{"id":549,"date":"2008-11-19T12:35:58","date_gmt":"2008-11-19T09:35:58","guid":{"rendered":"http:\/\/politeknik.org.tr\/\/?p=549"},"modified":"2013-11-07T18:45:19","modified_gmt":"2013-11-07T15:45:19","slug":"basri-77","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/basri-77\/","title":{"rendered":"\u0130MECE Toplumun \u015eehircilik Hareketi: &#8220;Ba\u015f\u0131b\u00fcy\u00fckte Kentsel D\u00f6n\u00fc\u015f\u00fcm Hukuk Tan\u0131m\u0131yor!&#8221;"},"content":{"rendered":"<p><!--StartFragment-->  <\/p>\n<p class=\"MsoNormal\">Maltepe Belediye Meclisi taraf\u0131ndan 09.10.2006 tarih ve 2006\/56 say\u0131l\u0131 karar\u0131 ile kabul edilen ve \u0130stanbul B\u00fcy\u00fck\u015fehir Belediye Meclisi taraf\u0131ndan 11.01.2007 tarih ve 123 say\u0131l\u0131 karar\u0131 ile onanan Ba\u015f\u0131b\u00fcy\u00fck Mahallesi kentsel Yenileme Alan\u0131 (Gecekondu D\u00f6n\u00fc\u015f\u00fcm) 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar plan\u0131 ve projenin ger\u00e7ekle\u015ftirilmesi amac\u0131yla belirlenen toplu konut alan\u0131n\u0131n in\u015faat\u0131 i\u00e7in Maltepe Belediyesi, \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi, TOK\u0130 aras\u0131nda imzalanan \u00fc\u00e7l\u00fc protokol\u00fcn iptali ve y\u00fcr\u00fctmenin durdurulmas\u0131 amac\u0131yla a\u00e7\u0131lan davada, \u0130stanbul 5. \u0130dare Mahkemesi 05.11.2008 tarihinde ald\u0131\u011f\u0131 kararla 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar Plan\u0131 ve \u00fc\u00e7l\u00fc protokol\u00fcn y\u00fcr\u00fctmesinin durdurulmas\u0131na karar verdi.<\/p>\n<p class=\"MsoNormal\">&nbsp;<\/p>\n<p class=\"MsoNormal\">Bu kararla daha \u00f6nce yap\u0131m\u0131na ba\u015flanan ve 6 bloktan olu\u015fan toplu konut projesinin hi\u00e7bir yasal dayana\u011f\u0131 kalmamas\u0131na ra\u011fmen Belediye bir kamu kurumu olarak yapmakla y\u00fck\u00fcml\u00fc oldu\u011fu m\u00fch\u00fcrleme i\u015flemini geride kalan bir haftada yerine getirmemi\u015ftir. Yap\u0131m\u0131na devam edilen toplu konutlar yang\u0131ndan mal ka\u00e7\u0131r\u0131rcas\u0131na, teknik \u015fartlar zorlanarak h\u0131zla devam etmektedir.<\/p>\n<p class=\"MsoNormal\">&nbsp;<\/p>\n<p class=\"MsoNormal\">Kentsel yenileme alan\u0131 olarak belirlendikten sonra Ba\u015f\u0131b\u00fcy\u00fck mahallesinin ye\u015fil alan olarak y\u0131llard\u0131r korudu\u011fu bir parselde blok halinde toplu konutlar yaparak d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecini ba\u015flatmay\u0131 hedefleyen \u00fc\u00e7l\u00fc protokol\u00fcn taraflar\u0131, mahalle halk\u0131n\u0131n beklenti ve ihtiya\u00e7lar\u0131n\u0131 dikkate almayarak niyetini ba\u015ftan ortaya koymu\u015ftur. Davac\u0131n\u0131n s\u00f6z konusu iptal ve y\u00fcr\u00fctmenin durdurulmas\u0131 talebine kar\u015f\u0131l\u0131k Toplu Konut \u0130daresi Ba\u015fkanl\u0131\u011f\u0131 savunmas\u0131nda davac\u0131ya ait parselin 1\/1000 Uygulama \u0130mar Plan\u0131 ve kentsel d\u00f6n\u00fc\u015f\u00fcm projesi i\u00e7erisinde yer almad\u0131\u011f\u0131 iddias\u0131nda bulunmu\u015f 5216 say\u0131l\u0131 kanunda Toplu Konut \u0130daresinin Gecekondular\u0131n tasfiyesine ili\u015fkin yetkisini belirterek \u00e7al\u0131\u015fmalar\u0131n amac\u0131n\u0131n \u00e7a\u011fda\u015f kentsel \u00e7evreler \u00fcretmek oldu\u011fu yalan\u0131yla davan\u0131n reddini talep etmi\u015ftir. Mahkeme mevcut bilgi ve belgelerle birlikte bilirki\u015fi raporunu da dikkate alarak yapt\u0131\u011f\u0131 de\u011ferlendirmede, iddian\u0131n aksine s\u00f6z konusu parselin kentsel yenileme alan\u0131 i\u00e7erisinde yer ald\u0131\u011f\u0131n\u0131 belirterek, uygulama imar plan\u0131n\u0131n getirece\u011fi n\u00fcfus yo\u011funlu\u011funun, \u00fcst \u00f6l\u00e7ekli plan kararlar\u0131 ile uyumsuz oldu\u011funu ortaya koymu\u015ftur. Kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn, yaln\u0131zca bir fiziki mekan d\u00fczenleme eylemi olmad\u0131\u011f\u0131, aksine b\u00f6lgenin kar\u015f\u0131 kar\u015f\u0131ya kald\u0131\u011f\u0131 t\u00fcm ekonomik ve sosyal sorunlar\u0131na b\u00fct\u00fcnc\u00fcl \u00e7\u00fcz\u00fcmler getirecek eylemler dizisi oldu\u011fu ifade edilirken, bu projeninse hangi ekonomik ve sosyal soruna nas\u0131l \u00e7\u00f6z\u00fcm \u00fcretti\u011finin belirsiz oldu\u011fu tespiti yap\u0131lm\u0131\u015ft\u0131r.
