Ormanlar insan ya\u015fam\u0131n\u0131n olmazsa olmaz\u0131 olan su ve oksijenin ana unsurudur, kaynak de\u011fil, korunmas\u0131 ve geli\u015ftirilmesi gereken do\u011fal bir varl\u0131kt\u0131r. Ormanlar\u0131 korumak insanl\u0131\u011f\u0131n temel g\u00f6revidir. Her ge\u00e7en g\u00fcn \u201cdo\u011fay\u0131\u201d el birli\u011fi ile kirleterek ya\u015fanabilir gelece\u011fi yok etmek bir insanl\u0131k su\u00e7udur. <\/p>\n<p align=\"justify\">\u00dclkemizde Cumhuriyet d\u00f6neminde Orman alanlar\u0131n\u0131n korunmas\u0131 ve geli\u015ftirilmesi y\u00f6n\u00fcndeki ilk ad\u0131m 1937 y\u0131l\u0131nda \u00e7\u0131kart\u0131lan yasa ile at\u0131lm\u0131\u015ft\u0131r. Yap\u0131lacak ilk i\u015f orman alanlar\u0131n\u0131n s\u0131n\u0131rlar\u0131n belirlenmesi, kadastrosunun yap\u0131lmas\u0131 ve tapu tescilidir. 2004 verilerine g\u00f6re ormanlar\u0131m\u0131z 21.19 milyon hektar olup, \u00fclke y\u00fcz \u00f6l\u00e7\u00fcm\u00fcn\u00fcn %27 sine denk gelmektedir. Verimli orman alanlar\u0131 ise toplam orman alan\u0131n %50 si d\u00fczeyindedir. Ormanlar\u0131m\u0131z\u0131n %94 ise do\u011fal orman niteli\u011findedir. Bug\u00fcn orman alanlar\u0131m\u0131z\u0131n ancak %20 sinin kadastrosu tamamlanarak tapuda tescili yap\u0131lm\u0131\u015ft\u0131r. 1961 ve 1982 Anayasalar\u0131nda Orman alanlar\u0131n\u0131n devlet taraf\u0131ndan korunmas\u0131 ve geli\u015ftirilmesi y\u00f6n\u00fcnden h\u00fck\u00fcmler getirilmi\u015ftir. 1957 de \u00e7\u0131kart\u0131lan 6831 say\u0131l\u0131 Orman Kanununda onlarca kez de\u011fi\u015fiklikler yap\u0131lm\u0131\u015ft\u0131r. Her ne kadar anayasa ve yasalarda orman alanlar\u0131n\u0131n korunmas\u0131 ve daralt\u0131lamayaca\u011f\u0131na ili\u015fkin h\u00fck\u00fcmler yer alsa da \u201cancak\u201d ile ba\u015flayan c\u00fcmleler ile bu ilkeler s\u00fcrekli a\u015f\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Yanan orman alanlar\u0131n\u0131n a\u011fa\u00e7land\u0131r\u0131laca\u011f\u0131 yasada zorunlu k\u0131l\u0131nsa da 1985 y\u0131l\u0131ndan g\u00fcn\u00fcm\u00fcze 234 482 hektar (2.344.820.000m\u00b2) orman alan\u0131 yanm\u0131\u015f, ancak bu alanlar\u0131n sadece 40 824 hektar\u0131 di\u011fer bir de\u011fi\u015fle yakla\u015f\u0131k %17\u2018si a\u011fa\u00e7land\u0131r\u0131larak geri kazan\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p align=\"justify\">Anayasan\u0131n 169&#8217;uncu maddesine dayan\u0131larak, Orman olarak muhafazas\u0131nda bilim ve fen bak\u0131m\u0131ndan hi\u00e7bir yarar g\u00f6r\u00fclmeyen aksine tar\u0131m alanlar\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesinde kesin yarar oldu\u011fu tespit edilen yerler ile 31.12.1981 tarihinden \u00f6nce bilim ve fen bak\u0131m\u0131ndan Orman niteli\u011fini tam olarak kaybetmi\u015f olan tarla, ba\u011f, meyvelik, zeytinlik gibi \u00e7e\u015fitli tar\u0131m alanlar\u0131nda veya hayvanc\u0131l\u0131kta kullan\u0131lmas\u0131nda yarar oldu\u011fu tespit edilen araziler, \u015fehir, kasaba ve k\u00f6y yap\u0131lar\u0131n\u0131n toplu olarak bulundu\u011fu yerlerin Orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kart\u0131labilece\u011fi h\u00fckm\u00fc i\u015fletilerek 473 bin hektar alan orman d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lm\u0131\u015ft\u0131r. Bu i\u015flem 6831 say\u0131l\u0131 yasan\u0131n 2B maddesi kapsam\u0131nda yap\u0131ld\u0131\u011f\u0131 i\u00e7in kamuoyunda konu \u201c2B\u201d olarak bilinmektedir. <\/p>\n<p align=\"justify\">Di\u011fer taraftan anayasan\u0131n 170 inci maddesinde ise orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lan yerlerin orman i\u00e7indeki k\u00f6yler halk\u0131n\u0131n yararlanmas\u0131na \u201ctahsisi\u201dni \u00f6ng\u00f6rm\u00fc\u015f olup, bu yerlerin orman k\u00f6yl\u00fclerine ya da ba\u015fkalar\u0131na sat\u0131\u015f\u0131na izin verilmemi\u015ftir. <\/p>\n<p><strong><\/p>\n<p align=\"justify\">15.01.2009 tarihinde kabul edilen <strong>5831<\/strong> Say\u0131l\u0131 Tapu Kanunu ve Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile orman kadastro komisyonunca orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan bu alanlar\u0131n kadastrosu yap\u0131larak, tesciline y\u00f6nelik bir ad\u0131m at\u0131lm\u0131\u015f gibi g\u00f6z\u00fckmektedir. \u0130lgili maddede Hazine ad\u0131na orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan yerlerin, \u201cfiili kullan\u0131m durumlar\u0131 dikkate al\u0131nmak ve varsa \u00fczerindeki muhdesat\u0131n kime veya kimlere ait oldu\u011fu ve kim veya kimler taraf\u0131ndan ne zamandan beri kullan\u0131ld\u0131\u011f\u0131\u201d belirtilmek suretiyle Hazine ad\u0131na tescil edilece\u011fi belirtilmektedir. <\/p>\n<p><\/strong><\/p>\n<p align=\"justify\">2\/B alanlar\u0131n\u0131n tapuya tescil i\u015flemi Anayasam\u0131zda belirtilen Orman i\u00e7i k\u00f6yler halk\u0131n\u0131n arazi koruma ve geli\u015ftirme planlar\u0131 \u00e7er\u00e7evesinde k\u0131smen ve tamamen bu yerlere yerle\u015ftirilmesi ve zilyetlik yolu ile i\u015fgalcilerin m\u00fclkiyetine ge\u00e7mesinin engellenmesi y\u00f6n\u00fcnde \u00f6nemli bir ad\u0131md\u0131r. <\/p>\n<p align=\"justify\">Ancak yine bu Kanunda di\u011fer bir d\u00fczenlemeyle \u201chazine ad\u0131na orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan yerler, daha \u00f6ncesi tescil olmu\u015f oldu\u011funa bak\u0131lmaks\u0131z\u0131n Maliye Bakanl\u0131\u011f\u0131n\u0131n talebi \u00fczerine, Tapu ve Kadastro Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce fiili kullan\u0131m durumlar\u0131 dikkate al\u0131nmak suretiyle ifraz ve\/veya tevhit de yap\u0131labilir\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. Orman rejimi d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lan alanlarda, fiili kullan\u0131m durumlar\u0131na g\u00f6re ifraz i\u015flemlerinin yap\u0131lmas\u0131 bundan sonraki ad\u0131m\u0131n sat\u0131\u015f olaca\u011f\u0131n\u0131 \u015fimdiden g\u00f6stermektedir. <\/p>\n<p align=\"justify\">\u00d6nceki y\u0131l g\u00fcndeme getirilen anayasa tasla\u011f\u0131nda, ormanlar\u0131m\u0131z\u0131n \u00f6zelle\u015ftirilmesi ve bu \u015fekilde b\u00fct\u00e7eye kaynak sa\u011flayaca\u011f\u0131 y\u00f6n\u00fcndeki zihniyetin varl\u0131\u011f\u0131 ile 2\/B alanlar\u0131n\u0131n sat\u0131\u015f\u0131na olanak verecek \u015fekilde d\u00fczenlemelerin yap\u0131ld\u0131\u011f\u0131 unutulmamal\u0131d\u0131r.<\/p>\n<p align=\"justify\">15.01.2009 tarihli (5831 say\u0131l\u0131 kanun) son d\u00fczenlemenin d\u0131\u015f\u0131nda orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lan alanlara y\u00f6nelik olarak siyasal iktidar taraf\u0131ndan y\u00fcr\u00fct\u00fclen ba\u015fka bir yasa \u00e7al\u0131\u015fmas\u0131 asl\u0131nda ger\u00e7ek yakla\u015f\u0131mlar\u0131 da ortaya koymaktad\u0131r. Taslak s\u00fcrecinde olan bu \u00e7al\u0131\u015fma ile \u201c2924 say\u0131l\u0131 Orman K\u00f6yl\u00fclerinin Kalk\u0131nmalar\u0131n\u0131n Desteklenmesi Hakk\u0131nda Kanun\u201d y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131larak yerine \u201cOrman K\u00f6yl\u00fclerinin Kalk\u0131nd\u0131r\u0131lmalar\u0131 ve Hazine ad\u0131na Orman S\u0131n\u0131rlar\u0131 D\u0131\u015f\u0131na \u00c7\u0131kar\u0131lan Yerlerin De\u011ferlendirilmesi Hakk\u0131nda Kanun\u201d \u015feklinde bir d\u00fczenlemeye gidilmektedir. <\/p>\n<p align=\"justify\">Orman alanlar\u0131n\u0131n bilim ve fen bak\u0131m\u0131ndan orman vasf\u0131n\u0131 yitirerek orman d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lmalar\u0131n\u0131n \u00f6n\u00fc kesilmesi gerekirken tam tersine farkl\u0131 ama\u00e7lar ve sekt\u00f6rler ad\u0131na i\u015fgal edilerek \u00f6zel m\u00fclkiyete ge\u00e7irilmesi, yerli veya yabanc\u0131lara sat\u0131larak b\u00fct\u00e7eye gelir sa\u011flanmas\u0131 vb. y\u00f6n\u00fcnde s\u00fcrekli giri\u015fimler yap\u0131lmaktad\u0131r. Bu ama\u00e7la anayasa ve yasa de\u011fi\u015fikliklerine gidilmektedir. <\/p>\n<p><strong><\/p>\n<p align=\"justify\">Orman K\u00f6yl\u00fcleri ve Orman D\u0131\u015f\u0131 Alanlara Dair Yasa Tasar\u0131s\u0131 Tasla\u011f\u0131nda; <\/p>\n<p><\/strong><\/p>\n<p align=\"justify\">&#8211; 6831 say\u0131l\u0131 yasan\u0131n 2\/A maddesine g\u00f6re Hazine ad\u0131na orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan yerlerin \u00c7evre ve Orman Bakanl\u0131\u011f\u0131, 2\/B maddesine g\u00f6re Hazine ad\u0131na orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan yerlerin de\u011ferlendirilmek \u00fczere Maliye Bakanl\u0131\u011f\u0131 emrine verilmeleri,<\/p>\n<p align=\"justify\">&#8211; 2\/B alanlar\u0131n\u0131n; fiili kullan\u0131m durumlar\u0131, kullan\u0131m \u015fekli ve kullan\u0131c\u0131lar\u0131n isimlerinin kadastro tutana\u011f\u0131n\u0131n beyanlar hanesinde g\u00f6sterilmek suretiyle \u00f6ncelikli kadastro yap\u0131larak Hazine ad\u0131na tescil edilmeleri, <\/p>\n<p align=\"justify\">&#8211; 2\/A alanlar\u0131n\u0131n \u0131slah, imar ve ihya edilmesi, tar\u0131msal i\u015fletme ve yerle\u015fim planlar\u0131 dahilinde Orman i\u00e7i k\u00f6yler halk\u0131n\u0131n bu alanlara yerle\u015ftirilmesi, devredilecek ta\u015f\u0131nmaz\u0131n bedelinin mevcut k\u00f6y i\u00e7inde kalan ta\u015f\u0131nmazlar i\u00e7in belirlenen rayi\u00e7 bedelleri \u00fczerinden mahsup edilmesi, bedel fazla ise pe\u015fin yada taksitli bu bedelin tahsil edilmesi, yirmi y\u0131l da\u011f\u0131t\u0131m amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lmamas\u0131, vb. h\u00fck\u00fcmler \u00e7er\u00e7evesinde yerle\u015ftirilen ta\u015f\u0131nmaz\u0131n <strong>m\u00fclkiyetinin hak sahibi ad\u0131na tapuya tescil <\/strong>edilmesi,<\/p>\n<p align=\"justify\">&#8211; 2\/B alanlar\u0131ndan hak sahibi olarak yararlanmak i\u00e7in ba\u015fvuruda bulunanlardan daha sonra sat\u0131\u015f bedelinden d\u00fc\u015f\u00fclmek \u00fczere 10 bin TL&#8217;ye kadar ba\u015fvuru bedeli al\u0131nmas\u0131,<\/p>\n<p align=\"justify\">&#8211; 2\/B alanlar\u0131n\u0131n belediye ve m\u00fccavir alan s\u0131n\u0131r\u0131 ile k\u00f6y yerle\u015fik s\u0131n\u0131rlar\u0131 i\u00e7erisinde ise 31.12.2007 tarihinden \u00f6nce be\u015f y\u0131l s\u00fcreyle yerle\u015fim yeri, bu alanlar\u0131n d\u0131\u015f\u0131nda ise ayn\u0131 s\u00fcreyle tarla, ba\u011f, bah\u00e7e, meyvelik, zeytinlik, f\u0131nd\u0131kl\u0131k, f\u0131st\u0131kl\u0131k gibi \u00e7e\u015fitli tar\u0131msal ama\u00e7larla kullan\u0131lm\u0131\u015f olmas\u0131,<\/p>\n<p align=\"justify\">&#8211; \u00dczerinde yap\u0131la\u015fma olan ta\u015f\u0131nmazlardan 400m2&#8217;ye kadar olanlar\u0131n tamam\u0131, \u00fczerindeki yap\u0131lan bu miktardan daha fazla ise yap\u0131n\u0131n taban alan\u0131 kadar, sulu alanlarda 40.000 m2, kuru alanlarda 100.000 m2&#8217;ye kadar tar\u0131m arazilerinin kullan\u0131c\u0131lar\u0131na sat\u0131lmas\u0131,<\/p>\n<p align=\"justify\">&#8211; Tar\u0131m alanlar\u0131 d\u0131\u015f\u0131nda kalan, \u00fczerinde yap\u0131la\u015fma bulunan ve Maliye Bakanl\u0131\u011f\u0131nca uygun g\u00f6r\u00fclen 2\/B alanlar\u0131n\u0131n Toplu Konut \u0130daresi Ba\u015fkanl\u0131\u011f\u0131\u2019na devredilmesi, devir bedellerinin 1319 say\u0131l\u0131 Emlak Vergisi Kanununa g\u00f6re belirlenen asgari m2 birim fiyat\u0131 \u00fczerinden yap\u0131lmas\u0131, TOK\u0130&#8217;nin devrald\u0131\u011f\u0131 ta\u015f\u0131nmazlar\u0131 kendi mevzuat\u0131na g\u00f6re de\u011ferlendirmesi,<\/p>\n<p align=\"justify\">&#8211; 2\/B alanlar\u0131ndan bo\u015f olan yani i\u015fgal edilmeyen alanlar\u0131n Maliye Bakanl\u0131\u011f\u0131 genel h\u00fck\u00fcmlerine g\u00f6re i\u015flem g\u00f6rmesi,<\/p>\n<p align=\"justify\">&#8211; 2\/B alanlar\u0131ndan daha \u00f6nce da\u011f\u0131t\u0131lan \u00f6zelle\u015ftirme kapsam\u0131nda sat\u0131lanlar ge\u00e7erli say\u0131lmakla birlikte, a\u00e7\u0131lan davalar sonucunda hazine ad\u0131na tescil edilenlerin \u00f6nceki kullan\u0131c\u0131lar\u0131na bedelsiz iade edilmesi, kanuna g\u00f6re yap\u0131lacak i\u015flemler sonu\u00e7lan\u0131ncaya kadar Hazine taraf\u0131ndan ki\u015filer aleyhine a\u00e7\u0131lmas\u0131 gerekli davalar\u0131n a\u00e7\u0131lmamas\u0131 gibi bir\u00e7ok h\u00fck\u00fcm yer almaktad\u0131r.<\/p>\n<p align=\"justify\">Yasa Tasar\u0131 Tasla\u011f\u0131nda da \u00f6zetle g\u00f6r\u00fclece\u011fi \u00fczere 2\/B alanlar\u0131 g\u00f6zden \u00e7\u0131kar\u0131lmaktad\u0131r. Konunun bilimsel ve teknik, kamusal ve toplumsal, hukuksal ve ekolojik boyutlar\u0131n\u0131n son derece \u00f6nemli oldu\u011fu bilinci i\u00e7erisinde de\u011ferlendirilmesi gerekmektedir.<\/p>\n<p><strong><\/p>\n<p align=\"justify\">Dolay\u0131s\u0131yla; \u00f6ncelikle<\/p>\n<p align=\"justify\">&#8211; Orman alanlar\u0131n\u0131n orman rejimi ve s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lma i\u015flemlerine olanak veren t\u00fcm yasal d\u00fczenlemeler ivedilikle mevzuattan \u00e7\u0131kar\u0131lmal\u0131d\u0131r.<\/p>\n<p><\/strong><\/p>\n<p align=\"justify\">&#8211; 21.19 milyon hektar oldu\u011fu belirtilen orman alanlar\u0131n\u0131n kadastrosu yap\u0131lmal\u0131, tapuda tescil i\u015flemleri tamamlanmal\u0131 ve bilgi sistemleri kurulmal\u0131d\u0131r.<\/p>\n<p align=\"justify\">&#8211; 1983 y\u0131l\u0131nda \u00e7\u0131kart\u0131lan \u201c2924 Say\u0131l\u0131 Orman K\u00f6yl\u00fclerinin Kalk\u0131nmalar\u0131n\u0131n Desteklenmesi Hakk\u0131nda Kanun\u201d kapsam\u0131nda Orman d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lan alanlara yerle\u015ftirilen Orman i\u00e7i k\u00f6y ve k\u00f6y halk\u0131 say\u0131s\u0131 nedir? Bu bilgiler kamuoyu ile payla\u015f\u0131lm\u0131\u015f m\u0131d\u0131r?<\/p>\n<p align=\"justify\">&#8211; AB&#8217;ye uyum \u00e7er\u00e7evesinde hayvanc\u0131l\u0131k ve tar\u0131m alanlar\u0131nda k\u00fc\u00e7\u00fclme politikas\u0131na y\u00f6nelik programlar olu\u015fturularak \u00fcretimden uzakla\u015f\u0131lmakta, ba\u015fta orman k\u00f6yl\u00fcleri olmak \u00fczere bu yerle\u015fim yerlerinden kentlere zorunlu g\u00f6\u00e7ler ya\u015fanmaktad\u0131r. Orman i\u00e7i k\u00f6yler halk\u0131n\u0131n \u00f6zellikle Anayasam\u0131z\u0131n 169 ve 170. maddeleri kapsam\u0131nda orman d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lan alanlara yerle\u015ftirilmeleri konusunda neler yap\u0131lmal\u0131, hangi destekler verilmelidir?<\/p>\n<p align=\"justify\">&#8211; Bu d\u00fczenlemenin 2\/B alanlar\u0131ndaki i\u015fgalcilere t\u0131pk\u0131 1986 y\u0131l\u0131nda \u00e7\u0131kart\u0131lan imar aff\u0131n\u0131 \u00e7a\u011fr\u0131\u015ft\u0131racak benzer bir \u201caf\u201d niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131 g\u00f6r\u00fclmekte olup, bu yakla\u015f\u0131m kamu vicdan\u0131n\u0131 d\u00fcn oldu\u011fu gibi bug\u00fcn de yaralamaktad\u0131r. Yapan\u0131n yan\u0131na kar kald\u0131\u011f\u0131 mant\u0131\u011f\u0131 bir kez daha kendini kabul ettirmektedir. <\/p>\n<p align=\"justify\">&#8211; Bir taraftan i\u015fgalciler af edilirken di\u011fer taraftan TOK\u0130&#8217;ye bu yerlerin devri beraberinde bir tak\u0131m sorular\u0131 da g\u00fcndeme getirmektedir. TOK\u0130&#8217;ye 5793 say\u0131l\u0131 kanunla imar yetkisinin verilmesiyle birlikte, \u015fimdi de bu alanlar \u00fczerinde m\u00fclkiyet hakk\u0131n\u0131n tan\u0131nmas\u0131 sonucu \u00fclke ve kent \u00f6l\u00e7e\u011findeki planlamadan ayr\u0131 par\u00e7ac\u0131 yakla\u015f\u0131mlarla bir planlama d\u00f6nemi mi yarat\u0131lmak istenilmektedir?<\/p>\n<p align=\"justify\">&#8211; Yasa tasar\u0131s\u0131 tasla\u011f\u0131nda 2B alanlar\u0131ndan bo\u015f olan alanlar\u0131n Maliye Bakanl\u0131\u011f\u0131n\u0131n genel h\u00fck\u00fcmlerine g\u00f6re de\u011ferlendirilmesinin anlam\u0131 nedir? K\u0131saca bu alanlar t\u0131pk\u0131 hazineye ait di\u011fer alanlar gibi yerli ve yabanc\u0131 sermayeye sat\u0131labilir anlam\u0131 m\u0131 ta\u015f\u0131yor?<\/p>\n<p align=\"justify\">&#8211; Ya\u015fam alanlar\u0131m\u0131zla birlikte gelece\u011fimiz yok edilirken bu yakla\u015f\u0131m nas\u0131l toplum ve kamu yarar\u0131 say\u0131labilmektedir? <\/p>\n<p align=\"justify\">&#8211; Ormanlar\u0131n anayasa h\u00fck\u00fcmlerine g\u00f6re g\u00f6zetilmesi, korunmas\u0131 ve geli\u015ftirilmesi devlete ait oldu\u011funa g\u00f6re bu alanlar\u0131n Turizmi Te\u015fvik Kanunu, \u00d6zelle\u015ftirme, Do\u011frudan Yabanc\u0131 Yat\u0131r\u0131mlar kanunlar\u0131 gibi yasa d\u00fczenlemeleriyle elden \u00e7\u0131kar\u0131lmas\u0131, Anayasa Mahkemesi taraf\u0131ndan tan\u0131mlanan kamu yarar\u0131 ilkesi ile ne \u00f6l\u00e7\u00fcde \u00f6rt\u00fc\u015fmektedir?<\/p>\n<p align=\"justify\">&#8211; 1937&#8217;den bu yana 80 bin orman yang\u0131n\u0131 \u00e7\u0131km\u0131\u015f ve 1.6 milyon hektar orman alan\u0131 yanm\u0131\u015ft\u0131r. 1985&#8217;ten g\u00fcn\u00fcm\u00fcze \u00e7\u0131kan orman yang\u0131n\u0131 sonucu ise 242 bin hektar orman alan\u0131 yanm\u0131\u015f, ancak yasada tamam\u0131n\u0131n ormana geri kazand\u0131r\u0131lmas\u0131 h\u00fckm\u00fc yer almas\u0131na kar\u015f\u0131n sadece %17&#8217;sinde bu i\u015flem yap\u0131labilmi\u015ftir. Bu s\u00fcre\u00e7 neden sorgulanmamaktad\u0131r, yoksa bu alanlar ba\u015fka ama\u00e7lar i\u00e7in mi bekletilmektedir? Dolay\u0131s\u0131yla, yasa tasar\u0131s\u0131 tasla\u011f\u0131nda belirtilen a\u011fa\u00e7land\u0131rma ve ormana geri kazand\u0131rma ifadeleriyle neyin hedeflendi\u011fi merak konusudur.<\/p>\n<p align=\"justify\">&#8211; \u00d6zellikle 1980 y\u0131l\u0131ndan itibaren neo-liberal politikalar do\u011frultusunda haz\u0131rlanan programlar siyasal iktidarlarca ad\u0131m ad\u0131m hayata ge\u00e7irilmektedir. AB, IMF, D\u00fcnya Bankas\u0131 ve D\u00fcnya Ticaret \u00d6rg\u00fct\u00fc taraf\u0131ndan istenilen yap\u0131sal de\u011fi\u015fiklikler sonucu yasal d\u00fczenlemelerle gelinen noktada \u00fcretim ekonomisinden uzak rant ekonomisine ve kamu varl\u0131klar\u0131n\u0131n sat\u0131\u015f\u0131na dayal\u0131 gelirler kapsam\u0131na \u015fimdi de 2\/B arazileri eklenmek istenilmektedir. <\/p>\n<p align=\"justify\">&#8211; 29 Mart 2009&#8217;da yap\u0131lacak yerel se\u00e7imlerde b\u00f6yle bir \u00e7\u0131k\u0131\u015f ile destek aranmas\u0131 ve 2\/B alanlar\u0131n\u0131n g\u00f6zden \u00e7\u0131kar\u0131lmas\u0131yla imar aflar\u0131na benzer bir politika izlendi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p align=\"justify\">Orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lan yerler hakk\u0131nda yap\u0131lan ve yap\u0131lmas\u0131 planlanan yasa de\u011fi\u015fiklikleri, anayasan\u0131n 169 ve 170 inci maddeleri birlikte de\u011ferlendirildi\u011finde ve anayasa mahkemesinin son olarak 23.01.2002 tarih 2001\/382 E. 2002\/21 say\u0131l\u0131 karar\u0131ndaki \u201c..<em>Orman s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan yerlerin yaln\u0131zca Orman k\u00f6yleri halk\u0131n\u0131n nakli ve yerle\u015ftirilmesi amac\u0131yla de\u011ferlendirilmesinin olanakl\u0131 oldu\u011fu, <strong>Anayasan\u0131n bu emredici kural\u0131 nedeniyle yasa koyucunun, bu alanlar\u0131n kullan\u0131c\u0131lar\u0131na veya ba\u015fkalar\u0131na, hatta Orman i\u00e7i k\u00f6yler halk\u0131na sat\u0131lmas\u0131n\u0131 veya bu ama\u00e7la devredilmesini sa\u011flayacak bir d\u00fczenleme yapmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131; bu nedenle Hazine ad\u0131na Orman S\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lan yerlerin sat\u0131\u015f\u0131 ve bu ama\u00e7la devrini d\u00fczenleyen Maddenin Anayasaya ayk\u0131r\u0131 bulundu\u011fu\u201d<\/strong><\/em> gerek\u00e7esine bak\u0131ld\u0131\u011f\u0131nda bu d\u00fczenlemelerin hukuk y\u00f6n\u00fcnden dayanaktan yoksun olaca\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p align=\"justify\">Haz\u0131rlanan bu yasa tasar\u0131s\u0131 tasla\u011f\u0131 da ne 2\/B alanlar\u0131n\u0131n kamu yarar\u0131nda kullan\u0131lmas\u0131na ne de 2\/A maddesi ile orman i\u00e7i k\u00f6yler halk\u0131n\u0131n kalk\u0131nmas\u0131na hizmet etmektedir. 2\/B alanlar\u0131n\u0131n sat\u0131larak b\u00fct\u00e7eye ek kazan\u00e7 sa\u011flayaca\u011f\u0131 anlay\u0131\u015f\u0131 art\u0131k terk edilmelidir.473 bin hektar oldu\u011fu ifade edilen 2\/B alanlar\u0131 bilimsel ve teknik \u00e7al\u0131\u015fmalarla belirlenmeli, bu alanlar\u0131n kadastrosu ve tapu tescili yap\u0131lmal\u0131d\u0131r. Bu tespitten sonra arazi koruma, kullanma planlamalar\u0131 ivedilikle ger\u00e7ekle\u015ftirilmelidir.
