>19. Bar\u0131nma hakk\u0131 sahipli\u011fi; m\u00fclkiyet belgesinden ba\u011f\u0131ms\u0131z, sa\u011fl\u0131kl\u0131 bir ya\u015fam \u00e7evresi i\u00e7inde, \u00e7a\u011fda\u015f, ya\u015fanabilir konut hakk\u0131 olarak kabul edilmelidir.<\/p>\n<p>20.
