Cumhuriyet\u2019ten \u0130klim \u00d6ngel\u2019in haberine g\u00f6re Dan\u0131\u015ftay 6. Dairesi, bilirki\u015fi raporundaki \u201cafete maruz b\u00f6lge\u201d tespitlerinin dikkate al\u0131nd\u0131\u011f\u0131n\u0131 belirterek davaya konu kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131n\u0131n \u015fehircilik ilkelerine ve kamu yarar\u0131na uygun olmad\u0131\u011f\u0131na karar verdi. Karar, oybirli\u011fi ile al\u0131nd\u0131.<\/p>\n<p>Mahkeme karar\u0131nda \u015fu ifadelere yer verildi:<\/p>\n<p>Belirsizlik kaynakl\u0131, analizlerden, de\u011ferlendirmelerden ve planlama sisteminden ba\u011f\u0131ms\u0131z, kamu yarar\u0131n\u0131n ger\u00e7ekle\u015fmesine, sa\u011fl\u0131kl\u0131 \u00e7evrelerin ve g\u00fcvenli mek\u00e2nlar\u0131n olu\u015fmas\u0131na engel olan, herkese g\u00fcvenlik sunmayan, e\u015fitli\u011fi zedeleyen uygulamalara yol a\u00e7ma tehlikesi bar\u0131nd\u0131rd\u0131\u011f\u0131ndan, dava konusu kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alan\u0131 s\u0131n\u0131r onay i\u015flemlerinin \u015fehircilik ilkelerine ve kamu yarar\u0131na uygun bulunmad\u0131\u011f\u0131 kanaatine ula\u015f\u0131lm\u0131\u015ft\u0131r<\/p>\n<p><strong>Davay\u0131, Ma\u011fdur Edilen Hak Sahipleri A\u00e7m\u0131\u015ft\u0131<\/strong><\/p>\n<p>G\u00fcneykent Kentsel D\u00f6n\u00fc\u015f\u00fcm ve Geli\u015fim Projesi, Ankara B\u00fcy\u00fck\u015fehir Belediyesi taraf\u0131ndan 2005 y\u0131l\u0131nda ba\u015flat\u0131lm\u0131\u015f ve b\u00f6lgedeki hak sahipleriyle anla\u015fma yap\u0131lm\u0131\u015ft\u0131. \u0130ki y\u0131l i\u00e7inde konutlar\u0131n teslim edilece\u011fini s\u00f6yleyen belediye, s\u00fcr\u00fcncemede b\u0131rakt\u0131\u011f\u0131 projeyi 2010 y\u0131l\u0131nda yenilemi\u015f ve Sinpa\u015f GYO A.\u015e. ile anla\u015fm\u0131\u015ft\u0131.<\/p>\n<p>Alt\u0131noran projesinin ortaya \u00e7\u0131kmas\u0131n\u0131n ard\u0131ndan hak sahipleri, projede kendilerinin izole edildi\u011fini, binalar\u0131n dere kenar\u0131na yap\u0131lmas\u0131n\u0131n \u00f6zellikle Samsun\u2019daki TOK\u0130 konutlar\u0131n\u0131n sel sonucu sular alt\u0131nda kalmas\u0131n\u0131 \u00f6rnek g\u00f6stererek risk anlam\u0131na gelece\u011fini belirtmi\u015fti. B\u00f6lgede bir araya gelen yurtta\u015flar, projeye ili\u015fkin dava s\u00fcrecini ba\u015flatm\u0131\u015ft\u0131.<\/p>\n<p>Projeyle ilgili bilirki\u015fi raporunda da \u201c\u015eehircilik ilkelerine, planlama esaslar\u0131na ve kamu yarar\u0131na uygun bulunmam\u0131\u015ft\u0131r\u201d denilmi\u015fti.<\/p>\n<p><strong>G\u00f6k\u00e7ek: \u2018Dava S\u00fcrerken Bin Konut Satt\u0131k, \u015eimdi Ne Yapaca\u011f\u0131z?\u2019<\/strong><\/p>\n<p>Ankara B\u00fcy\u00fck\u015fehir Belediye Ba\u015fkan\u0131 Melih G\u00f6k\u00e7ek, k\u0131sa bir s\u00fcre \u00f6nce Dan\u0131\u015ftay\u2019da d\u00fczenlenen \u201cKentsel D\u00f6n\u00fc\u015f\u00fcm ve \u00c7evre Hukuku Konferans\u0131\u201dna kat\u0131lm\u0131\u015f, konu\u015fmas\u0131na Sinpa\u015f \u00f6rne\u011fini vermi\u015fti.
