Derece do\u011fal sit alan\u0131na ve tarihi sit alan\u0131na ili\u015fkin ilke kararlar\u0131na ayk\u0131r\u0131 oldu\u011fu,<\/p>\n<p align=\"justify\">14- 5524 say\u0131l\u0131 Yasa\u2018n\u0131n Anayasan\u0131n 18., 35., 44., 45., 63., maddelerine ayk\u0131r\u0131 oldu\u011fu nedeniyle iptali i\u00e7in Anayasa Mahkemesi\u2018ne ba\u015fvurulmas\u0131 gerekti\u011fi nedenleriyle hukuka ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclerek iptali istemiyle a\u00e7\u0131lan davada y\u00fcr\u00fctmenin durdurulmas\u0131 talep edilmi\u015ftir.<\/p>\n<p align=\"justify\">Ankara B\u00fcy\u00fck\u015fehir Belediyesi, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131, G\u0131da Tar\u0131m ve hayvanc\u0131l\u0131k Bakanl\u0131\u011f\u0131 ve AO\u00c7 ile ilgili a\u00e7\u0131lm\u0131\u015f t\u00fcm davalara m\u00fcdahil olma e\u011filiminde bulunan Ba\u015fbakanl\u0131\u011f\u0131n savunmalar\u0131n\u0131 alan mahkeme heyeti,<\/p>\n<p align=\"justify\"><b>18.05.2011<\/b> g\u00fcnl\u00fc ara karar\u0131 ile uyu\u015fmazl\u0131k konusu yerde kesif ve bilirkisi incelemesi yap\u0131lmas\u0131na karar verilmis olup,\u00a0 <b>26.12.2012 tarihli<\/b> d\u00fczenlenen rapor almas\u0131na kar\u015f\u0131n\u00a0, bilirkisi raporu ve rapora\u00a0\u00a0itirazlar yap\u0131lm\u0131\u015f ve 2. kez\u00a0 <b>22.02.2013<\/b> g\u00fcnl\u00fc ara karar\u0131 ile mahallinde <b>ikinci kez kesif ve bilirkisi incelemesi yapt\u0131r\u0131lmas\u0131na karar verilmis,<\/b> yeniden olusturulan bilirkisi heyetince <b>20.05.2013<\/b> tarihinde yap\u0131lan kesif ve bilirkisi incelemesi sonucu d\u00fczenlenen\u00a0 <b>26.11.2013<\/b> tarihinde mahkemeye sunulan\u00a0bilirkisi raporlar\u0131n\u0131 incelemi\u015f ve Heyet;<\/p>\n<p align=\"justify\">1- Naz\u0131m imar plan\u0131n\u0131n i\u00e7eri\u011fi ile ilgili,<\/p>\n<p align=\"justify\">2- Plan notlar\u0131 a\u00e7\u0131s\u0131ndan,<\/p>\n<p align=\"justify\">3- Ula\u015f\u0131m semas\u0131 a\u00e7\u0131s\u0131ndan,<\/p>\n<p align=\"justify\">4- Kent ekolojisi a\u00e7\u0131s\u0131ndan ;\u00a0\u00a0 de\u011ferlendirmelerde bulunmu\u015ftur.<\/p>\n<p align=\"justify\"><b>Peyzaj Mimarl\u0131\u011f\u0131 disiplini ilke ve esaslar\u0131 \u00fczerinden yap\u0131lan KENT EKOLOJ\u0130S\u0130 A\u00c7ISINDAN YAPILAN DEGERLEND\u0130RME\u00a0 ve \u0130\u00c7ER\u0130\u011e\u0130 merkezi ve yerel y\u00f6netimlere ders verir niteliktedir.<\/b><\/p>\n<p align=\"justify\"><b>Mahkeme Heyetince yap\u0131lan; KENT EKOLOJ\u0130S\u0130 A\u00c7ISINDAN YAPILAN DEGERLEND\u0130RME;<\/b><\/p>\n<p align=\"justify\"><i>&#8220;Tar\u0131msal peyzajlar biyolojik \u00e7e\u015fitlilik a\u00e7\u0131s\u0131ndan \u00f6nemli alanlar oldu\u011fu, Avrupa peyzajlar\u0131ndaki tehlike alt\u0131ndaki t\u00fcrlerin %40`\u0131na tar\u0131msal peyzajlarda rastland\u0131\u011f\u0131, tar\u0131msal peyzajlar\u0131n ekolojik bak\u0131s a\u00e7\u0131s\u0131 ile planlanmas\u0131 ve geli\u015ftirilmesi Avrupa ve d\u00fcnya \u00f6l\u00e7e\u011finde do\u011fa koruma ama\u00e7l\u0131 etkili bir politika arac\u0131 olarak g\u00f6r\u00fcld\u00fc\u011f\u00fc, Avrupa Birligi Tar\u0131msal Biyo\u00e7esitlilik Eylem Plan\u0131 (EU Biodiversity Action Plan for Agriculture, 2001) tar\u0131msal alanlarda biyolojik \u00e7e\u015fitlili\u011fin korunmas\u0131 ve s\u00fcrd\u00fcr\u00fclebilir kullan\u0131mlar i\u00e7in \u00f6ncelikleri belirler, bu eylem plan\u0131na g\u00f6re gerekli ekolojik altyap\u0131n\u0131n varl\u0131\u011f\u0131n\u0131 temin etmek plan yap\u0131c\u0131lar ve karar vericilerin \u00f6ncelikleri aras\u0131nda yer almal\u0131d\u0131r denildi\u011fi, tar\u0131msal peyzajlardaki ekolojik altyap\u0131y\u0131 olu\u015fturabilmek ve \u00fcretken bir peyzaj elde edebilmek i\u00e7in \u00f6ncelikle planlama kararlar\u0131na y\u00f6n verebilecek temel peyzaj ekolojisi prensiplerini anlamak gerekti\u011fi, peyzaj ekolojisine g\u00f6re bir peyzaj\u0131 par\u00e7a-koridor-matris modeli ile tarif etmenin m\u00fcmk\u00fcn oldu\u011fu, (Forman 1997). Koridor lineer peyzaj elemanlar\u0131d\u0131r, nehirler, karayollar\u0131 koridorlar\u0131, kanallar bunlara \u00f6rnektir. <\/i><\/p>\n<p align=\"justify\"><i>Par\u00e7alar lineer olmayan, daha geni\u015f y\u00fczeyli, ormanlar, tar\u0131m alanlar\u0131, konut dokular\u0131 gibi lekelerdir. Peyzaj matrisini odaklan\u0131lan alana \u00fcst \u00f6l\u00e7ekten bak\u0131ld\u0131\u011f\u0131nda alg\u0131lanan en dominant par\u00e7a t\u00fcr\u00fc (alan kullan\u0131m\u0131\/arazi \u00f6rt\u00fcs\u00fc) belirledi\u011fi, Peyzaj ekolojisi prensiplerine g\u00f6re (Forman ve Godron 1986, Noss 2004) do\u011fal veya yar\u0131 do\u011fal (tar\u0131msal alanlar gibi) bir peyzaj\u0131 olu\u015fturan par\u00e7alar\u0131n alan\u0131 ne kadar b\u00fcy\u00fckse i\u00e7inde bulundu\u011fu \u00e7evreye ekolojik katk\u0131s\u0131 ve kalitesi o kadar fazla oldu\u011fu, dolay\u0131s\u0131 ile yap\u0131lan planlarda do\u011fal ve yar\u0131 do\u011fal par\u00e7alar\u0131n b\u00fcy\u00fckl\u00fcklerinin m\u00fcmk\u00fcn oldu\u011funca b\u00fcy\u00fck tutulmas\u0131na \u00e7al\u0131\u015f\u0131lmas\u0131 gerekti\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>par\u00e7alar ne kadar s\u00fcreklilik arz ediyorsa ekolojik kalitesi o kadar y\u00fcksek oldu\u011fu, \u00e7\u00fcnk\u00fc par\u00e7alanma (fragmantasyon) peyzajda biyolojik \u00e7e\u015fitlili\u011fi tehdit eden en \u00f6nemli unsurlardan biri say\u0131ld\u0131\u011f\u0131, dolay\u0131s\u0131 ile planlarda do\u011fal ve yar\u0131 do\u011fal peyzajlar\u0131n s\u00fcrekliliklerinin g\u00f6zetilerek, m\u00fcmk\u00fcn oldu\u011funca az par\u00e7a say\u0131s\u0131n\u0131 yakalamaya \u00e7al\u0131\u015fmak gerekti\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>bir \u00f6rnekle a\u00e7\u0131klamak gerekirse 50 hektarl\u0131k 2 adet par\u00e7adan olu\u015fan bir a\u00e7\u0131k alan sistemi, 25 hektarl\u0131k 4 adet par\u00e7adan olu\u015fandan (toplamda her ikisi de 100 hektar olmas\u0131na ra\u011fmen) ekolojik kalite ve yasam kalitesi a\u00e7\u0131s\u0131ndan kente daha fazla katk\u0131 sundu\u011fu, ayn\u0131 doku ve ekolojik i\u015fleve sahip par\u00e7alar birbirlerinden ne kadar izole olurlarsa ekolojik de\u011ferleri o kadar d\u00fc\u015fece\u011fi, bir di\u011fer deyi\u015fle bir dokunun antropojen kaynakl\u0131 kullan\u0131mlar ve materyallerle b\u00f6l\u00fcnm\u00fc\u015f olmas\u0131 onun ekolojik de\u011ferini d\u00fc\u015f\u00fcrd\u00fc\u011f\u00fc, <\/i><\/p>\n<p align=\"justify\"><i>\u00e7\u00fcnk\u00fc peyzaj birimleri birbirlerinden izole oldu\u011fu, izolasyon da materyal ve enerji al\u0131\u015f verisini azaltaca\u011f\u0131 i\u00e7in peyzajda istenen bir durum olmad\u0131\u011f\u0131, yukar\u0131daki \u00f6rnekten devam edilirse 25 hektarl\u0131k 4 par\u00e7adan olu\u015fan bu alan\u0131n par\u00e7alar\u0131 aras\u0131nda ortalama 300 metre mesafe olmas\u0131 ile 3 kilometre mesafe olmas\u0131 aras\u0131nda ekolojik isleyi\u015f a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck farklar do\u011fabildi\u011fi, par\u00e7alar kendileri ile doku ve i\u015flev a\u00e7\u0131s\u0131ndan ne kadar uyumlu alan kullan\u0131mlar\u0131 ile \u00e7evrelenir yada kom\u015fuluk ederse ekolojik dengelerini korumalar\u0131 o kadar kolay olur; bunun sonucunda da ekolojik kalitesi ve i\u00e7inde bulundu\u011fu ortama ekolojik katk\u0131s\u0131 daha fazla oldu\u011fu, <\/i><\/p>\n<p align=\"justify\"><i>ekolojik de\u011feri d\u00fcsen peyzaj par\u00e7as\u0131n\u0131n kentteki \u00e7evre kalitesini d\u00fczenleme ve iyile\u015ftirme y\u00f6n\u00fcndeki katk\u0131s\u0131 daha d\u00fc\u015f\u00fck oldu\u011fu, \u00e7evre kalitesinin d\u00fc\u015fmesinin sonu\u00e7ta insan sa\u011fl\u0131\u011f\u0131 ve yasam kalitesini etkiledi\u011fi, k\u00fcresel \u0131s\u0131nman\u0131n etkilerinin giderek hissedildi\u011fi g\u00fcn\u00fcm\u00fczde kent ekolojisine sayg\u0131l\u0131 davran\u0131lmas\u0131 ve planlar\u0131n bu do\u011frultuda haz\u0131rlanmas\u0131n\u0131n kamu yarar\u0131 a\u00e7\u0131s\u0131ndan \u00e7ok \u00f6nem ta\u015f\u0131d\u0131\u011f\u0131, <\/i><\/p>\n<p align=\"justify\"><i>Atat\u00fcrk Orman \u00c7iftligi Ankara`n\u0131n kent ekolojisi a\u00e7\u0131s\u0131ndan \u00f6nemli bir rezerv alan\u0131d\u0131r ve tar\u0131msal a\u011f\u0131rl\u0131kl\u0131 bir temayla kalmas\u0131 \u015fart\u0131yla ba\u011f\u0131\u015fland\u0131\u011f\u0131, bu durumda yukar\u0131da bahsi ge\u00e7en maddelerdeki kurallar\u0131 g\u00f6z \u00f6n\u00fcnde bulundurarak davaya konu plan incelendi\u011finde; <\/i><\/p>\n<p align=\"justify\"><i>ad\u0131n\u0131n \u00e7a\u011fr\u0131\u015ft\u0131rd\u0131\u011f\u0131 \u00fczere Atat\u00fcrk Orman \u00c7iftli\u011finin bir tar\u0131msal matris olmas\u0131 (tar\u0131msal \u00fcretim alanlar\u0131n\u0131n peyzajdaki en y\u00fcksek y\u00fczdeye sahip alan kullan\u0131m\u0131 olmas\u0131) gerekirken, bug\u00fcn bu \u00f6zelli\u011finden gittik\u00e7e uzakla\u015ft\u0131\u011f\u0131, buna ek olarak 1\/10.000 \u00f6l\u00e7ekli planda tar\u0131msal \u00fcretim alanlar\u0131 olarak belirtilen alanlar\u0131n AO\u00c7 geneline bak\u0131ld\u0131\u011f\u0131nda hem y\u00fczde olarak \u00e7ok d\u00fc\u015f\u00fck oldu\u011fu, hem de par\u00e7a b\u00fcy\u00fckl\u00fcklerinin g\u00f6receli daha ufak ve par\u00e7al\u0131 bir yap\u0131da oldu\u011funun g\u00f6r\u00fcld\u00fc\u011f\u00fc, <\/i><\/p>\n<p align=\"justify\"><i>tar\u0131msal \u00fcretim alan\u0131 ve a\u011fa\u00e7land\u0131r\u0131lacak alan ibaresi ile belirtilen alanlar\u0131n ise, tar\u0131msal \u00fcretim alanlar\u0131na g\u00f6re \u00e7ok daha b\u00fcy\u00fck par\u00e7al\u0131 kompozisyon olu\u015fturaca\u011f\u0131 ancak bu durumun s\u00fcreklilik arz etmeyen bir kompozisyon oldu\u011fu, plandaki en dominant kullan\u0131m\u0131n a\u011fa\u00e7land\u0131r\u0131lm\u0131\u015f alan oldu\u011fu, bu ileride AO\u00c7 peyzaj\u0131n\u0131n bir orman matrisi olaca\u011f\u0131n\u0131 i\u015faret etti\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>orman alanlar\u0131 ekolojik a\u00e7\u0131dan \u00e7ok k\u0131ymetli alanlar olmalar\u0131na ra\u011fmen bu alan\u0131n ta\u015f\u0131d\u0131\u011f\u0131 k\u00fclt\u00fcrel peyzaj de\u011feri a\u00e7\u0131s\u0131ndan tar\u0131msal bir matris olmas\u0131n\u0131 gerektirdi\u011fi, tar\u0131msal \u00fcretim alanlar\u0131 ve a\u011fa\u00e7land\u0131r\u0131lacak alanlar seklinde bir kullan\u0131mda alt \u00f6l\u00e7ekli planlara gelindi\u011finde ne y\u00f6nde bir kullan\u0131m karar\u0131 (tar\u0131m y\u00f6n\u00fcnde mi, a\u011fa\u00e7land\u0131rma y\u00f6n\u00fcnde mi) al\u0131naca\u011f\u0131 peyzaj\u0131n konfig\u00fcrasyonunu tamamen de\u011fi\u015ftirece\u011fi, konfig\u00fcrasyon bir peyzajdaki ekolojik isleyi\u015fi belirleyen \u00f6nemli bir parametre oldu\u011fu, <\/i><\/p>\n<p align=\"justify\"><i>tar\u0131msal \u00fcretim y\u00f6n\u00fcnde bir kullan\u0131m\u0131n verilmesinin izolasyonu kullan\u0131mlar\u0131 nispeten hakim olaca\u011f\u0131, a\u011fa\u00e7land\u0131rma y\u00f6n\u00fcnde al\u0131nacak bir karar ise hem peyzajda art\u0131k tar\u0131msal bir dokunun hakim olmamas\u0131na (ki bu da kurulu\u015f amac\u0131na ve plan kararlar\u0131nda belirtilenlere ayk\u0131r\u0131d\u0131r) hem de AO\u00c7 peyzajlar\u0131n\u0131n \u00e7ok farkl\u0131 i\u015flevlere sahip olmas\u0131na ve ekolojik isleyi\u015finde de\u011fi\u015fime sebep olaca\u011f\u0131, <\/i><\/p>\n<p align=\"justify\"><i>a\u011fa\u00e7land\u0131r\u0131lm\u0131\u015f alan park ve rekreasyon olabilece\u011fi ancak ekolojik a\u00e7\u0131dan bu kullan\u0131mlar\u0131n her biri farkl\u0131 dokuya ve i\u015fleve sahip oldu\u011fu, bu sebepten kent ekolojisine katk\u0131lar\u0131 da farkl\u0131 seviyelerde olaca\u011f\u0131, dolay\u0131s\u0131 ile ekolojik denge, yasam kalitesi ve \u00e7evre kalitesi a\u00e7\u0131s\u0131ndan bu tip kullan\u0131mlar\u0131n b\u00fct\u00fcnm\u00fc\u015f gibi ele al\u0131nmas\u0131n\u0131n sak\u0131ncal\u0131 oldu\u011fu, <\/i><\/p>\n<p align=\"justify\"><i>\u00e7\u00fcnk\u00fc antropojen bir yakla\u015f\u0131mla bak\u0131ld\u0131\u011f\u0131nda birbirine benzer g\u00f6r\u00fcnen \u015feyler ekolojik a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda farkl\u0131 de\u011ferlere sahip olabildi\u011fi, planlarda kent ekolojisine hizmet edebilir kompozisyonlar\u0131n olu\u015fturulmas\u0131 sonunda yine kamu ve insanl\u0131\u011f\u0131n yarar\u0131na olaca\u011f\u0131, mevcut planda \u00f6nerilen mevcut sanayi ve depolama tesisleri (MT) ile tar\u0131m aras\u0131ndaki kom\u015fuluk sanayi tesislerinden kaynakl\u0131 olarak tar\u0131m \u00fcr\u00fcnlerinin kirlenmesi ve halk sa\u011fl\u0131\u011f\u0131na verece\u011fi zarar ihtimalinden dolay\u0131 olumsuz oldu\u011fu, <\/i><\/p>\n<p align=\"justify\"><i>bu t\u00fcr tesislerin dokusu tar\u0131msal peyzaj dokusundan olduk\u00e7a farkl\u0131 oldu\u011fu, dolay\u0131s\u0131 ile peyzajdaki isleyi\u015fe dair etkilerinin de farkl\u0131 olaca\u011f\u0131, yukar\u0131da bir alan\u0131n kendisi ile doku ve i\u015flev a\u00e7\u0131s\u0131ndan ne kadar uyumlu alan kullan\u0131mlar\u0131 ile \u00e7evrelenir ya da kom\u015fuluk ederse ekolojik isleyi\u015fini o kadar kolay s\u00fcrd\u00fcrebilece\u011finin belirtildi\u011fi, bu kapsamda bu tesisler i\u00e7in planda uzun vadede kald\u0131r\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclen alanlar ibaresinin kullan\u0131lmas\u0131 ve yerine ne getirilece\u011finin belirli olmamas\u0131 b\u00fcy\u00fck bir risk oldu\u011fu, <\/i><\/p>\n<p align=\"justify\"><i>ekolojik bak\u0131\u015f a\u00e7\u0131s\u0131 ile bu ibarenin tar\u0131msal alanlarla kom\u015fuluk oldu\u011fu durumlarda &#8220;uzun vadede tar\u0131msal \u00fcretim alan\u0131 yap\u0131lacak alan&#8221; olarak belirtilmemi\u015f olmas\u0131 plan haz\u0131rl\u0131\u011f\u0131nda ekolojik prensiplerin ne kadar dikkate al\u0131nd\u0131\u011f\u0131n\u0131 g\u00f6sterdi\u011fi, mevcut tesislerin a\u011fa\u00e7land\u0131r\u0131lm\u0131\u015f alanla olan kom\u015fuluk durumunda ise gelecekte olmas\u0131 gereken kullan\u0131m\u0131n &#8220;a\u011fa\u00e7land\u0131r\u0131lacak alan&#8221; olarak yer almas\u0131 gerekirken bu bak\u0131\u015f a\u00e7\u0131s\u0131 ile olaya ve daha s\u00fcreklilik arz eden bir desenin hem tar\u0131m alanlar\u0131 hem de a\u011fa\u00e7land\u0131r\u0131lm\u0131\u015f alanlar a\u00e7\u0131s\u0131ndan elde edilmesi oldu\u011fu, rekteatif ama\u00e7l\u0131 yap\u0131lan \u00f6neriler alan\u0131n tas\u0131ma kapasitesi d\u00fc\u015f\u00fcn\u00fclmeden AO\u00c7 de yo\u011funla\u015ft\u0131r\u0131lm\u0131\u015f olmas\u0131n\u0131n d\u00fc\u015f\u00fcnd\u00fcr\u00fcc\u00fc oldu\u011fu, <\/i><\/p>\n<p align=\"justify\"><i>ayr\u0131ca Atat\u00fcrk Orman \u00c7iftli\u011fi`nde giderek artan yol a\u011f\u0131n\u0131n olu\u015fturaca\u011f\u0131 bariyer etkisinin d\u00fc\u015f\u00fcn\u00fclmedi\u011fi, yollar a\u00e7\u0131s\u0131ndan 40-50 m. geni\u015flik tarla sistemleri aras\u0131nda hareket edecek canl\u0131lar\u0131n ge\u00e7i\u015flerini tehdit edecek boyutta oldu\u011fu, yaban hayat\u0131 i\u00e7in yap\u0131lacak ge\u00e7itlerin d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcne dair bir plan notu veya \u015fematik bir anlat\u0131m ile kar\u015f\u0131la\u015f\u0131lmad\u0131\u011f\u0131, b\u00fct\u00fcn bunlar da plan\u0131n ekolojik a\u00e7\u0131dan baz\u0131 konular\u0131 g\u00f6z ard\u0131 etti\u011fi izlenimini verdi\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>yukar\u0131da bahsi ge\u00e7en ekolojik peyzaj planlamas\u0131 unsurlar\u0131na ek olarak k\u00fclt\u00fcrel peyzaj planlamas\u0131 bak\u0131\u015f a\u00e7\u0131s\u0131 ile olaya yakla\u015f\u0131ld\u0131\u011f\u0131nda g\u00f6r\u00fclmektedir ki: AO\u00c7 \u2018nin tar\u0131msal peyzaj matrisi olma \u00f6zelli\u011fini kaybetmesi hem \u00e7iftli\u011fin kurulu\u015f ve kamuya ba\u011f\u0131\u015flan\u0131\u015f amac\u0131na ters d\u00fc\u015ft\u00fc\u011f\u00fc, hem de kentsel haf\u0131zada ki \u00f6nemli bir izin ve kente karakter katan bir unsuru gelecekte de bozulmaya devam edece\u011fi, zaman i\u00e7inde k\u00fclt\u00fcrel peyzaj de\u011ferinin azalmas\u0131 ihtimali koruma ama\u00e7l\u0131 naz\u0131m imar plan\u0131n\u0131n Avrupa Peyzaj S\u00f6zle\u015fmesi ile de \u00e7eli\u015fkili yakla\u015f\u0131mlar sergiledi\u011fini g\u00f6sterdi\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>Avrupa peyzaj s\u00f6zle\u015fmesine g\u00f6re; &#8220;Peyzaj; insanlar taraf\u0131ndan alg\u0131land\u0131\u011f\u0131 sekliyle, karakteri do\u011fal ve\/veya insani unsurlar\u0131n eyleminin ve etkile\u015fiminin sonucu olan bir alan anlam\u0131na gelir&#8221;. 15. Maddede yer alan h\u00fck\u00fcmlere tabi olarak, bu S\u00f6zle\u015fme taraflar\u0131n \u00fclkelerinin tamam\u0131na uygulan\u0131r ve do\u011fal, k\u0131rsal, kentsel alanlar\u0131 ve banliy\u00f6leri kapsar. <\/i><\/p>\n<p align=\"justify\"><i>Karay\u0131, k\u0131ta i\u00e7i sular\u0131 ve deniz alanlar\u0131n\u0131 i\u00e7erir. \u00d6zellikleriyle \u00f6ne \u00e7\u0131kt\u0131klar\u0131 d\u00fc\u015f\u00fcn\u00fclebilecek peyzajlar\u0131 ve ayn\u0131 zamanda her g\u00fcnk\u00fc ya da bozulmu\u015f peyzajlar\u0131 ilgilendirir. 5. Maddede (Genel \u00d6nlemler b\u00f6l\u00fcm\u00fc) her bir Taraf, &#8220;a. peyzajlar\u0131, yasayla, insanlar\u0131n \u00e7evrelerinin \u00f6nemli bir bile\u015feni, onlar\u0131n payla\u015ft\u0131klar\u0131 k\u00fclt\u00fcrel ve do\u011fal miras\u0131n \u00e7e\u015fitlili\u011finin bir ifadesi ve kimliklerinin bir temeli olarak tan\u0131may\u0131; b. 6. Maddede belirtilen \u00f6zel \u00f6nlemlerin kabul\u00fc yoluyla, peyzaj\u0131n korunmas\u0131, y\u00f6netimi ve planlanmas\u0131n\u0131 ama\u00e7layan peyzaj politikalar\u0131 olu\u015fturmay\u0131 ve uygulamay\u0131; c. genel kamuoyunun, yerel ve b\u00f6lgesel makamlar\u0131n ve yukar\u0131daki b f\u0131kras\u0131nda bahsedilen peyzaj politikalar\u0131n\u0131n tan\u0131mlanmas\u0131na ve uygulanmas\u0131na ilgi duyan di\u011fer taraflar\u0131n kat\u0131l\u0131m\u0131n\u0131 sa\u011flamak i\u00e7in usul olu\u015fturmay\u0131; d. peyzaj\u0131, b\u00f6lgesel ve \u015fehir planlama politikalar\u0131na ve k\u00fclt\u00fcrel, \u00e7evresel, tar\u0131msal, sosyal ve ekonomik politikalar\u0131na ve ayn\u0131 zamanda peyzaj \u00fczerinde do\u011frudan veya dolayl\u0131 etkisi olabilecek di\u011fer politikalar\u0131na katmay\u0131 y\u00fck\u00fcmlenir&#8221; denildi\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>bu b\u00f6l\u00fcmde bahsi ge\u00e7en b\u00fct\u00fcn unsurlar davaya konu olan plan\u0131n peyzaj ekolojisi prensiplerini g\u00f6z ard\u0131 etmesi nedeniyle kent ekolojisine katk\u0131s\u0131n\u0131n yetersiz kald\u0131\u011f\u0131, AO\u00c7`nin k\u00fclt\u00fcrel peyzaj karakterini bozacak nitelikte kararlar ald\u0131\u011f\u0131, mevcut hali ile olay\u0131 sadece bir rekreasyon ama\u00e7l\u0131 a\u00e7\u0131k ye\u015fil alan sistemi kurmak seklinde geli\u015ftirmeye \u00e7al\u0131\u015fmas\u0131 nedeniyle vizyonunun geni\u015f olmad\u0131\u011f\u0131 izlenimini verdi\u011fi, bunun sonucu olarak, dava konusu plan\u0131n Ankara kentinden faydalananlar\u0131n sosyal ve k\u00fclt\u00fcrel gereksinimlerini kar\u015f\u0131lama yeterlili\u011fi, <\/i><\/p>\n<p align=\"justify\"><i>sa\u011fl\u0131kl\u0131 ve g\u00fcvenli bir \u00e7evre olu\u015fturma amac\u0131, yasam kalitesini art\u0131rma hedefi ve bu amac\u0131n ger\u00e7ekle\u015ftirilmesi i\u00e7in Ankara`n\u0131n sosyal, k\u00fclt\u00fcrel, tarihsel ve fiziksel \u00f6zellikleri g\u00f6zetilerek haz\u0131rlanmad\u0131\u011f\u0131 g\u00f6r\u00fc\u015flerine yer verildi\u011fi, an\u0131lan raporun taraflara tebli\u011fi \u00fczerine daval\u0131 idarelerce yap\u0131lan itirazlar\u0131n yerinde g\u00f6r\u00fclmeyerek bilirki\u015fi raporunda belirtilen tespitler ve yakla\u015f\u0131mlar nedeniyle h\u00fckme esas al\u0131nabilece\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/i><\/p>\n<p align=\"justify\"><i>Bu durumda, Ankara B\u00fcy\u00fck\u015fehir Belediye Meclisi`nin 13.08.2010 g\u00fcn ve 2494 say\u0131l\u0131 karar\u0131yla onaylanan &#8220;1\/10.000 \u00f6l\u00e7ekli Atat\u00fcrk Orman \u00c7iftli\u011fi Alanlar\u0131 Naz\u0131m \u0130mar Plan\u0131 ve I. Derece Do\u011fal ve Tarihi Sit Alan\u0131 Koruma Ama\u00e7l\u0131 Naz\u0131m \u0130mar Plan\u0131n\u0131n ve eki olarak onaylanan &#8220;1\/10.000 \u00f6l\u00e7ekli Ulas\u0131m Semas\u0131&#8221; ile &#8220;1\/1000 \u00f6l\u00e7ekli Ulas\u0131m (Yol-Kavsak vb.) Uygulama Projesi&#8221; nin; planlama hiyerar\u015fine y\u00f6nelik ilkelere uygun olmad\u0131\u011f\u0131, naz\u0131m imar plan\u0131 tekni\u011fi ve ilkelere uygun haz\u0131rlanmad\u0131\u011f\u0131, naz\u0131m plan kararlar\u0131 ile getirilen fonksiyonlar\u0131n da\u011f\u0131l\u0131m\u0131n\u0131n AO\u00c7`nin kurulu\u015f amac\u0131na uygun olmad\u0131\u011f\u0131, naz\u0131m plan kararlar\u0131ile getirilen fonksiyonlar\u0131n 1. Derece Dogal ve Tarihi Sit Alan\u0131`na uygun olmad\u0131g\u0131, planla getirilen ikili fonksiyonlar\u0131n kullan\u0131m\u0131na y\u00f6nelik plan notlar\u0131nda a\u00e7\u0131klama getirilmedi\u011fi, plan notlar\u0131 ile ilgili belirsizlikler bulundu\u011fu, ula\u015f\u0131m semas\u0131n\u0131n haz\u0131rlanmas\u0131nda \u00f6n inceleme ve de\u011ferlendirme yap\u0131lmad\u0131\u011f\u0131, ula\u015f\u0131m semas\u0131n\u0131n haz\u0131rlanmas\u0131nda bilimsel bir altyap\u0131n\u0131n bulunmad\u0131\u011f\u0131, peyzaj ekoloji prensiplerinin g\u00f6z ard\u0131 edildi\u011fi, dolay\u0131s\u0131yla imar mevzuat\u0131, \u015fehircilik ilkeleri, planlama esaslar\u0131 ve kamu yarar\u0131na ayk\u0131r\u0131 oldu\u011fu sonucuna var\u0131ld\u0131\u011f\u0131ndan dava konusu i\u015flemlerde hukuka uyarl\u0131k bulunmamaktad\u0131r.<\/i><\/p>\n<p align=\"justify\"><i>\u00d6te yandan; dava konusu i\u015flemin imar plan\u0131 ve uygulama projesine ili\u015fkin oldu\u011fu g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda, uygulanmas\u0131n\u0131n, telafisi g\u00fc\u00e7 zararlar do\u011furabilece\u011fi ac\u0131kt\u0131r.&#8221;<\/i><\/p>\n<p align=\"justify\">\u015eeklinde verilen yarg\u0131 karar\u0131 t\u00fcm yerel y\u00f6neticilere ve merkezi otoriteye ders verir nitelikte ve bilginin iktidar oldu\u011fu inanc\u0131m\u0131zdaki \u00f6nderli\u011fe hizmet etmi\u015ftir.<\/p>\n<p align=\"justify\">TMMOB Peyzaj Mimarlar\u0131 Odas\u0131 olarak; 10.02 2014 tarihi itibari ile Ankara 5.
