Bu hedeflerin, hemen her vesileyle ve tasar\u0131da da dile getirilen \u201ci\u015fsizli\u011fin \u00f6nlenmesi, istihdam\u0131 art\u0131r\u0131c\u0131 yat\u0131r\u0131mlar\u0131n \u00e7o\u011falmas\u0131, yeni i\u015f alanlar\u0131n\u0131n yarat\u0131lmas\u0131, aktif istihdam politikalar\u0131 ve kay\u0131t d\u0131\u015f\u0131 istihdam\u0131n azalt\u0131lmas\u0131\u201d arzular\u0131 ile \u00e7eli\u015fti\u011fi bilin\u00e7li kamuoyunca a\u00e7\u0131kt\u0131r.<\/p>\n<p>S\u00f6z konusu tasar\u0131, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fine ili\u015fkin Odam\u0131z ve TMMOB\u2019nin a\u00e7t\u0131\u011f\u0131 davalar \u00fczerine Dan\u0131\u015ftay\u2019\u0131n verdi\u011fi karara ters bir i\u00e7erikle g\u00fcndeme gelmi\u015ftir. Mevcut tasar\u0131n\u0131n da haz\u0131rlay\u0131c\u0131s\u0131 olan \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 taraf\u0131ndan haz\u0131rlanarak ge\u00e7en y\u0131ldan bu yana ilgili taraflar\u0131n g\u00f6r\u00fc\u015f\u00fcne a\u00e7\u0131lan \u201c\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanun Tasar\u0131s\u0131 Tasla\u011f\u0131\u201d Dan\u0131\u015ftay kararlar\u0131n\u0131 devre d\u0131\u015f\u0131 b\u0131rakan bir i\u00e7erikle haz\u0131rlanm\u0131\u015f ve taslak i\u00e7indeki baz\u0131 can al\u0131c\u0131 maddeler s\u00f6z konusu yeni tasar\u0131ya monte edilmi\u015ftir.<\/p>\n<p>Mevcut tasar\u0131 Yasa, T\u00fcz\u00fck, Y\u00f6netmelik zincir ve\/veya \u00fc\u00e7lemesini bozan bir tarzda; \u0130\u015f G\u00fcvenli\u011fi M\u00fchendisi ve \u0130\u015fyeri Hekimi istihdam\u0131n\u0131 daralt\u0131c\u0131 ve piyasaya a\u00e7\u0131c\u0131; sanayi sekt\u00f6rlerinde temel i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlem ve \u00f6rg\u00fctlenmesinden yoksun \u00e7al\u0131\u015fma ko\u015fullar\u0131 ve esnek \u00e7al\u0131\u015fmay\u0131 yayg\u0131nla\u015ft\u0131r\u0131c\u0131; i\u015fveren y\u00fck\u00fcml\u00fcl\u00fckleri ve istihdam\u0131 daralt\u0131c\u0131 bir i\u00e7erikle g\u00fcndeme getirilmi\u015f, \u00e7al\u0131\u015fma ya\u015fam\u0131ndaki bir\u00e7ok sosyal hak ve sosyal istihdam\u0131 ortadan kald\u0131r\u0131c\u0131 bir i\u00e7eriktedir ve de\u011fi\u015ftirilmesi gerekmektedir. Odam\u0131z\u0131n s\u00f6z konusu tasar\u0131ya ili\u015fkin saptad\u0131\u011f\u0131 olumsuzluklar a\u015fa\u011f\u0131da kamuoyunun dikkatine sunulmaktad\u0131r.<\/p>\n<p>As\u0131l i\u015fveren\u2013alt i\u015fveren ili\u015fkisi ve ta\u015feronla\u015fma: Y\u00fcr\u00fcrl\u00fckteki \u0130\u015f Yasas\u0131nda \u201c\u0130\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren i\u015fler d\u0131\u015f\u0131nda as\u0131l i\u015f b\u00f6l\u00fcnerek alt i\u015fverenlere verilemez\u201d h\u00fckm\u00fc yer almakta ancak \u00f6ng\u00f6r\u00fclen de\u011fi\u015fiklik ile as\u0131l i\u015fveren ve alt i\u015fveren aras\u0131nda \u201cs\u00f6zle\u015fme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc\u201d getirilerek ta\u015feronla\u015fmay\u0131 peki\u015ftirecek ve as\u0131l i\u015fverenin bir\u00e7ok alanda sorumluluktan muaf olaca\u011f\u0131 bir d\u00fczenleme yap\u0131lmaktad\u0131r. Oysa as\u0131l yap\u0131lmas\u0131 gereken, \u201cas\u0131l i\u015fin b\u00f6l\u00fcnerek alt i\u015fverene verilmemesi\u201dni peki\u015ftirici ve bunun uygulanmas\u0131n\u0131 sa\u011flayacak d\u00fczenlemelerdir.<\/p>\n<p>\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi \u00d6rg\u00fctlenmesinde de\u011fi\u015fiklik ve piyasala\u015ft\u0131rma: Tasar\u0131da \u0130\u015f G\u00fcvenli\u011fi M\u00fchendisi, \u0130\u015fyeri Hekimi, Sa\u011fl\u0131k Memuru ve Hem\u015fireleri kapsayan \u201c\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kurullar\u0131\u201dn\u0131n olu\u015fumunu engelleyen bir durum da olu\u015fturulmu\u015f; \u201cKurul\u201d kavram\u0131 \u201cBirim\u201de d\u00f6n\u00fc\u015ft\u00fcr\u00fclerek \u201cOrtak Sa\u011fl\u0131k ve G\u00fcvenlik Birimleri\u201dnin kurulmas\u0131 ve bu hizmetin d\u0131\u015far\u0131dan al\u0131m\u0131 ile piyasala\u015ft\u0131r\u0131lmas\u0131 ama\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n<p>\u0130\u015f G\u00fcvenli\u011fi M\u00fchendisli\u011finin kapsam\u0131 dar tutuluyor ve piyasala\u015ft\u0131r\u0131l\u0131yor: \u0130\u015f Yasas\u0131n\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi alan\u0131ndaki gereklilikleri kar\u015f\u0131lamad\u0131\u011f\u0131 ve \u00e7\u0131kar\u0131lan Y\u00f6netmelik maddelerinin yarg\u0131 kararlar\u0131yla iptal edilmesini dikkate alan de\u011fi\u015fiklikler yap\u0131lmas\u0131 gerekirken \u0130\u015f G\u00fcvenli\u011fi M\u00fchendisinin teknik elemanlarla ve m\u00fchendislik gibi bir meslek grubu olmayan \u201ci\u015f g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u201d ile e\u015fde\u011fer tutulmas\u0131 yanl\u0131\u015f\u0131 tasar\u0131da s\u00fcrd\u00fcr\u00fclmektedir.<\/p>\n<p>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fiyle g\u00f6revli m\u00fchendis istihdam\u0131n\u0131n en az 50 i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 i\u015fyerleri i\u00e7in \u00f6ng\u00f6r\u00fclmesi; i\u015fverenleri 50 i\u015f\u00e7i s\u0131n\u0131r\u0131na ula\u015fmama \u00e7abas\u0131na sokacak, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemleri yan\u0131 s\u0131ra istihdam\u0131 da olumsuz y\u00f6nde etkileyecektir. Oysa i\u015f kazalar\u0131n\u0131n % 60\u2019tan fazlas\u0131n\u0131n 50\u2019den az i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerinde ve en y\u00fcksek i\u015f kazas\u0131 oran\u0131n\u0131n toplam i\u015fyeri say\u0131s\u0131n\u0131n % 98\u2019ini olu\u015fturan ve \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kurulu, \u0130\u015fyeri Hekimi, \u0130\u015f G\u00fcvenli\u011fi M\u00fchendisi, \u0130\u015fyeri Hem\u015firesi veya Sa\u011fl\u0131k Memuru bulundurma gibi zorunluluklar\u0131n bulunmad\u0131\u011f\u0131 KOB\u0130\u2019lerde ya\u015fanmas\u0131 konunun \u00f6nemine i\u015faret etmektedir.<\/p>\n<p>Bu nedenle 50\u2019nin alt\u0131nda i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015fyerleri i\u00e7in de \u201cOrtak \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kurullar\u0131\u201dn\u0131n bir \u00f6rg\u00fctlenme modeli olarak yasada yer almas\u0131 gereklidir.<\/p>\n<p>Tasar\u0131da; i\u015fverenlerin bir personeli i\u015f g\u00fcvenli\u011fi uzman\u0131 olarak g\u00f6revlendirebilmelerine ya da bu hizmeti d\u0131\u015far\u0131dan alabilmelerine de olanak tan\u0131nmaktad\u0131r. Bir g\u00f6revi y\u00fcr\u00fctmekte olan bir personelin, i\u015f g\u00fcvenli\u011fiyle de g\u00f6revlendirilmesi yanl\u0131\u015f oldu\u011fu gibi d\u0131\u015far\u0131dan hizmet al\u0131m\u0131 i\u015f g\u00fcvenli\u011finin piyasala\u015fmas\u0131na neden olacakt\u0131r. \u0130\u015fverenlerin i\u015fletme i\u00e7indeki y\u00fck\u00fcml\u00fcl\u00fcklerinin gev\u015fetilmesi ve bu alanda ta\u015feron hizmeti sat\u0131n al\u0131nmas\u0131, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fini bir rekabet ve maliyet konusu haline getirecektir.<\/p>\n<p>\u0130\u015fyeri Kurma \u0130zni kald\u0131r\u0131l\u0131yor: \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131\u2019n\u0131n, i\u015fyerlerinin kurulma a\u015famas\u0131ndan \u00e7ekilmesi, \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131 ilgilendiren pek \u00e7ok konunun de\u011ferlendirme d\u0131\u015f\u0131 kalmas\u0131na neden olacak ve i\u015fyerlerine ili\u015fkin zaten yayg\u0131n olan denetimsizli\u011fi yasalla\u015ft\u0131racakt\u0131r.<\/p>\n<p>Zorunlu istihdam kald\u0131r\u0131l\u0131yor: Mevcut durumda \u00f6z\u00fcrl\u00fc, eski h\u00fck\u00fcml\u00fc, ter\u00f6r ma\u011fduru olarak % 6 olan zorunlu \u00e7al\u0131\u015ft\u0131rma oran\u0131 de\u011fi\u015ftirilerek, \u00f6zel sekt\u00f6rde \u00f6z\u00fcrl\u00fc \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu % 3\u2019e, kamu sekt\u00f6r\u00fc i\u00e7in % 4\u2019e d\u00fc\u015f\u00fcr\u00fclmekte; ter\u00f6r ma\u011fduru \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu kamuya b\u0131rak\u0131lmakta; eski h\u00fck\u00fcml\u00fclerin istihdam\u0131 zorunluluk kapsam\u0131ndan \u00e7\u0131kar\u0131larak sosyal istihdam daralt\u0131lmaktad\u0131r.<\/p>\n<p>\u0130\u015fsizlik Sigortas\u0131 Fonu ama\u00e7 d\u0131\u015f\u0131 kullan\u0131lacak, 29 ya\u015f \u00fcst\u00fc i\u015fsizlik te\u015fvik edilecek: Tasar\u0131n\u0131n en \u00f6nemli y\u00f6nlerinden biri, \u0130\u015fsizlik Sigortas\u0131 Fonunun i\u015fverenlere kaynak aktar\u0131m fonuna d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi ve 18\u201329 ya\u015f aras\u0131ndakiler ile ya\u015f \u015fart\u0131 aranmaks\u0131z\u0131n kad\u0131nlar\u0131n sigorta primlerindeki i\u015fveren hisselerinin, belli ko\u015fullarda ve kademeli olarak \u0130\u015fsizlik Sigortas\u0131 Fonundan kar\u015f\u0131lanaca\u011f\u0131n\u0131n \u00f6ng\u00f6r\u00fclmesidir. Bu d\u00fczenleme istihdam\u0131 daralt\u0131c\u0131 ve \u00fclkedeki istihdam dengesini 29 ya\u015f \u00fcst\u00fc \u00e7al\u0131\u015fanlar\u0131n aleyhine bozacak, i\u015ften \u00e7\u0131kar\u0131lmalar\u0131 ve yerlerine daha ucuz maliyetli gen\u00e7 i\u015f\u00e7ilerin al\u0131nmas\u0131n\u0131 te\u015fvik edecek niteliktedir.<\/p>\n<p>Sigorta pirim \u00f6demelerinde i\u015fverenler kay\u0131r\u0131l\u0131yor: Primlerde i\u015fveren hissesinin 5 puanl\u0131k k\u0131sm\u0131, yani neredeyse \u00bc\u2019inin Hazine\u2019ce kar\u015f\u0131lanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmekte; i\u015fveren prim hissesi 19\u2019dan 14\u2019e d\u00fc\u015f\u00fcr\u00fclmekteyken, i\u015f\u00e7inin pay\u0131 14,5 olarak kalmaktad\u0131r.
