Ancak kasabal\u0131lar ve belediye aras\u0131nda anla\u015fma sa\u011flanamad\u0131. TOK\u0130\u2019nin 2008 y\u0131l\u0131nda in\u015faat halinde olan konutlar\u0131 ise Hem\u015fin deresinin ta\u015fmas\u0131 ile zarar g\u00f6rd\u00fc.<\/p>\n<figure id=\"attachment_9977\" aria-describedby=\"caption-attachment-9977\" style=\"width: 470px\" class=\"wp-caption alignright\"><a href=\"\/wp-content\/uploads\/2014\/04\/11943.jpg\"><img decoding=\"async\" class=\"size-full wp-image-9977\" alt=\"11943\" src=\"\/wp-content\/uploads\/2014\/04\/11943.jpg\" width=\"470\" height=\"319\" srcset=\"https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/04\/11943.jpg 470w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/04\/11943-300x203.jpg 300w, https:\/\/eonmeet.com\/pol\/wp-content\/uploads\/2014\/04\/11943-150x101.jpg 150w\" sizes=\"(max-width: 470px) 100vw, 470px\" \/><\/a><figcaption id=\"caption-attachment-9977\" class=\"wp-caption-text\">16 Mart 2008 tarihinde \u015fimdinin Hem\u015fin Belediye Ba\u015fkan\u0131 AKP\u2019li Halim Bekar TOK\u0130 taraf\u0131ndan ba\u015flat\u0131lan toplu konutlar\u0131n tamamen Hem\u015fin mimarisine uygun \u015fekilde in\u015fa edildi\u011fini s\u00f6yleyerek \u201cHem\u015fin\u2019de bir ticaret merkezi \u00e7al\u0131\u015fmas\u0131 var. Binalar h\u0131zla y\u00fckseliyor. \u0130l\u00e7emizde tarihinde hi\u00e7 ya\u015fanmam\u0131\u015f bir \u00e7al\u0131\u015fma var.\u201d demi\u015fti.<\/figcaption><\/figure>\n<p>2009 yerel se\u00e7imi ile CHP\u2019den AKP\u2019ye ge\u00e7en Hem\u015fin Belediyesi daha \u00f6nceki projeyi de\u011fi\u015ftirdi ve bu sefer Hem\u015fin\u2019in tamamen y\u0131k\u0131l\u0131p yerine 157 konut ve 29 d\u00fckkanl\u0131 bir kasabaya d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine karar verdi.<\/p>\n<p><strong>\u00dc\u00e7 dava da TOK\u0130\u2019nin rant h\u0131rs\u0131n\u0131 durduram\u0131yor<\/strong><\/p>\n<p>2010 y\u0131l\u0131nda \u00fc\u00e7 vatanda\u015f TOK\u0130 ve Hem\u015fin Belediyesi\u2019ne haklar\u0131n\u0131n gasp edildi\u011fi gerek\u00e7esiyle dava a\u00e7t\u0131. Rize B\u00f6lge \u0130dare Mahkemesi kentsel d\u00f6n\u00fc\u015f\u00fcm projesiyle ilgili y\u00fcr\u00fctmeyi durdurma ve iptal karar\u0131 verdi.<\/p>\n<p>Bakanlar Kurulu, 2011 y\u0131l\u0131nda Hem\u015fin\u2019in kentsel d\u00f6n\u00fc\u015f\u00fcm alan\u0131 ilan edilmesi i\u00e7in karar verdi. Hem\u015finliler Dan\u0131\u015ftay 6\u2019nc\u0131 Dairesi\u2019ne dava a\u00e7t\u0131. Dan\u0131\u015ftay davay\u0131 kabul etti ve b\u00f6lgeden ke\u015fif ve bilirki\u015fi inceleme raporu istedi ama Bakanlar Kurulu bu sefer 2942 say\u0131l\u0131 Kamula\u015ft\u0131rma Kanunu\u2019nun 27\u2019nci maddesine dayanarak \u2018acele kamula\u015ft\u0131rma\u2019 karar\u0131 ald\u0131.<\/p>\n<p>Kasabal\u0131 bu sefer \u201cYurt savunmas\u0131yla ilgili maddenin kentsel d\u00f6n\u00fc\u015f\u00fcm i\u00e7in kullanmas\u0131 hukuka ayk\u0131r\u0131\u201d diye dava a\u00e7t\u0131.
