A\u00e7\u0131klaman\u0131n tam metni \u015fu \u015fekilde,<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>M\u00fchendis Mimar ve \u015eehir Planc\u0131s\u0131 Asgari \u00dccreti \u00dczerine TMMOB \u00d6rg\u00fctl\u00fcl\u00fc\u011f\u00fcne<\/em><\/strong><\/p>\n<p><em><br \/>Sevgili Arkada\u015flar,<br \/>31 Temmuz 2012 tarihinde Sosyal G\u00fcvenlik Kurulu ile Birli\u011fe ba\u011fl\u0131 odalar\u0131m\u0131z\u0131n \u00fcyelerine y\u00f6nelik bir protokol ger\u00e7ekle\u015ftirdik.<br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>Kar\u015f\u0131l\u0131kl\u0131 mutabakata vararak imzalanan bu protokol\u00fcn amac\u0131: &#8220;Sosyal g\u00fcvenli\u011fin toplumun t\u00fcm bireyleri i\u00e7in temel bir hak oldu\u011fu ger\u00e7e\u011finden hareketle, sosyal g\u00fcvenlik hakk\u0131ndan yoksun b\u0131rakan kay\u0131t d\u0131\u015f\u0131 istihdam ve emeklilik haklar\u0131n\u0131n eksik tesisine etki eden \u00fccretlerin SGK\u2018ya eksik bildirimini \u00f6nlemek, sosyal g\u00fcvenlik kavram\u0131n\u0131n temel bir hak oldu\u011funun toplumumun t\u00fcm bireyleri taraf\u0131ndan bilinmesini ve bu hakk\u0131 koruyan kurumlar\u0131n tan\u0131t\u0131lmas\u0131n\u0131 sa\u011flamak, vatanda\u015flar\u0131m\u0131z\u0131 yeni d\u00fczenlemeler ile ortaya \u00e7\u0131kan hak ve y\u00fck\u00fcml\u00fcl\u00fckler konusunda bilgilendirmek, toplumda sosyal g\u00fcvenlik bilincinin olu\u015fmas\u0131n\u0131 sa\u011flamak amac\u0131yla i\u015fbirli\u011fi yap\u0131lmas\u0131&#8221;d\u0131r.<br \/><\/em><\/p>\n<p>&nbsp;<\/p>\n<p><em>Bu protokol\u00fcn dayana\u011f\u0131; 31.05.2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2018nun 100. maddesi ile 16.05.2006 tarihli ve 5502 say\u0131l\u0131 Sosyal G\u00fcvenlik Kurumu Kanunu\u2018nun 13. maddesinin (g) bendi ve 14. maddesinin (d) bendidir.<br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>Bu protokole g\u00f6re Birli\u011fimiz &#8220;\u00fccretlerinin eksik bildirilmesini \u00f6nlemek amac\u0131yla m\u00fchendislik, mimarl\u0131k ve \u015fehir planlama alanlar\u0131nda meslek icra eden disiplinlere ili\u015fkin olarak y\u0131ll\u0131k bazda asgari \u00fccret seviyeleri belirleyerek SGK\u2018ya iletecektir&#8221;. Yine bu protokole g\u00f6re SGK; &#8220;Sosyal g\u00fcvenlik bilincinin art\u0131r\u0131lmas\u0131 amac\u0131yla TMMOB taraf\u0131ndan da\u011f\u0131t\u0131m\u0131 sa\u011flanacak dok\u00fcmanlar\u0131n haz\u0131rlanmas\u0131na yard\u0131mc\u0131 olmay\u0131, m\u00fchendis ve mimarlar\u0131n \u00fccretlerinin, TMMOB taraf\u0131ndan belirlenerek kuruma iletilen asgari \u00fccretlerin alt\u0131nda olmamas\u0131 i\u00e7in gerekli tedbirleri almay\u0131, di\u011fer konularla ilgili olarak teknik destek sa\u011flamay\u0131 ve TMMOB ile iyi niyet ve uyum i\u00e7inde i\u015fbirli\u011fi yapmay\u0131 kabul ve taahh\u00fct etmektedir&#8221;.<br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>Birli\u011fimizin bu protokol\u00fc imzalanmas\u0131n\u0131n dayana\u011f\u0131 ise 24-25 Eyl\u00fcl 2010 tarihlerinde Ankara\u2018da ger\u00e7ekle\u015ftirilen TMMOB 41. D\u00f6nem Ola\u011fan\u00fcst\u00fc Genel Kurulu\u2018nun ald\u0131\u011f\u0131 karard\u0131r: \u00a0<br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>&#8220;M\u00fchendis, mimar ve \u015fehir planc\u0131lar\u0131 meslek \u00f6rg\u00fctleri ile birlikte t\u00fcm emek\u00e7ilerin insanca ya\u015famaya yetecek asgari \u00fccret hakk\u0131 m\u00fccadelesine kat\u0131l\u0131rlar. TMMOB, \u00fcyeleri olan emek\u00e7i m\u00fchendis, mimar ve \u015fehir planc\u0131lar\u0131n da aralar\u0131nda bulundu\u011fu t\u00fcm i\u015f\u00e7i s\u0131n\u0131f\u0131 i\u00e7in insanca ya\u015fam \u00fccretinin belirlenmesi m\u00fccadelesini di\u011fer emek ve demokratik kitle \u00f6rg\u00fctleri ile birlikte verir. TMMOB ve ba\u011fl\u0131 odalar yasa ve y\u00f6netmeliklerden ald\u0131klar\u0131 yetkiyi emekten yana de\u011ferlendirerek, insanca ya\u015fan\u0131lacak \u00fccreti m\u00fchendis, mimar, \u015fehir planc\u0131lar\u0131 i\u00e7in asgari \u00fccret olarak ilan eder ve uygulanmas\u0131n\u0131 sa\u011flar.&#8221;<br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>Sevgili Arkada\u015flar,<br \/>Konu ile ilgili olarak TMMOB Y\u00f6netim Kurulu gerekli ve yeterli bir dizi \u00f6rg\u00fct i\u00e7i toplant\u0131y\u0131 ger\u00e7ekle\u015ftirdikten sonra 24 Kas\u0131m 2012 tarihinde 110 no\u2018lu karar\u0131 ald\u0131 ve SGK\u2018ya &#8220;Kurumunuz ve Birli\u011fimiz aras\u0131nda imzalanan protokol gere\u011fince, 2013 y\u0131l\u0131 ilk i\u015fe giri\u015f bildirgesinde baz al\u0131nacak asgari br\u00fct \u00fccret, Orman, Orman End\u00fcstri, A\u011fa\u00e7 \u0130\u015fleri End\u00fcstri M\u00fchendisleri (Meslek Yasas\u0131 gere\u011fi daha \u00f6nce ayr\u0131ca haz\u0131rlanm\u0131\u015ft\u0131r) hari\u00e7 2.700 TL olarak belirlenmi\u015ftir. Uzmanl\u0131k alanlar\u0131nda odalar\u0131nca belgeli \u00e7al\u0131\u015fman\u0131n ko\u015ful oldu\u011fu alanlar, arazi \u00e7al\u0131\u015fmalar\u0131, mesleki deneyimin arand\u0131\u011f\u0131 alanlar ile \u015fantiye \u015fefli\u011fi, sorumlu m\u00fcd\u00fcrl\u00fck, i\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131, yap\u0131 denetim eleman\u0131, teknik nezaret\u00e7i, uzak yol kaptanl\u0131\u011f\u0131 gibi hizmetlerde asgari \u00fccret uygulanmaz. Bu durumda olan m\u00fchendis, mimar, \u015fehir planc\u0131lar\u0131n\u0131n \u00fccretleri al\u0131nan sorumluluk gere\u011fi asgari \u00fccretin \u00fczerinde olmak zorundad\u0131r&#8221; \u015feklinde iletti.<br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>Sevgili Arkada\u015flar,<br \/>Hepimiz \u015fimdi elbirli\u011fi ile bu uygulamay\u0131 ya\u015fatmak ve b\u00fcy\u00fctmek zorunday\u0131z. TMMOB taraf\u0131ndan belirlenmi\u015f \u00fccretin alt\u0131nda \u00e7al\u0131\u015fan arkada\u015flar\u0131m\u0131z\u0131n durumlar\u0131 \u00f6rg\u00fct\u00fcm\u00fcz\u00fcn bu \u00e7abay\u0131 g\u00fc\u00e7lendirmesi ile d\u00fczelebilecektir. Oda Y\u00f6netim Kurullar\u0131, \u00fcyelerimizi bu konuda mutlaka bilgilendirmeli ve olas\u0131 yanl\u0131\u015f uygulamalar\u0131n d\u00fczeltilmesi i\u00e7in \u00e7aba sarf etmelidir. <br \/><\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>&#8220;Kurtulu\u015f yok tek ba\u015f\u0131na, ya hep beraber ya hi\u00e7 birimiz&#8221; s\u00f6z\u00fcm\u00fczden hareketle; sorunu olan \u00fcyelerimizin ba\u015fvuraca\u011f\u0131 yer ba\u015fta Odalar\u0131m\u0131z olmak \u00fczere TMMOB\u2018dir.
