{"id":8298,"date":"2014-02-03T14:02:27","date_gmt":"2014-02-03T12:02:27","guid":{"rendered":"http:\/\/politeknik.org.tr\/\/?p=8298"},"modified":"2019-01-28T18:33:51","modified_gmt":"2019-01-28T15:33:51","slug":"ulkemizde-is-sagligi-ve-guvenligi-alaninda-ilk-yilinda-osgb-gercekleri-izmir-tabip-odasi","status":"publish","type":"post","link":"https:\/\/eonmeet.com\/pol\/ulkemizde-is-sagligi-ve-guvenligi-alaninda-ilk-yilinda-osgb-gercekleri-izmir-tabip-odasi\/","title":{"rendered":"\u00dclkemizde \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Alan\u0131nda \u0130lk Y\u0131l\u0131nda OSGB Ger\u00e7ekleri &#8211; \u0130zmir Tabip Odas\u0131"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>\u0130zmir Tabip Odas\u0131<\/strong><br \/>\n<strong>\u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015fyeri Hekimli\u011fi Komisyonu<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>\u00dclkemizde \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Alan\u0131nda\u00a0<\/strong><strong>\u0130lk Y\u0131l\u0131nda OSGB Ger\u00e7ekleri<\/strong><\/p>\n<p>\u00dclkemizde b\u00fcy\u00fck umutlarla \u00e7\u0131kar\u0131lan \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Yasas\u0131n\u0131n bir\u00e7ok maddesi 2013 ba\u015f\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe girdi ve 2014&#8217;e girdi\u011fimiz bu g\u00fcnlerde bu yasan\u0131n en \u00f6nemli unsurlar\u0131ndan biri olan OSGB\u2019lerin 1 y\u0131ll\u0131k deneyimlerini t\u00fcm \u00e7\u0131plakl\u0131\u011f\u0131 ile kamuoyu ile payla\u015fmaya ba\u015fl\u0131yoruz.<\/p>\n<p>OSGB (Ortak Sa\u011fl\u0131k ve G\u00fcvenlik Birimi) ad\u0131 verilen d\u0131\u015far\u0131dan hizmet sat\u0131n al\u0131nmas\u0131 modeli asl\u0131nda daha \u00f6nce \u00e7\u0131kar\u0131lan torba yasalarla \u00fclkemizde k\u0131s\u0131tl\u0131 olarak denenmeye ba\u015flam\u0131\u015ft\u0131 ancak \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Yasas\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girmesi ile son bir y\u0131lda OSGB&#8217;lerde adeta patlama ya\u015fand\u0131.<\/p>\n<p>Son bir y\u0131lda ya\u015fanan OSGB ger\u00e7ekleri;<\/p>\n<p style=\"text-align: center;\"><strong>A) OSGB&#8217;LER\u0130N HAK\u0130M\u0130YET\u0130<\/strong><\/p>\n<p><strong>1.\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fini rant alan\u0131 haline getirdiler:<\/strong><\/p>\n<p>\u0130\u015f kazalar\u0131n\u0131n ve meslek hastal\u0131klar\u0131n\u0131n \u00f6nlenmesi i\u00e7in ciddi \u00e7al\u0131\u015fmalar yap\u0131lmas\u0131 gereken alan\u0131; yeni \u0130S\u0130G yasas\u0131n\u0131n getirdi\u011fi r\u00fczgar ile k\u0131sa zamanda b\u00fcy\u00fck paralar kazanmay\u0131 ama\u00e7layan \u015firketler hi\u00e7 bir kural tan\u0131mayan ticari sava\u015f alan\u0131 haline getirdiler.<\/p>\n<p><strong>2.Hi\u00e7bir sekt\u00f6rde g\u00f6r\u00fclmeyecek \u00f6l\u00e7\u00fcde mantar gibi \u00e7o\u011fald\u0131lar:<\/strong><\/p>\n<p>Yeni ISIG yasas\u0131 ve \u00c7al\u0131\u015fma bakanl\u0131\u011f\u0131n\u0131n her t\u00fcrl\u00fc kolayl\u0131\u011f\u0131 g\u00f6stermesi ile k\u0131sa zamanda b\u00fcy\u00fck bir ivme ile \u00e7ok say\u0131da OSGB kuruldu. Son say\u0131lara g\u00f6re 1037 adet OSGB kuruldu;<br \/>\n-Ankara\u2019da 108 adet \u015firket kuruldu<br \/>\n-\u0130stanbul\u2019da 270 adet \u015firket kuruldu<br \/>\n-\u0130zmir\u2019de 63 adet \u015firket kuruldu<br \/>\n-Kocaeli\u2019nde58 adet \u015firket kuruldu<\/p>\n<p><strong>3.\u0130\u015f d\u00fcnyas\u0131n\u0131 b\u00fcy\u00fck para cezalar\u0131 ile korkuttular:<\/strong><\/p>\n<p>Yeni \u0130S\u0130G yasas\u0131n\u0131n getirdi\u011fi astronomik \u00f6l\u00e7\u00fcde y\u00fcksek para cezalar\u0131 ile i\u015fverenler tedirgin edildi. Bu para cezalar\u0131ndan kurtulman\u0131n tek yolunun OSGB&#8217;lerden hizmet al\u0131nmas\u0131 oldu\u011fu propagandas\u0131 aylarca yap\u0131ld\u0131. Bu propagandaya baz\u0131 medya organlar\u0131 ve yazarlar\u0131 da bilmeden alet oldu.<\/p>\n<p><strong>4.Etik \u00e7al\u0131\u015fmayan-K\u0131rm\u0131z\u0131 OSGB&#8217;ler piyasaya hakim oldu:<\/strong><\/p>\n<p>K\u0131sa zamanda \u00e7ok say\u0131da OSGB kurulmas\u0131 nedeniyle OSGB&#8217;lerin co\u011funlu\u011fu \u015firketleri ele ge\u00e7irmek i\u00e7in etik olmayan davran\u0131\u015flar i\u00e7ine girdiler. K\u0131rm\u0131z\u0131 OSGB denen bu \u015firketler piyasan\u0131n % 70&#8217;ine hakim duruma geldiler. (Bak\u0131n\u0131z ekte-K\u0131rm\u0131z\u0131 OSGB nedir?-Ye\u015fil OSGB nedir?)<\/p>\n<p><strong>5.\u0130S\u0130G \u00e7al\u0131\u015fan\u0131 k\u0131y\u0131m\u0131 ya\u015fatt\u0131lar-y\u00fczlerce \u0130S\u0130G \u00e7al\u0131\u015fan\u0131 i\u015ften at\u0131ld\u0131:<\/strong><\/p>\n<p>Yeni \u0130S\u0130G yasas\u0131 i\u015fyerlerinin kendi b\u00fcnyesinde i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131 \u00e7al\u0131\u015fmas\u0131na olanak verdi\u011fi halde K\u0131rm\u0131z\u0131 OSGB&#8217;lerin menfi propagandalar\u0131, agresif fiyat politikalar\u0131 y\u00fcz\u00fcden i\u015fyerleri b\u00fcnyelerinde \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 hekimleri ve uzmanlar\u0131 i\u015ften \u00e7\u0131kar\u0131p OSGB&#8217;lerden hizmet almaya ba\u015flad\u0131lar. \u0130\u015ften \u00e7\u0131kar\u0131lanlar\u0131n tam say\u0131lar\u0131n\u0131 tespit etmek m\u00fcmk\u00fcn olmamakla birlikte bine yak\u0131n oldu\u011fu tahmin ediliyor.<\/p>\n<p><strong>6.Zincir OSGB&#8217;ler OSGB sava\u015flar\u0131 ba\u015flatt\u0131:<\/strong><\/p>\n<p>OSGB&#8217;lerin bir\u00e7ok \u015fehirde \u015fube a\u00e7maya ba\u015flamas\u0131 ile b\u00fcy\u00fck sermaye gruplar\u0131, hastane zincirleri de bu alana girmeye ba\u015flad\u0131lar. Alana d\u00fczen getirmesi beklenirken bu zincirlerin \u015fubeleri ne yaz\u0131k ki etik kayg\u0131dan uzak k\u0131rm\u0131z\u0131 OSGB&#8217;lerin en ba\u015fta gelenleri olmaya ba\u015flad\u0131. OSGB&#8217;ler aras\u0131 sava\u015f daha geni\u015f cephelere yay\u0131ld\u0131. Fiyatlar ve kalite daha da d\u00fc\u015ft\u00fc.<\/p>\n<p style=\"text-align: center;\"><strong>B) OSGB&#8217;LER VE \u0130\u015eYERLER\u0130<\/strong><\/p>\n<p><strong>1.En ucuza biz yapar\u0131z y\u00f6ntemi ile ucuzcu i\u015fyerleri ele ge\u00e7irildi:<\/strong><\/p>\n<p>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi gibi ya\u015famsal \u00f6neme sahip bir alanda ucuzcu i\u015fyerleri denen i\u015fyerlerine yaz\u0131k ki en ucuza teklif veren k\u0131rm\u0131z\u0131 OSGB&#8217;ler taraf\u0131ndan<br \/>\nele ge\u00e7irildi. Hi\u00e7bir etik kayg\u0131 duymayan k\u0131rm\u0131z\u0131 OSGB&#8217;ler b\u00fcnyelerinde hekim ve uzman \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerine inan\u0131lmaz ucuz teklifler vererek y\u00fczlerce ISIG<br \/>\npersonelinin i\u015ften at\u0131lmas\u0131na neden oldular.<\/p>\n<p>-\u00c7al\u0131\u015fan ba\u015f\u0131na 5 TL ye i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131 hizmeti (10 ki\u015fi \u00e7al\u0131\u015fan i\u015fyerine 50 TL) teklifine kadar fiyatlar\u0131 indirdiler<\/p>\n<p><strong>2.\u00dclkemizin b\u00fcy\u00fck kurumsal firmalar\u0131 k\u0131rm\u0131z\u0131 OSGB&#8217;lere kanmad\u0131lar:<\/strong><\/p>\n<p>\u00dclkemizin b\u00fcy\u00fck kurumsal firmalar\u0131, ISIG yasas\u0131n\u0131 bilin\u00e7li \u015fekilde yorumlay\u0131p kendi b\u00fcnyelerinde ISGB (\u0130\u015fyeri Sa\u011fl\u0131k ve G\u00fcvenlik Birimleri) kurdular.<\/p>\n<p>Kendi personeli olan i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131 \u00e7al\u0131\u015ft\u0131rmaya devam ediyorlar. D\u0131\u015fardan ta\u015f\u0131ma suyla de\u011firmen ta\u015f\u0131 d\u00f6nd\u00fcrmeye u\u011fra\u015fm\u0131yorlar. Yani d\u0131\u015fardan hizmet alm\u0131yorlar. K\u0131sacas\u0131 k\u0131rm\u0131z\u0131 OSGB&#8217;lere kanmad\u0131lar.<\/p>\n<p><strong>3. Bilin\u00e7li insan kaynaklar\u0131 y\u00f6netimi neden OSGB&#8217;leri benimsemiyor?:<\/strong><\/p>\n<p>Bilin\u00e7li insan kaynaklar\u0131\/personel b\u00f6l\u00fcmleri i\u015fyeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131n\u0131 b\u00fcnyesinde \u00e7al\u0131\u015ft\u0131rman\u0131n maliyetlerini \u00e7ok a\u00e7\u0131dan \u00e7al\u0131\u015farak iyi analiz ederler. D\u0131\u015far\u0131dan hizmet al\u0131m\u0131n\u0131n maliyetinin ucuz olmas\u0131 bir cazibe unsuru de\u011fildir. Hizmetin niteli\u011fi, ayr\u0131lan zaman, \u015firket bilgilerinin d\u0131\u015farda bir \u015firkete gitmesi gibi say\u0131s\u0131z bir\u00e7ok veri ayr\u0131nt\u0131l\u0131 i\u015flenip karar verildi\u011finde OSGB&#8217;lerin tercih edilmesi m\u00fcmk\u00fcn de\u011fildir.\u00a0Nitekim bu konuda bir\u00e7ok deneyimli insan kaynaklar\u0131 uzmanlar\u0131 bu konuda olumsuz g\u00f6r\u00fc\u015f belirtmektedir.<\/p>\n<p style=\"text-align: center;\"><strong>C) OSGB&#8217;LER VE \u0130S\u0130G H\u0130ZMETLER\u0130<\/strong><\/p>\n<p><strong>1. OSGB&#8217;ler artmas\u0131na ra\u011fmen \u00fclkemizde i\u015f kazalar\u0131 azalm\u0131yor:<\/strong><\/p>\n<p>OSGBlerin say\u0131lar\u0131n\u0131n mantar gibi artmas\u0131na ra\u011fmen \u00fclkemizde i\u015f kazalar\u0131 hala azalm\u0131yor. \u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131 OSGB&#8217;lerin hizmet verdi\u011fi i\u015fyerlerinde i\u015f kazalar\u0131 azald\u0131 m\u0131-artt\u0131 m\u0131 hi\u00e7bir bilgi vermiyor. Bu konuda a\u00e7\u0131klama merakla bekleniyor. Ancak \u00e7ok ucuza hizmet kalitesiz \u0130S\u0130G hizmetini beraberinde getirdi\u011fi i\u00e7in i\u015f kazalar\u0131n\u0131n azalmas\u0131 ne yaz\u0131k ki bir hayal.<\/p>\n<p><strong>2. OSGB&#8217;ler artmas\u0131na ra\u011fmen \u00fclkemizde meslek hastal\u0131klar\u0131 tespiti hala yok:<\/strong><\/p>\n<p>OSGB&#8217;lerin say\u0131lar\u0131n\u0131n mantar gibi artmas\u0131na ra\u011fmen \u00fclkemizde meslek hastal\u0131klar\u0131 tespiti halen yok. B\u00fcy\u00fck umutlar ba\u011flanan OSGB \u015firketlerinin meslek hastal\u0131klar\u0131 konusunda ne gibi olumlu \u00e7al\u0131\u015fmalar yapt\u0131\u011f\u0131 bilinmiyor. Ancak bu konudaki bir g\u00f6sterge olan meslek hastal\u0131\u011f\u0131 tespiti halen s\u0131f\u0131r.<\/p>\n<p><strong>3. OSGB&#8217;ler i\u015f kazas\u0131z b\u00fcy\u00fck \u015firketlere odaklan\u0131yor:<\/strong><\/p>\n<p>\u00dclkemizde i\u015f kazalar\u0131n\u0131n % 80\u2019i 50&#8217;nin alt\u0131nda i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerinde ger\u00e7ekle\u015fiyor. Ne yaz\u0131k ki OSGB&#8217;lerin bu \u015firketleri al\u0131p i\u015f kazalar\u0131n\u0131 azaltal\u0131m kayg\u0131s\u0131 yok. K\u0131rm\u0131z\u0131 OSGB&#8217;ler zaten i\u015f kazalar\u0131n\u0131n az oldu\u011fu-b\u00fcy\u00fck \u015firketlerin pe\u015findeler. Nedeni de bu b\u00fcy\u00fck i\u015fyerlerine hizmet vermek daha kazan\u00e7l\u0131. Kim u\u011fra\u015f\u0131r k\u00fc\u00e7\u00fck \u015firketlerle-riskli \u015firketlerle. Kim u\u011fra\u015f\u0131r k\u00fc\u00e7\u00fck \u015firketlerde i\u015f kazalar\u0131n\u0131 azaltmakla ?<\/p>\n<p><strong>4.OSGB&#8217;lerin part-time\/p\u0131rt-time i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmeti:<\/strong><\/p>\n<p>K\u0131rm\u0131z\u0131 OSGB ler yeni yasa ve y\u00f6netmeliklerin izin verdi\u011fi inan\u0131lmaz k\u0131sa \u00e7al\u0131\u015fma s\u00fcreleri sayesinde i\u015fyerlerine sadece \u015f\u00f6yle bir u\u011fruyorlar. B\u00fcnyesinde<br \/>\ni\u015fyeri hekimi-i\u015f g\u00fcvenli\u011fi uzman\u0131 \u00e7al\u0131\u015ft\u0131ran i\u015fyerleri s\u00fcreler a\u00e7\u0131s\u0131ndan daha rahatlar. Ancak OSGB&#8217;ler dakikalarla \u00f6l\u00e7\u00fclen zamanlarda i\u015fyerlerine ayda bir veya 15 g\u00fcnde bir u\u011fruyorlar. Bu durumdan i\u015fyeleri de \u015fikayet\u00e7i.<\/p>\n<p>-\u00e7al\u0131\u015fan ba\u015f\u0131na 4 dakika \/ ayda (Az tehlikeli i\u015fyerlerinde)<br \/>\n-\u00e7al\u0131\u015fan ba\u015f\u0131na 6 dakika \/ ayda (Tehlikeli i\u015fyerlerinde)<br \/>\n-\u00e7al\u0131\u015fan ba\u015f\u0131na 8 dakika \/ ayda (\u00c7ok tehlikeli i\u015fyerlerinde)<\/p>\n<p><strong>5.OSGB&#8217;lerin i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerinin niteli\u011fi:<\/strong><\/p>\n<p>K\u0131rm\u0131z\u0131 OSGB&#8217;ler ucuza teklifler vererek ald\u0131klar\u0131 \u00e7ok say\u0131da i\u015fyerine az say\u0131da ISIG \u00e7al\u0131\u015fan\u0131 ile yeti\u015fmeye \u00e7al\u0131\u015farak i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetlerinin niteli\u011fini d\u00fc\u015f\u00fcrmektedirler;<\/p>\n<p>-Copy-paste risk analizi yapmak (kopya)<br \/>\n-G\u00f6rmeden gitmeden risk analizi yapmak<br \/>\n-G\u00f6rmeden acil durum planlar\u0131 haz\u0131rlama<br \/>\n-Toplanm\u0131\u015f gibi g\u00f6sterilen ISIG kurullar\u0131<br \/>\n-4 dakikada i\u015fe giri\u015f muayeneleri<br \/>\n-Yap\u0131lm\u0131\u015f g\u00f6sterilen peryodik muayeneler<br \/>\n-\u0130\u015f kazalar\u0131n\u0131n saklanmas\u0131<br \/>\n-Olmayan e\u011fitimlerin kay\u0131tlar\u0131<\/p>\n<p><strong>6. Bakanl\u0131\u011f\u0131n OSGB denetlemeleri yetersiz:<\/strong><\/p>\n<p>\u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131 OSGB denetimlerini yasa ve y\u00f6netmeliklerdeki maddelere g\u00f6re yapmaya \u00e7al\u0131\u015f\u0131yor. Ancak say\u0131s\u0131 bini ge\u00e7en OSGBlerin yeterli denetlenebildi\u011fini s\u00f6ylemek g\u00fc\u00e7. \u00d6rne\u011fin: bakanl\u0131k taraf\u0131ndan yetki belgesi ge\u00e7erlili\u011fi iptal edilmi\u015f OSGB say\u0131s\u0131 sadece 12 dir. Ayr\u0131ca;<\/p>\n<p>-OSGB&#8217;lere etkin vergi denetimleri gerekiyor<br \/>\n-OSGB&#8217;lerin acilen i\u015f tefti\u015f kurulu planl\u0131 denetimlerine sekt\u00f6r olarak al\u0131nmas\u0131 gerekiyor<br \/>\n-OSGB&#8217;lerin ticari faaliyetlerinin etik denetimi gerekiyor<br \/>\n-OSGB&#8217;de \u00e7al\u0131\u015fan personelin \u00fccret, sosyal haklar a\u00e7\u0131s\u0131ndan denetimi gerekiyor<br \/>\n-OSGB&#8217;lerde \u00e7al\u0131\u015fan hekim ve uzmanlar\u0131n mesleki denetimi i\u00e7in meslek odalar\u0131na isim listelerinin bildirilmesi gerekiyor<\/p>\n<p style=\"text-align: center;\"><strong>D) OSGB\u2019LERDE EMEK S\u00d6M\u00dcR\u00dcS\u00dc <\/strong><\/p>\n<p style=\"text-align: left;\"><strong>1. Ucuza hekim-\u0130\u015f g\u00fcvenli\u011fi uzman\u0131 \u00e7al\u0131\u015ft\u0131rma:<\/strong><\/p>\n<p style=\"text-align: left;\"><strong><\/strong>K\u0131rm\u0131z\u0131 OSGB&#8217;lerde yayg\u0131n olan emek s\u00f6m\u00fcr\u00fcs\u00fcnde sistemin i\u015flemesi i\u00e7in \u00e7ok ucuza i\u015fyerlerini alan OSGB&#8217;ler bu nedenle \u0130S\u0130G \u00e7al\u0131\u015fanlar\u0131na \u00e7ok \u00fccret \u00f6demiyor. Genelde emekli hekimler, i\u015fssiz hekimler se\u00e7iliyor. \u0130\u015f g\u00fcvenli\u011fi uzmanlar\u0131ndan yeni belge alm\u0131\u015f ve alanda i\u015f bulamam\u0131\u015f olanlar \u00e7aresiz olarak bu OSGB&#8217;lerde \u00e7al\u0131\u015fmak zorunda kal\u0131yorlar.<\/p>\n<p><strong>2. S\u0131nava gir-uzman ol-OSGB&#8217;ye i\u015f g\u00fcc\u00fc ol:<\/strong><\/p>\n<p>\u00c7al\u0131\u015fma bakanl\u0131\u011f\u0131 s\u0131navlarla i\u015f g\u00fcvenli\u011fi uzman\u0131 say\u0131s\u0131n\u0131 artt\u0131rd\u0131 ancak i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n bireysel \u00e7al\u0131\u015fma olanaklar\u0131 OSGB&#8217;ler nedeniyle \u00e7ok azald\u0131. Bu nedenle OSGB&#8217;lere haz\u0131r ucuza i\u015f g\u00fcc\u00fc haline geldiler.<\/p>\n<p><strong>3. \u00c7al\u0131\u015fma s\u00fcresi-saat sat\u0131\u015flar\u0131:<\/strong><\/p>\n<p>Yetki alan i\u015fyeri hekimleri ve i\u015f g\u00fcvenli\u011fi uzmanlar\u0131n\u0131n \u00e7al\u0131\u015fma s\u00fcrelerine g\u00f6re \u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131 ISG-Katip program\u0131ndan i\u015fyerleri i\u00e7in yetki veriliyor.
